I n view of the provisions of section 9 sub section (3) of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015 (Mah. Act No. XXVIII of 2015) which came into force on the 1 2 ~ May, 2015, the Pravesh Niyantran Samiti existing as on the date of commencement of the Act shall continue to exercise the powers of the Admissions Regulating Authority till such Authority is duly constituted under the Act.

Minutes of the Meeting of the Admissions Regulating Authority held on Tuesday, the 3oth August, 2016 in the Conference Hall, Office of the Directorate of Medical Education and Research, IYumbai - 400 001 are approved and confirmed, subject to following modifications/corrections.

In case d vacancies aRer the Bast "Common Admisicsn Process" cowduaed by the Commissioner, State CET-CELL, M.S. for NER-CET-2016 candidates, the following Schedule is to be strictly followed for admission process sf first year M.B.B.S. and B.D.S. Courses in Unaided Private Colleges, for the Academic Year 2016-17:-

Individual M.B.B.S. and B.D.S. College to start the process of granting provisional admission(s) against vacant seats after last 'CAP" round strictly in accordaiice with inter-se merit of NEFT-UG-2016 only to be drawn from amongst the students applying to each College directly. Accordingly individual college to report category wise vacancy position to the State CFT Cell, Admissions Regulating ~uthority, DPlER & MUHS. Note :

ii) As per the preference brochure of NEET-UG-2016, Rule no. 9 published by the Commissioner, State CET-CELL, MS., it is mandatory on the students to submit self attested copies of all relevant documents keeping themselves with original certifi cates/documents or its copies, duly attested by the Gazetted Officer.

iii) All concerned Colleges/Institutes must give proper acknowledgement to the students/parents who are submitting their applications of admissions for Academic Year 2016-17.

iv) After 28th and 2gth September, 2016, if any vacancy arises then the College/Institute should publish the same on the notice board and website of College/Institute, and the College/Institute should immediately inform by e-mail to the State CET-CELL, MS., Directorate of Medical Education and Research, Mumbai and Maharashtra University of Health Sciences, Nashik without fail. Accordingly the State CET-CELL, Directorate of Medical Education and Research, Mumbai and Maharashtra University of Health Sciences, Nashik should publish the vacancy positions on their website immediately on the same day i.e. on 2gth September, 2016. The respective College/Institute should consider the next meritorious candidate of the waiting list which was prepared and displayed on 28th September, 2016.

vi) If in any case, any candidate who has secured his/her admission of lSt year M.B.B.S. or B.D.S. coume in unaided private College for the Academic Year 2616-17 and weeds to cancel his/her admission, then he has to cancel it on or before 2gth September, 2016 by 1500 hrs.

The Authority further directs the Colleges/Institutes to submit the admissions details online and also submit the following adn-~issions details in duplicate to the Authority on or before sth October, 2016 (within office hrs) :-

a) Category wise vacancy position after last round of NEET-UG-2016 - (Annexure - AA).

b) Copies of advertisements - (Annexure - BB).

c) Merit list prepared by concerned College - (Annexure - C i . d) List of provisional admissions granted against the vacant seats -

(Annmure - DD).

e) List of candidates selected through CAP round (Annexure - EE).

f) Names of students in Merit list but not selected - (Annexure - F .

g) Refusal letters from meritorious candidates, if refused to take admissions. (Annexure - GG).

h) Any other information which could be important to assess the transparency of the system - (Annmure - 13 . .

The Authority further directs the concerned Colleges to follow above directions strictly. The admission arocess of the Private unaided MBBS 8r BDS Colleges/Institutes is likelv to be disaa~roved bv the Authoritv for the Academic Year 2016-17, for those failina to submit their admission details to the Authoritv, within the arescribed time limit. The Authority perused the decision taken by it in its meeting held on 1 3 ~ ~ July 2016 which is as under-

In consonance with the above provisions and looking at the considerable number of Institutes/Col/eges and courses under it3 purview, the time scbedu/e and requirement of &st and eicient process to -orut?n12e and approve each such proposab I-he Authority is of view to adopt on/ine process for submission and verificae-ion of such proposals and approval to the students of these professional courses, for the Academic Year 2016-17 and onwards. Depa~ment of AYUSH sbted that they have followed the decision sf the Authorily in i ts meeting held on 1 3 ~ July, 2016 in respect of verification and approval of admission process d various professional caurses for the Academic Year 2816-17.

In view of the above, after deliberations, the Authority directs that all concerned Directorates should follow the directions of the Authority given in its meeting held on 1 3 ~ July, 2016 in respect of the verification and approval of admission process of various professional course for the Academic Year 2816-17.

