Subject RECOMMENDATION REPORT Housekeeping Amendment - Tariff of Fees By-law Main Street North Development Permit System

Overview
In August 2012 Council approved a Development Permit System (DPS) for Main Street North which is currently subject to an appeal at the Ontario Municipal Board
In September 2012 an amendment to the Tariff of Fees By-law was approved by Council which applied fees for applications that fall under the DPS
A recent update to the Tariff of Fees By-law for planning related applications inadvertently deleted the section that defined the fees for applications that fall under the DPS
The purpose of this report is to implement a housekeeping amendment that will re-insert the DPS fees into the Tariff of Fees By-law and to reorganize existing Schedule A information
Recommendations

BACKGROUND
The Development Permit System (DPS) is a process under the Planning Act that combines zoning site plan and minor variances into one approval process This process allows for greater flexibility in the planning framework to secure important land-use urban design streetscape and other objectives
The DPS by-law was approved in August 2012 for a section of Main Street North that extends from Church Street to Vodden Street The purpose was to provide a land-use approval process and policy environment that recognized the areas unique characteristics and gradual transition to commercial uses The DPS was appealed to the Ontario Municipal Board and remains under appeal In September 2012 the Tariff of Fees By-law was amended to include the associated fees for applications that fall under the DPS
As part of a recent Planning report that dealt with changes to planning application fees and other development application processes the fees that specifically dealt with the DPS were inadvertently removed
The purpose of this report is to re-insert the fees for applications that fall under the DPS This report also updates the Tariff of Fees By-lawto reflect changes to the lay-out of the by-law for clarity such as removing specific references to fees required for combined applications and highlighting the fees required for removing of an (H) Holding Symbol and reorganizes the notes of Schedule A
CURRENT SITUATION
The DPS for Main Street North remains under appeal at the Ontario Municipal Board Staff anticipate the appeal will be resolved by the third quarter of 2015 which means that staff will be able to begin processing applications for a Development Permit Public notice has been provided by way of an advertisement in the Brampton Guardian Members of the public would have the opportunity to provide any comments by way of delegation to Council
Attached as Appendix 1 to this report is the By-law amendment recommended for adoption which includes the fees that will apply to all applications under the DPS

There are no adverse financial implications associated with this housekeeping amendment

i) Council may refuse to accept or further consider the application until it has received the prescribed information and material required under subsections 22(4) 34(101) 41 (4) 41(7) and 51(17) of the Planning Act
H-2-raquol ii) No further processing of theapplication will take place until theapplicant has paid
thefees prescribed bythis by-law to thesatisfaction oftheChief ofPlanning and Infrastructure Services
B Decisions ofCouncil for the approval of rezoning applications will be considered null and void anda newdevelopment application will be required unless a zoning by-law is passed
i) Within 18months ofthe Council decision for applications notsubjectto a concurrent draft plan of subdivision application and
ii) Within 36 months of the Council decision forapplicationswith a concurrent draft plan of subdivision application
C Any resubmission by a person other than the original applicantshall be deemed a new application
D Inthe case whendraftapproval lapses newfees will be required as if a new application has been submitted

A minor revision to an approved site plan shall be subject to onlya processing fee of $ 585

B Except as otherwise provided the Chief of Planning and Infrastructure Services may upon written request authorize a refund of no greater than 50 percent of an application fee ifthe application is withdrawn priorto the Public Meeting required by the Planning Act ior the particular application
ANNUAL INDEXING
The fees in Schedule A shall be adjusted annually effective January 1 in accordance with the rate of increase of the Consumer Price Index-Torontofrom the previous year published by Statistics Canada In the event that a fee is not adjusted by the Consumer Price Index in any year the cumulative adjustment for the past years may be made in future years

The fees in Schedule A shall be adjusted annually effective January 1 in accordance with the rate of increase of the Consumer Price Index-Torontofrom the previous year published by Statistics Canada In the event that a fee is not adjusted by the Consumer Price Index in any year the cumulative adjustment for the past years may be made in future years

1 DEVELOPMENT APPLICATIONS
A Any application submitted prior to July 122005 and any application re-submitted after July 122005 shall be subject to the following actions
i) Council may refuse to accept or further consider the application until it has received the prescribed information and material required under subsections 22(4) 34(101) 41 (4) 41(7) and 51(17) of the Planning Act
H-2-raquol ii) No further processing of theapplication will take place until theapplicant has paid
thefees prescribed bythis by-law to thesatisfaction oftheChief ofPlanning and Infrastructure Services
B Decisions ofCouncil for the approval of rezoning applications will be considered null and void anda newdevelopment application will be required unless a zoning by-law is passed
i) Within 18months ofthe Council decision for applications notsubjectto a concurrent draft plan of subdivision application and
ii) Within 36 months of the Council decision forapplicationswith a concurrent draft plan of subdivision application
C Any resubmission by a person other than the original applicantshall be deemed a new application
D Inthe case whendraftapproval lapses newfees will be required as if a new application has been submitted

A minor revision to an approved site plan shall be subject to onlya processing fee of $ 585

ANNUAL INDEXING
The fees in Schedule A shall be adjusted annually effective January 1 in accordance with the rate of increase of the Consumer Price Index-Torontofrom the previous year published by Statistics Canada In the event that a fee is not adjusted by the Consumer Price Index in any year the cumulative adjustment for the past years may be made in future years
