The owner of a tree is theperson on whose land it grows.By statute, the owner of a treehas a duty not to allow the treeto obstruct a public highway.Often the tree’s branches androots will bridge the boundaryonto a neighbour’s privateland. This encroachment is atrespass on the part of thetree’s owner and the neighbourhas the right to prune branchesand cut roots coming acrossthe boundary. However, hemust offer any fruit removedfrom the tree and any branchesor foliage cut off to the tree’sowner to avoid running afoul ofthe Theft Act 1986.

The pruning of the offendingtree must take place on theneighbors’ own side of theboundary. One could not forexample go onto hisneighbour’s garden and cut theoffending tree down withoutfacing prosecution for criminaldamage or a civil action fortrespass.

Tree roots can cause damageto neighbouring properties bydirect physical damage, byremoving the moisture frombelow a foundation causingsubsidence, or in the winter bycausing heave. One couldclaim for damages caused by aneighbour’s tree roots throughan action for nuisance. Theleading case on the subjectfocuses on whether the ownerof the tree could have foreseenthe damage caused to hisneighbour and whether therewere any practicable measureshe could have taken to avoidor lessen the damage. Thesemeasures could includepruning or capping theoffending tree.

There is little law restricting theheight of trees. However,legislation has recently beenintroduced to addressunreasonably high hedges.The anti-social Behavior Act2003 allows Local Authoritiesto control hedge heights in

domestic properties. Under theact, one can complain to theLocal Authority about a highhedge provided that the hedge:is evergreen or semi evergreen;is at least 2 metres high; and,is blocking the light to theneighbouring property.

Thereafter the Local Authoritycan serve notice on the ownerof the hedge requiring him toreduce its height. If the ownerfails to do so, he facescontinuing fines of up to£1,000 until he complies.

A fee is usually payable to theLocal Authority by theindividual asking the Authorityto take action.

The best advice that can begiven in regards to all thepossible disputes described inthis article is to attempt toresolve them amicably.

In his recent Pre-Budget Report, the Chancellorconfirmed that the HM Revenue and Customs(‘HMRC’) Business Payment Support Service willcontinue to be available for the present. NickSkelton, partner at Doncaster-based CrozierJones, Chartered Certified Accountants,outlines how you can use this facility.

To quote HMRC “The Business PaymentSupport Service is available to help you if yourbusiness is viable and you are experiencingdifficulties in meeting your tax obligations as aresult of the current economic circumstances”.

The service is intended for new enquiries only.The helpline number is 0845 302 1435 and if youhave payments due soon, you should ring assoon as possible. If your payment is not due yet,you can ring the Business Payment SupportLine nearer the time and as soon as you areclear about whether you will be able to payHMRC or not. Remember that you need to getin touch with HMRC in advance. Don’t wait untilyour payment is overdue.

HMRC staff will review your circumstances anddiscuss temporary options tailored to yourbusiness needs, such as arranging for you tomake payments over a longer period. HMRC willnot charge additional late payment surchargeson payments included in the arrangement,although interest will continue to be payable onthose taxes where it applies.

HMRC advisers should only ask for theinformation they need to make a decision. Youshould have the following information to hand:

Your tax reference number; Details of the tax that you are or will havetrouble paying;When you expect to be able to pay the tax; Basic details of your business’s income andoutgoings.

HMRC say that in most cases they should beable to give you a decision in about ten minutes.However, for larger payment debts and thosethat are more complicated (including secondand subsequent requests for assistance), theymay need to have a longer, more detaileddiscussion with you and may need to call youback before agreeing payment arrangements.

Investing for Income

Against a backdrop of the lowest Bank ofEngland Base rate since the Banks foundation in 1690 what type of investments can produce a reasonable income in the current market? For many years the nominal returns savers canreceive on cash has been at a reasonable level,however investors may now need to diversifytheir investments across the four main assetclasses. Namely Fixed Interest investments suchas Government or corporate bonds, Equities andProperty.

