INTRODUCTION

Welcome to the Local 313 IBEW/NECA JATC. You have selected the electrical trade as yourcareer. The Electrical field is rewarding, ever changing, and both physically and academicallychallenging. In order to meet the educational requirements of the apprentice and journeymanelectrician, the Local Union and the Contractors association partnered to create the JointApprenticeship and Training Committee.

In 1946 the original Local 313 “Joint Apprenticeship Committee” was formed. In the same yearthe apprenticeship program offered by the committee was recognized by the “Federal Committeeon Apprenticeship” as a trainer for the trade classification of “Electrician”. Since its beginning thecommittee and apprenticeship programs have seen many changes. The committee is now the JointApprenticeship and Training Committee (JATC). There are eight JATC members, fourrepresentatives from the Local 313 IBEW and four from the Delaware Division of NECA. Thecommittee members act as trustees overseeing the jointly negotiated employer contribution to theapprentice fund. Along with their trustee duties the committee also oversees the application,processing, selection, education, and training of qualified individuals so that they may becomeknowledgeable, skilled, and have the abilities to perform the many tasks of the electrical tradesafely, efficiently, and to the high standards required by our customers and contractors. The JATCalso offers various advanced trade related training to all parties represented by the apprenticeshipfund.

Contained within this document are the general policies, rules, and regulations as set forth by theJATC. Please review the sections that pertain to you as either an apprentice, journeyman, or asanother classification of fund participant.

I would like to welcome all new eligible members to take advantage of the JATC programs andtraining offerings. The JATC continues to improve the apprentice and journeyman course offeringsas well as improve the facilities and equipment utilized for training through both fund contributionsand donations. Knowledge, Skills, and Abilities

The most important knowledge, skills, and abilities (KSAs) are listed for Electricians.

Knowledge: Building and Construction - Knowledge of materials, methods, and the tools involved in

the construction or repair of houses, buildings, or other structures such as highways androads.

Mechanical - Knowledge of machines and tools, including their designs, uses, repair, andmaintenance.

Mathematics - Knowledge of arithmetic, algebra, geometry, calculus, statistics, and theirapplications.

English Language - Knowledge of the structure and content of the English languageincluding the meaning and spelling of words, rules of composition, and grammar.

Design - Knowledge of design techniques, tools, and principals involved in production ofprecision technical plans, blueprints, drawings, and models.

Skills: Troubleshooting - Determining causes of operating errors and deciding what to do about

it. Repairing - Repairing machines or systems using the needed tools. Active Listening - Giving full attention to what other people are saying, taking time to

understand the points being made, asking questions as appropriate, and not interrupting atinappropriate times.

Critical Thinking - Using logic and reasoning to identify the strengths and weaknesses ofalternative solutions, conclusions or approaches to problems.

Judgment and Decision Making - Considering the relative costs and benefits of potentialactions to choose the most appropriate one.

Abilities: Problem Sensitivity - The ability to tell when something is wrong or is likely to go wrong.

It does not involve solving the problem, only recognizing there is a problem. Deductive Reasoning - The ability to apply general rules to specific problems to produce

answers that make sense. Inductive Reasoning - The ability to combine pieces of information to form general rules

or conclusions (includes finding a relationship among seemingly unrelated events). Near Vision - The ability to see details at close range (within a few feet of the observer). Oral Comprehension - The ability to listen to and understand information and ideas

presented through spoken words and sentences. Visual Color Discrimination - The ability to match or detect differences between colors,

including shades of color and brightness.

Tasks and ActivitiesOccupation specific tasks and the most important generalized work activities are listed forElectricians.

Occupation Specific Tasks: Plan layout and installation of electrical wiring, equipment, or fixtures, based on job

specifications and local codes. Connect wires to circuit breakers, transformers, or other components. Test electrical systems or continuity of circuits in electrical wiring, equipment, or fixtures,

using testing devices, such as ohmmeters, voltmeters, or oscilloscopes, to ensurecompatibility and safety of system.

Use a variety of tools or equipment, such as power construction equipment, measuringdevices, power tools, and testing equipment, such as oscilloscopes, ammeters, or testlamps.

Inspect electrical systems, equipment, or components to identify hazards, defects, or theneed for adjustment or repair, and to ensure compliance with codes.

Prepare sketches or follow blueprints to determine the location of wiring or equipment andto ensure conformance to building and safety codes.

Diagnose malfunctioning systems, apparatus, or components, using test equipment andhand tools to locate the cause of a breakdown and correct the problem.

Work from ladders, scaffolds, or roofs to install, maintain, or repair electrical wiring,equipment, or fixtures.

