1. These Rules may be cited as the Kingston and St. Andrew 102/82

Corporation (Market) Rules, 1944.

2. In these Rules, unless the context otherwise requires- "chairman" means the chairman of the committee of the Council

of the Kingston and St. Andrew Corporation having authority to deal with matters relating to the management of public markets;

"clerk" means clerk of the market; "markets" means public markets within the meaning of the Act; "stall" includes station.

3. Unless otherwise ordered by the Council, the Mayor or the chairman, or the clerk of each market, shall open such market to the public on the days and at the opening hours and shall keep the same open until the closing hours prescribed in respect of each market in the First Schedule. First

Cw -, 4.-(1) The opening of each market shall be notified by the ringing of a bell; and warning of the closing of the market shall be given by the ringing of a bell half an hour before the time fixed for closing; and the closing of each market shall be notified by a second ringing of a bell at the time of closing.

(2) No person shall enter a market after the ringing of the bell warning of the closing of the market. -7

(3) Every person who shall refuse or neglect forthwith to quit a market at the ringing of a closing bell shall be guilty of a breach of these Rules.

5.-(1) The fees for each market are hereby fixed and shall be Second payable according to the Second Schedule. In addition to the fees pay- Schedule. able upon goods entering a market, there shall be paid the fees pre-

scribed in the said Schedule for the occupation of the stall which the owner or vendor of goods may occupy until his articles are removed:

Provided, however, that the Council may by resolution apply to any market the fees fixed and payable shown in the Third Schedule, in which case the fees fixed and payable shown in the first and second

Third part of the Second Schedule will not be applicable. Schedule. (2) For the purposes of the said Second Schedule the expressions

set out in the first column of the appendage to this paragraph shall mean, unless otherwise expressed, such amount of goods when loosely packed as will hold in a container not exceeding the cubical content set out in the second column of the said appendage opposite each expression.

... 4 (3) In the event of any difference or dispute as to the quantity

of any articles presented for entry into a market the person presenting the same shall cause the same to be measured by placing same in a standard measure which shall be provided and kept at each market.

6. All goods taken into a market shall remain at the sole risk of the owners of such goods and the Corporation shall not under any circumstances be liable for any loss or damage thereto and if any such loss or damage shall be occasioned by the act neglect or default of any officer or servant of the Corporation such officer or servant shall alone be liable for any such loss or damage.

7. Every person proposing to take any goods into a market or to use any stall therein shall first pay the prescribed market fee to the clerk or such other person as may be authorized to receive or collect the same and obtain from the clerk or such other person a ticket or voucher in such form as the Council may from time to time prescribe and shall present such ticket to the porter or other person in charge of the market entrance and permit the porter or such other person to remove from the ticket or voucher the portion thereof prescribed to be given up and no person shall make use of any stall or take any goods into the market without receiving and presenting such ticket or voucher -as hereby required and every person using a stall or exposing goods for sale in a market shall upon demand by the clerk or other person authorized by the Council produce for inspection the ticket or voucher showing payment of the market fees payable in respect of such goods and/or the stall at which the same may be exposed and every person failing to produce such ticket or voucher shall be required to and shall forthwith pay the prescribed fees.

8. Stalls which may be hired by public competition under section 144 of the Act may be hired for a period not exceeding six months at the rate of hire (not being less than the rate fixed in the Second Schedule) which may be accepted by the clerk. Stalls which are not put up to competition may be hired by the day, week or month. No hirer or occupant of any stall shall have power to assign his hiring or sublet his stall without the previous permission in writing of the Mayor or chairman. The Mayor or chairman may in his discretion at any time determine the hire or occupancy of any stall notwith- standing that the period for which the same may have been hired or rented shall not have expired, if the hirer or occupant of such stall shall make default for seven days in payment of the rental of such stall or shall have been convicted on two or more occasions by a court of competent jurisdiction for any breach of these Rules and thereupon the said hirer or occupant shall forfeit any sum which he may have paid in respect of such stall.

