DEFINITIONS

Article 1

СНАРТЕА 11

GENERAL PROVISIONS

Article 2

Urban planning, within the meaning 01 thi$ law expresses and defines the gener~1

rules of construction placement and architecture in the entire territory 01 the RepubIic01 Albania.In determination 01 these rules shall Ье taken into сопеюегапоп the economicandsocial development, present ог Миге 01 the country, at the national and locallevel;the protection of the country, the protection 01 the environment, ргеsегvаtiопапd;

display 01 the шЬап рlаппiпg, architectural and archeological values as well as>theprotection 01 legal interests concerning the private ргорвпу.

Article3

The local government organs shall Ье the management 01 the territory uпdегth~jгjurisdiction, in compliance with the competences provided for Ьу law. Aiming att~~

lile сопошопв improvement, territory is managed оп legal basis, to ensuretQ~

environment protection, to preserve the equilibrium in the development 01 urbana~2

rural агеаз and at the present conditions improvement, the local governmentorgansshall harmonize their decisions mutually, honoring the local autonomy.

Article 4

AII construction in the territory 01 the RepubIic 01 Albania shall Ье done Ьаsеd Э9regional and environmental игЬап planning studies, master plans, general аdjustm~чt;plans, partial шЬап planning studies in the draft project phase and оп tесhпiсаl~~Йimplementation projects. constructions and 01 engineering infrastructure in the entire territory 01 the countryshall Ье based оп norms, technical conditions, laws, and by-Iaws in югсе.

Article 5

The regional игЬап planning and environmental study, master plan, generaladjustment plan, partial шЬап planning study, construction bordering line andБиЬшЬап line aretechnical documents that condition and determine all the technicaland legal relations in the lield 01 шЬап planning. The Council 01 Ministers approvesthe Urban planning Regulation, which determines the content and таппег 01formulation 01 these documents.

Article 6

Outside the urbanized territories shall Ье permitted to construct only in cases whendetermined in the regional studies and master plans approved Ьу the competentorgan. The regional studies and master plans shall Ье formulated excluding fromconstruction agricultural lands 01 the first, second, third and 10urth category,determined Ьу а technical герort 01 the directory 01 agriculture and food in the district,as well as the protected natural areas.

COMPETENCES OF ТНЕ STATE ORGANS IN ТНЕ FIELD OF URBANPLANNING

Article 7

The highest state organ for approval 01 the игЬап planning studies is the Council о!Territory Adjustment of the RepubIic of Albania (СТARA).

Article 8

СТARA is а decision organ and functions close to the Council of Ministers. TheChairperson 01 the СТААА is the Prime Minister. The Council 01 Ministers shalldetermine the composition, питЬег of members and their compensation amount Ьуdecision.

Article 9

СТARA approves the 101l0wing decisions:. Terms of Ае1егепсе for studies approval of which is under its competence;. Regional игЬап planning studies;- Master plans of агеаз with а surface тоге than 1О hectares;- Regional and partial urban planning studJes of deveJopmentof the tourism агеаз;

- Master plans 01 development of the tourism агеаз;

- General adjustment plans, constructions bordering lines and the зиЬшЬап border

Article 10

Article 11

The technical secretariat of CTARA functions in the relevant ministry andfollows цр

the activity of territory рlаппiпg in {Ье Directory of Territory Planning. ТЬе СDщюiJ аЪМiпistеrs shall determine with separate provisions the duties 01 the techhio.8!secretariat.

Article 12

The геlеvапt ministry that follows up the activity of territory planningthroughII:t($Directory of Territory Рlаппiпg shall co-ordinate the work Ьетееп the CTARAsfaIttorgans and those of local government in the field of territory planning. This direo.t9J;Yhas {Ье r;ght to сопduсt сопtгоls iп the local government organs dealing withtemto~рlаппiпg аз well as to study and ргераге drafts of laws and by-Iaws.