Advise management on whether continued operation of equipment could be hazardous. Place conduit, pipes, or tubing, inside designated partitions, walls, or other concealed areas,

and pull insulated wires or cables through the conduit to complete circuits between boxes. Maintain current electrician's license or identification card to meet governmental

regulations. Direct or train workers to install, maintain, or repair electrical wiring, equipment, or

fixtures. Repair or replace wiring, equipment, or fixtures, using hand tools or power tools. Install ground leads and connect power cables to equipment, such as motors. Assemble, install, test, or maintain electrical or electronic wiring, equipment, appliances,

apparatus, or fixtures, using hand tools or power tools. Perform business management duties, such as maintaining records or files, preparing

reports, or ordering supplies or equipment. Fasten small metal or plastic boxes to walls to house electrical switches or outlets. Construct or fabricate parts, using hand tools, according to specifications. Perform physically demanding tasks, such as digging trenches to lay conduit or moving or

lifting heavy objects. Provide assistance during emergencies by operating floodlights or generators, placing

flares, or driving needed vehicles. Provide preliminary sketches or cost estimates for materials or services.

Generalized Work Activities: Identifying Objects, Actions, and Events - Identifying information by categorizing,

estimating, recognizing differences or similarities, and detecting changes in circumstancesor events.

Getting Information - Observing, receiving, and otherwise obtaining information from allrelevant sources.

Making Decisions and Solving Problems - Analyzing information and evaluating results tochoose the best solution and solve problems.

Inspecting Equipment, Structures, or Material - Inspecting equipment, structures, ormaterials to identify the cause of errors or other problems or defects.

Handling and Moving Objects - Using hands and arms in handling, installing, positioning,and moving materials, and manipulating things.

Detailed Work Activities: Assist skilled construction or extraction personnel. Communicate with other construction or extraction personnel to discuss project details. Create construction or installation diagrams. Dig holes or trenches. Direct construction or extraction personnel. Estimate construction project costs. Fabricate parts or components. Inspect electrical or electronic systems for defects. Install electrical components, equipment, or systems. Order construction or extraction materials or equipment. Plan layout of construction, installation, or repairs. Prepare operational reports. Repair electrical equipment. Test electrical equipment or systems to ensure proper functioning. Thread wire or cable through ducts or conduits. Train construction or extraction personnel.

Update job related knowledge or skills. Constant changes in installation methods and materials as well as changes in code

requirements requires the electrical worker to continually to update related knowledge andskills.

Physical Demands of the Electrical Worker

This position involves occasional sitting, frequent walking, heavy lifting 5% of the time, moderatelifting 70% of the time, and light lifting 25% of the time. As far as carrying is concerned, it involves5% heavy carrying, 70% moderate carrying, and 25% light. There is frequent climbing, occasionalbalancing, frequent bending, stooping, crouching and kneeling, occasional crawling, frequentreaching, frequent turning and twisting, occasional pushing and pulling, fingering, and handling.

DEFINITIONS

Apprenticeship Registered Standards:National guidelines for apprenticeship representing the written plan delineating the terms andconditions for the recruitment, selection, employment, training, and supervision of apprentices assubscribed to by the JATC. The Standards are also approved by the Delaware State registrationagency for apprenticeship and training.

Collective Bargaining Agreement (CBA):Negotiated agreement between IBEW Local Union 313 and Penn-Del-Jersey, Delaware Division,NECA detailing working conditions and wages.

Electrical Training ALLIANCE (ETA):National IBEW/NECA training organization consisting of the National Joint Apprenticeship andTraining Committee (NJATC) and participating training partners.

IBEW:International Brotherhood of Electrical Workers. Represents the union membership.

JATC (Committee):Local 313 IBEW/NECA Joint Apprenticeship and Training Committee.

NECA:National Electrical Contractors Association. Represents the contractor’s association.

On The Job Training (OJT):Apprentices are assigned to contractors for employment and On the Job Training (OJT). The hoursworked in the field are considered OJT Hours.

Training Center (TC):Training Facilities of the JATC Located at 814 W Basin Road, new castle, DE 19720

Training Director (TD):Person hired by the JATC to run the Training Office according to the Policies, Rules, andRegulations set forth by the JATC.

Training Office (TO):Functions of the office include the processing of apprenticeship applicants as well as theadministration of apprenticeship and journeyman training.

Work Report (Time Sheet)Apprentice work report and evaluation to be completed and submitted on a monthly basis accordingto the Work Report instructions and JATC rules.

Article I. Purpose

Section 1.01 Document OverviewThis document was created by the Local 313 JATC to provide the guidelines by which the JATCand its programs are operated and maintained. The JATC reserves the right to change or modifythe policies, rules, and regulations contained within this document at any time without notification.

Section 1.02 QuestionsPlease direct all questions relative to these documents to the Training Director or the Committeefor clarification.

Article II. JATC (Committee) and Training Director

Section 2.01 Conformity of StandardsThe committee shall make rules and establish requirements for the training of apprentices,journeyman, and others according to “National Apprenticeship and Training Standards for theElectrical Contracting Industry”, the “Local 313 Collective Bargaining Agreement”, and theDelaware Department of Labor’s “Rules and Regulations Related to Delaware Apprenticeship andTraining Law”.

Section 2.02 SupervisionThe committee shall supervise all matters involving apprenticeship training. In case of a deadlockthe matter in dispute shall be referred to the parties of the Labor Agreement for settlement.

