COUNCIL OF MINISTERS REGULATION TOPROVIDE FOR THE ESTABLISHMENT OFTHE ETHIOPIAN STANDARDS AGENCY
This Regulation is issued by the Council of Ministers inaccordance with Article 5 and 34 of the Definition ofPowers and Duties of the Executiv e Organs of the FederalDemocratic Republic of Ethiopia Proclamation No.69112010.
PART ONE
GENERAL
1. Short Title
This Regulation may be cited as the "EthiopianStandard s Agency Establishment Council of MinistersRegulation No. 193/2010 " .
2. Definitions
In this Regulation, unless the context otherwise requires:
11 "quality" means the general characteristics of
products or services which describe the level of
fulfillment of those direct and indirect requirements;
21 "quality promotion" means any activity performed
to improve the productivity and management
system of each stage of product and service through
the required quality objectives and conditions at
optimum resource utilizat ion;

3/ "standard" means a document, developed by Q
recogni zed body on the basis of consensus, that
provides , for common and repeated use, rules,
guidelines or characteristics for products and their
re lated processes or production methods and
includes packaging and labelling requirements ;
4/ "mandatory standard" means standard requirements
that shall be fulfi lied by products and serv ices;
5/ "Ethiopian standard" means any standard approved
and announced by the Agency as a national
Ethiopian standard;
6/ "national standard mark" means a mark given for
the substantiation that a product meets the
requirements of the relevant Ethiopian standard;
7/ "product" means any industrially manufactured or
agricultural product;
8/ "service" means any work done for or to the
benefit of, and at the request of a recipient of
services and normally provided for remuneration ;
9/ "market surveillance means a regulatory activity to
check whether products or services supplied to the
market meet the relevant standard requirements ;
10/ "publicize" means making standards available by
means of printing, electronic, photographic or any
other medium to those concerned bodies;
11/ "conformity assessment" means a process of
assuring that specified standards and legal
requirernents relating to product, service or
management system are compli ed with;
12/ "conform ity assessment body" means a body that
delivers certification, inspection or laboratory
testing service ;
13/ "management system" means a proces s employed
for attaining quality and productivity of an
organization;
14/ ""national qua lity infrastructure" means a system
established for standardization, metrology,
conform ity assessment and accreditation;
15/ "certification" means a process of certifying on the
basis of conformity assessment findings;
16/ " inspection" means examination of a product
design, product, proces s, service or installation and
determination of its conformity with specific
requirements or, on the basis of professional

17/ "laboratory testing" means a test on whether ornot one or more conformity assessmentcharacteristics are in place through the use ofspecified test procedures';
181 "accreditation" means evaluation and
certification of conformity assessment bodies
that they meet predefined competency
requirements;
191 "Ministry" means the Ministry of Science andTeclmology;
201 "State" means any State referred to in Article47(1) of the Constitution of the FederalDemocratic Republic of Ethiopia and includesthe Addis Ababa and Dire Dawa cityadministrations;
21/ "person" means any natural or juridical person;
221 any expression 111 the masculine genderincludes the feminine,

11 The Ethiopian Standards Agency (hereinafter the"Agency") IS hereby established as anautonomous federal government office having- itsown legal personality,

The Agency shall have its head office in Addis Ababaand may have branch offices elsewhere, as may benecessary.

1/ develop, implement and follow upstandardization strategy for the purpose 0 fquality promotion activities which are in linewith the country's developmental programs;
2/ develop, through stakeholders involvement,approve and publicize Ethiopian standards;
3/ recognize any standard published by a national,regional, international or any otherstandardization body" as Ethiopian standard, asmay be relevant;
4/ establish national technical committees for thepurpose of developing Ethiopian standards anddetermine their working guidelines;
5/ determine the shape and content of the nationalstandard mark and authorize its use;
6/ establish national enquiry point and deliverservices on standardization, conformityassessment guidelines and technical regulations;
7/ develop and implement awareness creationstrategies for consumers on quality andstandards;
8/ enable domestic industries to benefit fromtechnology transfers through providing technicalsupport, training and consultancy services in theimplementation of standards;
9/ build the capability of companies throughtechnical support , training and consultancyservices for developing their own companystandards;
10/ promote the use of technologies, in the
industries, which help to reduce polution and
wastage during production process;
11/ work In collaboration with the concernednational and international institutions to ensurethat technical regulations are developed in linewith world trade legal requirements;
12/ undertake stud ies for the estab Iishment ofnational quality award system and administersame upon approval;
13/ represent the country's interest in internationalforums regarding standards and follow up theimplementation of treaties to which Ethiopia is aparty;
14/ work in cooperation with the relevantstakeholders to ensure the existence of anintegrated support for strengthening the nationalquality infrastructure;