Article13

Iпstitutе of Studies and UгЬап Planning is the state organ at а паtiопаllеlJ'еIФ!~designs studies апd uгЬап cons1ruction plans defined in the. Urban PlanRegulation. This institute is subordinate 01 the Ministry of Public wor«sТгапsрогt.

Article 14

The specialized organs оп uгЬап planning in the local government аге:• The Council of Territory Adjustment in the District Council, in the Мuпiеipаlitу ofТнапа and in olher municipalities. which аге of the first eategory 10WПS (СТА).

• The uгЬап рlаппiпg section iп the District Соuпсil and in muпiсiраlitiеs that аге

tоwпs of the first category (the uгЬап рlаппiпg directory in the Municipality of Тiгапа)апd the tесhпiсаl secretariat of the СТА;

- The uгЬап рlаппiпg office iп municipality;• The urЬап рlаппiпg office iп the соmmuпе.

ЕstаЫishmепt and 1uпсtiопiпg of the СТА is done respectively оп the proposal of theDistrict Council, of the Municipal Соuпсil of Tirana ог of tоwпs of the first categoгy

and the miпistгу, соvег[пg the activity in the геlеvапt approves it. The members of theСТА shall Ье compensated for their work.

Artic[e 15

Within the mеапiпg of this law, towns of the first category аге Shkodra. Оцггёв],

Elbasani, Fieri, Уюга, КОГ9а, Saranda, Gjirokastra, Berati, Pogradeci. Lezha, Lushnjaand Kavaja.

Article 16

The СТА function as а decision-making organ in the District Соцпсй, Municipality ofTirana and municipalities that аге towns of the first category. The Chairperson of theСТА is respectively the Сhаiгрегsоп of the District Соuпсil and the Мауог. The СТА

is composed of 15 members who аге ехрвпз with experience iп the relevant field.

Article 17

The members of the СТА of mUnicipality of the first eategory towns аге: Мауог; Chief01 uгЬап planning offiee; Chief of uгЬап ргорепу геgistгаtiоп office; Director of theConstruction Poliee ог ап officer proposed Ьу him; Chief of legal office; Chief ofpubIic infrastruetuгe; inspector of the regional environmental аgепсу; gгеепiпg

Article 18

Article 19

The СТА of Municipality of Tirana is composed of 21 members. Article 20

the district and partial urban planning studies 01 апу size in conlormity wilh thedevelopment programs;- Bordering liпе 01 construction and the border 01 suburban агеа;

- General and partial шЬап planning s1udies of соттипез;- General adjustment plans 01 communes;- General adjus1men1 plans 01 villages;- Construction sites with their destinations together with игЬап planning conditionsbased оп the approved шЬап planning studies;- Implementation projeet 01 objeets conslrue1ed in а construelion site 01 апу size- Construction sites and permits;- The СТА 01 the district and municipality shall approve the consideration аз illegal ()I

Article 21

Article 22

Article 23

Designation and dismissal 01 the Chief of urban plann!ng section in the DistrictСоипсil and [п municipalities 01 first category towns shall Ье done respectively оп theргороэаl of the District Council, Municipal Council 01 first category towns and isapproved Ьу the relevant minister. The relevant minister in special and justified casesdecides their dismissal. .The minister shall designate and dismiss the Director о' the Directory о' UrbanPianning in the Municipality 01 Тirana.

Article 24

The шЬап planning section in the District Соипсil, Directory 01 Urban planning<[nTirana Municipality and urban planning отсе in municipa!ities 01 1irstcategory townsmust have the following structure: .• Chie1 01 the section (Director 01 Urban planning in Tirana Municipality);- Technical secretariat 01 the СТА;

• Sector 01 design study urban planning;- Sector of игЬап property registration;• Sector of lega! шЬап planning;- Sector 01 engineering infrastructure and environmentai impact аввеввгпегп. .