Section 2.03 ConfidentialityThe committee shall use confidential information only for the purpose of fulfilling its fiduciaryduties, services, or employment obligations to the JATC and will not in any manner, either directlyor indirectly, disclose confidential information to any third party.

Section 2.04 Committee MeetingsThe committee shall meet monthly with the November and December meetings combined into one.The committee will hold two separate meetings on the meeting date, one for the JATC(Apprenticeship and Training Issues) and one for the JATC Trust (Financial). Contact the TrainingOffice for upcoming meeting dates.

Section 2.05 InterviewsThe committee will interview qualified applicants when scheduled. The committee members mayappoint individuals to replace their positon as an interviewer provided the rest of the interviewersdo not disagree on the replacement. This does not mean that a committee member can be replacedto serve as a trustee or JATC member in all other matters.

Section 2.06 Training Directors DutiesThe committee shall delegate to the Training Director the responsibility and authority to run theday to day operations of the Training Office. This includes the scheduling of classes as well aspurchasing materials, curriculum, and office and training supplies.

Section 2.07 Committee TrusteesThe committee members also act as trustees of the training fund. Trustees shall abide by all Federal,State, and Local laws pertaining to use of training funds.

Section 2.08 SuggestionsThe committee welcomes suggestions and constructive criticism from anyone wishing to furtherthe progress of apprentice and journeyman training.

Section 2.09 Committee AppearancesAppointments for appearance before the committee can be made with the committee Chairman orthe Training Director at least 48 hours in advance of a regular scheduled meeting. Apprentices maybe called to appear before the committee at any time.

Article IV. General Rules (Journeyman and Apprentices)

Section 4.01 ApplicationThe rules in Article IV apply to all students attending JATC sponsored training events held at theTraining Center or any other training facility that has been contracted to train the participants.Violations may result in denial of admittance to future training events.

Section 4.02 Host Facility RulesAll rules and regulations of the host training facility must be followed.

Section 4.03 Under the Influence of SubstanceStudents are not permitted to be under the influence of drugs or alcohol while attending a JATCsponsored training session.

Section 4.04 Substance UseStudents are not permitted to consume, use, or sell alcohol or illegal substances on training facilityproperties.

Section 4.05 RespectStudents shall be respectful to instructors and students in training sessions.

Section 4.06 AbusePhysical and verbal abuse toward anyone at the host facility is not permitted.

Section 4.07 SafetyStudents must follow all safety procedures while training including wearing appropriate workclothes and shoes as well as wearing safety equipment when required. All students performinghands on training are required to wear work clothes and safety glasses.

Section 4.08 Failure to Show for Registered ClassParticipants that register for a class and fail to show may be banned from registering for futureclasses. Should a participant register for a class then discover they are unable to attend, forwhatever reason, they must notify the Training Office prior to the day of the class.

Section 4.09 Destruction of PropertyDestruction of supplies, tools, equipment, curriculum, or facilities is not permitted.

Section 4.10 TheftTheft of supplies, tools, equipment, or curriculum is not permitted.

Section 4.11 LitteringLittering is not permitted inside or outside of training facilities. This includes cigarette butts.

Section 4.12 Related Training ReimbursementThe JATC encourages additional related training courses for Apprentices and Journeymen. Toreceive reimbursement for the cost of a course not being offered by the JATC you must submit a“Request for Reimbursement” form along with a course description for consideration. Afterapproval of the course submitted, you must submit verification of successful completion along withreceipts for your reimbursement to be issued.

Article V. Apprentice General Rules and Responsibilities

Section 5.01 ApplicationFailure to comply with all rules and regulations could result in probation, penalties, or terminationfrom the apprenticeship program. Take the time to read all Rules and Regulations carefully. Youare obliged to comply with these Rules and Regulations at all times.

Section 5.03 Questions or ConcernsAll requests or questions concerning your apprenticeship should be directed to the attention of theTraining Director. Should the problem require additional consideration, it will be forwarded to theJATC at their next regularly scheduled meeting.

Section 5.04 JATC MeetingsThe Joint Apprenticeship and Training Committee typically meets on the fourth Thursday of everymonth with the exception of November and Decembers combined meeting held in early December.

Section 5.05 JATC Appearance RequestIf you wish to speak with the JATC about your apprenticeship, you should request to do so inwriting at least one (1) week prior to the meeting.

Section 5.06 JATC Required AppearanceIf you, as an apprentice, are required to appear or request an appearance before the JATC, you arerequired to call the Training Office, one-day prior to the meeting to verify a scheduled appointment.

Section 5.07 JATC Failure to AppearFailure to appear before the Committee when required may result in disciplinary action asdetermined by the Committee.

Section 5.08 Harassment PolicyThe J.A.T.C. has adopted a Policy Against Sexual Harassment. The purpose of this document is toprotect the Apprentice from, as well as to warn the Apprentice from participating in unwelcomesexual advances, requests for sexual favors and other verbal and/or physical conduct of a sexualnature which has created or can create a hostile and/or abusive work environment. For specificinformation see “Article XIII Apprentice Harassment Policy”.