7. Organization of the Agency
The Agency shall have:
11 a National Standardization Council (hereinafterthe "Council",
21 a Director General and, as may be necessary, aDeputy Director General to be appointed by thegovernment, and

The Council shall have the powers and duties to:
61 submit for approval of the government theallowances to be paid to national technicalcommittee members and the rate of fees to becharged for the services of the Agency;
5/ approve directives to be issued by the Agencypursuant to this l ~ i:gulation;
41 approve the recognition of other standards asEthiopian standards pursuant to sub-article (3) ofArticle 6 of th IS Regulation ;
21 determine products for which use of the nationalstandard mark shall be mandatory;
31 examine and approv~ mandatory and optionalstandard requirements proposed by nationaltechnical committees;
11 approve the national quality and standardizationstrategy proposed by the Agency;

10. Meetings of the Council
11 The Council shall meet as frequent ly as itsfunction s require .
21 There shall be a quorum when more than half ofthe members of the COW1cil are present at anymeeting .
31 Decisions of the Counc il shall be made bymajority votes; in case of a tie, the Chairpersonshall have a casting vote.
41 Without prejudice to the provisions of thisArticle the Council may adopt its own rules ofprocedure.
11. Powers and Duties of the Director General
liThe Director General shall be the chief executiveofficer of the Agency and shall direct andadminister the activities of the Agency.
21 Without limiting the generality stated under subarticle (l) of this Article, the Director Generalshall:
a) exercise the powers and duties of theAgency specified under Article 6 of thisRegu lation ;
b) employ and administer employees of theAgency in accordance with the federal civilservice Jaws and, in the case of employeeswith rare skills, 10 accordance withdirectives approved by the governmentfollowing the basic principles of the federalcivil service laws;
c) prepare the work programs and budgets ofthe Agency and implement same uponapproval;
d) effect expenditures in accordance with theapproved budget for the Agency;

e) represent the Agency in its dealings withthird parties;
f) prepare and submit to the Ministry theperformance and fmanciaI reports of theAgency.
31 The Director General may delegate part of hispowers and duties to other officials andemployees of the Agency to the extent necessaryfor the efficient performance of the activities ofthe Agency.
12. Budget
The Agency 's budget shall be allocated by thegovernment.
13. Books of Accounts
liThe Agency shall keep complete and accuratebooks of accounts.

14. National Standard Mark
11 The use of the national standard mark withrespect to any product shall require the holdingof a permit issued by the Agency uponascertaining the conformity of the product to therelevant Ethiopian standard by an authorizedconformity assessment body.

Any person authorized to use the national
standard mark shall use the mark only for those
products specified in the permit.
The Agency shall keep a register showingdescriptions of persons authorized to use thenational standard mark, and the register shall beopen to the public.
Any permit holder shall display his permit withinhis business premises at a conspicuous place andin such a manner that it shall be easily visible.

assessment bodies to ascertain whether or not
products and services available in the market

Any concerned person shall have the duty to
cooperate with the law enforcement bodies in
exercising their powers under this Article.

16. Effectiveness of Regulations
The provisions of the Standard Mark and Service Fee
Council of Ministers Regulation No. 13/1990 shall, in
so far as they are not inconsistent with this Regulation,continue in force until replaced by new regulations.
17. Transfer of Rights and Obligations
The rights and obligations of the Quality and Standard
Authority of Ethiopia other than those relating to
metrology and the rights and obligations of the body
known .astne Ethiopian Cleaner Production Centre are
hereby transferred to the Agency.
18. Effective Date
This Regulation shan enter into force on up on thedate of publication in the Federal Negarit Gazeta.
