In 1975, Kentucky voters supported a constitutional amendment to the Judicial Article that provided for aunified, four-tiered judicial system for operation and administration, called the Court of Justice. Judicial powerof the Commonwealth of Kentucky is thus vested in one Court of Justice, which is divided into a SupremeCourt, a Court of Appeals, a trial court of general jurisdiction known as the Circuit Court and a trial court oflimited jurisdiction known as the District Court.

past year for the redress ofgrievances and resolution ofdisputes. As in prior years, thecourts dealt with severeproblems within families, actsof outrage against the innocent,commercial disputes overmonies and the host of otherconflicts for which the courtsserve as neutral arbiter; this

past year over 940,000 legal matters were brought to courts.And, as it has since its inception, the Court of Justicecontinues to meet public trust and confidence that it servesas a fair, efficient and effective forum for the resolution ofthose conflicts.

To serve that trust amid growing demands for judicialoversight, the Court of Justice effectively uses innovativecourt management, technology and the highly-skilledjudges, clerks and staff of the courts. Our unified judicialsystem and unified court administration promote theefficient administration of justice. The Court continues toexpand those resources to serve the people of theCommonwealth, supported by the Kentucky GeneralAssembly and its funding of ongoing operations and courtinnovations.

The Family Court Project continues to grow, consolidatingthe legal problems of families in distress before a single judge.An innovation in court management, the one-family, one-judge system of the Family Court Project has grown toencompass nineteen counties. With their special focus, theFamily Courts have been given special resources to handlethe painful and complicated issues of families. With onejudge to focus on the difficulties our families in court mustface, those families won’t “fall through the cracks” but willhave a better chance with the judicial resolution of theirproblems.

This year the Family Court Project will face the people ofKentucky for a vote on its continued existence. ThisNovember, the voters will decide on an amendment to theConstitution of Kentucky that will make the Family Courtsa permanent part of the Court of Justice. With theamendment, the current Family Court Project courts willcontinue as Family Courts, with gradual expansion asresources permit; without the amendment, the Family Court

Project will end and Family Court families will have theircases sent out to the several different courts and judges thatwould have previously heard them. The vote on the FamilyCourt Amendment is one of great and long-lastingimportance to the courts and the families of Kentucky.

I am pleased that judicial resources to deal with the hundredsof thousands of cases before the Kentucky courts have grownwith the addition of five new judgeships in this last fiscalyear. These new judgeships and the resources to supportthem will address pressing caseloads in Clay, Leslie,Jackson, Henderson, Union, Crittenden, Webster, Carter,Elliott, Morgan, Russell, and Wayne Counties.

In addition to new judgeships, the Court of Justice isimplementing both a state-wide electronic network and anew, Windows-based case management system for thecourts. The wide-area network for our courts is complete,giving real-time electronic access via the Internet to thecourts for case data, e-mail and computer-assisted legalresearch. Our case management system, KyCourts, haseased the growing record-keeping duties of the courts andprovides the foundation for expanding public and lawyeraccess to information on court activities.

And to adequately and safely house the courts, twenty-sevennew courthouses and judicial centers have been completedor are under construction. These new facilities reflect thedignity of our courts and the respect that should be shownall who come before them. These new courthouses are alsosecure in their design and operations, reflecting the risks tothose who enforce the rule of law in America and the world.

It is the rule of law that assures the best security for all,and the blessings of peace for the people of theCommonwealth. There may always be those who claim tobe above the law or who abuse their powers. Yet in the courtsof Kentucky all stand equally before the law, for protectionor for punishment. The men and women of the Court ofJustice, as I, will always support the Constitution of theUnited States and of this Commonwealth of Kentucky. Iam proud of the work of justice we have all done, judges,clerks, you and I. As always, I invite and welcome you towork with us on this great enterprise of justice and law.

LETTER FROM THE DIRECTOR

C icely Jaracz Lambert, appointed March 8, 1999 as its fifth director, overseesthe seventeen departments of the AOC that provide support services forKentucky’s 261 judges and 120 circuit court clerks. Ms. Lambert was in

private legal practice in Louisville, Kentucky before accepting her appointment.She also served as the General Counsel at the AOC for eight years and as AssistantAttorney General under former Attorneys General Steve Beshear, DavidArmstrong and Fred Cowan. Ms. Lambert holds a Bachelor of Arts degree inEnglish from Transylvania University and a Juris Doctorate from the Universityof Kentucky.

REPORT OF THE DIRECTOR OFTHE ADMINISTRATIVE OFFICE OF THE COURTS

As the Director of the Administrative Office of the Courts these last three years, I am pleased to report that we haveconsistently fulfilled the statutory duties of the Kentucky Constitution while moving steadily forward in improving andincreasing services for the Court of Justice. The AOC, acting as fiscal agent for the Court of Justice, prepares a biennialbudget draft and executes the judicial budget. With 2.62 percent of the Kentucky’s general fund appropriations, this officedirects and supports the activities of over 3,300 Kentuckians employed by the Court of Justice, including the electedoffices of justices, judges and circuit clerks.

The Kentucky Court of Justice is a national leader in court technology. Responding to the needs of its unified courtsystem, AOC maintains a state of the art data communications network linking computers for courts and court supportedactivities in all 120 counties across the state. With input from several AOC departments, Information Systems developedcomputer systems to manage trial and appellate cases, jury lists, court document imaging, criminal histories, as well aspersonnel records, budget, and facility payments. The Office of General Counsel guided the development of “smart”forms. Court personnel, members of the bar, law enforcement and the public can access these forms at any time from anyInternet enabled computer, enter data, print the completed document, and file it in Kentucky courts. This technologyprepares the way for electronic submission of documents to Kentucky courts. With the filing and deposition of nearly onemillion cases each year in the court system, the value of these innovative services cannot be overstated.

During 2001, the Department of Court Facilities took on a major role in courthouse construction throughout theCommonwealth. In implementing the Real Property Management Guide, the AOC for the first time became a truepartner with local governments in the construction and renovation of courthouses. Court Facilities oversaw theconstruction or renovation of twenty-seven courthouses, totaling over $350 million in costs. Court security remained animportant topic throughout fiscal year 2001. Court Security trained 134 bailiffs for service to the courts of theCommonwealth, and maintained security for high profile trials. Court Security also works with Court Facilities to addresssecurity needs in our 600 court related facilities. The AOC is responsible for supporting these facilities throughout theCommonwealth. It also distributes and maintains supplies and equipment for the facilities and for court personnel.

The 2001 General Assembly, at the urging of Chief Justice Lambert, passed a bill that puts the issue of Family Courts tothe voters. Eleven Family Courts currently operate in the Commonwealth as a pilot project. Their success has become amodel for how issues can more efficiently be resolved when brought before a single court, with the same judge hearing allmatters relating to a particular family. The Department of Family Courts oversees these courts.

The AOC also houses several statewide programs. Pretrial Services department collects data to assist trial court judgesin making informed decisions about release of persons awaiting trial on criminal charges. Additionally, the Recordsdivision of Pretrial Services operates twenty-four hours a day, seven days a week to provide criminal history information

to the judiciary and the public. Juvenile Services processed over 42,000 youth cases submitted for diversion from formalcourt.

