At 3:00 p.m., Deputy Speaker Michael L. Romero, PhD called the session to order.

PRAYER AND NATIONAL ANTHEM

The Members observed a minute of silent prayer and thereafter sang the National Anthem.

Upon direction of the Chair, the Secretary General read the title of the Bill, to wit:

“AN ACT CREATING THE DEPARTMENT OF FILIPINOS OVERSEAS AND FOREIGN EMPLOYMENT, DEFINING ITS MANDATE, POWERS AND FUNCTIONS, APPROPRIATING FUNDS THEREFOR.”

Representative Palma stated that the parliamentary status was that the Bill was in the period of sponsorship and debate; and on his motion, the Chair recognized Rep. Mario Vittorio “Marvey” A. Mariño, chairperson of the sponsoring Committee, to continue his sponsorship of the measure.

Thereafter, on motion of Representative Palma, the Chair recognized Rep. Jose L. Atienza Jr. for his interpellation.

INTERPELLATION OF REPRESENTATIVE ATIENZA

Representatives Mariño and Atienza initially discussed the present policy of the Department of Labor and Employment and other government agencies involved with the concern of overseas Filipino workers and its relation to the purpose and rationale for the creation of the proposed Department of Filipinos Overseas and Foreign Employment. Representative Atienza stated however that he was contented with the performance of the DOLE and that there was no need for another department to handle the concerns of the OFWs as it could be another source of red tape and corruption that would just be detrimental to the interest of the migrant workers.

Representative Mariño stressed that there are different policies which address the various concerns of the OFWs and that the new department would

formulate a new set of guidelines and would focus solely on the interest of the OFWs.

Representative Atienza inquired whether foreign employment and the creation of a new department would solve the nation’s problems on poverty and underemployment as well as eventually improve the lives of Filipinos working abroad. He opined that the creation of a department will just add another layer in the government bureaucracy because there are already existing agencies tasked primarily to attend to the concerns of OFWs and just needed to improve on their coordination with one another.

In reply, the Sponsor argued that the primary reason for the proposed creation is to do away with sub-agencies merely doing coordinating work in relation to issues affecting OFWs. He stressed that deploying Filipino workers overseas has its own benefits because they find opportunities to improve their lives. He added that with the creation of the proposed department, addressing OFW concerns will no longer be complicated because all directives regarding their concern shall no longer come from different agencies but directly from the head of the proposed department. Considering that the Philippines has the biggest percentage of overseas deployment in Asia and is being looked up to by other Asian countries, he opined that the country should take the lead in creating a Department of Filipinos Overseas and Foreign Employment for other countries to emulate. Both Representatives then discussed the estimated total budget needed to efficiently run the department.

On the matter of labor attachés, Representative Atienza subsequently stressed that they should be retained to address the concerns of OFWs. Representative Mariño explained that the proposed department will absorb the Philippine Overseas Labor Office and deploy Assistance-to-Nationals career officers in all foreign posts.

Deputy Speaker Garcia (P.J.) relinquished the Chair to Deputy Speaker Johnny Ty Pimentel.

Representative Atienza then reiterated his arguments against the creation of the proposed department and proposed to improve instead the performance of all agencies handling the needs of OFWs. He also clarified that his interpellation was in support of the latter’s welfare as he and the Sponsor argued on the real need for said department.

REMARKS OF REPRESENTATIVE LAGMAN

Much as he wanted to continue with his interpellation, Representative Lagman commented that like Singapore, which was mentioned by the Sponsor of House Bill No. 5832 as not having the need to create a Department of Housing because of its small population, the plenary hall was sparsely populated. He then moved for a recess so he could confer with the acting Majority Leader.

PRIVILEGE HOUR

With leave of the House, on motion of Representative Palma, there being no objection, the

Chair declared a Privilege Hour; and on his motion, the Chair recognized Rep. Raul V. Del Mar for his privilege speech.

PRIVILEGE SPEECH OF REPRESENTATIVE DEL MAR

For the record, Representative Del Mar denied that: (1) the Visayas bloc had met and agreed to take a stand on the renewal of the ABS-CBN franchise, and (2) they supported the stand of the House Speaker that there was no urgent need to act on proposed measures for the network’s continued operation. He further clarified that media reports attributed to a colleague from Cebu were not true and had no basis, and that he himself did not express support to the purported view of the Visayas bloc.

On the issue of said franchise renewal, he opined that the network should be given due process and fair hearing; and informed the Body that he filed a resolution extending the operation of ABS-CBN until the closing of the 18th Congress in June 2022 or until Congress decides on the pending bills relative to the network’s franchise.

Considering the lack of time for the Body to tackle said franchise, he expressed hope in the assurance given by Speaker Alan Peter “Compañero” S. Cayetano that ABS-CBN will be given fair hearing, that legislators will be informed of the merits of the franchise application, and that the network will be allowed to continue its operations until deliberations are completed and the matter is voted upon by Congress.

MANIFESTATION OF REPRESENTATIVE ABELLANOSA

On motion of Representative Palma, the Chair recognized Rep. Rodrigo A. Abellanosa who, with the indulgence of Representative Del Mar, expressed his disappointment over Rep. Vincent Franco “Duke” D. Frasco’s press statement that almost all of the 48 Congressmen from the Visayas supported the House Speaker’s stand regarding the Body’s inaction on the ABS-CBN franchise.

