WHEREAS by "The }'isheries Act, 1905," it is pro­vided that the Goyernor may, by Proclamation, declare, inte1' alia, that any 'West Australian waters shall be closed against the taking of any prescribed species of

portion of Hall's Point, and extending North ono­quarter of a mile; thence East to the sea-shore, and along it to the entrance to Peel's Inlet Sonthward and Eastward to a Point East of the East end of Creery Island; thence West to the said cIlll and IV'estward along the South shore of the said Creery Island to its Southern­most point; thence "Westerly to the South-East corner of 11:urray Location 5; thence in a general Northerly direction by the "Western shore of the entrance to Peel's Inlet an(1 the soa-shoro to tho starting point. Previded always, that such portion of the said waters which is situatod North or North-West and sealYllnl of the bar at the ontrance to Pecl's Inlet, near Mandurah, shall (except within a radins of a quarter of a mile from any opening 1'01' the time being through the bar), be opon for fishing generally from tho 2'lth day of March, HJl~, to tho 15th clay of lIfay, 1!Jl2, both days inclusive,

'1'0 include also the Murray River and Sorpentine River, with their estuaries, tributaries, lakes, and lagoons the waters of which, at any time of the year, have access directly or indirectly to the sea.

C. Koombana Bay, as follows:-That portion of Koom­

bana Bay situated Southward of a line extending about 64 degrees from the junction of the stone eauseway with the Bunbury Jetty, to a white post on the shore of North Bunbury.

D. The waters of tho J:'reston River, the Collie River, the

Brunsv:ick River, and the Capel RiYer, with their tribu­taries.

E. 'l'oby's Inlet, as i"ollmrs:-The whole of Toby's Inlet

and that portion of tho sea \yithin a radius of a quarter of a mile from the mouth of Toby's Illlct.

:D'. Kalgan River and King River, and portions of Oyster

Harbour as follows (1.) Kalgan River and King River and portion of

Oyster. Harbour, bounded by lines starting from Point Henty and extending Southward along the Il\Testern shore of Oyster Harbour about 20 chains; thence South-East­erly to a point on the Eastern shore of Oyster Harbour aforesaid situate 15 chains Southward from Swan Point; thence N Ol'thward and Westward alO!lg part of the Eastern and N orthel'll shores of the said Ovster Har­bour to a point N ortll f"om Point Henty; th~nce Sonth to the starting point.

WHEREAS by "The Fisheries Act, 1905," it is pro­vided that the Governor may, by Proclamation, declare inter alia, that any West Australian 'waters shall b~ closed against the taking of any prescribed species of fish by any means whatever, or against fishing gBllerally, by any method of capture, during any specifiel1 time in any year: And for the more effectual conservation of the fish supply, and for the protection of the spawninR: and feeding gI'ounds for immature fish, that the whol~ or any defined portion of any West Australian waters shall be closed against the use of fishing nets or .fishinCf lines, or of either such methods of catching fish, [or such term as the Governor shall think fit: And whereas it is desirable that the ,mters described in the Schec1ule hereunder should be declared closed, as hereinafter pro­vided: Now therefore I, the saia, Governor, by and with the advice and consent of the Executive Council, do hereby declare as follows:-

the taking of prawns, by means of any net other than a hand-scoop net, from the date of the publication of this Proclamation in the Government Gazette to the 31st December, 1912, inclusive.

And I, the said Governor, by and with the advice of the EXGcuti,-e Council, and in the exercise o[ the powers conferred by the said Act to make regulations for the purpose therein mentioned, do hereby declare that the leugth of nets to be used for prawning in the Swan or Canning ~iyers ill waters open for prawning shall not exceed 2.J fathollls in length, and the mesh thereof shall not be less than one-half inch.

Schedule. That :portion of the Swan River extending downwards

from a hne drawn from Point 'Walter to Point Resolution and the S\\'an River extending upwards from the Narrows at :Mill Point.

Applications must be lodged with the Government Land Agent for the District in which the land is sitnated.

Any application may be lodged before the fixed date, but ,vill be treated as having been received on that day; if there are more applicants than one for any lot the application to be granted will be determined by the Land Board, and should any lands remain uTlselected such will continue available until applied for or other­wise dealt with.

If a Land Board sitting becomes necessary, after the closing of the date for receiving applications, notice will be given in the Government Gazette and at least one llewspaper advising the applicants for the blocks of the ,late, time, and place of the meeting of the Board, to deal with the matter; but it shall not be obligatory on the Department to give any other notice.

If an applicant wishes to appear before the Land Boarel in person, he may apply to the Head Office for a cbrtificate to the Railway Department, which, on presen­tation at the nearest Railway Station, will entitle him to a Return Ticket, at Excursion Rates, to the place where the Board will sit, avnilnble for seven days from the date of issne.