Fixed Interest

Fixed Interest investments come mainly in twoforms. Sovereign debt would be invested in Government gilts and corporate bonds.Sovereign debt is typically seen as a lower riskoption although it does depend on the nationyou are investing in.

The UK government has not seen the cost ofborrowing rise yet and consequently the returnon investing in longer dated gilts is around 3%.Although the UK economy is clearly in recessioninvestors still appear to regard their capital safein Gilts mainly as Bank Of England has notmissed a capital or interest payment since theformation of the bank of England in 1690.

Corporate Bonds

Corporate Bonds operate in the same way asGilts in that they pay a fixed rate of interest for a set time period before capital is repaid.

The capital values may be affected by changinginflation and the general level of market interestrates. Due to the greater risk of defaultCorporate Bonds generally pay a higher level of interest than Sovereign debt with qualitycompanies’ typically paying 0.5% to 1% pamore than comparable government gilts.Currently there are good opportunities forinvesting in this area.

Equities

For one of the few times in the last 50 years thedividend yield or income generated on the FTSEAll Share index is higher than the yield on tenyear government gilts.

A well diversified portfolio of equities using a collective investment such as an OEIC heldwithin a pension fund or an ISA could produce a useful income well in excess of cash coupledwith longer term capital growth potential.Dividends could be cut reducing overall incomepaid and capital value could fall.

Commercial Property

A diversified portfolio or property fund shouldprovide a good level of rental yield althoughtenant defaults and falling occupancy rates foroffices and retail property would reduce the levelof income received.

At some point we feel values should start torecover providing rental income and inflationprotection. As always the value of propertyinvestments and income from them can godown as well as up and investors might not

get back the amount originally invested, therecan also be delays in realising propertyinvestments due to their illiquidity.

In recent months I have advised clients onconstructing portfolios with the underlyinginvestments split between mainly UK Equityincome funds, high quality corporate bond fundsand government gilt funds. Using our in houseresearch systems it is possible to identify theunderlying asset allocation of the portfolio andthe top holdings in the portfolio. The underlyingincome yield on these portfolios is typically inexcess of 6%. Clearly there is no guaranteethese levels of income will not drop and theunderlying assets may decrease in value. Itshould also be remembered when analysingportfolios past performance is not a guide tofuture performance.

I admire the fact that people can live it. Totalcommitment. It isn’t always the healthiest thingto do, lots of other things can suffer, but I stilladmire anybody that can do it.

Clive Hutton of CH Powertools and HuttonBusiness Centres. As a lad me and my brotherused to BMX with Clive. Clive has always been apunk rocker at heart (and anybody who has seenhis evening wear at the Business Awards willunderstand that!) and not the most academicperson. But through sheer hard work,determination and an unprecedented drive andwinning attitude he has overcome manyobstacles, and even won the DoncasterChamber Entrepreneur of the Year Award alongthe way!

What would you like to improve about businessin Doncaster?

More graduates returning to work in Doncaster.A recent survey shows that there is a massiveshortfall of candidates possessing NVQ level 4qualifications and above in Doncaster, costingthe borough some £248 million in productivityshortfall – a problem only intensified by the factthat only 1% of graduates return to the boroughafter gaining a degree. How can Doncasterbusinesses compete Nationally or Internationallyif they can’t employ staff with the necessaryskills for the business?

What’s your favourite place to relax inDoncaster?

There are many great places to relax inDoncaster, Sprotbrough falls, cycling the TransPennine Trail, a stroll around Lakeside, but I mypersonal favourite is the top of Cusworth Hall hillon a Summers day. A great place to take apicnic and watch the beautiful changinglandscape of Doncaster.

What should Doncaster be remembered for?

The attitude of it’s people. After the close of themines in 1980s, Doncaster’s future looked bleak.One of the best things to come from this wasthe development of entrepreneurs and theentrepreneurial attitude. A huge amount ofpeople were given the opportunity to do whatthey always dreamed of doing and influencingeveryone around them. The results speak forthemselves today.