The Authority further directs to all Private professional Colleges/Institutes as follows :-

1. Every Unaided College/Institute shall submit the admission approval proposals to the concerned Directorate within fifteen days from the cut off date of admission.

2. After verification by the concerned Directorate, the College/Institute should submit immediately such proposals to Admissions Regulating Authority for Approval latest by 3oth November, 2816.

3. The College/Institute should subniit its proposal within the given time frame. Authority may charge the College/Institute processing fees as well as late fees, if there is delay in submission of the proposal.

Office to take necessary steps and inform the all concerned accordingly.

A) Medical Education

Item No. 4: To discuss and decide in respect of the decision taken bv the Authoritv in its meetina held on 3oth Auaust, 2016 [at Item No. 4 and 5 rectardina non submission of sanction letter of loan approval of the Bank.).

The Authority went through the decisions taken by it in its meetings held on i) 6th May 2016, ii) 8th June 2016, iii) 1 3 ~ July 2016, iv) 27th July 2016, v) 1 2 ~ August 2016 and vi) 3oth August 2016.

The Authority observes that the Institute of Medical Sciences and Research, Satara has failed to submit the clear and final sanction letter of loan approval of the bank to the Authority, even after the additional one week time given after 3oth August, 2016.

I n view of the above, after deliberations, the Authority decides that the decisions taken by the Authority regarding the provisional approval w.r.t. the students admitted in Institute of Medical Sciences and Research, Satara for First Year MBBS course hereinbefore for the Academic Year 2014-15 stands cancelled. Office to inform accordingly.

The &cmbry, Admissions Regulating Authority, Mumbai submitted that a) Shree Chhatrapati Shivaji Education Society's Institute of Medical Sciences and Research, Mayani, Satara and b) Shaswat Rathore filed Writ Petition No. 24493 of 2016 and 25322 of 2016, respectively in Honble High court Bombay. Shree Chhatrapati Shivaji Education Society, Satara filed the petition against Admissions Regulating Authority to reduce the penalty aniount imposed by the Authority in its meeting held on 6h May, 2016 (at Item No. 3), whereas Shri. Shaswat Rathore filed the petition for approval of their admissions and for declaration of results of Ia Year M.B.B.S. The Authority observes that the aforesaid College has opted for the admission process conducted by Association of Management of Unaided Private Medical and Dental Colleges of Maharashtra on the basis of results of APGD-CET-2015 for admissions to Post Graduate MDS course for the Academic Year 2015-16. But the College/Institute has admitted 1. Dr. Kulkarni Anuja Sanjay, 2. Dr. Sheth Darsh Haren through PGD-CET-2015 for Academic Year 2015-16.

I n view of the above, after deliberations, the Authority directs the aforesaid College/Institute to submit sufficient evidence regarding no qualified students as per APGD-CET-2015 and the list of qualified students through APGD-CET-2015 has been exhausted fully for Academic Year 2015-16 for Post Graduate Dental courses, duly certified by the Competent Authority, Association of Management of Unaided Private Medical & Dental Colleges of Maharashtra along with affidavit explaining therein following points:-

a) That the list of candidates qualified from the APGD-CET-2015 had exhausted, and therefore, College/Institute admitted the candidates from another CET by following set procedure.

b) Sufficient advertisements for filling in vacant seats were also given in leading newspapers and was published on website as well as notice board too.

c) That no nieritorious candidates of APGD-CET-2015 were denied admissions.

The Authority went through the decision taken by it in its meeting held on 2Yd July, 2816 along with verification report dated 9~ June, 2016 submitted by the Directorate of Medical Education and Research, Mumbai.

It is noticed that the Expert Committee i.e. the Directorate of Medical Education and Research, Mumbai in its report dated 9/06/2816 stated that the aforesaid College/Institute selected one candidate (SML: 1081 Wankhede Sonal: Category SC), it is shown in the selection list of Terna Dental College, Navi Murrlbai against SC seat.

The aforesaid college vide its letter under reference stated that Miss. Sonal Wankhede was selected on 24-09-2016 and on 25-09-2015 the said Miss. Wankhede cancelled her admission vide her letter dated 25-09-2015 and the said vacant seat was filled by Miss. Devyani Kishor Shegokar on 30-09-2015 for Academic Year 2015-16 and further requested to grant approval of the admission of Miss. Devyani Kishor Shegokar (SC) for the Acaderr~ic Year 2815-16.

In view of the above, after deliberations, the Authority accedes to the request made by the aforesaid College/Institute and approve the admission of Miss. Devyani Kishor Shegokar in First Year MBBS course for the Academic Year 2015-16, subject to fulfillment of the eligibility norms laid down by the concerned Authorities. Office to inform accordingly.

