Rights in Water and Irrigation Act, 1914-1964.

PROCLAMATIONBy His Excellency Major-General Sir DouglasAnthony Kendrew, Knight Commander of theMost Distinguished Order of Saint Michael andSaint George, Companion of the Most Honour-able Order of the Bath, Commander of theMost Excellent Order of the British Empire,Companion of the Distinguished Service Order,Governor in and over the State of WesternAustralia and its Dependencies in the Com-

monwealth of Australia.

WHEREAS it is enacted by section 18 of the Rightsin Water and Irrigation Act, 1914-1964, that theGovernor may, by proclamation, declare any partof the State lying north of the twenty-sixth parallelof South Latitude, named or defined in the pro-clamation to be a proclaimed area for the purposesof section 18 of the said Act; and whereas anyproclamation previously issued under the authorityof this section may be varied or cancelled: Now,therefore I, the said Governor, acting with theadvice and consent of the Executive Council, andin exercise of the powers conferred by the saidAct, do hereby declare that the proclamation issuedon 24th April, 1963, under the authority of the saidsection declaring that part of the State lyingnorth of the twenty-sixth parallel of South Lati-tude and described in the Schedule thereto andshown marked and defined on Plan P.W.D., W.A.40192 as kept in the Public Works Department, ishereby varied as described in the schedules hereto.

Schedules.

Carnarvon Irrigation.Variation of Proclaimed Area.

SCHEDULE A.

All that portion of land bounded by lines startingfrom a point on the northern boundary of Gas-coyne Location 196 situate in prolongation north-erly of the western side of Beasley Street, a pointon the present boundary of the Carnarvon Irriga-tion Proclaimed Area and extending northerly to apoint situate in prolongation westerly of the north-ern boundary of Location 226 (Reserve 24749) ;thence easterly to the northwestern corner of thatlocation, a point on the present boundary of Car-narvon Irrigation Proclaimed Area aforesaid andthence southerly, generally southwesterly andwesterly along that boundary to the starting point,as delineated and coloured red on Plan P.W.D.,W.A. 43266.

SCHEDULE B.

All that portion of land bounded by lines start-ing from the intersection of the southeastern sideof a one chain road passing along the southeasternboundary of Gascoyne Location 250 and the north-eastern side of a one chain road passing along itsnortheastern boundary, a point on the presentboundary of the Carnarvon Irrigation ProclaimedArea and extending 327 degrees 39 minutes a dis-tance of about 43 chains and 38 links; thence 23'7degrees 39 minutes to the present boundary of theCarnarvon Irrigation Proclaimed Area aforesaidand thence generally northwesterly and generallynortheasterly along that boundary to the startingpoint, as delineated and coloured red on PlanP.W.D., W.A. 43266.

Mines Corres. No. 261/03.WHEREAS section 74 of the Constitution Act,1889-1963, provides that the Governor in Exe-cutive Council may vest in Heads of Departmentsor other officers or persons within the State powerto make minor appointments; and whereas it isdesirable that appointment of all persons employedin the Government Chemical Laboratories Branchof the Department of Mines at a daily or weeklyrate of wages be vested in the Director of Govern-ment Chemical Laboratories or any personappointed by the Minister for Mines to temporarilyact as Director: Now, therefore, His Excellency theGovernor by and with the advice of the ExecutiveCouncil hereby vests in the Director of GovernmentChemical Laboratories or any person appointed bythe Minister for Mines to temporarily act asDirector, the appointment of all persons employedin the Government Chemical Laboratories Branchof the Department of Mines at a daily or weeklyrate of wages.

Traffic Act, 1919-1966.ORDER IN COUNCIL.

Land Act, 1933-1965.ORDERS IN COUNCIL.

WHEREAS by section 33 of the Land Act, 1933-1965, it is made lawful for the Governor to directthat any Reserve shall vest in and be held by anymunicipality, body corporate, or other person orpersons to be named in the order, in trust for anyof the purposes set forth in section 29 of the saidAct, or for the like or other public purposes tobe specified in such order and with power ofsubleasing; and whereas it is deemed expedient,as follows:—

Corres. 325/67.—That Reserve No. 19242 shouldvest in and be held by the Shire of Collie, in trustfor the purpose of "Recreation".

Corres. 943/66.—That Reserve No. 28414 shouldvest in and be held by the Shire of Perth, in trustfor the purpose of "Kindergarten Site".

