    When the Obama administration decided tomilitarily intervene in Libya, they did so withoutapproval from Congress. A UN resolutionauthorized a mission to protect the civilianpopulation from Libyan leader Muammar

    Gadhafis forces, but the mission quickly morphedinto an extended military conflict aimed at regimechange. Not only did Obama violateConstitutional requirements which give Congressthe authority to authorize war, he also disregardedthe applicability of the post-Vietnam Warlegislation the War Power Resolution whichrequires notifying Congress of military action andreceiving formal authorization if it lasts more than60 days.

    gratuitous expansion of Executive power plainlynot in keeping with much lauded Americanprinciples like checks and balances. There waseven opposition within Washington: there was a

    House vote on an amendment to stop funding theLibyan War, a formal letter by the Speaker toconform to the law, and ten legislators filed alawsuit against the Obama administration forunlawfully taking the country to war.

    This controversy was something of a nod to

    various antiquated notions of the rule of law inthis country. As James Madison said: Theconstitution supposes, what the History of allGovernments demonstrates, that the Executive isthe branch of power most interested in war, &most prone to it. It has accordingly with studiedcare, vested the question of war in theLegislature. This is such a fundamental tenet ofbasic rule of law as initially conceived, that evenin such a criminal and corrupt Congress as wenow have, some opposition to Obamas martialoverreach was perhaps predictable.

    But for the past decade, weve seen the rise of asecret, unaccountable U.S. military force withactivities and implications far more perniciousthan Obamas criminal disregard for the rule oflaw for intervention in Libya. This rise has

    occurred without even a fraction of the feignedopposition to intervention in Libya. Joint SpecialOperations Command (JSOC) is an unwieldyprivate army at the command of the President, and

    him only. And they conduct military and spymissions all over the world, never receiving formalcongressional approval and never garnering eventhe limited scrutiny applied to the U.S.-led no-flyzone in Libya.

    Without the knowledge of the American

    public, wrote Nick Turse back in August, asecret force within the U.S. military is undertakingoperations in a majority of the worlds countries.This new Pentagon power elite is waging a globalwar whose size and scope has never beenrevealed. According to a recent CongressionalResearch Service report, JSOC forces reportedlyconduct highly sensitive combat and supportingoperations against terrorists on a world-widebasis. As the New York Times this week reported:

    The Special Operations Command nownumbers just under 66,000 people

    including both military personnel andDefense Department civilians a doublingsince 2001. Its budget has reached $10.5billion, up from $4.2 billion in 2001 (afteradjusting for inflation).

    Over the past decade, Special OperationsCommand personnel have been deployedfor combat operations, exercises, trainingand other liaison missions in more than 70

    countries. Since the invasion of Iraq in 2003,Special Operations Command sustainedoverseas deployments of more than 12,000troops a day, with four-fifths committed tothe broader Middle East.

    JSOC operates outside the confines of the

    traditional military and even beyond what the CIAis able to do. Its unprecedented, but the Timesreported that the leader of the Special OperationsCommand Admiral William H. McRaven isrequesting even more unaccountability. He wantsthe authority to quickly move his units to potentialhot spots without going through the standardPentagon process governing overseasdeployments. Those deployments have beenfocused in the Middle East, but also include Asia,Africa, and Latin America.

    These forces have been known for their brutality

    and have been at the forefront of Bush andObamas night raid strategies as well as savagetorture regimes in both Iraq and Afghanistan.Night raids have more than tripled there since2009. In one notableincident in February of

    2010, U.S. Special Operations Forces surroundeda house in a village in the Paktia Province inAfghanistan and ended up killing two civilian menand three female relatives (a pregnant mother of

    ten, a pregnant mother of six, and ateenager). U.S. troops, realizing their mistake, liedand tampered with the evidence at the scene,attempting blame the murders on theTaliban. These tactics very often killcivilians and the vast majority of thosedetained during night raids and sent without a trial

    to the detention facility at Bagram Airbase havebeen civilians.