Our citizens receive direct benefit from nationally acclaimed programs administered and/or supported by AOC staff.Among these are Kentucky Drug Courts, which have successfully integrated treatment services with the judicial system.The Dependent Children Services department works with dependent child advocacy initiatives to expedite permanentplacement for Kentucky’s abused and neglected children. The Office of Minority Affairs works with the judiciary andthe public to eliminate real or perceived cultural barriers within our justice system. The Youth, Families and CommunityServices department develops and implements practical alternatives for Kentucky’s at risk youth and families throughits various outreach and prevention programs.

The Education Services department provides continuing educational programs for judges, court clerks and supportstaff. The Administrative Services department coordinates purchasing and accounting for the Court of Justice andpublishes and prints all judicial and administrative materials. Field representatives and judicial auditors from the CourtsServices department assist circuit court clerks with court record keeping and cash management. The State Law Libraryprovides support to our judiciary, and the department of Research and Statistics provides information from our statewidedatabase to all three branches of government, the media, and the public. Our Personnel department processes payroll,insurance and other benefit information for over 3,300 elected officials and employees. The Budget Review departmentoversees the biennial budget.

Serving the Commonwealth of Kentucky in the many seen and unseen aspects of my office is an honor, not only for thehigh purposes of ensuring justice for its people, but for the responsible manner with which those who are entrusted withthis service, the men and women with whom I work, carry out their appointed tasks. I am proud of the achievements of theCourt of Justice and look forward to the new challenges we face.

The Supreme Court is the court of last resort and the final interpreter of state law. It consists of seven justices who areelected from the seven appellate districts and serve eight-year terms. The Chief Justice of the Commonwealth ischosen by his or her colleagues and serves a term of four years. The justices, as a panel, hear appeals of decisionsfrom the lower courts and issue decisions or “opinions” on cases. A case which comes before the Supreme Court isnot retried. The case is presented to the Supreme Court by attorneys with written briefs and oral arguments addressingthe legal issues which the Court must decide. Cases involving the death penalty, life imprisonment or imprisonmentfor twenty years or more go directly from the circuit court level, where the cases are tried, to the Supreme Court forreview. After a decision by the Kentucky Supreme Court, a case can only be appealed to the United States SupremeCourt. The Supreme Court is also responsible for establishing rules of practice and procedures for the Court ofJustice, which includes the conduct of judges and attorneys.

Joseph E. Lambert was sworn in as Chief Justice of the Supreme Court of Kentucky on October 5, 1998,having been elected by his peers to serve as Kentucky’s fourth Chief Justice. He has represented the 3rd SupremeCourt District since his election in November 1986.

Chief Justice Lambert was born in Berea, Kentucky in 1948. He received his B.S. from Georgetown College in 1970and his J.D. from the University of Louisville School of Law in 1974.

Chief Justice Lambert served as a staff member for United States Senator John Sherman Cooper in Washington,D.C. from 1970-1971. From 1974-1975 he served as law clerk for United States District Judge Rhodes Bratcher in

Louisville, Kentucky. He was in private practice in Mount Vernon, Kentucky from 1975-1987.

Chief Justice Lambert was awarded the Distinguished Alumni Award by the University of Louisville School of Law in 1988. He wasFeatured Alumnus of the Association of Independent Kentucky Colleges and Universities in 1995. He was named Lambda Chi Alpha,Outstanding Alumnus in 1997. In 1999 he was awarded Honorary Doctor of Laws from Georgetown College and Eastern KentuckyUniversity. He was named Outstanding Judge of Kentucky by the Kentucky Bar Association in 2000. He received the LeadershipAward from the National Association of Drug Court Professionals in 2000, and presently serves on its Board of Directors. Chief JusticeLambert also serves on the Board of the National Conference of Chief Justices.

Donald C. Wintersheimer has the distinction of being the longest serving member of the court. Firstelected to represent the 6th Supreme Court District in 1982, he was reelected in 1990, and again in 1998.

Justice Wintersheimer was born in Covington, Kentucky in 1932. He received his A.B. from Thomas More Collegein 1953, his M.A. from Xavier University in 1957, and his J.D. from the University of Cincinnati in 1960. He was inprivate practice until he was elected to the Kentucky Court of Appeals in 1976, where he served until his electionto the Supreme Court.

A prolific opinion writer, Justice Wintersheimer writes, on average, over 40 opinions each year. He has publishednumerous articles in various state and national law journals. Recognized nationally for his judicial experience and legal expertise,Justice Wintersheimer appeared on a 1998 PBS television special entitled “Inside the Law.”

Justice Wintersheimer is a member of several bar associations, the American Judicature Society, the institute of Judicial Administration, PhiDelta Phi, and Tau Kappa Alpha. Prior to his judicial career, Justice Wintersheimer served for 14 years as Covington city attorney. Hismilitary service includes two years in the U.S. Army Infantry.

Justice Wintersheimer is a former president of both the Thomas More Alumni Association and the Kentucky Municipal Attorneys’ Association. Hereceived the Community Service Award from Thomas More College in 1970 and was named Outstanding Teacher in 1973. He is a member of theAdjunct Faculty of the Chase College of Law at Northern Kentucky University. In 1998 he was recognized as a Distinguished Alumnus of theUniversity of Cincinnati College of Law. He served as Distinguished Jurist in Residence at Chase College of Law and was named OutstandingJurist by Phi Alpha Delta Legal Foundation in 1990.

In 2001 the Supreme Court recorded 1,177 cases filed and disposed 1,106 of those.

Janet L. Stumbo is the first woman elected to the Supreme Court of Kentucky. She has representedthe 7th Supreme Court District since her election in November 1993.

Born in Prestonsburg, Kentucky in 1954, Justice Stumbo received her B.A. in 1976 from Morehead StateUniversity and her J.D. in 1980 from the University of Kentucky. She worked as a staff attorney for theKentucky Court of Appeals from 1980-1982. While in private practice from 1982-1988, she served as assistantcounty attorney for Floyd County from 1982-1985. In 1989 she returned briefly to private practice beforebeing elected to the Court of Appeals where she served until her election to the Supreme Court.

Justice Stumbo was elected to the Morehead State University Hall of Fame in 1990. She received the Justice Award from theKentucky Women Advocates in 1991 in recognition of her work in the area of spousal abuse. In 1995 her work in the area ofgender fairness won her the group’s Outstanding Jurist Award, also receiving the 1995 Bull’s Eye Award from the Women inState Government Network. In 1996 Justice Stumbo received the Woman Lawyer of Achievement Award from the KentuckyBar Association.

John William Graves began serving in Kentucky’s trial courts in 1984, first serving as a districtjudge and later as a circuit judge. He was elected to the Supreme Court in November 1995. Justice Gravesrepresents the 1st Supreme Court District.