Section 5.09 College CreditThe apprenticeship program has been evaluated by the American Council on Education (ACE).Upon completion of your Apprenticeship, you may apply to ACE for a transcript of your credits.Contact the Training Office for more information.

Section 5.10 Apprenticeship Assistance ProcedureShould you have a problem that requires additional assistance relative to your apprenticeship, or ifyou have a problem regarding another matter that you feel is being handled improperly relative toyour apprenticeship, the following is the order you must follow to remedy the situation. If, after areasonable amount of time, you have not been successful through the first step, then proceed to thesecond step and so forth.

a) Contact the Training Director.b) Request to speak to the JATC in writing.c) Contact the State Apprenticeship Registration Agency.

Section 5.11 Apprentice License RequirementApprentices are required to obtain and maintain an active “Delaware Professional Regulation Boardof Electrical Examiners” Electrical, Journeyman, or Apprentice license. If the license is madeinactive the apprentice is required to notify the Training Office immediately.

Section 5.12 Apprentice Personal Hygiene and AppearanceApprentices are required to present themselves in a professional manner, with regard to attire,personal hygiene, and appearance while attending related instruction or during On-the-Job-Training. Apprentices must exercise sound judgment and common sense for his or her attire at alltimes.

Section 5.13 Electrical Worker Medical RequirementsElectrical work is a demanding occupation that requires good sensory abilities, dexterity,endurance, strength, balance and agility. As a condition of training assignments the JATC needs tomake sure that you are able to safely performance the essential tasks and functions of an electricalworker.

a) New apprentices to the program must be cleared by the JATC medical evaluator to performthe essential tasks and functions of an electrical worker, without restrictions, prior to initialjob referral.

b) Active apprentices must be able to safely performance the essential tasks and functions ofan electrical worker, without restrictions, for future job referral.

c) Apprentices that are on medical leave from the program must be able to safely performancethe essential tasks and functions of an electrical worker, without restrictions, prior tobecoming eligible for job referral.

d) While referred to an employer the apprentice may work with medical restrictions at theemployer’s discretion.

e) The JATC reserves the right to require the apprentice to obtain clearance from the JATCmedical evaluator should the apprentices’ medical providers “return to work evaluation”come in to question.

f) The JATC reserves the right to require the apprentice to obtain clearance from the JATCmedical evaluator should the JATC have concerns regarding the ability of the apprenticeto safely performance the essential tasks and functions of an electrical worker, withoutrestrictions.

Section 5.14 Veterans BenefitsThe apprenticeship program is approved as a training provider by the Veterans Administration. Ifas an apprentice, you are entitled to veterans benefits you must contact the Training Director inorder to file for your benefits.

Section 5.15 Americans with Disabilities Act (ADA)In order to fulfill any obligations that it may have under the Americans With Disabilities Act andin order to help protect the JATC apprentices against violations of that law by others, the Committeehas concluded that it should adopt a procedure that will enable it to identify and, thereby, hopefullyavoid, or assist in correcting, any problems that may arise due to an apprentice either having aphysical and/or mental disability that may prevent him/her from performing all of the essentialfunctions of an electrical apprentice. The JATC’s goals can be achieved only if apprentices complywith this procedure by providing the JATC with information that it would otherwise lack. As therules set forth indicate, information provided to the Committee will be treated in a confidentialmanner as protected by State and Federal law.

a) Any apprentice who believes that he/she has a physical and/or mental disability thatprevents him/her from performing any of the essential functions of an electrical apprenticewithout reasonable accommodation, and who is requesting an accommodation with regardto any aspect of the apprenticeship program (classroom, on-the-job, etc.), shall inform theJATC immediately in writing as to (1) the nature and extent of the disability, (2) theessential functions that the apprentice is unable to perform without reasonableaccommodation, and (3) the reasonable accommodation that the apprentice believes isnecessary so that he/she can perform those functions.

b) Any apprentice who believes that his/her status as an apprentice, classroom training, and/oremployment opportunities have been adversely affected in any way (includingdiscrimination and/or harassment) because of an actual or perceived physical and/or mentaldisability that he/she has, shall inform the JATC immediately in writing as to (1) the natureand extent of the disability or perceived disability and (2) how he/she has been adverselyaffected.

c) All issues and requests regarding disability will be considered and investigated promptlyby the Committee in consultation with the apprentice. In some cases, the process ofconsideration and investigation may require the Apprentice to provide additional medicalinformation and/or to submit to a medical examination. (See paragraph 4 below). In othercases, the process may involve consultation by the Committee with the Apprentice'semployer(s). The Committee, at the conclusion of the process, will give the Apprentice awritten response.

d) In order to assist the JATC in identifying the precise limitations resulting from anydisability that the Apprentice may have, and any potential reasonable accommodation thatmight overcome those limitations, the JATC may require an apprentice who has notified itpursuant to paragraphs 1 or 2 above, to cooperate with the JATC by furnishing it withmedical documentation regarding the disability, and/or by allowing a health care providerselected by the Committee to discuss the disability with apprentice's health careprovider(s), and/or by submitting to a physical and/or mental examination conducted by aqualified person selected by the JATC.