Lanci snecifiecl as carrying an Agricultural Bank ad­vance which is situated within 15 miles of a rail,· Iyay or authorised railway is available subject to the special conditions that an expenditure of not less than one-fourth of the amount set out shall be made on prescribed improvements in each of the first four years of the lease; but this shall not "elease the holder from any covenant in the Agricultural Bank Mortgage requiring the improvements to be made at an earlier date. Such adyauce is subject to the usual condition governing a loan from the Agricultural Bank, particulars of which may be had on application to the lI'Tanaging Trustee.. Applications for advance must be accompanied by a fee of ono per cent.

THE i)CHEDULE HEREINBEJTORE REJTEl'tRED TO.

1. Ilours.-(a .. ) :Forty-eight hours shall constitute a week's work for all workers in the industry except those hereinafter specifically provided for.

(b.) Tho hours of bbour for stablemen shall be fifty-six per week, extending ever seven days.

(c.) The hours of duty for night-watchmcn shall not exceed seven days of twelve hours each week.

(d.) Forty-eight hours shnJI constitute a week's work for horse-drivers, such forty-eight hours to be oxdusi vc of meal timc and also of such time itS is required for grooming, harnessing, and unh<n'nessing the horses. Three-quarters of an hour, clear, shall be allowed for meals on tho first four working dttys of'the week, and one hour clear on Friday.

(a.) Each stableman shall be allowed one Sunday off eaeh month, in respect of which no deduction shall be made from his weekly wage.

(b.) If the stableman is required to live at the stables the employer shall provide reasonable accommodation for him, free of charge.

5. A night watchman, if called upon in the night time to do work other t,han that of tending to boiler fires shall be paid at the rate of (ill. per hour for the time so occupied, in [,ddition to the night-watchman's wage.

6. Ove1'timc.-Overtime at t,he rate of of time and a-quarter shall be paid for all time worked ,tfter the hour of 5 pm. on Monday, Tuesday, Wednesday, Thursday and ]'riday, and after the hour of noon on Saturday of each week.

Provided that in the case of horse-drivel'S overtime shall not include time spent in harnossing and grooming the horse, and th,"t overtime slutH not be deemed to have commenced unless the driyer shall be more than fifteen minutes late in to the yard.

(The Court is of opinion that, owing to the nature of the Vl:'jl]oyment, there shall be a few minutes "giw and b,ke" on either side, hence the exemption in the latter portion of tho foregoing proviso, but tho said exemption is not to be deemed to confer upon the employer the ,nbitrary right of working the dTivcr for an extm period of fifteen minutes per day).

This chuse shall not be deemed to apply to night-watchmen or stablemen. 7. Payment.-AH wages shall be paid weekly, immediately on the completion of the

week's work. 8. Record.-Each employer shall keep a record of the time worked, and the wages

paid to each worker, including overtime, and the s,tid record sha11 be aV[1ilable at least once in every month during working hours to the Secretary or other ]lerson appointed by the union.

9. Under-mte worl.·ers.-A \vorker who is unable to cam tho minimum rate heroby prescribed may be employeel at 11 lesser rate, which shall be agreed upon in writing between tho worker and the secretary of the worker's union.

If, within soyen (bys' after being notified in writing, of the workers' desire to work at a lower rate of wage thr11l that prescribed, the said sccretl1l'Y I,nel worker arc unable to agree upon a lower mte, then the worker may apply, in writing, to the nearest resident or polioe ml1gistrate to fix such lower mte of wage.

10. Apprentices.-(i.) to the machining bl'l1nch of the industry shall, unless bound by indentures, be under t he terms hereinafter set forth. (ii.) They shall not exceed in number one to every four machinists or fraction of the first four employed by each employer or fi-rm of employers for the twelve months previous to engaging the apprentice.

(iii.) The term of apprenticeship to the maching branch of the trade shall be four years. A probationary period of six months previous to being bound shall be lawful. Such proba­tionary period shall be decmed portion of the term of apprenticeship.

(iv.) Should any employer from unforeseen circumstances be unablc to carry out his obliga­tions to the apprentice, he shall be allowed to transfer the apprentice, to complete his term with another employer, but it shall be incumbent upon such former employer to notify the Clerk of the Court of Arbitration of the date of such transfer and when such apprenticeship commenced. (Form 2 in the Appendix hereto.)

(v.) In the absence of indentures apprentices shall be bound for the term and on tho conditions herein provided and subject to the following provisions:-

(a.) Any employer takLllg (111 apprentice shall give notice thereof to the Clerk of UlO Court of Arbitration in the form hereinafter provided (Form } in Appendix heTeto), and shall be deemed to undert(1ke the duty which he agrees to perfoTm as a duty enfOTcea ble undeT this award, and shall, subjcct to the pro\'isions of sub-clause (xii.) he1'Oof, pay the apprentice the rate of Wtegos herein pTovided.

Upon any such proceeding the report may be received in evidence.
