Important Information for Applicants

OBJECTIVE

The Western Australian Industry Participation Strategy (WAIPS) – Local Capability Fund (LCF) round is an initiative under the Government’s Plan for Jobs. The Western Australian Jobs Act 2017 (“The Jobs Act”) received royal assent on 13 December 2017 and is scheduled to take effect from 1 October 2018.

The purpose of The Jobs Act is to use the State Government procurement process to enhance local industry participation in the supply of goods and services to or for agencies of the State Government, focusing on benefits to small and medium enterprises (SMEs).

This round focuses on competitive SMEs in Western Australia who are seeking to better prepare to participate as suppliers of products, services and works to Western Australian State or Local Government agencies and entities – the market (market). Specific objectives of this round include:

Improving the applicant’s capability and Capacity to service the market Meeting the requirements for prequalification, contractual or technical

compliance of the market Overcoming barriers and constraints to participate in the market Improving innovation and research Improving overall applicant competitiveness

LEVEL OF FUNDING

The level of funding support under this specific round of the LCF is 50% of eligible costs up to a maximum of $20,000 (excluding GST) per successful applicant. The LCF is a re-imbursement scheme and therefore successful applicants will need to pay for the activity before making a claim for the approved funding support. In-kind contributions are not considered as part of the applicant’s commitment to activity costs.

INDUSTRY ENGAGEMENT

In order to be considered for funding, applicants, whether they are current suppliers to Government or not, must detail within the application their engagement with the market, and provide evidence to demonstrate such engagement. The engagement must support the activities the applicant is seeking funding support for.

REPORTING

As a condition of funding, successful applicants will be required to provide a report within six (6) months and twelve (12) months of receiving payment (a reporting template will be provided by JTSI when the reports are due for Updated as at 19 November 2018 Page 2 of 31

ELIGIBLE ACTIVITIES

Planning - This includes, but is not limited to:

o Strategic and business planningo Contract and tender negotiation planning, including terms and conditions adviceo The writing and implementation of marketing planso Feasibility studieso Assistance in applying for other government and international grantso Domestic and International market entry planning

o Works carried out by unqualified consultants without the appropriate expertise to deliver the service

o Works carried out by third parties that are not perceived by JTSI to be at arm’s length from the applicant

o Support of any legal action

Plant and Equipment - This includes, but is not limited to:

o Upgrading or modifying existing equipment or machineryo Acquiring equipment, machinery

o Equipment, and machinery acquired second-hand through a private saleo Motor vehicles of any kind

Improvements to internal business infrastructure/systems - This includes, but is not limited to:o Improvements to occupational health & safety systems, quality assurance systems,

manufacturing and management systemso The implementation and audit of ISO management system standards, including but

not limited to, ISO 9001 Quality Management, ISO 31000 Risk Management, ISO 14000 Environmental Management and general occupational safety and health standards

o Upgrades or expansions to applicant owned property/buildingso Software purchase and upgrades e.g. tender management software, computer aided

drafting or project management software linked to a specific outcome and to raise capability

o Technical advancements/processeso Other activities identified as necessary to help meet the pre-qualification

requirements of the target market

o General computer hardware, software and office equipment upgrades and purchases e.g. Microsoft Office/Windows operating systems, photocopiers etc. (Unless it is specialised equipment considered vital to the operations of the applicant’s business and is used exclusively for business purposes)

o Land and property acquisitionso Internal research and development activitieso Expenditure of an operational nature

Training – includes but is not limited to:o Up-skilling employees which leads to improved operational processeso Training linked with the acceleration and boosting of Australian Apprenticeship

collegesIn-kind contributions are not considered as part of the applicant’s commitment to activity costs and are not funded under the LCF.

ELIGIBILITY

To be eligible for funding, applicants must meet the eligibility criteria outlined in the self-assessment checklist below.

Previous recipients of funding through the Industry Facilitation and Support Program (IFSP) or the Local Capability Fund (LCF) are eligible to apply, subject to:

the applicant having complied with the requirements of the Financial Assistance Agreements entered into for the prior funding; and

the applicant having received no more than three (3) approvals under this grant process in the last 5 years.

Retrospective activities will not be funded. The activity or expenditure on the activity should not be undertaken prior to submitting this application.

USE OF CONSULTANTS

Consultants used to help the applicant deliver the activities funded under this program must be at arm’s length from the applicant. Applicants will not be funded where works are carried out by third parties that are perceived by JTSI not to be at arm’s length from the applicant.

APPLICATION PROCESS

LCF applications must be received prior to the closing date of 17:00 (WST) 28 February 2019.

Your application will be assessed by an independent panel and scored against the criteria listed in Part C of this application. Assessments will be conducted on a monthly basis after the launch date until the LCF round closes or until funds are exhausted.

The applicant will be notified on the outcome of its application via the email address provided in the application form.

Approval of funding is subject to the applicant entering into an LCF Financial Assistance Agreement (FAA) with the Department of Jobs, Tourism, Science and Innovation (JTSI).

The FAA requires the applicant to provide a report within six months and 12 months of receiving payment (a reporting template will be provided).

The FAA also stipulates that at any time within two (2) years of payment, JTSI may contact the applicant for verbal updates on business performance generally.

PAYMENT TERMS

A lump sum payment will be made as a single reimbursement of approved activity expenditure.

This payment will be made on submission of a Tax Invoice to JTSI and must be accompanied by receipts as proof that the activity has been paid for in line with the application and Financial Assistance Agreement.

JTSI must receive the applicant’s claim for reimbursement within three months of funding or as otherwise agreed.

JTSI is registered for GST and has been issued with Australian Business Number 90 199 516 864. JTSI regards grants under this scheme as payment for a supply. GST registered grant recipients will therefore be liable for GST in connection with the grant.

For GST registered grant recipients, JTSI will increase the grant by the amount of GST payable. GST registered grant recipients must provide JTSI with a tax invoice for the GST inclusive value of the grant unless JTSI and the recipient have agreed in writing to the issue of a recipient created tax invoice.

Payment will not be made until JTSI receives a tax invoice or an agreement to issue a recipient created tax invoice.

The recipients acknowledge that the grant provided is consideration for a supply to JTSI and that the GST component will be included in the recipient’s next Business Activity Statement lodged with the Australian Taxation Office.

For recipients not registered for GST, JTSI will not include GST, nor will it reimburse an unregistered recipient for GST paid or payable to a third party. Unregistered grant recipients must provide JTSI with an invoice for the amount of the grant.

JTSI collects the information sought in this application so that it can check the applicant’s suitability for funding under the LCF and for the purpose of verifying the applicant’s ability to meet its contractual obligations. JTSI will treat all information as confidential.

However, JTSI operates within a public accountability framework and applicants are informed that JTSI is subject to the Freedom of Information Act 1992 which provides a general right of access to records held by Western Australian State and Local Government agencies.

Applicants should be aware that information pertaining to the receipt of State Government financial support may be tabled in the Western Australian Parliament.

This information could include names of recipients, the amounts of financial support, the name of the initiative/activity and, possibly, a brief description thereof.

This could result in requests for more detail to be released publicly.