It is said that up to 15% of people will sufferfrom depression at some time in their lives andwill experience the typical symptoms of moodswings, anxiety, feelings of despair, insomniaand loss of interest in life generally. The goodnews is that recognition and treatment has neverbeen more effective with many sufferers makinga complete recovery.

Medication in the form of modernantidepressants, have been welcomed as fastacting and effective. These are in the form ofselective serotonin reuptake inhibitors (SSRIsbetter known as Prozac and Seroxat). There aremany different causes of depression and insome cases there is no obvious explanation forthe condition.

However working as a weight loss counsellor foralmost five years, I have noticed that many ofthe clients who come to me to lose weight aretaking medication for depression. The stronglinks between feeling in a low mood and the use of food to help individuals feel better is acommon theme. They have explained their needin the past to feel better and how food has beeninvolved in this process, but then how they seemto experience guilt and anger because they haveused food in this way.

This then seems to create even greater feelingsof anxiety, and an increased need to feel betteragain. Turning to food to temporarily changetheir feelings again and again. They describe thisas a vicious circle, a spiral of distruction andtheir weight inevitably goes up and up, creatingincreased lack of self esteem, a feeling of being

out of control and deeper depression.Identifying this downward spiral is one thing, but knowing what to do about it is quite often a challenge. It often takes a lot of courage tomake the first phone call to come to a freeinformation session to find out what is on offer.My clients come to lose the weight and by usingthe psychological approaches of cognitivebehavioural therapy and transactional analysisalong side a VLCD (very low calorie diet) withmeal replacements, results are usually quick andconsistent.

I notice that the combined methods prove to bevery effective for most people, and as the weightcomes off they experience a sense of euphoria,and increased feelings of being in control. Manyunder the guidance of their medical practitionerscome off the antidepressants, and take controlof their lives in many more ways than just foodchoices.

A long term plan of management support is alsooffered to clients to help them move graduallyinto healthy choices and smaller portions tokeep the weight under control. Regular freemonthly sessions help to keep reminding themthat they can behave differently, challenging thenegative thoughts which may induce a return tothe old behaviours which led them to be sounhappy in the past.

So it’s all over now, you have eaten your turkey,given your gifts and received all those thingsthat go to increasing your waist. I bet you havealso set a few resolutions about how you aregoing to behave in the coming 12 months.

Maybe you have decided to lose weight, stopsmoking, or put an end to some other bad habit.But have you really set this resolution in stone?Has it been prepared in a way that means youwill achieve it?

Here are a few tips that will help you get to yourgoal:

1 Write it down. Describe the end result in away that includes what you will see, hear,feel and say to yourself.

2 Identify how you will know you haveachieved what you want, specifically, eg. I am a size (choose your ideal dress size),or I weigh (choose your ideal weight).

3 Make sure that the resolution is for you andthat it is yours to control. You have noinfluence over others, so resolving that yourson will do better at school is unlikely to berealised unless it is his resolution.

Nobody likes backing up, butone day you will be thankfulthat you did. Here are the mostefficient methods of protectingyour stuff, no matter what yoursituation.

One day, your hard drive mightcrash or worse still thieves mightsteal your computer. Or youmight realize that you need anold version of an importantdocument that you have justoverwritten.

At times like these, having asecure, up-to-date backup canbe a lifesaver. Here are somepractical strategies for backingup your data.

What to Back Up

Your documents: You shouldback up your word processingfiles, spreadsheets, and similardocuments regularly .

Application data: Applicationscreate and maintain data filessuch as e-mail messages,browser favourites, calendarentries, and contacts that mayrequire regular backing up.

Media: If your backup medium issufficiently roomy and fast, youcan back up your photo, music,and video files.

Sentimental items: Files that youwant to keep forever such asfamily photos need to be backedup twice to offer extra protection.

Your system: You can alwaysreinstall Windows and yourprograms, (provided you havethe original discs of course!). Butif your system did not come withany Windows discs follow yourmanufacturers instructions onhow to create a Recovery Disc,and keep this tucked awaysafely.