Now, therefore, His Excellency the Governor, byand with the advice and consent of the ExecutiveCouncil, doth hereby direct that the beforemen-tioned reserves shall vest in and be held by theabovementioned bodies, in trust for purposes afore-said, with power to the said bodies, subject to theapproval in writing of the Minister for Lands be-ing first obtained, to lease the whole or any portionof the said reserve for any term not exceedingtwenty-one (21) years from the date of the lease.

Land Act, 1933-1965.ORDERS IN COUNCIL.

WHEREAS by section 33 of the Land Act, 1933-1965, it is inter alia, made lawful for theGovernor by Order in Council, to direct that anyland reserved pursuant to the provisions of thisAct shall be granted in fee simple to any person(as defined in the said section) subject to the con-ditions that the person shall not lease or mort-gage the whole or any part of the land withoutthe consent of the Governor and subject to suchother conditions and limitations as the Governorshall deem necessary to ensure that the land

is used for the purpose for which the land isreserved as aforesaid; and whereas it is deemedexpedient, as follows:—

Corres. 1250/65.—That Reserve No. 28409(Rockingham Lot 1241) should, subject as afore-said be granted in fee simple to the Western Aus-tralian Fire Brigades Board, to be held in trustfor the purpose of a "Fire Station Site".

Corres. 1848/64.—That Reserve No. 28453(Wyndham Lot 1265) should, subject as aforesaidhe granted in fee simple to the Royal FlyingDoctor Service of Australia, to be held in trust forthe purpose of a "Radio Receiving Station Site".

Now, therefore, His Excellency the Governor byand with the advice and consent of the ExecutiveCouncil doth hereby direct that the beforemen-tioned reserves shall be granted in fee simple tothe aforesaid bodies, to be held in trust for theaforesaid purposes, subject to the conditions thatthe land shall not be leased or mortgaged in wholeor in part without the consent of the Governor.

WHEREAS by section 33 of the Land Act, 1933-1965, it is made lawful for the Governor to directthat any Reserve shall vest in and be held by anymunicipality, body corporate, or other person orpersons to be named in the order in trust for thelike or other public purposes to be specified in suchorder: And whereas it is deemed expedient, asfollows:—

Corres. 3027/62.—That Reserve Nos. 26860 and28411 should vest in and be held by the Town ofAlbany, in trust for the purpose of "Infant HealthClinic and Kindergarten" and "Hall Site", respec-tively.

(The previous Vesting Order over Reserve No.26860 issued under Executive Council Minute No.1253 dated 21st June, 1963, is hereby superseded.)

Corres. 4027/66.—That Reserve No. 28446should vest in and be held by the Minister forWater Supply, Sewerage and Drainage, in trustfor the purpose of "Water Supply Purposes".

Now, therefore, His Excellency the Governor,by and with the advice and consent of the Execu-tive Council, doth hereby direct that the before-mentioned reserves shall vest in and be held bythe aforementioned bodies in trust for the pur-poses aforesaid, subject nevertheless to thepowers reserved to him by section 37 of the saidAct.

F.D. 289/66; L. & S. 3315/57.WHEREAS by the Forests Act, 1918-1964, it isprovided that a dedication under the said Act ofCrown land as a State Forest may be revoked inwhole or in part in the following manner:—

(a) The Governor shall cause to be laid onthe Table of each House of Parliament aproposal for such revocation.

(b) After such proposal has been laid beforeParliament the Governor, on a resolutionbeing passed by both houses that suchproposal be carried out, shall by Order inCouncil revoke such dedication.

And whereas His Excellency the Governor didcause to be laid on the Table of each House ofParliament his proposal dated the 19th day ofOctober, 1966, for the revocation in part of thededication of Crown lands as State Forest; andwhereas after such proposal had been laid beforeParliament a resolution was passed by both Housesthat such proposal should be carried out: Now,therefore, His Excellency the Governor with theadvice and consent of the Executive Council doth

WHEREAS by the Land Drainage Act, 1925-1954,it is provided that before undertaking the construc-tion of drainage works, the Minister shall submitplans, descriptions, books of reference and esti-mates of the proposed works to the Governor forapproval; and that if they are approved, the Gov-ernor may forthwith, by Order in Council empowerthe Minister to undertake the construction of theproposed works: Now, therefore, His Excellencythe Governor, with the advice of the ExecutiveCouncil, doth hereby approve of the plans, descrip-tions, books of reference and estimates marked onPlan P.W.D., W.A. 43510 for the construction ofthe drainage works within the Capel-BoyanupDrainage District which were duly submitted forapproval, and hereby empowers the Minister toundertake the construction of the said works.