9. No person shall place any article upon any stall until the fees for the hire of such stall have been duly paid or in the case of a stall hired for more than one week until the rental for at least one week in advance has been paid and upon the expiry of the time for which

for any period exceeding twenty-four hours to commence at 6 p.m and continue until 6 p.m. of the day following (Sundays and Good Fridays being excluded from computation) and in any other case to be that part of the day during which the market shall be kept open.

10. No person shall place any box, barrel or other impediment or obstruction in any part of a market nor shall he introduce into any market any box or barrel except such as the hirer of a stall may introduce with the permission of the clerk, and no person in charge of any stall shall permit any box, barrel, impediment, obstruction or thing whatever to be kept or placed under, in front of, or around any stall. All persons shall comply with all the directions from time to time of the clerk in relation to the stacking or arrangement of articles to be exposed in a market and no person shall stack any article or articles to a greater height than six feet from the pavement. All persons transacting business in a market or attending the same shall in all matters affecting the ,peace or regularity government or regulation of the said market obey the orders and directions of the clerk and his assistants and of any constable acting under any general or special instruction of the clerk.

11. No person shall take into a market place any live ox, bull, cow, heifer, calf, sheep, goat or pig, nor any live turtle exceeding fifteen pounds in weight, but sucking pigs and kids may be taken into and disposed of at such market as the Council may by resolution from time to time determine.

12. No live poultry or game shall be sold or exposed for sale at any stall or place except at such stall or place as may be specially appropriated for the purpose by the Council.

13. No person shall place on the same bench the flesh of goats and sheep; but each of these kinds of flesh shall be kept distinct on separate benches; and whenever goats' flesh is exposed for sale, the bench at which it is so exposed shall have a board fixed on a conspicmus part of it, with the words "Goats' Flesh Sold Here" the same being printed in white letters on a black ground, each letter to be not less than one and a half inches in height. The carcase of every sheep, lamb, goat or kid the flesh whereof is intended to be sold in any market shall be carried into the market with the head and tail attached thereto.

14. Every person selling or assisting at a meat, fish or turtle stall shall remain behind the stall whilst attending to the business of such stall; and every person occupying a stall at which meat, fish or turtle shall be exposed for sale shall have his name written or printed in legible characters over his stall, and no such person shall refuse to sell to any person requiring the same and tendering the current market price, any butcher's meat, fish or turtle, and the same shall be cut up and sold and disposed of to customers without any um- reasonable or unnecessary delay.

15. No persons shall in any market-

(a) sell or expose for sale any wine, malt, liquor or spirits or any article the sale of which in such market the Council may have prohibited;

(b) unnecessarily obstruct or impede the passage of persons along any aisle, passage or walk way in a market;

(c) sit or lie on the pavement, or on any bench or stall;

(d) stand, loiter or sit in any space between stalls; (e) smoke any pipe, cigar, cigarette or other form of tobacco;

(f) use any obscene, abusive or insulting language; (g) swear or otherwise misbehave;

(h) create or cause to be created any riot or disturbance;

(i) expectorate, urinate, or throw dirt, filth, rubbish or litter other- wise than in the place set apart or provided for the purpose;

(j) break, cut, pull down, destroy, remove, injure or spoil any stall or any part thereof, or any appurtenance or any portion of any building or the floor thereof;

(k) move about the market to vend his or her goods, but shall remain at his or her stall or on the spaces on the pavement allotted to him or her;

( I ) expose for sale there any meat which has not been marked with the brand of the slaughter house;

(m) unless he be a servant of the Council or person authorized by the Council lift or remove or otherwise interfere with the grating or covering to any drain in any market;

(n) unless he be the hirer or tenant of a stall or a servant of the Council or some person authorized by the clerk go in the rear of any stall;

(0) bring any dog or permit any dog to follow or accompany him or her in any market;

(p) without the special permission of the clerk leave in any market after its closing any articles except such goods as belong to a stall-holder;

(9) sell or oRer for sale in the space set apart for vehicles in any market any articles except such as are brought into that space by the vehicles and on which payment of the vehicle load fee has been made;

( r ) use a stall rented for the sale of a particular class of goods for the sale, display or stacking of goods of any other class :

Provided, however, that persons authorized to vend vegetables or fruit in the portion of the market specially set aside for that purpose may sit on the pavement while engaged in the disposal and exposure for sale of their goods. But this proviso shall only apply to persons who shall bring vegetables or fruit into the market and shall not include the holder of a stall or persons who may purchase such articles in the market and such last named persons shall be required either to foithwith remove such articles from the market or to hire a stall for the purpose of exposing their g o d s for sale.