The Authority perused the aforesaid letter received from the Maharashtra University of Health Sciences, Nashik regarding registration and eligibility of students admitted in 15% NRI Quota for the Academic Year 2012-13, 2013-14, 2014-15 and 2015-16.

It is noticed that various admissions of admitted students in 15% NRI Quota in Academic Year 2012-13, 2013-14, 2014-15 and 2015-16 was pending for approval and due to non approval of such admissions, result are withheld by the Maharashtra UI-~iversity of Health Sciences, Nashik.

The Secretary, Admissions Regulating Authority submitted that various Colleges/Institutes have not complied with the requisite documents regarding NRI Quota admissions and therefore have not been approved by the Authority. The Secretary further added that due to shortage of manpower, the proposals are pending for scrutiny and verification.

The Asst. Registrar, Maharashtra University of Health Sciences, Nashik who attended the meeting on behalf of the Registrar, Maharashtra University of Health Sciences, Nashik, pointed out that the result of NRI students appeared for Summer- 2016 Medical Examination has not been declared so far and the dates of submission of forms for Supplementary Examination to the Colleges and University are 17-09-2016 and 22-09-2016, respectively, and further requested that the result of the students, failed in

The Authority went through the decision taken by it in its meeting held on 3oth August, 2016 at Item No. 12.

It is pointed out that as per the clause 1 para No. 3 of All India Council for Technical Education (AICTE) 'Approval Process Handbook 2016-2017' €3. Architecture education was also placed under the purview of AICTE. As per the Hon'ble Supreme Court Judgment in Civil Appeal No. 9048 of 2012 and Writ Petition No. (Civil) No. 538 of 2014, the cut-off-date for admissions is 1 5 ~ August. The Cut-Off date which CET Cell has declared in its Admission Notice is 1 4 ~ ~ August 2016 (As 1 5 ~ ~ August is a National Holiday), as per AICE guidelines and the Supreme Court Judgment.

The Authority perused the report dated 7th September, 2016 received from The Directorate of Technical Education, Mumbai regarding transfer of candidates (Course/Institutions) in Unaided Private Professional Diploma Technical Courses for the Academic Year 2016-17.

The Authority went through the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions to the Full Time Professional Diploma Technical Courses) Rules, 2016, 16(2).

As per the provisions of Rule, 16(2) the Principals of the Professional Diploma Technical Institutes submitted the applications of transfer of students with their recommendations to office of the Admissions Regulating Authority. These Applications were forwarded to the Director, Technical Education M.S., Mumbai for verification and observations.

The Authority in its previous meeting held on 27' July, 2016 had err~powered the Secretary, Admissions Regulating Authority to approve the transfer of candidates (Course/institutes). The Director, Technical Education submitted its report on 7' September, 2016. As per the observation report, with office note dated 17' September, 2016, the Secretary, Admission Regulating Authority approved the same.

After deliberations, the decision of approval of the transfer of Candidates (Course/Institutions) in Unaided Private Professional Diploma Technical Courses with no discrepancies for Academic Year 2016-17 is ratified, subject to compliance of the Rules, Regulations, Terms and Conditions laid down earlier by the Government of Maharashtra and the Directorate of Technical Education, Mumbai. However, the request can not be consider at this stage for want of additional data from Director, Technical of Education, Mumbai.

The Authority perused the aforesaid letter received from Brahmdevdada Mane Institute of Technology, Solapur requesting to approve the admission of OBC candidate viz. - Vibhute Mahanteshwar Shreeshail admitted in Open quota for MBA course in Academic Year 2016-17.

The aforesaid college in its letter stated that at the time of registration for admission process for MBA course the candidate viz. - Ku. Vibhute Mahateshwar Shreeshail applied in open category, however in after the B.Sc. degree result he did not secure requisite marks i.e. he got less than 50%. Hence college requested to consider his admission in OBC category, instead of open category.

I n view of the above, after deliberations, the Authority comes to the conclusion that the request made by the aforesaid College/Institute to approve the admission of Ku. Vibhute Mahateshwar Shreeshail in OBC category cannot be acceded to. Office to inform accordingly.

The Commissioner, State CE-CELL, Mumbai submitted that as per the admission rule No. 9(1-h) for UGIPG and 8(1-h) for Diploma, the candidate (of General, VJ/DT, NT, SBC/OBC Category), who is offered seat as per allotment of the CAP round, was required to report to Admission Rep~rting Center (ARC) and pay b. 58881- (Rs. 30801- for Diploma) as 'Admission Acceptance Fee' as applicable while the candidate belonging to SCIST category was required to pay b. 10001- as Seat Acceptance Fee by Demand Draft (DD).