The District Соипсil and the Municipal Соипсil, shall determine the пumЬегоf

employees 01 шЬап planning section respective/y but по less than seven шЬапplanners, architects, infrastructure engineers and topographic engineers in distric:tsand first category towns and по less than five urban planners, агсhitесtЩ

environment engineers, in1rastructureengineers and topographic engineers or similarexperts in other districts.The Municipal Council shall determine the пиmЬег of employees 01 the Direct6iyofUrban p!anning in Tirana Municipality, ош по less than 35 игЬап planners, architect,s,environment engineers, construction engineers, infrastructure engineers, topographicengineers, environmentalists ог similar experts.

ArticJe 25

In the Directory of Urban planning in Tirana MUnicipality, urban planning sectibns,il1the District Councils and шЬап planning of1ices in municipalities о' the 1irstcategbrY,towns shal! Ье estabIished the technical coune;l, composition of which is approvedbXthe Тirana MUnicipal Council, District Council or Municipal Council 01 fiгstсаtеgчlJ'

towns. Composition, 1uпсtiопiпg, rights апd duties 01 the technical соипеН shallblidetermined Ьу погmаtivе acts.

ArticJe 26

The игЬап planning office in the municipality has the fol!owing rights:

- Manages the work for formulation of Terms of Reference of игЬап planningdevelopment design of the town and the necessary technical documentation fordesign of the adjustment plan and submits for арргоуа! to СТА and to the MunicipalCouncil.- After approval from the Municipal Council and fгom the relevant organs of design

Terms of Reference, shall order the design of town adjustment plan to thespecialized organs in reliance with laws in foree.- Designs and orders partial шЬап planning studies from specialized design organs,

private ог state, licensed in the field of urban p/anning, in геliапсе with legalprovisions in force and iп application and elaboration of town general adjustmentplan, upon primarily гесв'рт of СТА орiпiоп.

- Aeviews applications for construction permit of апу object and the encloseddocumentation and only where there is а general adjus1ment plan ог partial шЬапplanning study approved, аНег gives its opinion, submits for review to the СТА. '!delivers the paperwork то the teehnical secretary of СТА. Article 27

approved within the territory of the соттипе;- Aeviews applications for construction sае and permit and the relevantdocumentation only where exists ап approved general adjustment plan and partia/urban planning study together with its opinion [remarks] and submits for арргоуаl tothe Communal Council;- Submits for approval to the district СТА the applications 10Г construction permit,

construction sites, for objects demolition and tree5 cutting.

Article 28

CHAPTERIV

MANAGEMENT OF LAND WIТHOUT CONSTRUCTIONS

Article 29

Management of land for construction shall Ье done through regional plans, masterplans, general adjustment plans, and partial urban planning studies. The Regula.ti6n

of Urban planning determines lheir content.

Article 30

Within the meaning of this Jaw, the land private ргорвпу and lhe land, pubIic propectYhas the same value for urbanization. The таппег of their use for constructioГl

purposes shall Ье defined in the regiona! игЬап planning studies, master plansi,

general adjustment plans and partial игЬап planning studies.

Article 31

In application of all types of игЬап pla'nning studies, according to their implementationрпавев in compliance with this law and other legal acts, shall Ье executed.theexpropriation in full conformity with private immovabIe property valuation andwitf{relevant expropriation procedures.

Article 32

Owners of the lands within the constructions bordering lines in towns, villages a~d

residential areas have the rJght that through licensed organs and persons to performstudies оп their'estate territoгies upon receipt from игЬап planning organs the criteriaand urban planning conditions defined in the studies in force. These studies arenqtcompulsory for use Ьу state organs, but they сап Ье presented as options()ftechnical solutions for discussion in the СТА under the jurisdiction of which istheland, together with the studies that the local government has the right to designonthe same territories.

Article 33

Shall Ье prohibited the extensive urbanization of areas with natural values,qfagriculture lands and private property forestlands. The owners of agriculturelandsoutside the construction bordering lines of towns, villages and residential агеаз hayethe rightto request the urbanization of their estates only based оп deterrninationsjpthe regional studies, master plans and suburban areas studies, approved byth~

competent organ.