Born in Paducah, Kentucky in 1935, Justice Graves received his B.S. in 1957 from the University of NotreDame. He studied at the University of Louisville School of Medicine from 1957-1958. He received his J.D.in 1963 from the University of Kentucky. Prior to his appointment as district judge, Justice Graves was inprivate practice for 20 years, concentrating primarily on disability law and negligence law, with specialemphasis in worker’s compensation cases. He was appointed as circuit judge in 1989 and was elected to

the Supreme Court in November 1995.

During more than 35 years of active and reserve military service, Justice Graves completed the Command & General StaffCollege, the Airwar College, and the National Defense University. He was awarded the Army Commendation Medal in 1987,the Army Meritorious Service Medal in 1989, and the Defense Meritorious Service Medal in 1993.

Martin E. Johnstone is the first judge in Kentucky to have served at all four levels of the Court ofJustice. Prior to the Judicial Article of 1975, Justice Johnstone was elected as a magisterial district judge. In1978 he assumed the duties of district judge, and in 1983 he was elected as circuit judge. He served asJefferson County Chief District Judge and Chief Circuit Judge. In 1993 he was appointed and later electedto the Kentucky Court of Appeals, where he served as Chief Judge Pro Tem. He has represented the 4thSupreme Court District since his election in November 1996 and has served as Deputy Chief Justice since1998.

Justice Johnstone is a native of Louisville, Kentucky and was born in 1949. After receiving his baccalaureatedegree from Western Kentucky University and his J.D. from the University of Louisville, he was in private practice until 1976.

Justice Johnstone was named Judge of the Year by the Louisville Bar Association in 1981 and 1999. He received the Henry V.Pennington Outstanding Trial Judge Award from the Kentucky Association of Trial Attorneys in 1991.

William S. Cooper began his judicial career as a circuit judge in 1979. He served as Vice-chief RegionalJudge from 1981-1992, and as Chief Regional Judge from 1992-1996. In 1996 he was elected to represent the 2ndSupreme Court District.

Justice Cooper was born in Elizabethtown, Kentucky in 1941. He received both his B.A. and J.D. from the Universityof Kentucky, graduating first in his law school class of 1970.

An Air Force veteran, Justice Cooper is a member of the American Legion, Rotary, and the Knights of Columbus.He is past president of the University of Kentucky Law Alumni Association. Justice Cooper has served on numerous

working committees, some of which include the Kentucky Council for Higher Education Subcommittee for Legal Education, theCommittee on Justice and Corrections, the Evidence Rules Review Commission, and the Commission on Guardians ad litem. He currentlyserves as chair of the Supreme Court Criminal Rules Committee and the Kentucky Evidence Rules Review Commission.

Justice Cooper is a diligent lecturer, dedicated to the continuing education of those in the legal community. He has published several lawjournal articles and wrote Kentucky Instructions to Juries, Vol. 1 (Criminal). Justice Cooper was named a Charter Life Fellow of the KentuckyBar Foundation in 1986 and received the association’s Kentucky Bar Center Award in 1992. Other awards include the Knights of Columbus1991 Community Service Award, the Elizabethtown-Hardin County Chamber of Commerce 1997 Hall of Fame Award. He was elected tothe University of Kentucky Law Alumni Hall of Fame in 2001.

James Keller is the newest member of the Supreme Court. Appointed to the court in May 1999, Justice Kellersubsequently won election to a full term as the representative of the 5th Supreme Court District.

Justice Keller was born in Harlan County, Kentucky in 1942. He completed his undergraduate studies while attendingEastern Kentucky University on a football scholarship. He received his J.D. from the University of Kentucky in 1965.During the ten years he spent in private practice, he served for eight years as Master Commissioner of the FayetteCircuit Court. He was appointed as circuit judge in 1976, where he served until 1999. Twice elected as president ofthe Kentucky Circuit Judges Association, he also served two terms as Fayette County Chief Circuit Judge.

Justice Keller helped to establish several highly effective court programs during his tenure as circuit judge. He is most proud of his effortsin establishing the Parents Education Clinic, a program for divorcing parents, which is now used in several Kentucky jurisdictions. He wasinstrumental in establishing Kids’ Time, a program for children of divorcing parents. He helped establish the Kentucky Mediation Centerand the Fayette Drug Court. Justice Keller currently serves as a member of the Judicial Advisory Committee to the Governor’s Office ofChild Abuse and Domestic Violence Services.

The Kentucky Court of Appeals is comprised of fourteen judges. Two judges are elected from each of the sevenappellate districts, to serve a term of eight years. Each month, the judges are randomly divided into panels of threeto review and decide cases, with the majority determining the decision. The panels do not sit permanently in oneplace, but try to visit all parts of the state on a regular basis. For the most part, cases come to the Court of Appealswhen the losing party in a lower court decides to have that court’s decision reviewed. The Court of Appeals does notretry the case. Rather, the panel bases its decision on the record compiled in the lower court and on arguments byattorneys criticizing or supporting the lower court’s disposition of the case as reflected in that record. The KentuckyCourt of Appeals ranks as one of the nation’s busiest. In 2001, the Court recorded 2,992 cases filed and 3,320 casesdisposed.

Circuit court

The Circuit Court is the court of general jurisdiction and hears civil matters involving more than $4,000. Circuitcourts have jurisdiction over cases involving capital offenses and felonies, divorces, adoptions, terminations ofparental rights, land dispute title problems and contested probates of will. Circuit courts have the power toissue injunctions, writs of prohibition, writs of mandamus and hear appeals from district courts andadministrative agencies.

Currently, there are 111 circuit judges in 57 judicial circuits. One judge may serve more than one county withina circuit. Some circuits contain only one county but have several judges, depending on population and caseload.Circuit judges serve eight-year terms.

DISTRICT court

The District Court has limited jurisdiction, which means it hears only certain types of cases. Ninety percent ofall Kentuckians involved in court proceedings appear in District Court.

Juvenile matters, city and county ordinances, misdemeanors, traffic offenses, probate of wills, felony preliminaryhearings, and civil cases involving $4,000 or less are heard in District Court, as well as voluntary and involuntarymental commitments and cases relating to domestic violence and abuse.

There are 129 district judges in 60 judicial districts in Kentucky. If a district has a high population and a heavycaseload, it may consist of only one county but have several judges. In less populated areas, a district mayencompass more than one county, but have only one judge who travels between the counties to hear cases.

The 120 clerks of the circuit courts oversee the documentation of the activities of trial courts of Kentucky ineach of Kentucky’s counties; the clerk of the circuit court for a county is also the clerk of the district court forthat county. Clerks are elected for six-year terms and manage staffs of deputy clerks and others; the officesof the circuit clerks range in size from two to 300+ deputy clerks and administrative staff.

The clerks of each trial court keep a docket for each original action filed in that court; each such action isassigned a consecutive file number. All papers filed with the clerk, are marked with the file number and notedchronologically in the docket on the page or pages of the docket assigned to the action. These notations showthe nature of each paper filed or issued and the substance of each order or judgment of the court and of thereturns showing execution of process. This process is maintained and secured in both paper and electronicrecords for the nearly one million actions filed in Kentucky courts each year.