He said he was alluded to be part of the 48 Representatives, which was totally opposite because he signed House Resolution No. 639 urging the Committee on Legislative Franchises to consolidate all pending bills and to immediately report in plenary its action thereon without doing a shortcut or omission on its process for renewal.

This, he said, was in response to the call of the President and of some senators who wished that the matter be considered by the Body in plenary. He said that he was offended by and took exception to Representative Frasco’s statement about the renewal of the ABS-CBN franchise.

Representatives Del Mar and Palma duly noted the foregoing manifestation.

REFERRAL OF PRIVILEGE SPEECHOF REPRESENTATIVE DEL MAR

On motion of Representative Palma, there being no objection, the Body referred the privilege speech of Representative Del Mar and the manifestation thereon to the Committee on Rules for its appropriate action.

PRIVILEGE SPEECH OF REPRESENTATIVE GO (M.)

On subsequent motion of Representative Palma, the Chair recognized Rep. Mark O. Go who first pointed out in his speech the need to continue efforts on generating more productive and higher quality employment to ensure that the country’s economic growth remains sustainable and inclusive. Citing statistics, he explained that despite the decrease in unemployment and underemployment rates, labor force participation and labor productivity are still far from global figures. He also talked about the agricultural sector which falls significantly behind other sectors in terms of productivity and employment contribution, and the issue of job and skills mismatch as a hindrance to the full utilization of the labor force and development of employment conditions.

He thereafter made the following suggestions, among others, to truly improve labor participation and employment in the country: develop new mechanisms and matrices to measure progress in addressing job-skills mismatch; integrate profiling of workforce, in-demand jobs, and industry developments in analyzing labor conditions; develop and improve the curriculum of the college programs offered to address industry needs and identify which industries or sub-industries are already saturated with appropriate college graduates; and develop information dissemination campaigns among the youth and engage them towards degree programs leading to gainful employment.

He further proposed that domestic industries should be strengthened by increasing productivity

of firms and workers; while businesses should be required to adopt service incentive programs and profit-sharing mechanisms, as well as improve working conditions. He maintained that in order to curb poverty and inequality, it is important to increase labor productivity that is complemented with education and skills training which are responsive to the modern-day demands of industries.

Stressing that nation-building is a shared responsibility by all, Representative Go then urged his colleagues to work together to ensure the creation of productive, gainful, and dignified jobs for the Filipino people.

On motion of Representative Palma, the Chair recognized Rep. Ferdinand R. Gaite for his interpellation.

INTERPELLATION OF REPRESENTATIVE GAITE

Representative Gaite exchanged views with Representative Go (M.) about the issue of job mismatch in domestic employment and how this could be addressed by the current educational system in the Philippines particularly the K-12 program, strengthening the capacity of the Commission on Higher Education or CHED, and providing financial support to tertiary students under the Universal Access to Quality Tertiary Education Act.

Thereafter, the Members talked about the disincentive to work in the agriculture sector because of its low productivity and slow growth, and whether the Rice Liberalization Law further discouraged participation in said sector thus raising the need for more concrete policies to make it more attractive to the people.

Thereupon, both Members agreed that the CHED should strengthen agricultural programs in universities and colleges to encourage students to enroll therein considering its impact in the labor sector and the economic productivity of the country.

Representative Palma stated that the parliamentary status was that the Bill was in the period of sponsorship and debate; and on his succeeding motions, the Chair recognized Rep. Victor A. Yap, to continue his sponsorship of the measure, and Rep. France L. Castro for her interpellation thereon.

INTERPELLATION OF REPRESENTATIVE CASTRO (F.L.)

Using a PowerPoint presentation on several multinational retail companies currently operating in the country, Representative Castro sought clarification on the rationale for amending the Retail Trade Liberalization Act of 2000 to lower the minimum paid-up capital requirement for foreign businesses when many of said companies had been widely operating in the Philippines. She opined that the proposed amendment could be detrimental to micro, small, and medium enterprises or MSMEs.

Representative Yap (V.) explained that the proposed minimum paid-up capital of $200,000 was consistent with the provisions of the Foreign Investment Act, and maintained that the foreign retail businesses would not compete directly with local micro entrepreneurs, as it would greatly benefit not only the economy in terms of taxes and employment opportunities but also the consumers who will have more choices for better and cheaper products.

Thereafter, Representative Castro sought clarification on the assurance that employment

of local workers will continue in case foreign companies stop their operations in the country; the mushrooming of multinational retail stores all over the country because of the new minimum paid-up capital requirement; and the proposed $200,000 minimum paid-up capital requirement on retail stores as compared with ASEAN countries and their laws to protect local industries. She and Representative Yap discussed the opposition of the Philippine Retailers Association on the reduced minimum capital requirement as cited from their position paper, with the Sponsor explaining that small local businesses have nothing to fear and emphasized the merits of increased competition in the industry.

Representative Castro explained that she disagreed with the proposed amendment because foreign investors were not coming into the country due to factors such as local corruption and shifts in their investment strategies, and not because of investment requirements. She then stressed the Bill’s negative impact on MSMEs which have taken initiatives in developing their businesses even as Representative Yap refuted the same and reiterated the benefits of competitiveness for entrepreneurs and consumers.
