1. INTRODUCTION

Terratest (Pty) Ltd has been appointed by Mr N. Moosa to undertake the environmental services

required for the proposed mining of shale on the Farm Thandisizwe No.16691, Umgungundlovu District

Municipality, KwaZulu-Natal. This Notification Sheet aims to inform Interested and Affected Parties

(IAPs) of the Application for Environmental Authorisation (EA) that is being conducted in the form of a

Basic Assessment Process. All issues and comments raised by IAPs during the EA process will be

documented in the Basic Assessment Report. This will assist in the identification of environmental

issues that could have a negative and / or positive impact on the site and the community.

According to the National Environmental Management Act (NEMA) (Act No. 107 of 1998)

Environmental Impact Assessment (EIA) Regulations (2014, as amended), it is necessary for the

Applicant to appoint an independent Environmental Assessment Practitioner (EAP) who will adhere to

the environmental regulations and complete the applicable environmental process on behalf of the

Applicant. The relevant role players in this regard are provided in Table 1.

2. PROJECT DESCRIPTION AND LOCALITY

Specific details of the Application for Environmental Authorisation are provided in Table 2.

Proposed activity: Development of a shale quarry on the Remainder of the Farm

Thandisizwe No.16691.

Project description: The proposal includes for the development of shale mining quarry on the

Farm Thandisizwe No. 16691. The development includes the

establishment of the shale quarry, as well as topsoil and overburden

stockpiles. The development will be limited to 4.3ha.

Property description: of the Farm Thandisizwe No. 16691.

Location: Off the R33, past Copesville, KwaZulu-Natal.

Centre co-ordinates: 29⁰31’09.16” S; 30⁰26’18.71” E

3. THE ENVIRONMENTAL LEGAL FRAMEWORK

3.1 EIA Regulations (2014, as amended)

In accordance with the NEMA: EIA Regulations (2014, as amended), the following Listed Activities

documented in Table 3 will be triggered by the proposed development.

GNR 983 (Listing Notice 1):

Item 12

“The development of (ii) infrastructure or structures with a physical footprint of 100 square metres or more; where such development

occurs (a) within a watercourse; (b) in front of a development setback;

or (c) if no development setback exists, within 32 metres of a

watercourse, measured from the edge of a watercourse”. Applicability: The proposed quarry will be constructed within a

watercourse and or within 32m if a watercourse.

GNR 983 (Listing Notice 1):

Item 19

“The infilling or depositing of any material of more than 10 cubic metres

into, or the dredging, excavation, removal or moving of soil, sand,

shells, shell grit, pebbles or rock of more than 10 cubic metres from a

watercourse”. Applicability: As the proposed development is to occur within

close proximity to a watercourse, construction activities are

anticipated to result in the removal and/or the deposition of 10m3

or more of material into, or out of, a watercourse.

Item 21

“Any activity including the operation of that activity which requires a

mining permit in terms of section 27 of the Mineral and Petroleum

Development Act, 2002 (Act No. 28 of 2002).

Applicability: The proposed development requires a mining permit.

“The clearance of an area of 1 hectare or more, but less than 20

hectares of indigenous vegetation” Applicability: The proposed development will require the clearance

of more than 1 hectare of indigenous vegetation.

Environmental Authorisation is to be obtained from the Department of Mineral Resources prior to

construction commencing.

4. SPECIALIST STUDIES

Specialist Studies identified to-date include:

• Wetland Identification, Delineation, Functionality and Risk Assessment;

• Vegetation Assessment; and

• Heritage and Palaeontological Assessment.

5. PUBLIC PARTICIPATION PROCESS

The Public Participation Process, as promulgated in terms of Chapter 6 of the NEMA: EIA Regulations

(2014, as amended) is a fundamental process whereby the proponent, technical team, government

authorities, key stakeholders and IAPs can engage in an informed decision–making process.