Established in 1976, the Administrative Office of the Courts serves as staff for the Chief Justice ofKentucky. The state constitution outlines certain duties which are the responsibility of the AOC,under the supervision of its administrative director. Statutory duties include: act as fiscal agent

of the Court of Justice; maintain data processing systems; disperse and maintain supplies and equipmentfor the court system; administer personnel policies and payroll for the Court of Justice; oversee thestate pretrial and juvenile services programs; supervise the State Law Library; provide educationalprograms for judges, court clerks, and support staff; prepare, publish and print manuals, forms,stationery, and other materials; and handle press and public information for the courts.

The Administrative Office of the Courts consists of seventeen departments, currently employing 222people through the central office in Frankfort and another 3,154 at offices across the state. Departmentsinclude:

OVERVIEW

ADMINISTRATIVE SERVICESLee Guice, General Manager

The primary function of the Department of Administrative Services is to providecentralized purchasing and accounting of all goods and services used by the Court ofJustice. In fiscal year 2001, Administrative Services processed 5,381 purchasedocuments, 35,000 payment documents, and monitored the receipt of all goods andservices purchased. The department also manages all Memorandum of Agreement(MOA) and Personal Service Contracts (PSC), price contracts, federal and privateagency grant activity, and insurance claims for the Court of Justice.

To meet the increasing demands of the Court of Justice and to provide more efficientservice, Administrative Services is developing new processes, forms, and databasesfor tracking and reporting. Administrative Services staff works closely with executivebranch personnel to effectively integrate Management Administration & ReportingSystem (MARS) technology, an accounting and purchasing management softwareused by all branches of state government. In compliance with KRS Chapter 45A,Administrative Services recently assumed more responsibility for issuing bidsolicitations and negotiating contracts for services rendered to the Court of Justice.This function was formerly handled by the Cabinet of Finance and Administration.

Another component of Administrative Services’ responsibilities is to meet virtuallyall the Court of Justice printing needs. These include judicial and administrative forms,stationery, publications, manuals, and reports. A new computerized application assistsprinting services with filling inventory requests and maintaining a surplus of forms,publications, and supplies. Printing services consistently upgrades equipment andimplements new technology to meet today’s printing demands.

Administrative Services’ staff directs all incoming telephone calls to theAdministrative Office of the Courts and receives visitors to its Central Office locatedin Frankfort, Kentucky. It opens and distributes mail received and processes alloutgoing mail.

BUDGET & PROGRAM REVIEWJohn Kilkenny, General Manager

The Department of Budget and Program Review monitors the Judicial Branch budgetand serves as staff for the AOC Director in coordinating budgetary administration.In this capacity, Budget and Program Review oversees the preparation and executionof the annual operating budget and the preparation of the Judicial Branch BiennialBudget Request. It attends legislative committee meetings during the GeneralAssembly and provides legislative analysis for fiscal or programmatic impact.

The Budget enacted by the 2000 General Assembly provided for continuance of currentservices, including a 5% salary increment in each year of the biennium (FY 01 & FY02). The 2001 General Assembly session authorized five new judgeships to be effectiveApril 2002. New judgeships are: 5th District, 37th District, 41st Circuit, 51st Circuit,and 57th Circuit.

Budget reductions were implemented in FY 2001 due to declining revenues. The totalreduction for the Judicial Branch was $200,000 from Court Operations andAdministration appropriation. A budget reduction of $2.3 million is anticipated forFY 2002.

COURT SERVICESDonna Tucker, Manager

The Department of Court Services provides technical support and assistance toKentucky’s 120 circuit court clerks. The workload is separated into two divisions:Case Management, which concentrates on court record organization, maintenanceand retrieval, and Cash Management, which concentrates on bookkeeping andfinancial reporting.

The Division of Case Management has nine field representatives, eight of whom areassigned a fifteen county per representative area. These field representatives traveldaily to designated counties within that area to give individualized, on-site trainingto circuit court clerks and deputy clerks. Field representatives provide staffingsubstitutions when unexpected emergencies arise at circuit court clerk’s offices. Theyalso provide daily phone support, as needed, to all counties within their area. Onefield representative is assigned to the AOC central office in Frankfort and worksclosely with Information Systems to design and develop new circuit court clerk casemanagement programs. Field representatives collaborate with the Office of GeneralCounsel on updating the Circuit Court Clerk’s Procedures Manual and related forms.KyCourts I, an automated case management system developed by InformationSystems, was successfully implemented in thirty-five counties during this biennium.Field representatives conducted ten two-day classes of KyCourts I training for 875deputy clerks.

The Division of Cash Management has six judicial auditors who each cover a twentycounty area. Like the field representatives, judicial auditors travel to specific locationsto give individual instruction to court bookkeepers, and they provide daily phonesupport to all counties within their area. Judicial auditors work with InformationSystems to develop new software for receipt and bookkeeping. It is expected that anew program will be implemented in fiscal year 2002. Updating the Circuit CourtClerk’s Accounting Manual and related forms is an integral part of the responsibilitiesof this division. Judicial Auditors advise circuit court clerks on the safe keeping andinvestments of court funds. Judicial auditors worked closely with a contractedCertified Public Accountant firm to perform twenty full-scope financial/proceduralaudits for each year of this biennium. During the biennium, judicial auditors reviewed2,952 Summary Financial Reports.

Department of Court Services’ field representatives and judicial auditors conductregional training sessions every year for circuit court clerks and deputy clerks toacquaint them with new legislation affecting the courts and its implementation.

Dependent Children’s Services oversees and supports dependent child advocacyboards and initiatives that expedite permanent placement for Kentucky’s abused andneglected children. It promotes education and accountability among professionalswho provide services to dependent children. Dependent Children’s Servicesadministers the Kentucky Court Improvement Project, recruits and trains volunteersfor Citizen Foster Care Review Boards, and coordinates education programs for theGuardian ad litem Training initiative.

The Kentucky Court Improvement Project (CIP) is dedicated to serving Kentucky’schildren and families by improving the courts of juvenile and family jurisdictions.Judges face difficult decisions directly affecting abused and neglected children infoster care and other substitute placements throughout the state. CIP plays an essentialrole in helping judges handle each child’s case safely and expeditiously. The missionof CIP is to develop best practice guidelines and technology systems to help courtsstreamline and improve the permanent placement process for children and theirpermanent custodians.

CIP maintains a Foster Care Information Management System that facilitates CitizenFoster Care Review Boards case reviews. This tracking system identifies all childrenin foster care and follows them through the review process, houses review boardfindings and recommendations data , and tracks all children in foster care throughcourt placement orders. Data on 23,000 children is updated daily and made accessibleto judges, volunteers, court personnel, and other state officials. Recent collaborationbetween Dependent Children’s Services and the Cabinet for Families and Childrenhas allowed information sharing and the possibility of electronic case notification.

By coordinating the efforts of Family Courts, interagency groups, Foster Care ReviewBoards, Guardians ad litem, social workers, attorneys, and other professionals, CIPreduces system delays that Kentucky’s children experience in foster care. CIP pilotsites have been successful in moving children toward permanent placement bynetworking with adoption initiatives, model court work groups, cross-disciplinetraining, and the “One Legal Voice” initiative.

