• FirstNetmayassess:• Networkuserfees;• SpectrumleasefeesrelatedtonetworkcapacityunderCoveredLeasingAgreements;• Feesfromaccesstooruseofanyequipmentorinfrastructureconstructedorotherwiseownedby

FirstNet.

FirstNetFees- NoticeofProposedRulemaking(NPRM)• Focus:NTIAproposesafeereviewapproachcompatible withFirstNet’sneedtooperateinacompetitive marketplace.

• Scope:Examines whetherthefeesare,inaggregateandincombinationwithnon-feerevenue,sufficient,butnotinexcess of,thefundsneeded forFirstNettocarryoutitsstatutoryobligations.

• Methodology: NTIAwillutilizeFirstNet’sregularbudget,audit,andaccountingoutputsandretrospectively examine priorfiscalyearactualrevenuesandexpenses.

• FeesReviewed:StatuteauthorizesNTIAreviewofonlythreetypesoffees;non-feerevenuereviewedaspartofbudgetprocess.

• NTIAproposes tonotevaluate thereasonableness, orsimilar subjective attributes, ofthespecific feesproposedbyFirstNet.

TheActrequiresthatFirstNet’sNPSBNwillconsist ofacorenetworkandaradioaccessnetwork(RAN)that linkstothecoretoensure asingle,interoperable nationwide network.

Toobtainspectrum fromFirstNetandgetagrantforRANconstruction,astatemustdemonstrate toNTIAthatithastheability tobuild,operate,maintain,andimproveaRANthat interoperateswiththeNPSBN.

Statesandterritoriesmaydecide to“opt-out”ofFirstNet constructionoftheRANintheirstate. Iftheyopt-out,statesacceptresponsibility toconstruct,operate,maintain,andimprovetheirownRANthatstillmustconnecttotheFirstNetcore.

• SNAPP isdesignedforstatesandterritoriesthat seektoconstruct,operate,maintain,andimprove theRANintheirstate.

• Statesmust applytoNTIAfortherighttoenterintonegotiationsforspectrumleaseagreementwithFirstNetandtheymay applyforagranttogotowardsthecostofbuildingtheRAN.

• Therewillbeoneapplicationandsetofcriteriaregardlessofwhetherastateappliesforoneorboth.