Backup Mediums

External Hard Drives – A greatmass storage device, but don’tforget that these types of harddrive are just as likely to fail asthe one in your laptop PC, sodon’t store all your data herewithout also having it copiedelsewhere.

USB Pen Drives – Not usually bigenough for long term storage,but great for portable and shortto medium term storagerequirements.

RAID Drives – These are harddrives with a difference. That isthey offer two or more harddrives in a single enclosure. If set up correctly (and if is theimportant word here) then theywill automatically provide youwith two copies of your datawhenever you save a file tothem.

Home Network – Great forencouraging the whole family tomake copies of their importantfiles. Link your computerstogether via a router, add a NASdrive (network attached storage)and all the people with access toyour network can make copies oftheir data in one place.

DVD/CD-ROM – No longer theanswer to many backupscenarios as they have beenovertaken by hard drivetechnology in terms of speedand capacity. But still useful forlong term backups where youdon’t need regular access to thedata.

Cloud Storage – The new kid onthe block. For a monthly fee (andeven some free offerings areavailable) you can store yourbackups in Cyberspace, awayfrom your home and any of therisks therein. Your data will be

stored securely on a largecomputer which could be locatedanywhere in the world. The onlydownside is speed of access.Large quantities of data can takehours or even days to transfer, sonot always good for recoveringfrom a complete system failure.

Backup Software

Many types of software can beobtained to automate your databackups. If configured correctly,they can provide an invaluableservice, taking away the humanelement of forgetfulness from theprocess. More sophisticatedsoftware can also provideversioning, which allows you torecover a number of differentversions of your documents fromdifferent dates should youaccidentally overwrite one.

Firstly – Staying Healthy;

7 steps to maintaining a healthy heating and hotwater system;

Read all the manuals for your system. Make sureyou know what all the knobs, dials and switchesare for and where they should be set. If youdon’t have manuals you can normally get themfrom the internet. If that fails you can contact usthrough our website atwww.waveformservices.co.uk and we will dowhat we can to help.

Make sure your heating system is free of air. Doyour radiators sound like a chip pan when it iswarming up? This is a sign of air in the system.

Make sure your controls are working and setcorrectly and remember the cylinder stat too.Make sure your hot water storage is properlylagged. Pipes should also be lagged if they runin unheated areas.

Check that you have no leaks on the system. A common sign is the brown streaks on yourpipes to the radiators.

Check your pump for signs of leakage and see ifit sounds nice and quiet.

Check the water in your system. If it’s black andsludgy you should consider flushing the systemputting in some inhibitor chemicals and fittingone of the system cleaners (Magna Clean orBoiler Buddy).

Please don’t attempt to do any repairs to yourequipment yourself.

Call a suitably qualified and certified engineer.

You can look on the GasSafe website to find onein your area.

Often these essential jobs canbe overlooked during thegrowing season as therealways seems to be morepressing things to do. Believeme sharp tools make goodgardening much easier andmore enjoyable.

WHAT DO YOU WANT FROMYOUR GARDEN?

Next have a think about whatyou want from your gardenover the coming year. What isthe main purpose of yourgarden?

Well, here we are again in February. Perhaps youare reflecting on the results you achieved during2009 from a health & fitness perspective. Maybeyou are contemplating what you want to achievenext year.

So, what will it be in 2010? Become healthier?Lose weight? Get fit? Tone up? Have moreenergy? Eat well? Be more active? The goalsvary from person to person. Have you thoughtabout what you want next year?

In my experience the following facts are true;many people consider (and I stress the word‘consider’) health & fitness goals and New Yearsresolutions at this time of year. Many peoplevery rarely set effective empowering goals thatthey write down and follow through – they tendto just vaguely list them in their head.

Many people will simply not achieve want theywant. Many people will do the exact same thingevery year and expect a different result! Wakeup! It is never going to happen.

You simply cannot do they same thing each yearand expect to get a different result. You will likelyget what you have always got and if that isnothing then you are a creature of habit which is a good thing, I’ll explain later.