Statewide Citizen Foster Care Review Boards (CFCRB) are mandated to review casefiles of all children committed to the Cabinet for Families and Children (CFC). TheCFCRB mission is to ensure that permanency for at-risk children remains a centralobjective of the courts and the CFC. Case file review is required by statute (KRS 620)at least once every six months until the child is permanently placed or until adoptionproceedings become final. Findings and recommendations of the boards are sent tothe judge assigned to the case and to the CFC.

AOC began administering these boards in 1987. Boards are located in each ofKentucky’s 120 counties. There are currently over 650 volunteers serving on the 144CFCRB operating in the Commonwealth. Volunteers are recruited, trained, andprovided continual support by the AOC in conjunction with other volunteers. All

volunteer reviewers must be certified and maintain a minimum of six continuingtraining credit hours annually.

During fiscal year 2001, review boards conducted 14,173 reviews of 6,514 children,which means that these children were reviewed an average of 2.2 times during theyear. Of those children reviewed, 2,316 were released; the remaining 4,197 were stillactive in the foster care system as of August 15, 2001. Approximately 332 of the childrenreleased were adopted. The average age of children active in the foster care system iseleven years old and the average age of children released is 10.7 years. Childrenexperience an average of 37 months in foster care.

A Guardian ad litem (GAL) is an attorney appointed by the courts when anindependent view is needed to ensure that the interests of an abused or neglectedchild are properly represented. The GAL does not work for the local authority or thecourt involved in the case, but helps the courts make informed decisions about thewelfare of the child. The GAL interviews all parties concerned, studies the relevantcase files and gets to know the child or children involved. Once the necessary inquiriesare made, the GAL writes reports to the court and makes recommendations.

In 1998, Chief Justice Lambert established a commission to study and recommendimprovements in the legal representation of children. One of these recommendationswas to establish and implement a standard GAL training program administered bythe AOC in coordination with the Kentucky Bar Association. A GAL EducationSpecialist is on the staff of Dependent Children’s Services to coordinate and assistthe GAL training program. Since its inception, over 400 attorneys have been trainedwith the best practice model for abuse, neglect, and dependency cases.


DRUG COURTLisa Minton, Manager

The Department of Drug Courts was created in 1996 to oversee Kentucky’s adult andjuvenile drug courts. Drug Courts operate or are planned in over half of the 120 countiesin Kentucky. These courts have become exemplars of non-adversarial approaches todrug offenses, integrating treatment services and the justice system. Judges work withtreatment providers and community representatives to help eligible participantsachieve both sobriety and productive lives. Combining intensive judicial supervision,mandatory drug testing, and graduated sanctions with a continuum of alcohol anddrug treatment, drug courts help offenders break the cycle of addiction. Participantsin Kentucky’s drug court programs are required to take part in educational andcommunity service activities and to hold employment. They contribute to society andsupport their families. In 2001 they paid over $88, 600 toward restitution, child support,court costs, fines, and other obligations.

The Conference of Chief Justices and the Conference of State Court Administratorsadopted resolutions on August 2, 2000 supporting these problem solving courts whichrepresent the best practice of therapeutic jurisprudence. In June, 2001, Chief JusticeJoseph E. Lambert became the first Chief Justice elected to the National Board ofDirectors of the National Association of Drug Court Professionals. In August, 2001,the U. S. Justice Department reported the first decline of inmate population in stateprisons since 1972 and attributed this to “new attitudes about offering drug offenders

treatment instead of locking them up.” A recent Kentucky Treatment Outcome Study,funded by the Division of Substance Abuse, showed that $8 in avoided cost is savedfor every $1 spent on treatment services. For example, forty-two drug free babies havebeen born to participants in Kentucky’s Drug Courts, a significant achievement givingthose at-risk children a healthy, drug-free start on life, as well as avoiding the reportedcost of $250,000 in medical expenses for every drug-addicted baby born. The CriminalJustice Council and the Kentucky Agency for Substance Abuse Policy have endorsedDrug Courts for continuation and expansion.

The University of Kentucky Center on Drug and Alcohol Research is one of six researchentities awarded a $1.9 million grant by the National Institute on Drug Abuse to monitorthe effect on drug court retention through programs that increase employment skillsof participants. The randomized study focuses on Drug Courts in Fayette and Warrencounties. According to the National Institute of Justice (NIJ), only one quarter of drugusers in U. S. prisons were previously in treatment, but the number of those chargedwith drug related crimes who need treatment exceeds two million a year. Periods ofincarceration alone do not change drug use behavior; 60 to 75% of untreated paroleeswith a history of cocaine and/or heroin use, return to addiction within 3 months ofrelease. The U. S. Bureau of Justice Statistics reports that 82% of paroled personsreturned to prison were drug and alcohol abusers; 40% of those were unemployed;75% have not completed high school; and 19% were homeless.

The UK Center performs evaluations of all Drug Courts in the Commonwealth. AOCand the UK Center have developed a revolutionary automated Drug CourtManagement Information System (MIS) to process drug court cases. MIS statisticalreports, generated from information collected statewide, help rate the overalleffectiveness of Drug Court programs. Evaluation outcomes of the first three sites,Jefferson, Fayette, and Warren, express the savings of Drug Courts graduates in“avoided” costs to society, such as arrest and conviction, victim compensation,Medicaid claims, public aid, and decreased annual earnings. Drug Court costs for 586graduates was $1,548,691 as compared with $8,609,100 for one year in prison, anavoided cost savings of $7,060,900.

EDUCATION SERVICESMichael Losavio, Manager

The Department of Education Services plans and coordinates continuing educationand professional training for the judiciary and other Court of Justice personnel.Seminars and conferences provide professional curricula for judges, circuit courtclerks, deputy clerks, trial commissioners, domestic relations commissioners, andother court support staff.

Education Services staffs the Mandatory Continuing Judicial Education Commission,which oversees judicial education in Kentucky. Kentucky Supreme Court Rulesmandate continuing judicial education (CJE) for justices and judges. A minimumattendance of twenty-five hours of approved programs in a two-year period isrequired. With direction from the Circuit and District Judges Education Committees,Education Services conducts annual judicial colleges and specialty programs asneeded. In 2001, Education Services provided 95.5 hours of CJE programming.Program courses included domestic violence, judicial ethics, evidence, and courtprocedure.

Circuit court clerk and deputy clerk training is a significant part of Education Services’schedule. The department, assisted by the Circuit Clerk’s Education Committee, plansand conducts summer and fall conferences for circuit court clerks. Circuit and deputyclerk regional conferences are also conducted across the state. Training concentrateson legal requirements, office management, bookkeeping practices, personnel policiesand procedures, judicial accounting, driver licensing, legislative updates, and courttechnology. Education Services delivered 115 hours of training for circuit and deputyclerk regional conferences in fiscal year 2001.