16. Except in the case of a firm or partnership, no stall shall be rented to or used by more than one person at the same time.

17. It shall be lawful for the Council or the Mayor or the clerk of the market in their or his discretion to refuse to lease or hire a stail or station to any person or persons who shall have been con- victed on two or more occasions by a court of competent jurisdiction of any breach of these Rules or of any offence involving violence or dishonesty and the Council may in their discretion prevent any person who may have been so convicted from selling or assisting at any stall or from engaging in the sale of any article whatsoever in any market.

18, Overaowding shaii not be allowed on any stall and only such reasonable quantities of goods shall be allowed on each stall at any one time as the clerk in his discretion may permit.

19.-(1) No person shall sell beef, turtle, pork, goat's flesh, mutton or liver in any market in which such goods may be sold urnless he holds a licence from the Council permitting him so to do. Licences will be granted to butchers, cutters, assistant$ and other attendants on a written application being made for the same, and shall be tenable

for such period as the Council may from time to time determine. Licensees while operating at a stall or bench shall be dressed in clean clothes and be properly shod and shall in addition to the ordinary wearing apparel wear a clean white cap and a clean white apron extend- ing from the collu to the ankle and shall replace such cap and apron every morning by a clean one. Licences will be granted in such a manner and at such times and on such conditions as the Council may from time to time determine, and any holder of a licence who in any way offends against these Rules, or the Kingston and St. Andrew Corporation (Slaughter House) Rules, 1940 or the Jamaica Defence Regulations, 1940 or any rule or order made thereunder or otherwise misconducts himself on the market premises may have his licence revoked by the Council and such licence shall forthwith be suspended by the Mayor or the chairman until the question of revocation thereof shall have been considered and determined by the Council.

(2) Every person selling or assisting in the sale of beef, turtle, pork, goat's flesh, mutton or liver in any market in which such goods may be sold shall upon being required so to do by the clerk or a public health inspector or constable or other person duly authorized by the Council produce his licence and if he fails to do so shall be guilty of an offence against these Rules and may be removed from the market.

20. In the event of any person requiring to hire a stall for the sale of any article or articles not provided for in the Schedule of Fees, the fee payable and the terms on which such stall may be rented shall be fixed by the clerk with the sanction of the Mayor or chairman and the fees so fixed shall be payable by the person making the application for the use of such stall.

21. No person occupying a stall for the sale of beef shall have ex- posed thereon at any one time a greater quantity of beef than is contained in the single carcase of an ox or cow, and no person shall deposit or expose for sale any meat elsewhere or otherwise than on such a stall.

22. Every person renting any stall for sale of any commodity shall use such stall continuously for the sale of such commodity for the term of which such stall is rented and shall not allow such stall to remain unused for such purpose except with the special permission of the Council or the Mayor or chairman.

23. Every hirer or tenant of a stall in any market shall be present at such stall for the purpose of selling goods from such stall and he shall not be represented by any other person except with the special permission of the Mayor or chairman. No person shall hire or rent either in his own name or that of any other person more than one stall for the sale of dry goods at any one time except with the written permission of the Mayor or chairman.

24. No hirer or tenant of any stall shall use such stall except during the period for which he shall have actually paid the hire, but no non-user for non-payment of hire shall affect the accrual of hire during the term of the hire or tenancy, and every hirer or tenant of a stall shall quit and deliver up possession of such stall at a termination of the period of his hire or tenancy. If the clerk shall decline to renew the hire or tenancy of any stall the hirer or tenant shall immediately remove all goods that he may have on such stall.

25.-(1) No person shall use any axe, cleaver, chopper, knife or other similar implement on the slate, marble or concrete slabs of any marker stall or any part thereof but shall use the wooden chopping blocks and cutting board provided for the purpose.