Article VI Apprentice On the Job TrainingApprentices shall strive to obtain On the Job Training (OJT) in all work processes as detailed inthe Apprenticeship (Registered) Standards. Apprentices receiving training in a limited number ofthe work processes for an excessive amount of time should contact the Training Director to discussthis issue.

Section 6.01 On The Job TrainingAs an Apprentice, you are assigned for on-the-job training with a signatory contractor of IBEWLocal 313 Until such a time as the JATC should decide that a new on-the-job training assignmentis necessary or until such a time as your present contractor must lay you off for lack of work, youare assigned to work for and train under your assigned contractor. It is not an option of theapprentice to terminate his or her on-the-job training assignment with a signatory contractor withoutfirst seeking the approval of the JATC. This request must be made in person at the regularlyscheduled JATC meetings. You must submit your request to appear before the JATC in writing atleast one (1) week prior to their meeting. The request must state that you are requesting to appearbefore the JATC to discuss the termination of your on-the-job training assignment with your presentemployer.

Section 6.02 Termination from Job AssignmentShould you be terminated by your employer you must contact the Training Office within one (1)business day. For reasons other than lack of work, you must appear before the JATC at the nextregularly scheduled JATC meeting before you will be reassigned to a new contractor. You mustcontact the Training Office to verify that you are on the Agenda for that meeting. Failure to contactthe Training Office and or failure to appear at the next regularly scheduled JATC meeting mayresult in your termination from the program.

Section 6.03 Poor Performance, Attendance, AttitudeYour apprenticeship is an ongoing evaluation process. Your evening school grades as well as yourmonthly time sheets are a constant feedback of your performance, attendance, and attitude. Shouldyour records indicate you are not progressing as expected, you will be requested to appear beforethe JATC for review. The JATC will make every effort to assist, offer suggestions and/or providespecific directions to help remedy the problems of the individual. It is the Apprentice'sresponsibility to follow the directions of the JATC and to do what is necessary to improve thesedeficiencies.

Section 6.04 Conduct WarningsAny apprentice conduct that, in the opinion of the JATC, interferes with or adversely affects thebusiness of the contractor to which that Apprentice is assigned for on-the job training or otherwiseinterferes with or adversely affects the progress of training as determined by the Committee for thatindividual or in any way interferes with or adversely affects the progress of any individual orindividuals also participating in the Apprenticeship Training Program will be grounds fordisciplinary action. This action can range from verbal warnings to immediate dismissal from theprogram. Depending on the conduct, it is the general policy of the Committee to take disciplinarysteps in the following order:

Verbal warnings Written warnings Probation Termination

Section 6.05 Monthly Work Report (Time Sheet)Apprentices are required to submit completed monthly work reports at the beginning of the monthfollowing the worked month. You must submit a report whether you are working, unemployed, oron medical leave. Only worked hours may be submitted. The report must be complete, neat, withall areas completed prior to submittal. Incomplete submittals will be returned to the apprentice forcorrection and completion and will not be entered into the apprentice’s record until returned to theTraining Office with all errors and corrections completed. Review detailed instructions listed onthe back of the work report.

Section 6.06 Late Work Report SubmittalsWork reports submitted after the 10th of the month will not be entered as scheduled and will resultin an automatic one (1) month OJT penalty. Work Reports must still be submitted for all monthswhile in the program even if they are submitted late.

Section 6.07 OJT ResponsibilitiesYou are provided On-the-Job Training to learn your trade by assisting the Journeyman on the job-site.

a) When assigned a task, be sure you understand what to do.b) Pay attention to every detail.c) When in doubt, ask questions.d) Anticipate your journeyman's moves and plan ahead.e) On the job, you represent IBEW LU 313 and your employer.

Dress in clean work clothes. Wear appropriate attire. Practice good personal hygiene.

a) Keep yourself busy, pick up loose materials, clean up your work area, etc.b) You must work safely. Construction work is a hazardous occupation. Others are working

over, under and around you. Be alert.

c) Don't watch welder's arc.d) Don't wear rings or other jewelry.e) Practice good housekeeping habits to prevent trips and falls.f) Wear hard hats on all jobs (OSHA Requirement).g) Wear required PPEh) Get in the habit of testing wiring before you touch anything.i) Make sure that the circuits are DE-energized! Use the proper tester for the job.j) When in doubt-ASK!k) Don't play with electricity. Respect it!l) You are on the job to develop good work habits.m) Be on time and be ready to go to work at the starting time.n) You are part of a team. If for any reason, you cannot report to work, notify the employer

regarding your absence or tardiness.o) The IBEW LU313 Agreement defines your starting, quitting, lunch and coffee times, as

well as other conditions of your employment. You are expected to adhere to these timesand work rules as specified. If you should have any questions, see your shop steward orcall the Local Union Office.

p) Excessive absenteeism or lateness will result in your removal from the apprenticeshipprogram.

q) Monthly Work Progress Reports are your responsibility. Follow the Time Sheet (WorkReport) Rules as detailed on the Work Report.

