NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PAGOSA SPRINGS, COLORADO, as follows: 1. Amendment to Chapter 13, Article 1, Section 13.1.1. of the Municipal Code. AN EMERGENCY ORDINANCE OF THE TOWN OFPAGOSA SPRINGS AMENDING CHAPTER 13 OF THEMUNICIPAL CODE

WHEREAS, the Town of Pagosa Springs (“Town”) is a home rule municipalityduly organized and existing under Article XX of the Colorado Constitution and thePagosa Springs Home Rule Charter of 2003, as amended (the “Charter”); and

WHEREAS, pursuant to Section 1.4 (A) of the Charter, the Town has all power oflocal self-govemment and home rule and all power possible for a municipality to haveunder the Constitution and laws of the State of Colorado; and

V. Amendment to Chapter 13, Article 3 of the Municipal Code to Add aNew Section. Chapter 13, Article 3 of the Municipal Code is amendedby adding a newSection 13.3.2., as follows:

Section 13.3.2. Noise in excess of permissible levels.

Except as provided in Section 13.3.3.,it shall be unlawful forany person to operate or permit to be operated a source ofnoise which creates a sound pressure level that exceeds thelimits set forth in Table I in this Section for more than ninety(90) percent of any measurement period. The measurementperiod shall not be less than two (2) minutes and shall bemeasured at the approximateproperty boundary of theproperty affected by the noise. When a noise source can beidenti?ed and its noise is measured in more than one (1)zoning district, the applicable limits of each zoning districtshall apply within such district.Noise levels for any overlaydistrict shall confonn with Table I and shall be determinedaccording to the base zoning district.

VII. Amendment to Chapter 13, Article 3 of the Municipal Code to Add aNew Section. Chapter 13, Article 3 of the MunicipalCode is amended by adding a newSection 13.3.4.,as follows:

Section 13.3.4. Sound ampli?cation systems.

It shall be unlawful to use or operate a sound ampli?cationsystem in a fixed or movable position or mounted upon anymotor vehicle upon any street, alley, sidewalk,park, public orprivate property within the Town without a pennit issuedpursuant to Section 13.5.1.Nothing in this Section shallprohibit the use of a sound ampli?cation system within anenclosedarea, as long as the noise created from such soundampli?cation system does not exceed the limitations set forthin Sections 13.3.2. and 13.3.3.,as applicable.

VIII. Renumbering of Chapter 13, Article 3, Section 13.3.3. of the MunicipalCode. Chapter 13, Article 3, Section 13.3.3. of the Municipal Code is renumbered asSection 13.3.4.

IX. Amendment to Chapter 13, Article 4, Section 13.4.1. of the MunicipalCode. Chapter 13,Article 4, Section 13.4.1. of the Municipal Code is amendedby addingthe capitalized and double-underlined text and removing the stricken text, as follows:

Section 13.4.1. - Construction Projects.

Construction projects ARE EXEMPT FRQ THEMAXIMUMPERMISSIBLELEVELSSETFQRTH INSECTIQNS13.3.2.AND 13.3.3, QQNSTRQCTIQNPRQJEQTS shall be conductedbetween the hours of 6:00a.m. and 10:00p.m. Monday through Friday and 8:00 a.m.and 8:00 p.m. Saturday and Sunday. Any noise generated by

‘ such activity outside of these hours shall be deterna-ined—to—beunreasonable;declared a nuisance, constitutes a violation ofthis Chapter, and is subject to ?nes set forth in Section 13.6.1herein. This section shall not preclude emergency work ofpublic service utilities. Furthermore, the Police Chief or his orher designee is hereby authorized to issue a construction worknoise permit allowing constructionwork noise to occur at atime other than the time set forth above based oncircumstances that necessitate such constructionwork.

X. Amendment to Chapter 13, Article 4, Section 13.4.2. of the MunicipalCode. Chapter 13,Article 4, Section 13.4.2. of the Municipal Code is amended by addingthe capitalized and double-underlinedtext and removing the stricken text, as follows:

Section 13.4.2. - Emergencies.

Noise caused in the performance of emergency work for theimmediate safety, health, or welfare of the community orindividuals of the community or to restore property to a safeconditionfollowing a public calamity shall not be subject tothe provisionsof this Chapter. Nothing in this Section shall beconstrued to permit law enforcement, ambulance, fire or otheremergency vehicles to make LJNEEASQNABLEexcessivenoise in the performance of their duties when such noise isclearly unnecessary.

XI. Amendment to Chapter 13, Article 5, Section 13.5.2. of the MunicipalCode. Chapter 13,Article 5, Section 13.5.2. of the Municipal Code is amended by addingthe capitalizedand double-underlinedtext and removing the stricken text, as follows:

Section 13.5.2. - Applications for Permits.

Any pennit granted by the Police Chief pursuant to thisChapter shall be effective only for the location and timesdesignated within the pennit and shall be further subject tosuch limitations with regard to sound measurementlimitationsas may be set forth in such permit. Upon receipt ofa permit application,the Town shall adhere to the followingprocedures:

(1) The Police Chief shall respond to a request for a permitwithin ten (10) business days of receiving the application.

(2) The Police Chief shall consider all the factors set forth inSection 13.5.1and balance the interestsof the applicantandthose who are likely to be affected by the noise if a permitwere granted. The Police Chief shall ERESQRIBEprescribeany reasonable conditions or requirements deemed necessaryto minimize adverse effects upon the community or thesurrounding neighborhood, so long as such restrictions do notunreasonably restrict the activities of the applicant. XIV. Declaration of Emergency. Because there is an immediate need to amendChapter 13, as described herein, in order to protect the public peace, health and safety ofthe residentsand visitors to the Town, this Ordinance shall be immediately effective uponpassage.

XV. Effective Date. As provided in Section 3.10 of the Charter, this Ordinanceshall become effective immediately upon a single reading and passage and shall berecorded in the official records of the Town kept for that purpose and shallbe authenticatedby the signatures of the Mayor Pro Tem and the Deputy Town Clerk. The Town Clerk orDeputy Town Clerk shall post and publish notice of this Emergency Ordinance as requiredby Sections 3.10 A) and 3.9 D) of the Charter.