(2) The hirer and occupant of every stall shall be responsible and accountable for all damage done to the slate, marble, concrete and other parts of such stall or to the fixtures and fittings thereof and shall on demand by the clerk forthwith pay the cost of any repairs or replacements required as the result of any such damage and the Corporation shall in no case be required to prove how such damage was occasioned.

26. No person in a state of intoxication or under the influence of liquor or who is suffering from any infectious disease shall enter into or remain in any market and every such person may be removed from the market by the clerk or any employee or constable at the direction of the clerk.

27.-(1) No person shall take into or operate within a market any handcart wnless such person shall have previously obtained from the Town Clerk a licence so to do and is wearing the badge hereinafter prescribed.

(2) The licence shall be in such form and for such period as the Council may from time to time determine and shall be revocable at any time by the Town Clerk.

(3) The badge shall be of such size, shape and material and have thereon such letters, symbols and/or figures as the Council may from time to time determine and shall be worn on the outer part of the left arm of the person licensed.

(4) No person other than the person to whom it was issued shall wear any such badge.

28. No person shall within any market make or kindle or use any fire for any purpose-

(a) without having first obtained the permission of the Council and a certificate in writing of such permission signed by the Town Clerk; or

(b) otherwise than in conformity with such permission and certifi- cate.

29.-(1) The Council may from time to time by resolution deter- mine the class of commodities which may be sold in each market and may prohibit the sale in any one or more or all of the markets of any class of commodity and any market may if the Council so direct be divided into sections for the sale of such commodities in one or more sections by wholesale and in the other section or sections by retail.

(2) In any wholesale section of a market goods shall unless otherwise directed by the Council be kept in the vehicle in which they were brought into the market until the sale of such goods whereupon the same shall be removed by the purchaser and no goods shall be kept or exposed for sale on the ground or pavement within or without the stand allotted to the vehicle.

30. Where in any market, refrigeration space is provided-

(a) the Council may from time to time by resolution determine the class of commodity which may be admitted to storage in such space;

(b) the fees for the storage of goods in such space are hereby fixed and shall be payable according to the Fourrh Schedule; Fourth

Schedule. (c) all goods tendered for storage in such space shall be con-

tained in clean baskets, bags of cloth or paper or such other containers as the clerk may consider suitable. The name of the person depositing the container and the nature and weight of the goods deposited shall be marked in legible

characters upon the container or upon a tag or label securely attached thereto;

(d) every person proposing to deposit any goods shall first pay to the clerk or such other person as may be authorized to receive or collect the same the prescribed fee and shall receive a receipt in such form as the Council may from time to time prescribe and shall tender such receipt to the officer in charge of the storage space along with the goods to be stored and such officer shall if he accepts the goods note upon the said receipt the receipt of the goods;

(e) the officer in charge of the storage space shall have the right to refuse to accept for storage any goods for which there may not be space or which he may consider to be unfit folr storage and shall in such case endorse a note of his refusal on the receipt;

(0 delivery of goods stored shall be made to the person who shall produce and deliver up the receipt issued in respect thereof and to no other person;

(g) the Corporation shall not be liable for any loss of weight or deterioration of quality during storage of any goods how- ever caused;

(h) the person depositing goods for storage shall not later than 6 o'clock in the forenoon of the day following the deposit cause the receipt for the goods to be presented to the officer in charge of the storage space and request the return of such goods provided that if the day following the deposit is a day on which the market is not required to be opened such request shall be made before the closing hour of the date of deposit;

( i) the clerk shall cause to be destroyed all goods deposited in the storage space-

(i) the return of which shall not be requested within the prescribed time ;

(ii) which shall become unwholesome or unfit for human consumption.

31. Every person driving, operating or in charge or control of a wheeled vehicle of any kind including a bicycle which shall be taken into a market shall obey all orders and instructions which may be given by the clerk or any officer or employee authorized by the clerk for

the purpose or by any constable in relation to the route to be taken by such vehicle and the place at and manner in which goods may be placed or loaded upon or discharged or unloaded from such vehicle and the clerk or any such officer, employee or constable may require any such vehicle to be removed from the market immediately upon the completion of the loading, unloading or discharge thereof.