Article VII Apprentice Related Classroom Instruction

Apprentice related classroom instruction classes are scheduled throughout the year during any dayof the week.

Section 7.01 School YearApprentices will be required to attend classes from September 1st through May 31st. All apprenticesare required to attend the annual Wilmington Labor Day Parade. The parade is considered yourfirst day of school.

Section 7.02 AttendanceSchool attendance is mandatory. The apprentice program has been registered with the State ofDelaware for a minimum of one hundred and eighty (180) hours of related instruction.

a) Unexcused absences will not be tolerated. Should the apprentice fail to prove just causeto the committee for his or her absence, the committee may penalize the Apprentice.

b) Should you miss three nights of school, for whatever reason, excused or unexcused, youwill be required to appear before the Committee for disciplinary action that could includeprobation, OJT penalties, repeat of current year, or termination from the program.

c) You will be marked late if you are late to class or return from break after the break periodends. More than 15 minutes late will be treated as an absence, and all rules governingabsences will apply.

d) For any combination of lates or absences totaling four (4), whether excused or unexcused,you will be required to appear before the Committee for disciplinary action that couldinclude probation, OJT penalties, repeat of current year, or termination from the program.

e) Make up hours are required for all absences both excused and unexcused.

Section 7.03 Excused AbsencesConsideration for excused absences will be given with regards to:

a) Death of immediate family member.

b) Birth of dependent children.c) Wedding; Submit to the Committee for possible approval the wedding date and dates you

are requesting to be absent from school. The request must be submitted before the meetingdate preceding the wedding date.

d) Surgery; Submit to the Committee for possible approval the date of surgery and dates thatyou will be absent from school.

e) Illness.

Section 7.04 Written Excuse SubmittalFor all absences you must submit a written letter of excuse to the Committee to explain thecircumstances as to why you were absent from school.

a) Failure to submit an adequate excuse for any absence will require an appearance before thecommittee and possible disciplinary action.

b) The JATC must receive this document within fifteen (15) days of the absence. Failure toprovide this document will result in an automatic one-month penalty to be imposed.

Section 7.05 Failure Attend Classes as Registered for or AssignedApprentices failing to show for classes or events for which they are assigned, or they register for,will be required to serve three (3) penalty hours of make-up time.

Section 7.06 HomeworkIn order to enhance the effectiveness of the classroom learning experience, the assignment ofhomework will be done on a regular basis.

a) Assigned homework must be completed prior to the start of class.b) Failure to complete homework prior to class will result in your dismissal from class and

require an appearance before the Committee. This will also count as an absence for theclass.

c) Apprentices must complete all homework for their school year.d) Apprentices utilizing the LMS system are required to complete each homework quiz with

a 75% score or better. Failure to obtain a 75% score on the first attempt will require asecond attempt. Failure to obtain a 75% score on the second attempt will require a thirdattempt.

e) Apprentices that repeatedly have second and third attempts on quizzes will be required toappear before Committee for disciplinary action that could include probation, OJTpenalties, repeat of current year, or termination from the program.

f) Apprentices that fail to spend sufficient time (log in time) completing homeworkassignments will be required to appear before the Committee for possible disciplinaryaction.

g) It is your responsibility to find out the homework assignments in your absence and to haveit completed for the next class.

Section 7.07 Grade Point Average RequirementsAll instructors are more than willing to spend whatever time is necessary to help you through anydifficult assignments or lessons on a one to one basis. It is your responsibility to make this happen.Contact your instructor any time you need help. Should you require addition help contact theTraining Director.

a) First year and probationary apprentices who are not maintaining a 70% average after taking50% of the school year tests, may, at the discretion of the Committee, be dropped from theprogram.

b) All apprentices who are not maintaining a 75% average after taking 50% of the school yeartests will be required to appear before the Committee for disciplinary action that couldinclude probation, OJT penalties, repeat of current year, or termination from the program.

c) First year and probationary apprentices who finish the school year with a final averagebelow 75%, may, at the discretion of the Committee, be dropped from the program.

d) All apprentices who finish the school year with a final average below 75% will be requiredto appear before the Committee for disciplinary action that could include probation, OJTpenalties, repeat of current year, or termination from the program.

e) Apprentices must obtain a final GPA of 75% or greater to pass their current school year.f) Any Apprentice whose average falls below the acceptable level of 75% will have their

wages frozen until their GPA rises above 75%.

Section 7.08 Test Score/Course Credit RequirementsApprentices must complete the required related class instruction as determined by the JATC foreach year of the apprenticeship. This section applies to course credit requirements, all other GPArequirements as outlined in the Rules and Regulations still apply.

a) Apprentices must obtain a score of 70% on each course test in order to receive the assignedcredits for that course.

b) The test grade from the first attempt will become the official grade for that course and usedto calculate the grade point average.

c) Any course test resulting in a grade below 70% must be retaken. Apprentices must obtaina passing score of 70% or higher to receive the credits assigned to that course.

d) Test re-takes must be scheduled by the apprentice for a time outside of the regularclassroom hours. Apprentices must contact the Training Office to schedule re-takes duringnormal Training Office hours.

e) Apprentices must achieve a passing score within two months of the original test date.f) Apprentices will be given three chances to retake the failed section test within the two-

month time period.g) Any Apprentice unable to obtain a passing score after three retakes will fail the school year.h) Total credits for all core courses as well as required applications and advanced training

sections selected by the JATC must be obtained to advance to the next year ofapprenticeship.