All the candidates who have reported at ARC were also required to report to the allotted institute during the period as indicated in respective published admission schedule and confirm the admission as per admission rule 8(4) for Diplonia and 9(4) for Under Graduate and Post Graduate Admissions before cut-off date.

After deducting the processing charges of b. 1000/-, the State CET Cell is required to transfer the remaining amount to respective institute as part of fees. But many students have completed ARC reporting but did not report to the allotted institute due to various reasons such as 'not interested in taking admission in allotted institute etc".

The State CE-CELL is in receipt of applications from number of candidates requesting refl~nd of Rs. 50001- , as they have not reported to the institute and have not confirmed the admissions.

Therefore, the Commissioner, State CET-CELL proposed the Authority to return the balance amount after deducting Rs. 10001- as processing charges and any other charges required for refund of the amount (such as Bank Commission, RTGS charges

I etc. as actual) from the DD amount after actual reflection of such amount in the account of the State CET-CELL, to such candidates who approach to the office of the State CET- CELL.

In view of the above, after deliberations, the Authority approved the request made by the Commissioner, State CET-CELL. Office of the Commissioner, State CET- CELL to take necessary steps.

Precess' of NEm-UG-Gn-2016 was already over and State Cn-CELL has not oobbined the preferences from desirous candidates for the said College and now it's not possible to take fresh preferences for the said college/Inst%&e from the candidates.

In view of the above, after deliberations, the Authority decides request made by the aforesaid Coilege/Institute to include the College/Institute (New College) in "Common Admission Process" for the Academic Year 2016-17 cannot be acceded to. Office to inform accordingly.

The Authority perused the aforesaid letter received from Bhausaheb Mulak Ayurved Mahavidyalaya, Nagpur asking for correction in number of eligibility of PG admitted students in Academic Year 2015-16.

The Authority went through the decision taken by the Authority in its meeting held on 8th June, 2016 at Item No. 14(a).

The aforesaid College/Institute in its letter stated that they admitted 19 students through Associate CET and only 04 students through College level CFT for the Post Graduate Ayurved course for the Academic Year 2015-16.

In view of the above, the Authority accede to the request made by college as 19 students admitted through Asso-CFT and 04 students admitted through college level CET. Authority further decides to approve the admissions of 19 students admitted through Association CFT for the Post Graduate Ayurved course for the Academic Year 2015-16, subject to fulfillment of eligibility criteria laid down by the respective Authorities. Office to inform accordingly.

The Admissions Regulating Authority perused the observation report w.r.t. MBBS (03 Colleges), BDS (01 College), B.Sc. Nursing (16 Colleges) and B.P. Th. (08 College) submitted by the Directorate of Medical Education and Research, Mumbai having found no discrepancies in admission process of these Under Graduate Courses for the Academic Year 2015-16.

The Admissions Regulating Authority, after deliberations decides to approve the collegewise admissions for Academic Year 2015-16, where the Directorate of Medical Education and Research, Mumbai found no discrepancy. The report of Directorate of Medical Education and Research, Mumbai is marked herewith as Annexure-F.

It is noticed that Directorate in its verification report dated 21/09/2016 pointed out that various B.Sc. Nursing Colleges/Institutes, admitted students from both the lists i.e. MH-CET-2015, Asso-CET-2015 and also admitted Non-CET students during the admission process.

The Authority perused the Government Resolution No. yd$% ? 0 ??/ST .3. (TT/ ??/hWJT - 7, dated 2gth April 2015, in this regard.

After, deliberations, the Authority decides to approve admissions of B.Sc. Nursing course as per the provisions of Government Resolution dated 29/04/2015 which is effective for Academic Year 2015-16 and on the basis of verification and observation report of Directorate of Medical Education & Research, Mumbai (in which the admissions have been approved). However the Directorate should sort out and dispose off with the discrepancies after appropriate compliances within two weeks from respective College/Institute.

Item No. 16lal: Letter dated Seotember, 2016 received from Director, Technical Education, Mum bai askina for confirmation of admission of allotted students but not vet re~orted to allotted colleae for Direct Second Year of Diploma Enaineerina course in Academic Year 2016-17.

However, the request can not be consider at this stage for want of additional data from Director, Technical of Education, Mumbai.

The Director, Technical Education, Mumbai in its aforesaid letter stated that students were allotted seat for First Year and Direct Second Year Diploma Polytechnic course from 'Common Admission Process' to Govt.
