LAW3320 Long DissertationGRADEMARK REPORT

GENERAL COMMENTS

Instructor

First marker,

This thesis demonstrates an excellent understanding ofthe law in this area.

has evaluated the sources and consideredcounterarguments to arrive at her own conclusions. There were one or two weak spots in the argument(e.g. the rebuttal of Finnis, which 'played the man notthe ball' and there could have been a few morecounterarguments in the autonomy section) but, overall, the level of analysis was strong throughout.

The work is logically structured. the introduction setsout the problem and signposts the dissertation. It isclear what the 'job' of each section is and theconclusion ties together the argument.

The range of sources and discussion of the ethicalliterature was impressive. has evidentlyresearched the topic from a number of different angles.

The work is clearly communicated, neatly presentedand properly referenced. However, there wasan overuse of commas and transitional words for thestart of sentences - the latter was distracting at times.

Second marker, This is a well-researched and clearly-argueddissertation, which showed good understanding of thelaws surrounding enforced caesareans. The doctrinalanalysis was particularly strong. But the conceptualwork could have been better. Autonomy is an important

Page 57: LAW3320 Long Dissertation - Resources | Library

principle, but it is often limited in health law as in otherareas - and I wonder if it might have been worthcomparing and contrasting enforced caesareans withsome of these.

Good discussion. Counterargument: some might say that if you lack capacity you do not haveautonomy to restrict in the first place.

Counterargument - some conditions where it is not in the child's interest to be saved? But I suppose

effectively as argument is developed throughout