Section 7.09 Electronic Device Requirements, Restrictions, and UseThe following section applies to all electronic devices including laptops, phones, tablets, calculatorsetc.

a) Apprentices are required to obtain, maintain, and bring to class a tablet or laptop that meetsthe Learning Management System (LMS) computing requirements. These devices will berequired throughout the apprenticeship.

b) Apprentices are not permitted to have any type of electronic device out when taking a testor reviewing a test. JATC issued calculators are excluded.

c) Apprentices that copy, scan, photograph, receive, or distribute test or instructor documentswill be referred to the LU 313 JATC for disciplinary action and most likely will beterminated from the program. Apprentices will also be reported to the National JointApprenticeship Committee.

d) The Training Center and Delcastle High School have Wi-Fi access. Apprentices are notpermitted to download or upload any illegal or inappropriate data over these networks.

e) Excessive use of phones in the classroom or at work is not permitted.

Section 7.10 CurriculumThe J.A.T.C. will furnish schoolbooks for all Apprentices.

a) Lost or damaged books will be replaced promptly by the apprentice at the expense of theApprentice. Failure to complete a homework assignment due to lost or damaged JATCprovided books or training materials is not an acceptable excuse for not having a homeworkassignment completed. Missing homework will be handled as detailed in section 7.06.

b) Any Apprentice who quits their Apprenticeship or who is dropped from the ApprenticeshipProgram, will be required to return school books to the J.A.T.C. and pay for any books thatare not reusable.

Section 7.11 OSHA, Built-rite, First-aid, and Basic Life SupportApprentices are required to obtain and maintain OSHA 10 Hour Construction, Built-rite, First-aid,and Basic Life Support.

a) First Year and new apprentices are required to obtain the JATC OSHA 10 Hour or greatercertification within their first year in the program.

b) First Year and new apprentices are required to obtain the JATC Built-rite (PSM)certification within their first year in the program.

c) All apprentices are required to obtain the JATC First-aid and Basic Life Support or greatercertifications within their first year in the program.

d) All apprentices are required to maintain the JATC First-aid and Basic Life Support orgreater certifications while in the program.

Section 7.11 Mathematics Curriculum and Testa) First Year Apprentices are required to complete the mathematics workbook prior to the

date provided when the curriculum is distributed.b) First Year Apprentices must pass the mathematics proficiency test with a score of 75% or

greater. Failure to obtain a passing score may result in additional education requirementsas determined by the Committee.

Section 7.12 School ClosingsThe JATC will follow the NCCVT AED decision on when to cancel classes due to weather. Thisdecision applies to all training campuses where classes are scheduled. The closing information willbe announced on various radio and news stations. You may also call the NCCVT weather hotlineat 302-683-3653.

Article VIII Apprentice Tool Requirements

An apprentice is expected to have a full tool kit as listed in the applicable Collective BargainingAgreement under which the apprentice is working.

a) Apprentices are required to have their required full tool kit with them during all workassignments.

Article IX Apprentice Advancement

To successfully complete the training program, each Apprentice will be required to complete 8,000hours on on-the-job training, satisfactory complete all of the assigned related class instruction, andpass the journeyman’s exam in their final year. Upon successful completion apprentices willreceive training certificates from; NCCVT, DE DOL, and the NJATC as well as be invited to theannual graduation banquet.

Section 9.01 Apprenticeship Progression RequirementsThe apprenticeship program currently has ten (10) wage progression periods. The criteria for eachprogression is detailed below. In order to advance to the next pay period both the hour andacademic requirements must be met. Hours must be proven by Work Report and/or paystubsubmittals. The year GPA requirement is obtained after taking the first test of the apprenticeshipschool year.

Section 9.02 Apprenticeship Wages and BenefitsWages and benefits are covered under the Local Union 313 IBEW Agreement (CBA). TheJourneyman’s Base Rate is determined by the CBA.

Section 9.02 Local Union MembershipThe probationary period for all new Apprentices who have entered into the J.A.T.C. ApprenticeshipProgram is two thousand (2000) hours. After this two thousand (2000) hour period, you will beconsidered for membership into Local Union #313, IBEW.

Section 9.02 Credit Union MembershipAfter you have been indentured into Local Union #313, IBEW, you will be eligible to become amember of the Credit Union, pursuant to the rules and regulations Federal Credit Union. The CreditUnion phone number is: (302) 322-5086.

Article X Apprentice Withdrawal/Leave of Absence

Apprentices may request a program leave of absence or withdrawal by submitting a written requestto the JATC.

Section 10.01 Apprentice Leave of AbsenceApprentices must submit a request for a program leave of absence in writing. After receiving arequest for a leave of absence the JATC will decide whether a leave of absence shall be grantedbased on personal or medical reasons at the committee’s discretion.