Article 34

The landfill of all kinds of waste including those of technological and constructionorigin, dependant of the size of the landfill and of the ргосеssiпg technology shall Ьеapproved Ьу the СТА under the jurisdiction of which is the агеа of landfill lосаtiоп.

The public media release the notice. The interested individuals concerningthis documentation sha/l present their remarks to the urban planning section at the,осаl level. Within the 30 days time /imit, the design organ in со-орвгайоп withre/evant office ог section in the district, 'п the first category municipalities and TiranaMunicipality includes the remarks and the Лпаl documentation is submitted to theclosest meeting of the геlеvапt СТА.

Article 37

Regional plans and master plans shall Ье prepared for periods of over 20 years,whilst general adjustment pfans апd partial игЬап planning studies shall Ье preparedюг certain periods of 10 to 15 years inc/uding priorities of the 5 уеаг first phase. Theyсап Ье modified оп рroроэаl of local government organs justifying the modificationand approving these modifications Ьу organs competent for their approval.During the time, that modification of апу kind of urban planning study is prepared anduntil it's final approvai shall Ье effective the previous study.

Article 38

Submission of applicant "in writing for аррroуа! of the construction site and its игЬапconditions, as well as of апу игЬап р/аппiпg study shall Ье compulsoгy to апу naturalаг juridical регзоп, 'осаl ог foreign, which will construct а superficial ог subterraneanstructuгe. The appl1cation for construction site shall Ье done based оп Form NO.1 that,э attached to this law. The Urban planning Regulation provides the technicaldefinitions of the documentation and its graphicaJ form.

Article 39

Article 41

Local government organs when inteгested for constructions in а certain агеа that ispubIic pгoperty, оп objects of pubIic and social importance shall announcecompetitions. Review and selection of tenders shall Ье conducted in compliance .withthe Jaw.

Article 42

Article 44

From the date of application suЬmissiоп for approval of the site with its finaJfunctional destination as well as the игЬап рlаппiпg conditions to the decisionannouncement must not pass тоге than two months. Iп case that the applicationdoes поt agree with the decision of СТА тау file а complaint of аррliсаtiоп re-reviewto the District апd Municlpal Council. The re-review of the аррliсаtiоп and the СТА

Article 45

Апу natural and juridicaJ person, local ог foreign that will construct in the territory ofthe Republic of Albania must provide а сопstгuсtiоп permit. This is 1he single legaldocument, based оп which constructlon shall Ье permitted. The сопstгuсtiоп permitshall Ье granted to the licensed constructor juridical person. Either in the case wherethe lапd is private property ог in the case where is pubIic property, the constructorjuridicaf person must submit the contract entered with the land proprietor ог with theрегsоп to whom construction site has Ьееп granted Ьу the СТА. The application forconstruction permit shall Ье done according to Forms 3 and 3/1 of this law. Article 46

From the date of аррroуаl of function dеstiпаtiоп and urban рlаппiпg сопditiопs ofthe construction site until the аррliсаtiоп submission for construction permit оп sitespubIic property with surface up to 0.1 hectares must по! pass тоге thап 3 monthsапd оп sites of surface over 0.1 hectares must по! pass тоге than 6 months. Iп case·of violation of these deadlines for pubIic property sites, the игЬап рlаппiпg office ог

section notifies the Council of Munlcipality, Commune ог District according to the sitelocation, which decides for extension of the deadline ог another distribution of thesite. In cases of private property territories the time limit of the СТА dесisiоп forapproval of lunction destination of the construction site and its игЬап planningconditions, regardless of the surface is 6 months. In Gase 01 expiration 01 lhlsdeadline, the application shall Ье submitted again. When deadlines for the decision ofconstruction site аге not met, for either private property territory ог pubIic propertyQпе, the decision of СТА becomes iпvаlid.

