Alan joined Associated Realty in 2000 after previous careers in secondary education, life insurance and dairying. Tauranga’s commercial and industrial market has grown a lot since then with the opening up of new zones at Papamoa and Tauriko as inner city commercial areas have become mature.

Alan has gained experience in all aspects of the market, but as a preference prefers industrial leasing and sales. Recent successes in industrial sales include the sale of both vacant and leased industrial buildings, with the most recent being the sale of a substantial property in Hull Road. He is convinced that industrial and commercial property represents the ideal investment for an investor, offering a good yield well above interest rates and a hedge against inflation. He has taken his own advice and owns industrial property himself.

In his spare time, Alan is still scuba diving after 40 years in the sport, and still catching his share of crays. He is still also heavily involved in target shooting and maintaining his master grading in Small bore and A grading in Full bore shooting. He is looking to competing in the Oceania Championship later this year in Sydney.

A search in June 2018 of realestate.co.nz showed that there were 51 developed industrial properties being offered for sale in the Tauranga region. From these, the number of sales at each price level were indicated as follows:

From this sales activity it can also be seen that the most popular price bracket is under $500,000. Though there is a significant amount of sales activity over $3,000,000. The locations of these sales are shown to the following graph.

Mount Maunganui and Tauriko are the stand out locations in terms of activity. With more established areas such as Greerton and Judea lagging significantly behind in terms of sales numbers.

The propetry category selected was for developed industrial properties and therefore excluded vacant land sales. It is clear then that the bulk of properties advertised for sale are still within the lower price brackets. We have also analysed sales through our sales database. This indicates that there have been 198 industrial property sales in the Tauranga region over the last two years (excluding vacant land sales). A breakdown of price brackets within these sales were as follows:

al The New Zealand construction industry - how will this impact on your future

commercial property investment plans?By Janine Hellyer, Director, BDO Tauranga Ltd

BDO has recently undertaken a 2018 Construction Industry Survey, which surveyed over 85 businesses operating across the housing, commercial construction, and civil/infrastructure sectors. The results provide valuable insights into the issues and challenges faced in this industry. In turn some of the outcomes could substantially impact on your plans for commercial building development in the future as costs may be set to skyrocket.

Some key findings were as follows:

• The sector is comprised of two distinct tiers –

1. Good operators with strong balance sheets and robust cash resources, and

2. Fragile businesses susceptible to the marketplace’s challenges and forces

Although there are a good number with sufficient financial strength, far too many are not in this same position. These fragile businesses face the risk of entering a downward spiral that could result in their financial collapse.

• Profit margins were identified as being too low and not sustainable, nationwide. The commercial sector is operating on margins of 5-6%, with higher margins of 8% found in the housing sector. In addition, margins were generally, but only slightly, above the forecasted margin in project budgets. Several respondents noted that over 30% of their projects by value are making or will make losses.

• Despite contractual commitments to pay on time, over 41% of respondents said they are not paid on time and 28% find juggling cash flow a challenge.

• Staffing was identified as the single greatest issue in terms of both availability and quality. Specifically, recruiting and retaining staff, availability of skilled labour, and training challenges.

• The importance and vulnerability of sub-contractors was highlighted, particularly in the event of the financial collapse of a significant construction company. An inability to pay subcontractors is likely to have a domino effect through the industry, impacting a lot more individuals than in the first wave.

• Results indicated that the requirement to hold retentions in trusts has made little difference to the way retentions are held. Just under three quarters of organisations have not enquired to ensure that their retentions are held in trust; further, out of those who did enquire, one third found they were not held in trust. In the absence of specific requirements to hold retentions separately it appears there has so far been little or no effective change.

Despite these identified issues and concerns, the construction industry is still full steam ahead, with sufficient levels of committed forward work indicating a strong sector. For those that are looking to build in the near future you will be well aware of the delay faced when trying to contract a reliable builder/contractor.