    But it goes well beyond the war zones. In concertwith the Executives new claims on extra-judicialassassinations via drone strikes, even if the targetis an American citizen, JSOC goes around theworld murdering suspects without the oversight ofa judge or, god forbid, granting those unfortunatesouls the right to defend themselves in courtagainst secret, evidence-less government decreesabout their guilt. As Pulitzer Prize winningjournalist Seymour Hersh said at a speaking event

    Congress has no oversight of it. Its anexecutive assassination ring essentially, andits been going on and on and on. Just today

    .Combatant Command system, a recent Congressional Researchreport explains, signified the recognition by the United States that would continue to have a world-wide, continuous global militarypresence. U.S. Central Command (USCENTCOM) had

    responsibility over the Middle East and parts of Asia, U.S. NorthernCommand (USNORTHCOM) over the North Americas, U.S.European Command (USEUCOM) over Europe, and so on.

    This system was itself a betrayal of principles espoused in theAmerican Revolution against an all-powerful Executive and standinarmies. It was truly the makings of Empire, and Americassubsequent military adventures and bourgeoning national securitystate came at the expense of civil liberties here at home and thelivelihood of millions abroad. In September 2000, the WashingtonPosts Dana Priest published a series of articles on this system ofglobal militarism (cited in the CRS report) exposing how eachdomain had yielded an inordinate amount of influence in

    policymaking. She wrote that they had evolved into the modern-day equivalent of the Roman Empires proconsulswell-funded,semi-autonomous, unconventional centers of U.S. foreign policy.The CRS report asks whether or not COCOMs [CombatantCommands] have assumed too much influence overseas, therebydiminishing the roles other U.S. government entities play in foreignand national security policy.The assertion that COCOMs have

    usurped other U.S. government entities in the foreign policy arenamay deserve greater examination.

    The imperial mechanisms fully embraced by Washington insulatedthe government from the basic standards of a free society: that the

    of their representative government; that the people and the statewere engaged in a consensual relationship. JSOC takes this animmense step further. As Ambinder said in his interview:

    There are legal restrictions on what the CIA can do in terms ofcovert operations. There has to be a finding, the president hasto notify at least the Gang of Eight [leaders of theintelligence oversight committees] in Congress. JSOC doesnthave to do any of that. There is very little accountability fortheir actions. Whats weird is that many in congress whod bevery sensitive to CIA operations almost treat JSOC as an entitythat doesnt have to submit to oversight. Its almost like this isthe presidents private army, well let the president do what heneeds to do.

    Which evokes another of Madisons insights: A standing militaryforce, with an overgrown Executive will not long be safe

    companions to liberty.

    In late 1942 Adolf Hitler issued the "Commando Order" in response to the

    increasing number of Allied (mostly British or British-trained) commando

    raids on Europe specializing in unconventional warfare, sabotage and

    assassination , the most notable being the assassination of SS Security

    Chief Reinhard Heydrich. These commando teams were operating in much

    the same manner as JSOC today, and many German soldiers as well asinnocent civilians were killed. Hitler considered these commandos little

    more than pirates, brigands and terrorists operating outside the Geneva

    Conventions and rules of war, and ordered summary execution for any

    captured commandos. Perhaps other nation's leaders should issue their

    own "Commando Orders".

    It is only just a matter of the time for the accountability/over-reachparadigm to end up in a fiasco....

    With JSOC boys being perp walked past the world media on their way to

    foreign incarceration..

    All this stuff works only as long as it works... Eventually the cowboys end

    up being an embarrassment. We must wonder how the JSOCs crew

    contributed to Moqtada Al Sadr's unflinching and stunning triumph overthe empire's continuing occupation of his country......... In that having the

    unaccountable JSOC gang running around their streets with blanket

    immunity... was sure no incentive for extending that immunity and it's

    mandate.... As empire sulks off the Iraqi stage in silence........ No parades,
