Snow and ice.11 (a) No person shall permit any snow or ice to remain on any PUBLIC sidewalk adjacent to any12 house, building or lot owned or occupied by that person, or on the PUBLIC sidewalk adjacent to13 any multifamily dwelling or unoccupied house, building or lot owned by that person, for more14 than twenty-four hours after the same has fallen or formed. THE NOTICE OF VIOLATION SHALL STATE

IF THE4 ASSESSMENT IS NOT PAID WITHIN 60 DAYS, IT SHALL BE PLAC ED AS A5 LIEN AGAINST THE PROPERTY AS PERMITTED BY LAW. ANY UNPAID6 PORTION OF THE SNOW OR ICE REMOVA L ASSESSMENT WILL BE SUBJECT7 TO A FIVE PERCENT (5% ) ADDITIONAL ADMINISTRATIVE FEE IF NOT PAID8 WITHIN 60 DAYS.9 ($ O ANY PERSO N IN VIOLATION OF SUBSECTION (a) OR (b) OF THIS SECTION10 SHALL ALSO BE RESPONSIBLE FOR A MUNICIPAL CIVIL INFRACTION AND MAY

For purposes of12 establishing civil fines, all PUBLIC sidewalks and rights-of-way shall be divided into two tiers,13 as follows:14 (1) Tier one shall be every PUBLIC sidewalk adjacent to a roadway with a speed limit of15 30 mph or more.16 (2) Tier two shall be all PUBLIC sidewalks which are not tier one.17 (d) (e) A police officer or duly authorized agent of the City shall issue a snow violation citation18 to the occupant or owner of any property in violation of this section.19 The Director of Public Service shall designate personnel to be authorized by Council to enforce20 this section. After such authorization, each designated person shall subscribe to an oath and place21 the same on file with the City Clerk. The oath shall be in substantially the following form:22 "I do solemnly swe ar (to uphold the C onstitution of the United States, and) that I will faithfully23 discharge my duties in enforcing the provisions of Section 1020.06 of the Codified Ordinances24 of the City of Lansing."

    Section 1. That Section 1248.03 of the Codified Ordinances of the City of L ansing,Michigan, be and is hereby amended to read as follows:1248.03. Uses permitted subject to special conditions.

    10 (a) Conditional uses described in this section shall be permitted in an A, A-1 or B Residential11 District, if the dimensional requirements described in Sections 1248.05 to 1248.12, the12 landscaping, screening and buffering requirements described in Chapter 1290, the conditions13 imposed by this section and all local, State and Fede ral laws are met.14 (b) An accessory structure and/or an accessory use which meets all of the following floor area15 conditions shall be permitted in an A, A-1 or B Residential District, except as otherwise16 specifically provided in this section:17 (1)18 TABLE INSET:19

    1 (2) The floor area of additions and structures attached to the private garage, including, but not2 limited to, covered patios, decks, storage areas and carports, shall be included in calculating the3 total allowable floor area of that garage.4 (3) The floor area of a garage or carport space in a Planned Residential Development shall not5 exceed 770 square feet.6 (4) The floor area of an accessory building shall not exceed the ground floor area of the7 principal building.8 (5) A single-family lot shall not have more than one storage shed and one garage or detached9 carport.

    10 (6) Each accessory structure shall not be located closer than 60 feet from the front lot line, nor11 closer than three feet to a rear or side lot line, unless attached to the structure containing the12 principal use. Detached accessory structures of 1,000 square feet or more shall be setback not13 less than six feet from a side lot line and a rear lot line. If an accessory structure is attached to a14 structure containing the principal use, it shall meet all dimensional requirements imposed upon15 the structure containing the principal use, except as provided in subsection (n) hereof.16 (7) Accessory structures for an approved nonresidential use shall comply with the setback17 requirements for the principal structures and shall provide landscaping, screening and buffering18 in accordance with Chapter 1290. T hese accessory structures are not subject to the size19 limitations of this section.

    DRAFT #3JUNE 29, 20101 (8) On through lots, an accessory structure located behind the principal structure shall conform2 to the front yard setback of the district in which it is located.3 (9) An attached garage with doors, that is designed for three or m ore vehicles, shall have at4 least one vehicle stall offset by not less than two feet from the front facade of the remaining5 vehicle stalls.

    (10) The accessory structure shall not involve the operation of a business.7 (11) An accessory structure shall not be used to service or repair a motor vehicle owned by a8 person other than a person having a legal or equitable interest in the lot on which the accessory

    structure is located.10 (12) No accessory structure maybe a public garage.11 (13) An accessory use on a lot shall not include motor vehicle repair. "Motor vehicle repair"12 does not include minor motor vehicle service which is completed within a 24-hour period and is13 limited to:14 A. Changing oil or other fluids;15 B. Minor tuneup;16 C. Tire rotation; and17 D. Changing brake pads if the vehicle is supported in a safe manner.18 (14) An accessory use of a lot may include the parking of up to four operable vehicles or one19 operable vehicle for each licensed resident driver at the dwelling, whichever is greater. All

    20 vehicles must be incidental to the primary use and not be stored on the lot.21 (15) An accessory use on a lot shall not include junk storage.22 (c) A temporary structure or a temporary use which meets all of the following conditions shall23 be permitted in an A, A-1 or B Residential District:

    DRAFT #3JUNE 29, 20101 (1) In the case of a temporary structure, a perm it has been issued by the B uilding Safety Office2 authorizing the temporary structure.3 (2) In the case of a temporary use, a permit has been issued by the Planning Division. In4 determining whether to issue a permit, the Planning Division shall review a request in5 accordance w ith the standards outlined in Section 1282.02(f)(1) to (9) and shall approve the6 request, deny it or approve it with conditions.7 (3) The person issued a permit under subsection (c)(1) or (2) hereof agrees in writing to remove8 the temporary structure or cease temporary use pursuant to the permit.9 (4) Permits issued under subsection (c)(1) or (2) hereof shall be for a period not to exceed tw o

    10 weeks, and upon request may be extended twice for a period not to exceed two weeks for each11 extension.12 (d) The temporary use of a permanent structure as a real estate office for the purpose of13 marketing new residential development which meets all of the following conditions shall be14 permitted in an A, A-1 or B Residential District:15 (1) The temporary use of the perma nent structure is located within the residential development.16 (2 ) The temporary use of the permanent structure shall be removed after three years, or after 9017 percent of the residential development is sold, whichever comes first.18 (e) A home occupation which meets all of the following conditions shall be permitted in an A,19 A-1 or B R esidential District:20 (1) No person, other than a member of the family residing in the dwelling unit, SHALL engages21 in the home occupation AND NO MORE THAN ONE PRIMARY CAREGIVER, AS THAT22 TERM IS DEFINED IN THE MICHIGAN MEDICAL MARIHUANA ACT, BEING MCL

    the home occupation.(4) No change occurs in the outside appearance of the dwelling.(5)

NO SIGNS SHALL BE10 POSTED ON THE LOT ADVERTISING ANY HOME OCCUPATION.11 (6) The sale of goods does not occur in the dwelling unit or on the lot on which the dwelling12 unit is located.13 (7) No equipment is used, except equipment which is normally used for purely domestic or14 household purposes. Equipment not normally used for purely domestic or household purposes15 OR ANY PORTION OF THE DWELLING UNIT WHERE ENERGY USE AND HEAT16 GENERATION RESULTING FROM THE GROWTH OF MARIHUANA EXCEEDS LEVELS17 REASONABLY ATTRIBUTABLE TO RESIDENTIAL USES ARE PERMITTED may be18 installed if the Board of Zoning Appeals approves such use. The Board shall approve of such19 use if it is satisfied that the intensity of use will not be increased to a level that will adversely

    20 impact any lot within 300 feet of the lot seeking Board approval AND THAT ANY ENERGY21 USE AND HEAT GENERATION RESULTING FROM THE GROWTH OF MARIHUANA22 EXCEEDING LEVELS REASONABLY ATTRIBUTABLE TO RESIDENTIAL USES HAS

    (f) A temporary bulletin board or sign which meets all of the requirements of Chapter 1440 of

    Part Fourteen--the Building and Housing Code and does not exceed ten square feet in area shall10 be permitted in an A, A-1 or B Residential District, if the sign advertises the sale or lease of a11 structure or lot on w hich the sign is located.12 (g) An educational facility, except an educational facility or an agent thereof that is a high13 school, college, university, trade or vocational scho ol or a comm unity or junior college, shall be14 permitted in an A, A-1 or B Residential District.15 (h) A group day care home which meets all of the following conditions shall be permitted in an16 A, A-1 or B Residential District:17 (1) The facility provides and maintains on the lot not less than 900 square feet of outdoor play18 space.19 (2) The use of the structure as a group day care home shall be clearly incidental to the principal

    BY THE COMMITTEE OF DEVELOPME NT AND PLANNINGRESOLVE D BY THE CITY COUNCIL OF THE CITY OF LANSINGSLU-4-201 03300 Block, Bardaville StreetChurch in the "F" Commercial DistrictWH ERE AS, the applicant, Woo dside E&D, LLC has requested a Special Land Use permit (SLU-4-2010) to construct a church with related site improvement on the vacant property locatedbetween 3310 and 3320 Bardaville Street; andWH ERE AS, the property is zoned "F" Co mm ercial District where churches are permitted subjectto obtaining a special land use perm it; andWHEREAS, a review was completed by staff evaluating the character, location and impact thisproposal would have on the surrounding area and the impact on the environment, utilities,services and compliance with the Zoning Code and objectives of the Com prehensive Plan; andWHEREAS, the Planning Board held a public hearing on June 15, 2010, at which no commentswere received; andWHEREAS, at its meeting held on June 23, 2010, the Planning Board, based upon testimony,evidence and the staff report, voted unanimously (3-0) to recommend approval of SLU-4-2010to permit a church on the vacant property located between 3310 and 3320 Bardaville Street,with conditions; andWHEREAS, the City Council held a public hearing regarding SLU-4-2010 on August 9, 2010;andWHEREAS, the Committee on Development and Planning has reviewed the report andrecomm endation of the Planning Board and concurs therewith; andNOW THEREFORE BE IT RESOLVED that the Lansing City Council hereby approves SLU-4-2010 to construct a church on the vacant property located between 3310 and 3320 BardavilleStreet, with the following conditions:

    1. Landscap ing, as described in this staff report, is installed along the east and w estproperty lines.2 Any dumpsters on the site are screened per the requirements of the ZoningOrdinance.3. The seating capacity of the building is limited to the amount of on-site parking orparking that can be leased within 300 feet of the site.4. The church agrees, in writing, that is will not object to the issuance of liquorlicenses within 500 feet of the site.