Key findings indicate that profit margins are squeezed and with the new retentions regime, increased overheads, lack of resources, cash flow and lack of profitability makes for increased risk of collapse of ‘fragile’ companies. Now, three to four years into the building boom, low margins appear to be unsustainable long term. As property investors our recommendation is that you do your due diligence when appointing new builders to try to reduce the risk of being caught out unwittingly.

Asbestos was used in building products up until the 1990s due to its ability to resist heat, electricity and chemical corrosion. However, in New Zealand an estimated 170 people die of asbestos-related diseases each year making it the largest single cause of work related deaths. In response, the Health and Safety at Work (Asbestos) Regulations 2016 (“Regulations”) were introduced and came fully into effect on 4 April 2018. These regulations impose additional duties on Persons Conducting a Business or Undertaking (“PCBU”), including landlords, managers and tenants, in relation to work involving asbestos. This includes the obligation of managing and removal of asbestos risks to ensure the working environment is free of airborne asbestos fibres. Generally, if your building was built prior to 1 January 2000 it is more likely to have asbestos-containing material incorporated within it.

Under the Regulations, a PCBU who knows or ought to reasonably know that there is a risk of exposure to respirable asbestos fibres in the workplace must ensure that all asbestos or asbestos containing materials (“ACM”) are identified. An ACM includes items such as concrete, stipple ceiling coatings and window putty.

The first step in complying with the Regulations is to identify if asbestos is present within the workplace. Therefore, one should not merely assume that asbestos is not present. Instead to comply with the Regulations, a PCBU should organise an inspection by a suitably qualified consultant to identify whether asbestos or ACM is present within the property. If the survey results show that there is or there is likely to be asbestos, all PCBUs must ensure that a written asbestos management plan is prepared. As property owners we recommend that you drive this process in consultation with your tenant.

As per the Health and Safety at Work Act 2015 (“HSWA”), to ensure that their legal obligations are met, a PCBU is obligated to consult, co-operate and co-ordinate so far as reasonably practicable with all other PCBUs who have a duty in relation to the same matter. This means that each PCBU will need a management plan.

An asbestos management plan needs to include the identification of asbestos or ACM, the decisions made in relation to the management of the risk arising from asbestos, as well as the reasons for such decisions. The management plan needs to detail the procedure for detailing incidents or emergencies involving asbestos or ACM at the workplace and the workers who are responsible for carrying out work which involves asbestos. In relation to the workers responsible, the plan must also detail any information and training that has been provided to the workers, their responsibilities and role and any health monitoring of the workers that has been undertaken.

As per the Health and Safety at Work Act 2015 (“HSWA”), to ensure that their legal obligations are met, a PCBU is obligated to consult, co-operate and co-ordinate so far as reasonably practicable with all other PCBUs who have a duty in relation to the same matter. This means that each PCBU will need a management plan.

Under the new Regulations, we recommend when purchasing a property, due diligence investigations include determining whether a survey or management plan has been conducted or put in place for the property. If not the purchaser should arrange an inspection by a suitability qualified consultant to identify whether asbestos or ACM is present within the property.

The Regulations also will affect tenancy relationships. Under the HSWA, landlords must ensure that when work is carried out on their property, it is done in a safe manner without endangering workers or others, including tenants. While the obligation to identify and manage asbestos cannot be contracted out of, when leasing a property parties should consider whether the inspection cost is to be allocated to one party or shared. This means that each party should note what the lease obligations are in relation to who is responsible for the costs.

PCBU’s must ensure that the asbestos management plan is kept up-to-date. In addition, the management plan needs to be revised if there is a review of a control measure, asbestos is disturbed or removed, the plan is no longer adequate, a workers’ representative requests a review or when five years have passed since the plan was last reviewed.

Failure to comply with a review can result in fines upwards of $6,000 for individuals, and $30,000 for companies and other corporates. Therefore, we encourage those who own, occupy or manage a commercial property to ensure they clearly understand their responsibilities under the Regulations.