Article XI Apprentice Disciplinary Actions

All apprentices in their first 2000 hours of OJT are considered probationary. Any violations of theRules, Regulations, or Policies of the JATC may result in disciplinary action.

Section 11.01 Disciplinary ActionsThe Committee may consider the following with regards to disciplinary action:

a) The seriousness of the Apprentice's conductb) The Apprentice's overall recordc) The ability of the Apprentice to correct the conductd) Actions that the Committee has taken for similar conduct for other Apprenticese) How the action of the Apprentice affects the employer's customers and other circumstances

related to employer's business.f) If the apprentice is on Probationg) The number of offenses, severity, and frequency disciplinary action has been

implemented or considered. (commonly referred to as the three strike policy)

Section 11.02 Immediate Apprenticeship TerminationThe following is a partial list of types of conduct that may result in immediate dismissal from theprogram. These are examples, whether on the job, on JATC property, or at a JATC sponsoredtraining function:

a) Theft of employer or JATC property.b) Excessive tardiness or absenteeism.c) Arguing with or fighting with customers, co-workers or contractor representatives.d) Making false statements on an Apprenticeship application.e) Violating any of the Rules and/or Regulations contained within this document or binder.f) Unlawful discrimination or harassment.g) Poor job performance.h) Poor related study gradesi) Refusal to follow instructions.j) Insubordination.k) Abusing Sick Time.l) Possession of a weapon while on a job site, on contractor company property, in a company

vehicle, or on any property being used by the JATC for training purposesm) Intentionally endangering the safety and/or health of co-workers, classmates, or customers

of the contractor.n) Engaging in criminal activity while on the job or while participating in a JATC training

exercise, meeting or function.o) Behaving violently.p) Areas covered under the Substance Abuse Policy.q) Disclosure of employer's client's trade secrets.

These are only examples. As you may terminate your agreement with the JATC at any time, theJATC reserves the same right. The Committee reserves the right to terminate your apprenticeshipfor reasons not stated in this handbook or for no reason at all.

Article XII Apprentice Scholarship Loan Agreement

Section 12.01 Apprentice Scholarship Loan AgreementThe J.A.T.C. has adopted the Apprentice Scholarship Loan Agreement. The purpose of thisdocument is so the JATC may recoup money spent training the apprentice should the apprenticeleave the program for whatever reason.

Article XIII Apprentice Harassment Policy

Section 13.01 Apprentice Harassment PolicyThe J.A.T.C. has adopted a Policy Against Sexual Harassment. The purpose of this document is toprotect the Apprentice from, as well as to warn the Apprentice from participating in unwelcomesexual advances, requests for sexual favors and other verbal and/or physical conduct of a sexualnature which has created or can create a hostile and/or abusive work environment. A copy of thatpolicy has been provided in this binder. You must review this Policy and abide by the guidelinesand procedures as set forth within this Policy. Failure to comply with the guidelines and proceduresas detailed in the Policy Against Sexual Harassment may result in your termination from theprogram. Should you have questions or a problem relative to sexual harassment, relative to anyaspect of your apprenticeship experience, you should contact the Training Director for assistance.Should the Training Director be unavailable you should contact the Business Manager of Local 313for assistance? All matters relative to this issue will be kept confidential and are privileged underState and Federal Privacy Laws.

Article XIV Apprentice Substance Abuse Policy

Section 14.01 Substance Abuse PolicyThe JATC has adopted a Substance Abuse Policy. All Apprentices are required to sign and abideby this policy. The policy dictates all conditions and procedures relative to substance abuse.

Article XV Appeals Procedures

Section 15.01 ApplicationThis appeal procedure applies to any controversy or difference arising with respect toapprenticeship training (including discipline) or an apprenticeship agreement or application exceptfor:

a) Matters which cannot be adjusted locally.b) Matters covered by a collective bargaining agreement or its grievance and arbitration

procedures.c) Any complaint concerning discrimination or other equal opportunity matters. All

complaints concerning discrimination or other equal opportunity matters shall besubmitted, processed and resolved in accordance with applicable provisions in 29 CFR Part30, as amended, or applicable provisions of a state plan for Equal Employment opportunityin Apprenticeship adopted pursuant to 29 CFR Part 30 and approved by the U.S.Department of Labor.

Section 15.02 Appeals ProcedureUsed when an Apprentice is in question of Statement of Policy or a decision given from theStatement of Policy.

a) The apprentice may appeal to the JATC in writing within thirty (30) days, any opinion ordecision made.

b) An apprentice may seek review of a final decision of the JATC under this appeal procedureby filing a complaint with the Apprenticeship and Training Section of the DelawareDepartment of Labor or other appropriate registration authority, federal or state, which hasregistered or approved the program in which the apprentice is enrolled.

c) An apprentice may request a hearing in connection with an appeal and shall appear inperson before the JATC upon written notice. The JATC has no obligation to hold ahearing but may deny an appeal for failure to appear at a hearing