Education Services is committed to excellence in all its programs. Faculty Developmentseminars are held for instructors to prepare their presentations under the guidance

of expert trainers. A valuable component of Faculty Development is feedback fromother presenters. In 2001, Education Services brought together faculty presenters forseveral of its diverse programs to exchange program ideas on professional education.

In 1999, a federal law enforcement grant helped fund the creation of a statewideInternet based computer network for Kentucky’s Court of Justice. In conjunction withInformation Systems, Education Services provides court technology training for thejudiciary and court support personnel. At the Circuit and District Judges JudicialColleges and the Circuit Clerks’ Fall Conference, small breakout sessions withcomputers gave participants concentrated, hands-on training at their proficiency level.An Education Services technology coordinator surveys and coordinates courttechnology training needs and designs strategies for learning.

With assistance from the Office of General Counsel, Education Services maintains aninternal web site for bill tracking during the annual legislative sessions of the GeneralAssembly. Education Services also prepares the Court of Justice Annual Report andpress releases on Court of Justice activities. It assists the Court of Justice TechnologyCommittee and Court Security Task Force.

Education Services supports other Court of Justice initiatives such as Regional Bench-Media Forums. These forums bring together justices, judges and journalists from theprint and broadcasting professions to examine their unique roles in service of thepublic good. Conflicts over the citizen’s right to information and the court’s duty toguarantee a fair trial are discussed in an open exchange. The candid nature of theseforums improves the working relationship of the judiciary and the media. Forumsbegan in 2000 and have moved across the Commonwealth.


FACILITIESGarlan E. Vanhook, General Manager

The Court of Justice currently occupies over 300 facilities throughout theCommonwealth of Kentucky, some of which are Kentucky’s finest historicalsites. The gross size of these facilities totals over 3,500,000 square feet. Spaceneeded to house the Court of Justice, however, is constantly increasing withKentucky’s growingpopulation. Additionaljudicial services and judicialsponsored communityprograms such as DrugCourts, Family Courts andjuvenile outreach effortsrequire a dynamic approachto space management andvisionary planning forexpansion.

Construction projects forthe Court of Justice in fiscalyear 2001 enjoyed dramaticand positive changes. Theenactment of House Bill 734

by the 2000 General Assembly solidified the authority and responsibility of the Courtof Justice to achieve specific goals and resolve pertinent issues. In compliance withthe Court of Justice Rule of Administrative Procedure, Part X., implemented in October2000, projects are now subject to comprehensive and defined criteria for programdevelopment policy, which makes it possible for the Court of Justice to proactivelyrespond to the judicial needs of the Commonwealth.

The Department of Court Facilities Management is responsible for operating,maintaining and equipping courtroom and office space statewide, including facilitiesleased from the private sector. Court Facilities Management assists countygovernments in maintenance, repair, and preservation of their historic sites. It alsooversees all construction of new court facilities. During fiscal year 2001, Court FacilitiesManagement undertook major construction programs in twenty-seven counties,costing approximately $350,000,000. The scope of these programs ranged fromprojects under construction to site procurement and design. (See map on page 31)

Court Facilities Management is also responsible for all shipping, receiving, andinventory accountability of the furnishings, supplies, and equipment it distributesand maintains for court facilities. It provides conscientious management of all leasedspace, including security systems, building repairs, and grounds maintenance.

Anticipating growth and future needs, Court Facilities Management effectively andeconomically prepares construction and operation budget forecasts. It managescontracts to focus expenditures on design features that minimize operation andmaintenance costs. This includes new construction as well as existing courthouseexpansions, major repairs and upgrades, and small construction projects. Allconstruction design and implementation take into consideration the need foradaptable infrastructures to facilitate evolving information systems andcommunication technologies.

The Department of Family Courts provides the resources necessary for family courtsto effectively respond to the unique communities they serve. Kentucky’s family courtsare a pilot project that began in 1991 with the creation of a first site in Jefferson County.There are now eleven family court projects, involving nineteen counties, operating inthe Commonwealth.

These courts have comprehensive jurisdiction over all civil matters relating to thefamily. The impetus for establishing family courts arose from the difficulty of settlingdisputes that overlap the jurisdictions of the separate courts. Moving families througha complicated system of several courts to resolve an issue creates confusion, delaysand hardships. In family courts, cases are presented before a single court with thesame judge hearing all matters involving a particular family.

The success and growth of Kentucky’s family courts is one of the most praiseworthyaccomplishments of the Court of Justice in the last ten years. Family courts havereceived national recognition and statewide appreciation for their innovativeimprovement of court services to families and children. The Department of FamilyCourts is involved with every phase of family court development and operation, frombudgetary considerations, facility procurement and equipping to linking courts with

social services, such asdrug and alcoholtreatment providers,social workers, and otherhelping professionals. Itestablishes performancegoals and measures forthe courts, and assistswith standardizing courtorders, procedures, andrules. It provides familycourt program training forjudges and staff, andcontributes to continuingeducation for judges. Thedepartment developsdiversionary alternativesto court action through court-community collaborations. Outreach programs,community education, family court councils, and advisory committees help familiesresolve matters without a formal court hearing. “Families in Transition,” a divorceeducation program, is one example of how family courts impact the community.

The Family Courts department is constantly refining internal evaluation and reportingmechanisms to improve case coordination and system response to the needs of familiesserved by the courts. Tools for data capture and outcome analysis are underdevelopment, with enhancements such as courtroom data entry and immediateissuance of court orders from the bench. With a grant from the State Justice Institute,the Family Courts department created a valuable technical assistance publication forother states contemplating a family court model. In 2001, Kentucky Rural Family Courts:Lessons Learned: A Comprehensive Handbook for Implementation was completed anddisseminated throughout the United States.

As Kentucky family courts begin a second decade of operation, their “project” statusis at issue. Judges assigned to family courts must be “cross-sworn” to hear mattersunder both circuit and district court jurisdictions. The Kentucky Constitution allowsthe Chief Justice to assign any judge to sit in any court, but only “temporarily.” Aproposed amendment to the Kentucky Constitution would provide the Supreme Courtwith the authority to designate family courts as a permanent division of Circuit Court.On November 5, 2002, Kentucky voters will be asked to ratify or reject the familycourt amendment. Passage of the Constitutional Amendment will ensure that familycourts continue to provide services that protect Kentucky’s children and families.

The Department of Court Information Systems supports the computer infrastructureof Kentucky’s unified court system. From the introduction of computer automationto the Court of Justice in the 1980s, Information Systems has developed a basic, intra-office system into a highly sophisticated and complex statewide data communicationsnetwork. This network connects all computers in the Court of Justice to all outsideagencies, and other Internet-accessible people and systems.

Over 3000 computers communicate with each other on this network, using over 170frame relay circuits to provide e-mail services to all employees, computer assistedlegal research for judges and staff, and updates to the statewide court database everytwenty minutes. Information Systems maintains over 300 file and database serversand a large mainframe computer to process, store, analyze and communicate courtdata. This statewide network, designed and implemented in-house by InformationSystems, was completed in 2001. Information Systems provides user support for thistechnology with on site training, equipment and software installation, and Help Desktrouble-shooting and consultation for over 3,300 Court of Justice employees.