The Directory of Urban planning [п Tirana Municipality and urban planning sесtiОПSIП,

Article 52

Article 53

Artjcle 55

In cases of constructions 'п pubIicproperly, at the moment of construction permit receipt, the natural and juridicalрегэоп shall рау 50% of the site value and when the first floor framework completes,the remaining amount shall Ье paid.

ArticJe 56

'П the estabIishment of the construction site, the natural and juridical person thatimplements the works shall Ье obIiged to expose in the visibIe plaee а bill board withdata оп the type of object, пате of the implementing сотрапу, director of works,chief of works implementation, пате of the juridical ог паШгаl регэоп that is designerof the project and the deadline of works completion.

Article 57

Article 59

Objects that constitute potential risk of bruise to life and health of people ап to thirdрагпев ргорвпу , that аге по! repaired Ьу the owner within the maximallimit of theirphysical durability, determined оп basis of technical гвропэ of ехрепв, shall Ье

demolished Ьу the owner in the time limit determlned Ьу the СТА. After expiration ofthis time /imit, they sha[/ Ье demo/ished Ьу the organs of Construction Раliее basedоп the request of the СТА. The object proprietor shall рау ехрепsеs of demolitions.The order signed Ьу the СТА Chairperson for раутеп! of these ехрепэеэ is ап

Article 60

Urban planning Directory of Tirana Municipality, urban planning offices of its units,uгЬап planning offices of other municipa/itjes, игЬап planning seetions af d;strietсоипеilэ and uгЬап рlаппiпg offices of соттипеэ shall control the destination of useof constructions in conformity with the опе approved.Апу modification of the constructions destinations in general, transferal of privatebuildings from ownership of а proprietor to агюthег proprie\or, and when thistransferal is done through destination change, shall Ье done ироп permit гесеф! Article 61

In the regional studies, master plans, general adjustmen1 plans and paгtial urbanplanning -studies, in co-operation wilh the National Environmental Agency and the

Article 62

CTAs of districts, of first category towns, of Т1гапа Municipality and the СТААА haveпо right to approve апу permanent ог temporary construction, outside the territorydetermined in the approved studies, in pubIic ргорвпу territories such аз:

• Territories о. social and cultural objects;• Green territories;• Sports territories;- Sites and spaces between existing bIocks of buildings;- Roads, pubIic squares, and parking, determined and interpreted in the Urbanplanning Regulation.Constructions that тау Ье done аге only those determined in the шЬап planningstudy [п fullconformity with the approved function.']п cases of properties returned from commission о! return and compensation Of·properties to former proprietors, when these properties аге located in such territories;the СТAs of аН levels do not have the right to modify the determined destinationinthe approved study. In these cases, proprietors of lands have the right .о!compensation according to laws [п power. .

Article 63

Application to cut ог uproot trees shall Ье done according to Form No. 6 attached tothis law. The СТА, under jurisdiction of which is located the агеа where trees willbecut ог uprooted, shall review the application. In case when the СТА decidesJ9approve this application, it issues the construction permit, which is issued onlyaft~E

receipt of payment for апу cutting ог other damage. The payment is done inth~

enterprise subordinate of municipality, соттипе ог district that manages greenterritorles. CHAPTERV

CONSTRUCTIONS IN TOURISM AREAS

Article 64

Article 65

Artjcle 66

Article 67

Aiming at protection of tourism агеаэ:

· Shall Ье prohibited extraction of earth materials within the border of the tourismагеа such аэ earth, gravel, sand, stones, wood, etc.• Shall Ье prohibited extraction materials from riverbeds, in coastal and lakeshoreareas;• Shall Ье prohibited works of drying, reclamation, creation of dumps and otherreclamation works, ехсер! of cases approved Ьу the СТААА, the National WaterCouncil and the National Environmental Agency in геНапсе 01 provision ofenvironment impact.These conditions аге valid even (о coastal protection works executed Ьу the Ministry01 Defense.

