  • HUMAN RIGHTS ISSUE

    • The right to Housing is codified as a human

    right in the universal declaration of human

    rights(1948)

    • Everyone has the right to a standard of living

    adequate for the health and well-being of

    himself and of his family; including food

    clothing, housing…{article 25(1)}

  • COUNCIL(CONTEXT)

    Section 26(1) states that

    ‘everyone has the right

    to have access to

    adequate housing.’

    Section 26(2) also

    provides that the state

    must take reasonable

    legislative and other

    measures, within its

    available resources, to

    achieve the progressive

    realisation of this right

    The South Africa Constitution Act, Act No. 108 of .1996

    The Housing Act, Act 107 of 1997 and the Housing Code

    The Housing Act, Act No 107 of 1997 provides for the facilitation of a sustainable housing development process; for this purpose to lay down general principles applicable to housing development in all spheres of government, to define the functions of national, provincial and local governments in respect of housing development.

  • COUNCIL (CONTEXT)

    The purpose of the Housing Consumer Protection

    Measures Act, Act No. 95 of 1998 is to “ To protect

    the housing consumers and regulate the home

    built environment by promoting innovative home

    building technologies and improving the

    capabilities of home builders”

    Housing Consumer Protection Measures Act, Act 95 of 1998

    VISION:-

    To be a champion of the Housing consumers.

    MISSION:-

    To regulate the homebuilding environment

    and protect the housing consumers.

  • OBJECTIVES OF COUNCIL To represent the interest of housing consumers by providing warranty

    protection against defects in new homes.

    To regulate the Home Building industry.

    To provide protection to housing consumers in respect of the failure of

    home builders to comply with their obligations in terms of the Act.

    To establish and promote ethical and technical standards in the home

    building industry.

    To improve structural quality in the interest of housing consumers and

    the home building industry

    To promote housing consumer rights and provide housing consumer

    information.

  • MANDATE OF COUNCIL

    To assist home builders through training and inspection, to achieve and

    to maintain satisfactory technical standards of home building.

    To regulate insurers homebuilders obligation in terms of insurance

    scheme that is exempted from the provisions of the insurance Act.

    On particular, to achieve the stated objectives of this section in the

    subsidy housing sector.

    To communicate with and assist home builders to register in terms of

    the Act

  • NHBRC’s Contribution to Sustainable Human Settlements

    NHBRC’s involvement in:

    Contributing to Government’s national policy on Sustainable

    Human Settlements;

    Designing and production of project documentation of housing

    typologies and sustainable housing solutions for the subsidy &

    social housing sector;

    Developing standards that ensure sustainability of houses;

    Providing a warranty on all enrolled houses; and

  • REGISTRATION

    • Copies of IDs of managing directors, shareholders, owners or close corporation

    members.

    • Company registration number and copy of registration, if applicable

    • Names and contact details of technical staff on site (e.g. foremen or project

    managers).

    • Names and contact numbers of engineers.

    • Financial information - banking details and financial statements stating turnover,

    profitability and fixed assets.

  • ENROLMENTS

    NHBRC requires Housing Units to be enrolled with the Council prior to

    construction in terms of the Act

  • ENROLMENT

    • 15 days prior to commencement of construction

    • Engineers input

    • Average: enrolment fee

    ‒ 1.3% enrolment of the total selling price including land value

    ‒ Subsidy: In Principle = 1% levy

    ‒ Final enrolment = 0.75 %

  • INSPECTIONS

    Inspections of ALL enrolled homes is a statutory obligation for NHBRC in

    terms of the Act

    • RATIONAL DESIGN:-

    • THE USE OF DETAILED KNOWLEDGE ON THE STRUCTURE

    • Non-Compliance

    Notice of non-compliance is a document issued to a Home Builder

    where they have deviated from the National Building Standards and the

    Home Building Manual.

    • BQIH Form

    Building Quality Index for Houses is a standard quality assessment

    system developed by NHBRC in conjunction with CSIR. Its main

    purpose is to ensure that the building industry has a standard

    quality assessment system.

  • Documents

    • Compliance Documents

    Compliance documents are documents submitted by the Engineers and

    the Homebuilders in response to the non-compliances issued to them.

    These documents are a confirmation of rectification done on the items

    raised on the noncompliance.

    NHBRC Standard Documents: B1 and D1.

    • Rational Design Documents

    To ensure that the competent person accepts full responsibility for the

    Rational Design and works completed under his/her supervision.

    Technical Skills Training 6.2.1 Bricklaying • Set out, excavate, cast concrete strip foundations and build foundation walling • Build masonry superstructure using solid units • Build masonry superstructure using hollow units 6.2.2 Plastering • Prepare for plastering • Apply plaster to surface • Plaster walls and screed a floor and steps 6.2.3 Roofing NOTES: Trainers offered Theoretical Tuition as well as Simulated Training in the form of mock-ups after which Learners are subjected to further assessment by the Construction Education and Training Authority through NHBRC accredited Training Providers. Learners doing Bricklaying & Plastering were taken to site as well for practicals.