Information Systems developed computer programs to manage trial and appellatecases, jury lists, criminal histories and court document imaging. An automated jurymanagement system was installed in Jefferson County during fiscal years 2000-2001for the large number of jurors called daily. Technical personnel within InformationSystems, who are familiar with the business processes of the courts, designed systemsto manage administrative tasks for the Court of Justice, such as bookkeeping, personnelrecords, budget management, and facilities payments.

Using Internet technologies, Information Systems created KyCOURTNET, to allowjustice personnel access to criminal case information from any web-enabled computerat any time. Over 3,000 law enforcement and corrections personnel, prosecutors, andpublic defenders registered to use this system to obtain data regarding charges,convictions, bench warrants, bail, pretrial release conditions and sentences. KyCOURTSI, another Information Systems innovation, is a windows-based case managementsystem that replaced the earlier SUSTAIN system. It was installed in over sixty countiesduring the 2000-2001 fiscal years. An enhanced version, KyCOURTS II, is now in useand has upgraded features, including full digital imaging of court documents.

With the assistance of the Office of General Counsel, Information Systems convertedmore than seventy-five court forms to on-line Internet “smart” forms. Using “smart”forms, attorneys, court personnel, law enforcement and the public can now enterinformation, print, and submit a signed hard copy to the court for filing. Theseelectronic forms pave the way for future electronic filing directly to the courts.

Another technology embraced by the Courts in 2001 is digital audio recording. Thistechnology replaces the cassette tape with Compact Disc (CD), and the four-channelrecorder with a personal computer. Not only does digital audio produce higher qualityrecordings, but these records may also be transmitted electronically.

The Office of General Counsel (OGC) provides a wide range of legal services to theCourt of Justice with special emphasis on personnel and contract law, legislativeanalysis, and administrative procedures. It offers other counsel as needed. The workof the legal staff encompasses virtually every aspect of the Court of Justice operationsthroughout the Commonwealth.

The Office of Minority Affairs develops diversity outreach programs for the communityand assists with diversity training for judges and support staff. It conducts publicforums to promote trust and understanding of court process and provides a contactpoint for the community to express concerns about diversity issues in the courts.Minority Affairs also provides leadership for overcoming organizational barriers anddiscriminatory conditions, purposeful or inadvertent, within the court system. It worksto ensure that policies and procedures do not operate to the detriment of any personbased on race, creed, religion, color, gender, sexual orientation, age, disability, ornational origin.

The Court of Justice is committed to equal employment opportunity. Minority Affairsmaintains a resume bank and an expanded employment notice circulation to increaseopportunities for minorities within the courts. It maintains high visibility at job fairs,minority conventions, and college and university campuses to make the public awareof opportunities for service. Because of the under-representation of minority studentsapplying for judicial clerkships, which are important starting points for law schoolgraduates, the Office of Minority Affairs is developing a minority law clerk recruit-ment program to encourage students to seek these positions. It encourages law schoolplacement officers and the Kentucky Bar Association to mentor minority law students.

Active with the Minority Speaker’s Bureau, Minority Affairs arranges for judges andkey court personnel to address issues affecting the minority community. An openrelationship with minority organizations and associations is vital to the success of theOffice of Minority Affairs. Among others, it networks with the NAACP, Urban League,Hispanic Coalition, Arab American Association, Women’s Task Force, Black Achievers,Blacks in Government, American Bar Association Council on Racial & EthnicJustice, National Bar Association, and National Association of Blacks in Criminal Justice.It also maintains a relationship with various commissions and task force initiatives:Race Relations Commission, Peace and Justice, National Consortium of Task Forces,and the Commission of Racial Bias in the Courts. Chief Justice Lambert recently createdtwo commissions to study diversity issues in Kentucky courts: Commission of Reviewon Racial Fairness in Jefferson County Courts, and Implementation Task Force forRacial/Ethnic Fairness in Kentucky Courts.

Minority Affairs promotes National Law Day programs that honor the importance oflaw in a free society. It attends open house ceremonies in courthouses around the stateand encourages the minority community to take part. During Jurors AppreciationWeek, Minority Affairs holds special ceremonies to applaud jurors for their citizenship.

Beginning in the spring of 2001, OGC worked closely withInformation Systems and the AOC Print Shop to convert many of these forms to a“smart” on-line format accessible via the Internet. Court personnel, attorneys, lawenforcement, and the public may now access smart forms 24 hours a day, seven daysa week, and electronically enter data onto the form, print the completed document,and file it in Kentucky courts as needed. This project is providing valuable informationon the use of electronic documents as the Court of Justice prepares for direct electronicsubmission of documents to Kentucky trial courts. OGC also assisted in the developmentof KyCourts II, an enhancement of the statewide case management system. Othersignificant projects assigned to OGC include administering the Senior Status JudgeProgram, jury list requests, balloting for the Judicial Conduct Commission, andrevision of the judicial candidate packet.

Legal Support: Legal Support: Legal Support: Legal Support: Legal Support: AOC staff attorneys are statutorily prohibited from appearing inKentucky courts, but OGC provides extensive support when the Court of Justiceand/or its employees are named in litigation. Examples of this type of support includesecuring legal representation for judges and circuit clerks as well as researching anddrafting pleadings. Staff attorneys have defended Court of Justice interests beforethe Equal Employment Opportunity Commission (EEOC), the Board of Claims andthe Occupational Safety and Health Administration (OSHA).

OGC provides legal support to all AOC departments. For example, in concert withthe Personnel Manager, OGC revises the Court of Justice Personnel Policies. Withthe Department of Court Facilities, OGC analyzes Court of Justice constructionguidelines for courthouse facilities and reviews all lease agreements for court space.AOC staff attorneys draft and/or review all personal service contracts, memorandaof agreement (MOA), memoranda of understanding (MOU) and requests for proposals(RFP) involving the Court of Justice. An AOC staff attorney attends all GovernmentContract Review Committee hearings.

The OGC represents the interests of the Court of Justice on various boards, workgroups, task forces and commissions. Examples include the Court Security Task Force,Court of Justice Statewide Technology Committee, Criminal Justice Council UniformCourt Costs Work Group (co-chair), Penal Code Revision Work Group, CapitalLitigation Committee, Court Facilities Standards, and the Uniform Schedule of BailRevision Committee. AOC staff attorneys assist the agency’s Committee on SexualHarassment, the Americans with Disabilities Act Committee, and the EmployeeGrievance Committee. OGC also reviews felony and misdemeanant diversionprotocols as well as domestic violence protocols prior to submission to the ChiefJustice for approval. This year OGC represented Kentucky in the multi-state ProjectPassport initiative, which resulted in a statewide uniform domestic violence orderthat has become a model for the nation. OGC also serves on the Governor’s Councilon Domestic Violence and Sexual Assault, and the Intimate Partner ViolenceSurveillance Advisory Committee of the University of Kentucky Injury Preventionand Research Center.

