Los Rios Specific Plan The purpose and intent of the District is to provide for “Low density commercial office uses that are compatible with the rural character of the Los Rios area and will not alter the existing topography.”
Problems with CUP
Negatively Impact traffic and congestion
Applicant is National Franchise Adverse effect on rural character
Does zoning change in our protected district mean other retail franchises?
San Juan local since 1988 San Juan Capistrano success story
Started Los Rios Rock School
In historic district on Lobo Street
As we outgrew the historic
district we moved to
current location next to
Post Office on Paseo Adelanto
Chose Commercial zoned location
to not adversely impact Historic District
Today Our School has: ● 5000 square feet ● Hundreds of students ● A dozen staff members ● A charity for kids in need ● Two recording studios ● Live pro practice stage
Our success has attracted a National Franchise
Our issue isn’t with competition we support entrepreneurs globally
We are on the board of EO 11,000 business globally
Van parked out front
brought this to our
attention
Music Makers vs National Franchise
They were not forthcoming about the fact that there
are over 170 locations globally
Permits not
pulled Franchise was
acting in bad faith
A high impact national franchise is not compatible with “low density” office use it is a customer
driven RETAIL operation
Are we changing the zoning to retail?
There are many RETAIL
opportunities in SJC that wouldn’t affect
historic district
(13 for Retail spots for lease on Loopnet.com)
Misleading LOI / Application ●Misrepresented who they are ●Made a inaccurate business comparison ●Parking was understated ●Traffic impact was understated
Planning staff didn’t have accurate information
Didn’t state that they were a National Franchise
Compared operation to a children's Day Care
Daycare: Kids are dropped for half or full day Music School: Kids are only there 45 Minutes
Parking was understated At our school many parents want to stay, especially with younger kids. If everyone were to park just to pick up their kids there is the potential for 41 cars to be struggling for the 11 allotted spaces (16 students twice an hour dropping off and picking up plus 9 teachers = 41)
Traffic Congestion If parents are to drop off and pick up twice an hour plus other parents arriving to drop off… there is a potential for 48 extra cars per hour at an already congested intersection!