So, why do we do this? How do we do this?How can we overcome this? Well, get ready,here it comes the moment you have all beenwaiting for, the answer that you are literallygagging to hear (OK Mark get on with it!).

The answer is YOU must CHANGE by becomingan effective GOAL SETTER.

I know, sounds obvious and simple doesn’t it?You are right it is simple and it is obvious. GoalSetting is a simple procedure you musteffectively complete before you begin any diet orexercise program. To be successful at anything,you must aim for it and those who aim atnothing will likely hit nothing everytime.

If you ignore this step – like most people do -you are destined to fail no matter what you do orhow hard you try. This crucial first step is goalsetting and you are about to learn some of thestrategies and techniques I use with my clientsto help them set some powerful goals.

Goal setting is a huge subject, entire books havebeen written about setting effective goals. This article will likely only scratch the surface but at least it gets you started. Here we go.

Firstly write down this question on a piece ofpaper: What do I want? Then write downunderneath exactly what you do want and bespecific. Tell yourself where you are now inrelation to the goal and where you want to be?How soon do you want to be there realistically?

Next write down this question: Why is itimportant to me? And then ask: For whatpurpose do I want it? Only settle for a lot ofdetail at this stage and you are looking for the‘emotional’ button.

The phrase that you are looking for will likelystart like this: I want it because it will make mefeel.....

You will have now found your main ‘motivator’.Finally ask yourself this: How will you knowwhen you have achieved it? Actually anotherway to ask this to get you to write down adetailed answer is to ask: What will my life belike when I have achieved it? How different willyour life be?

Whilst doing this only focus on the things thatyou want and avoid focusing on the things thatyou do not want. Remember, you get what youthink of every time! Always perform a goalsetting session in a very happy, positive frame ofmind. Put on your favorite music perhaps andgo to your favorite room or location.

Once you have competed your goals, I challengeyou to re-affirm them every day by reading themout loud to yourself at least twice per day. Thismay seem pretty strange at first but trust me it isone of the most powerful things you will ever do

to yourself. Remember, you have to do thingsdifferent to make a difference.

You can do it and do not let anyone elseinfluence you otherwise. Make 2010 your year.

“About 6 years ago I was asked to help out atBalby Primary School as they did not have aSanta and were desperate, I did this, and theyear after they asked me again but the Santa suitwas very threadbare so I had a new one madefor me.

At the same time my father then 82 years oldwas also being Santa at Ackworth GardenCentre (he had been asked to do this by mySister who worked there). I then started to beSanta at Ackworth at the weekends to give myDad a rest.

Four years ago my Dad stopped this job and as Inow had all the gear I decided to raise money forcharity by being Santa for local schools, libraries,children’s homes etc and charging them a smallfee, all money going to the chosen charity.

My January to November job is an ICT TechnicalOfficer, for DMBC, this meant that I had quite afew contacts so getting work wasn’t a problem. In 2007 and 2008 I raised about £1000 in totalfor the NSPCC.

Last year (2009), it was for the Sick Children’sCharity which provides free overnightaccommodation for parents who have childrenbeing treated at the Sheffield Children’s Hospital.

I persuaded one of our Help Desk girls (Maxine)to accompany me and we visited various DMBCoffices shaking the bucket (and anything elsethat helped!) and we were very successful, goingto Nether Hall, Carr House Centre and all 11floors of the Council House, collecting £700 in 4hours.

In total I have raised just over £1800 for“treetops” at Sheffield (20 gigs!), this has beenquite hard as I have had to do my normal job atthe same time and take annual leave, half daysoff etc to be Santa but it has been well worth it.The money is going to “sponsor” a room at theHospital which will ensure its availability for anyparents to use free of charge for 72 days andnights”.

Mos Lakeside security wasincreased on the 20thDecember as a group ofStormtroopers and anImperial Officer undertookroutine checks on thepassing traffic.

The Stormtroopers werelooking for a band of LocalKnowledge Rebels andproceeded to stop andcheck the Local KnowledgeVolvo.

Having studied Jedi from anearly age I was able to getthem to bend to my will.