Key activities to be undertaken as part of Public Participation Process include:

• Identification of key stakeholders, authorities and municipalities, environmental groups and members of

the public who may be interested in, or may be affected by the proposed development;

• Giving written notice to IAPs (this document);

• Placement of an advertisement in a newspaper applicable to the region notifying the public of the

proposed activity;

• Placement of on-site posters detailing the activity and contact details of the Environmental Assessment

Practitioner; and

• Recording all IAP comments and presenting such comments, as well as responses provided by the

Environmental Assessment Practitioner, in a full Comment and Response Report to accompany all

relevant documentation submitted for public review and Competent Authority consideration.

Further, specific to the Basic Assessment Process, a Draft Basic Assessment Report will be circulated to all

registered IAPs for a 30-day review and comment period. Thereafter, a Final Basic Assessment Report will

be submitted to the DMR for a decision on Environmental Authorisation.

6. HOW DO I PARTICIPATE?

IAPs are invited to register with the Environmental Assessment Practitioner via the completion and

submission of the attached form (see Appendix 1) and declare their interest in the project. Any comments or

queries may also be submitted to the Environmental Assessment Practitioner via email, fax or post as per

the details provided.

Thank you for your correspondence and the invitation to comment on the application for the proposed shale quarry.

After my mother's death last year, during which we had 2 noticeable burglaries, we decided to see if it was time to

pull up our roots.

We put the property on the market and were pleasantly surprised (and blessed) to get our price and therefore

decided that it was meant to be.

We have purchased a property in town and moved in February 2018.

We are happy with our decision.

RE: OBJECTION FOR ENVIRONMENTAL AUTHORISATION PROPOSED SHALE QUARRY ON THE FARM THANDISIZWE NO. 16691, UMGUNGUNDLOVU DISTRICT MUNICIPALITY, KWAZULU-NATAL

Your objection letter dated 01 May 2018 refers. Please consider this formal correspondence in

response to your objections. Please further note that your objections and the responses

hereunder have been captured in the Final Basic Assessment Report which will be submitted to

the Department of Mineral Resources for a decision on Environmental Authorisation.

1) OBJECTION:

Air Pollution - Quarry will make big effect on daily pollution which is a health hazard.

RESPONSE:

Noted. As per the Basic Assessment Report, dust impacts will be minimised through the

spraying of roads and working areas with water, or chemical dust suppressants. Dust impacts

will also be monitored monthly through the installation of dust buckets around the site.

Further mitigation measures are provided in the Basic Assessment Report:

Soil stockpiles must be located in areas to limit the erosive effects of wind. This will serve to

limit dust impacts;

Removal of vegetation must be avoided until such time as soil stripping is required. This will

serve to limit dust impacts;

Heavy vehicles and machinery should be serviced regularly to minimise exhaust fumes;

Equipment must be operated within its specifications and capacity and must not be overloaded;

and

The entire contractors’ vehicles must be fitted with effective exhaust silencers and must comply

with Road Traffic Act (Act 29 of 1989) when any such vehicle is operated on a public road.

2) OBJECTION:

Noise and vibration - Due to grinding and sizing crusher. Big plant on quarry moving up and

down.

RESPONSE:

Noted. However, no crushing, grinding or sizing will occur on site and the only vehicles / plant

on site will be a single pay-loader and tipper truck. As per the Basic Assessment Report, Stages

of development: Operation, (page 13), the following is noted:

“The operational phase of the quarry will involve quarrying of shale with a payloader.

Approximately 30-40m3 of shale will be quarried per day, three times a week. The quarried shale

will be cured in the sun and then loaded onto a tipper truck for delivery to the brick yard, located

adjacent to the site. In this regard, no processing will occur in the quarry area. The quarried

shale will be utilised in the manufacturing of bricks.”

Therefore, noise impacts associated with the quarrying of shale with a payloader will be limited

to 6-7 hours, 3 times a week; and the movement of a tipper truck as required.

The site is also located some 1.5km to the west of the Old Wartburg Road providing a noise

buffer.

3) OBJECTION:

Huge blast - Abuse to animals and humans being due to quarry blast.