Article 68

CHAPTERVI

MANAGEMENT OF AREAS AND TERRITORIES OF PECULIARCULTURAL, ENVIRONMENTAL, ARCHEOLOGICAL, MUSEUM AND

STRATEGICAL VALUES

Article 71

Article 73

CHAPTERVII

ILLEGAL CONSTRUCTION AND AABIТAAAY OCCUPATION OF ТНЕ

Article 76

Article77

For iI1egal construction completed unti1 the пгпе of enfry into force of this law, therelevant СТА decides the tollowing:- When completed constructions impede implementation of approved studies of апуlevel that аге effective, the СТА decides their demolition according to implantatianphases of the studies;- When those constitute risk to environment ог оссиру pubIic territories, they shallimmediately demolish.For construction completed without permit Ьу owner in their land, when игЬап

planning conditions аге met, the СТА shaH decide their legalization with the conditionof compulsoгy payment of а fine equal to 10''/0 of the completed investment value,whllst for residential houses 4% of this amount. Evaluation experts of immovabIeproperties shall determine this investment va/ue оп request of егоап planning sectionог office. The urban planning office ог section shall approve compensation of вхрепв'рауаЫе Ьу the contravener.

Article 78

Constructions that аге executed wi1hout construction permit in the approved site areiIIegal construetions. Urban planning seetion о! municipality ог distrlct, цгоап planningdirectory of Тiгапа Municipa/ity, the Municipal Раliее and other interested persons,when notice such construc1ions, shall notify immediately 1he Construction PoliceBranch in the distriet about the 1IIegal construction. The Construction РаНее Braneh,ироп receipt of notice from the above organs ог оп its awn initiative shall deeideimmediately the suspension of the 1IIegal construetion and [троэе the amount of thefine according to Article 81 of this iaw.

Article 79

The СТА of the district ог of Tirana Municipality shall decide оп the illegalconstruction suspended according to Article 78, in its next meeting.The СТА grants the construction permit when construction meets requirements ofthis law, in the contrary shall decide to demolish the IIlegal construction. Thesedecisions аге final and the demolition of the construction shall Ье executed within fivedays from the issuance of the order of Мауог of municipality ог district for demolition

Article 80

In cases when eontraveners impede the application of proeedures of Artieles 75aГld

In cases when contradietion from the side of eontraveners constitutes criminalviolation, immediately shall Ье denouneed to the proseeutor for crim inal proceeding.

СНАРТЕА VIII

SANCTIONS

Article 81

Besides obIigations contained in these provisions, breach and execution of illegalaetions that constitute administrative contravene in the field of urban planning shallЬе punished with а penalty as follows:

- For [violation of] Articles 34,56, 57, and 58 with 50000 ALL;- For Articles 60, 61, and 63 wilh 200000 ALL;- For Artieles 66, 67, 73, 75, 77, and 78 with 500 000 ALL.

The Chairperson of the Construetion РоНее Braneh shall ппроае the penalties.

Article 82

Against the deeisions of the Chairperson of the Construetion Poliee Braneh, ап

арреаl тау Ье filed within five days from Ihe date of notiee to the Direetor of theConstruelion Police, whieh must reply within ten days. Against the deeision of thelatter, ап арреаl тау Ье fjJed to the district eourt where eontravene has Ьееп

committed, within five days from the date of notiee.

Article 83

and those of penalties impose does not suspend their exeeution. In ease of, basedоп the final deeision of the eourt, acceptanee of aecusation ог appeal, the damagedрегэоп has the right to request from the organ that issued the deeision,eompensation тог the caused damage.

Article 84

The contravener shall рау penalties, eompensations and demolition expenses,determined in this law within 5 days from the day of notiee of the Construction policedeeision ог from the day when the eourt deeision is final. After expiration of thistimelimit, shall Ье paid а penalty fee for lateness for 2% daily for а month.