OGC staff haveserved as faculty at education programs for deputy clerks, pretrial officers, DomesticRelations Commissioners, Trial Commissioners, court designated workers and lawclerks on topics ranging from accountability and ethics to technology and courtpractice. OGC staff also review Court of Justice brochures and web postings andcoordinate presentations on various AOC programs for bar groups.

The Department of Personnel Administration provides the administrative, accounting,and clerical services necessary to support approximately 3,300 elected and non-electedemployees of the Court of Justice. It prepares payroll each month for the entire Courtof Justice and administers its personnel policies, including the selection of AOCpersonnel and the maintenance of personnel classification. Personnel Administrationalso processes workers’ compensation claims, and responds to approximately 1,300requests regarding employee benefits each year. Improved technologies, such ascustom-made personnel records and the automated reporting system, help thedepartment achieve fiscal accountability and provide quality service to the courts.

The Department of Pretrial and Court Security Services provides three major servicesfor the Kentucky Court of Justice: Pretrial Release, Record Services and Court Security.

PRETRIAL RELEASEPretrial Services supports the courts in their constitutional duties to individuals chargedin a criminal matter. It was created in 1976 as a part of the Bail Bond Reform Act,which eliminated the commercial bail bond system that tied the constitutional rightto bail to a profit-making enterprise. Kentucky remains the only state to statutorilyabolish this archaic practice of providing bond for profit. Investigative PretrialServices now compiles background information on defendants awaiting trial oncriminal charges. Trial court judges use this information to reach knowledgeabledecisions about releasing an accused from custody, and if so, under whatconditions.

By checking criminal histories and conducting interviewswith defendants to determine eligibility for release, the Pretrial Services Officer actsas a neutral information-gathering arm of the courts. The defendant’s compliance withimposed conditions for release is tracked by Pretrial Services Officers who assist intheir return to court should they fail to appear. Pretrial Services Officers also collectAffidavits of Indigence for defendants seeking representation by the Public Defender’sOffice pursuant to the Sixth Amendment of the United States Constitution.

RECORD SERVICESThe Record Services Division responds to the growing demand by the public, stateand other agencies for the criminal histories and court disposition of persons seekingemployment, housing and other services. Record Services also provides backgroundinformation to licensing agencies, such as the Kentucky State Police, Alcohol andBeverage Control, Kentucky Board of Nursing, and the Kentucky Bar Examiners.

The CourtNet Criminal History database contains records of all misdemeanor andtraffic cases for at least the last five years, and felonies dating back to 1978. It containsinformation from all 120 counties, and includes over 4 million records. This databaseis updated every twenty minutes with information from the offices of the 120 circuitclerks across Kentucky. A record can be obtained via fax, standard mail, or walk-inservice through the AOC Central Office in Frankfort for a $5 fee. With the close offiscal year 2001, Record Services completed its first year during which backgroundscreening for school volunteers was required. It provides screening free of charge forpersons with the supervisory responsibility for minors, and will continue to do so foras long as possible. However, requests for school volunteer screening now represent29% of Pretrial Services’ workload. This is an increase from 8% in 2000 when the servicewas first implemented.

Pretrial Services, with the help of Office of General Counsel, developed the ElectronicAccess to Court Records Policy, which was reviewed by the Court of Justice Committeeon Technology and approved by the Supreme Court. This policy balances the need forreasonable access to information with the strong privacy safeguards that protect citizensfrom exploitation and abuse.

COURT SECURITY SERVICESCourt Security Services provides special security at trials and court-sponsored eventswhere high-risk conditions are anticipated. Preparations involve coordination at manylevels. Meetings with judges, sheriffs, local police, jailors, prosecutors, and otherparticipants are held. Surveys of facilities determine what procedures, staffing, andequipment are necessary for a secure environment for court business. In some cases,emergencies require immediate mobilization of security professionals. To maintain

readiness, Court Security Specialists train local bailiffs so they can provide professionalassistance to the judicial officers of the state.

In December of 2000, the Chief Justice convened the first comprehensive Task Forceon Court Security in the history of the Commonwealth. The Task Force brought togetherjudges, judge executives, legislators, sheriffs, court officials, and others whose solefocus was to develop recommendations for improving the security of each courthousein the state. These recommendations were issued in a final report sent to allgovernmental units in each court and court related facility.

The Department of Research and Statistics collects and disseminates judicial caseloaddata for the Court of Justice. The department also fulfills written requests from thepublic and private sector for caseload data. Circuit and District caseload informationis reported by circuit court clerk offices and must be accurately handled. The Court ofJustice is in the process of replacing older case management systems with KyCourts,developed in house by Information Systems. As this conversion process moves acrossthe Commonwealth, Research and Statistics must still deal with older systems in circuitclerk offices in many counties. The Quality Assurance program used by Research andStatistics tracks errors or potential inaccuracies through fifty-five different editingprocesses established for older systems. This allows staff to make corrections andexpungements of older case records to the new KyCourts database. These self-criticalanalysis mechanisms are vital to keeping criminal history data accurate.

The State Law Library is established by statute (KRS 27A.200, et seq.) as a supportservice for the Court of Justice and is the central collection of legal research tools forstate government. The primary function of the State Law Library is to provide researchand reference assistance to the Court of Justice. It purchases and maintains researchtools for the use of judicial offices throughout the Commonwealth and maintains andimproves the central library’s legal research capabilities. Through the use of technology,the State Law Library has been able to replace a number of expensive print materialsin favor of more cost efficient formats, which reduce space requirements.

The State Law Library is also available for the use of public officials and their staffs,state employees, attorneys and the public.

The Department of Youth, Families and Community Services provides outreach,prevention, and diversion services for Kentucky’s at-risk families through the CourtDesignated Worker Program and citizenship education. Youth, Families andCommunity Services was created in 1998 by combining Juvenile Services and Court-Community Relations departments. Supporting the activities of these departmentsthrough one office is a more holistic approach to serving youth and families.

Worker Program. According to the U.S. Office ofJustice, juvenile crime incidents in Kentucky weresignificantly lower in 2001 than in previous years,indicating that prevention programs are making apositive difference in young people’s lives. Incompliance with the mandate, each of the 59 judicialdistricts in the Commonwealth has the services ofCourt Designated Workers (CDW) available 24hours a day, seven days a week. The 135 CDWemployed by the Court of Justice provide in-takeservices for all juveniles charged with public(criminal) and status offences. CDW assist law-enforcement with juveniles taken into custody andformulate alternative, diversionary placements forjuveniles prior to arraignment.

Formal sanctions for delinquency are the last resort.Uniform criteria determine which juvenilecomplaints require court action and which areeligible for informal processing by the CDW. Afterconducting preliminary investigations with aneligible juvenile, a CDW formulates and enters into

a diversionary agreement with the juvenile for redress of offenses without court actionand a formal court record. Diversionary terms may include paying restitution to thevictim, completing assigned community service, and attending counseling andeducational programs. CDW managed approximately 42,000 juvenile cases and 16,000custody cases during fiscal year 2001. Of those public offenders processed by CDW,92% successfully complete the terms of diversion.