RESPONSE:

Please note, the Applicant will use a payloader to quarry shale material. In this regard, there will

be no blasting associated with the quarrying activity. As per the Basic Assessment Report,

Preferred Technology Alternative, (page 23):

“PREFERRED TECHNOLOGY ALTERNATIVE

The preferred technology alternative involves the quarrying of shale via a payloader. The

payloader will quarry approximately 30-40m3 of shale per day. Quarrying will be conducted for

6-7 hours, three times a week. The quarried shale will be stockpiled and cured in the sun until

ready for use in the clay brick factory where it will be transported via tipper-truck along existing

access roads.

An additional technology alternative is quarrying of material via blasting. Blasting can be a

disruptive and intrusive technology often used in hard-rock quarries or similar. The Applicant will

not use blasting as a technology alternative as the same result (i.e. quarrying of shale) can be

achieved with the use of a payloader, at a reduced expense. Further, the proposed operation

does not justify the technology of blasting in terms of quarry size, resource to be quarried (shale

– soft rock) and proximity of infrastructure (i.e. clay brick factory to the quarry). Blasting has

therefore not been considered as a technology alternative.”

4) OBJECTION:

Existing quarry (Copesville) area is less than 12km from Thandisizwe Farm. It is unhealthy to be

surrounded by quarry, our life will be in danger.

RESPONSE:

Noted. The quarry located to the south of the Copesville area is, however, a tillite quarry. The

Applicant is proposing to quarry shale, not tillite, which is proposed to be utilised to manufacture

bricks in the adjacent brick factory.

The impacts associated with the quarrying of shale are not considered to be life-threatening,

especially as the quarry will be some 1.5km west of the Old Wartburg Road providing a large

buffer. The environmental impacts associated with the proposed quarrying activity have been

identified and scored in the Basic Assessment Report and the outcome or significance is

considered to be low.

Further, as per the Regulations governing Mining Permits, a Mining Permit is only valid for a

period of two years, and can be extended for a subsequent two years. Thereafter the activity is

to cease and the affected area rehabilitated. The activity of quarrying will therefore not be

indefinite.

5) OBJECTION:

Nature around proposed quarry will be affected in one way or other.

RESPONSE:

Noted. Agreed, the surrounding habitats will be affected by the proposed quarry. Rehabilitation

measures have been provided post-quarrying. These are provided in the section Stages of

development: Decommissioning / Rehabilitation Phase, page 13, of the Basic Assessment

Report:

“The decommissioning of the quarry will occur once all the available resource (i.e. shale) has

been quarried. The overburden stockpile will be disposed of in the quarry pit and the benches

sloped to allow for a gentler gradient. All compacted areas, including access roads and

platforms, will be ripped, topsoiled and seeded.

The following best practice procedures will also be followed:

The excavated area (quarry pit) must serve as a final depositing area for the placement of

overburden material;

Rocks and coarse material removed from the excavation must be dumped into the pit

simultaneously with the overburden;

Under no circumstances is waste permitted to be deposited in the quarry pit;

Waste material of any description, including receptacles, scrap, rubble and tyres, will be

removed entirely from the quarry area and disposed of at a recognised landfill facility;

Waste will not be permitted to be buried or burned on the site;

Once excavations have been refilled with overburden, rocks and coarse natural materials and

profiled with acceptable contours and erosion control measures, the topsoil previously stored,

shall be returned to its original depth over the area;

The area shall be fertilised, if necessary, to allow vegetation to establish rapidly;

The site shall be seeded with a local or adapted indigenous seed mix in order to propagate the

locally or regionally occurring flora; and

All infrastructure, equipment, ablutions, plant and other items used during the quarrying period

will be removed from the site.”

Further to the above, the Applicant is required to determine and set aside an amount of money

dedicated to both manage and rehabilitate the environment in respect of rehabilitation. This is

termed Financial Provision. The Financial Provision for the proposed shale quarry is provided for in

the Basic Assessment Report.

Please be advised that it is the mandate of the Department of Mineral Resources to assess the

Final Basic Assessment Report submitted to them, taking into consideration all comments,

concerns and objections raised, in terms of granting Environmental Authorisation to the

Applicant or not.

As a registered Interested and Affected Party in this Application, you will be kept informed of

progress as and when it occurs.
