MEMORANDUM OF AGREEMENT BETWEEN ASSOCIATED GENERAL CONTRACTORS SAN DIEGO CHAPTER AND SOUTHERN CALIFORNIA DISTRICT COUNCIL OF LABORERS AND ITS AFFILIATED LOCAL 89 RE CHANGES TO 2012-

2016 MASTER LABOR AGREEMENT (ENGINEERING) FOR 2016-2019 MASTER LABOR AGREEMENT (ENGINEERING)

The Associated General Contractors San Diego Chapter and the Southern California District Council of Laborers and its affiliated Local 89 agree to the following changes from the 20 12· 2016 MLA (Engineering) to be included in the 2016-2019 MLA (Engineering). All other provisions remain the same.

1. Dates of Agreement. Change dates throughout Agreement to reflect new tern from July 1, 2016 to June 30, 2019, including:

a. Preamble- "This Agreement is entered into this l 5l day of July ~2016, ... "

b. Section 2- "The term of this Agreement is July 1,~ 2016 to June 30, ;w.}-6

2019, and from year to year thereafter unless either the Union or the Association gives written notice received by the other not Jess than sixty ( 60) days prior to June 30, ~2019, or sixty (60) days prior to any subsequent year, of a desire to change, ame~d, modify or terminate the Agreement."

3. Section 4.B. ro Modify to read: All work necessary to tend all other building trades craftsmen, including stripping of concrete forms, handling and raising of slip forms, sewer cleaners, gardening,

horticulture, landscaping, trackmen (construction, maintenance, and repair), cleanup of debris, grounds and buildings, drinking water distribution ... "

The Southern California District Council of Laborers and Laborers Local 89 (Union) and the Associated General Construction of America, San Diego Chapter, Inc. are parties to the San Diego Laborers Master Labor Agreement (Building Construction) and the San Diego Laborers Master Labor Agreement (Engineering Construction), and agree as fol1ows:

L The San Diego Laborers Master Labor Agreement (Building Construction) covers all work in the construction of Type 1 through 5 buildings.

2. The San Diego Laborers Master Labor Agreement (Engineering Construction) covers all construction work not covered by the San Diego Laborers master Labor Agreement (Building Construction).

GENERAL PREVALING '\Y AGE DETERMINATION

The California Labor Code requires the Director of the Department oflndustrial Relations to determine the prevailing rate of per diem wages for all workers employed upon public works projects. The Division of Labor Statistics and Research ("DLSR") undertook an investigation in 2009 to determine the prevailing wage rates for the installation of solar and photovoltaic systems in Los Angeles, San Diego and Imperial Counties. The results of the questionnaire have been compiled and based on them the minimum rate of pay for the work in question is -- Electricians: Inside Wiremen for the Los Angeles, San Diego, and Imperial Counties General Prevailing Wage Determinations.

The classifications of work listed below, as identified in the 2007-2011 San Diego Laborers’ (Engineering Construction) Master Labor Agreement by and between Associated General Contractors of America San Diego Chapter and Laborers’ International Union of North America Local No. 89 were not published or recognized by the Department of Industrial Relations in the August 22, 2010 issuance of the San Diego Laborers’ (Engineering Construction) general determination, SD-23-102-3-2010-1 and continuing with any subsequent San Diego Laborers’ (Engineering Construction) general determination until superseded by the Director.
