Meeting Supervisors Transact Much Needed Business. Pursuant to n call issued by all of the members of .thn board of Super- visors the entire board met in the ollico of the County Clerk Saturday morning for the purpose of appoint- ing road overseers and the transac- tion of other needed business. Supervisor W. P. Ilaia moved the suspension of the rules and that the mattorof appointing the road over seers lie taken up. This motion was seconded by T. T. Meyer and car ried. Ilaia moved the apiHrintment of P. Witrock as road overseer for liana. The motion was seconded by Meyer and carried. Ilaia moved the appointment of F. Somerfeld as road overseer for Wailuku. The motion was second ed by Meyer. T. 15. Lyons moved the appointment of Thomas Clark as road overseer which motion was seconded by Kauhi. The vote was strictly a party vote and was deeid ed by the chair in favor of Sotnmer- - feld. Ilaia nominated Decoto for La- - haina which nomination was second-- . cd by Meyer. Kauhi nominated Philip Palis which nomination was seconded by Lyons. The chair voted with .Ilaia and Meyer and Decoto was appointed. t - T. T. Meyer, nominated J. II. Mahoo as road overseer for Molokai. This nomination was seconded by .Haiti. Lyons nominated Paia Naki wlu'ch nomination was seconded by Kauhi.' The chair decided in favor of the Republican instead of Naki. When the matter of the bonds for the various ollicers came up for con- sideration Chairman W. F. Pogue gave notice that he would not servo under resolution number 82 which made each supervisor coresponsible with the road overseer of his dis- - trict. He said that the. road work should be in the hands of the road .overseer and that that officer should be responsible to the Hoard for his acts but that the individual super- visors should not butt in on work of that kind. T ho bonds of Keliinoi and Groves, were received and accepted. A communication from County Attorney J. L. Coke was read and ho was. excused from attendance at the special meeting of the board. A resolution was introduced by . Ilaia requiring each road overseer to file his bond and oath of oflico with the County Clerk not later than the next regular meeting of the board. At this point Supervisor Lyons registered a kick because of the re- ceipt of a written opinion from the County Attorney. He objected to the, reading of the opinion. Chair- man Pogue stated that he had not seen the opinion nor knew any thing of its nature. lie said that' he, as an ollicer had requested an opinion from the County Attorney and that he had a right to request an opinion. Lyons said that ho objected to any member requesting an opinion. lie said that any opinion requested should be done by the. lioard and not by a single member. At this novel statement there was a general smilo. The opinion was gotten rid of in a most unusual way. To the Honorable Hoard of Super visors of the County of Maui, Terri- tory of Hawaii, Wailuku, Maui. Gentlemen: In response to your verbal request for an opinion from me as to the legality of the special meeting pro- posed to be hejd by you upon this date, I beg to say that assuming the facts to be that this meeting was called by the Chairman of your Hoard, and not by a majority of the Board, and further assuming it to bo that neither tlio County Clerk of the County of Maui, nor any deputy County Clerk is at present within the County of Maui, I am of the opinion that such meeting is not legally called, and that the transac- tion of any business by your Hoard at such meeting would be null and void. Section (Hi of the County Act pro vides inter alia as follows: "Tho Hoard shall hold regular meetings and it shall call such special meetings, as may be necessary for tho public we- lfare." ' , It clearly appears that this does not confer authority upon any one member of tho Hoard the . right to call a special meeting. All special meetings must be called by the Hoard, and as I take" it meaning a majority of the Hoard. The call for the meeting not being conformable to the provisions of the section just cited, no business can be legally transacted at said meeting. The absence of the Clerk or any deputy, in my opinion, also would invalidate the proceedings of the meeting. Hy Section 71 of tho County Act thi' County Clerk is mado io clerk of the Hoard of Supervisors, and as such, among other things, shall "Record all proceedings of the Hoard. Make full entries of all their resolutions and decisions on all quos- - Continuud oif l'age 6. Death Claims Dr. Beckwith Was Loved by All Who Knew Him. Rev. Dr. Edward Griffin Heck with of llamakuapoko who died at Paia hospital during tho early morn mg of the 3rd was universally be loved for liis good works, his high character, his purity of mind, his nobility of soul. He loved his fellowmen and they loved him whether as teacher. preacher, or citizen. As a citizen he loved his country much, was intensely patriotic. Ik-wa-s always desirous to exercise the right of suffrage esteeming it not only a duty but a pleasure. No one of his congregation can ever forget the eloquence of his Thanksgiving sermons ,in praise of his native land; nor can any of his 'auditors fail to remember his patriotic address delivered at Paia church at the public reception to Senator Cullom and Congressman Ilitt. As a teacher he was unexcelled. He was the second president of Oahu College and did much in educating and training many of the prominent men of the Territory. Hon. II. P. Baldwin and his con- temporaries in Hawaii nei, the children of the Hawaiian mission, were educated by Dr. Beckwith at Punahou. He was the minister of a church in the .Mission District of San Fran- cisco of tho Central Union church of Honolulu, and of the Makawao Union church. As a preacher as well as a speaker he was most eloquent. He was simple and direct in his theology and in his methods of thought. He was not . ah ex- ponent of the higher criticism and had little liking for advanced philosophical .thought as ipplied to theology. In his beliefs he was orthodox but not bigoted. Ho was a line type of the New England Puritan which he was by birth and training. His teitderness, his sympathy, hisehavj-t- y for the weakness of human nature were predominating traits of charac- ter. "With malice toward none and charity for all" especially "applied to Dr., Beckwith. In his social life he exhibited the courtesy of the old time gentleman. He was slow to anger and long suffering. One of his most con- spicuous qualities was his .spirituali- ty, his unshaken belief in the im- mortality of tho soul and all Christian teachings. His more than four score years have been well spent. Dr. Beckwith was born at Great Harrington, Mass, Nov. Kith, lS2(i. Ho had two brothers and one sister: Daniel, Morris and Martha. Daniel, tho older brother is still living in the old homo village at the ago of So as is also the sister. Morris lived for many years in the Ilawaiiian Islands, teaching during the early years at the Royal School, in Honolulu, with his brother, Edward. Dr. Beckwith graduated from Williams College, after which he taught a year at West field, Mass. Then came the call to the Sand- wich Islands, to teach in the Uoyal School. For ten years he taught in Honolulu, ISoO-lSG- In 1S53 he married Caroline P. Armstrong, "a gifted daughter of one tho early., missionaries, Richard Armstrong. George W. Wilbur is the now head overseer and lias assumed his duties. Mr Wilbur is a plan tation man of many years ex perienee and is considered one of the best hero. In l.Slio he organized and build the Third Congregational Church in San Francisco. During these years he also preached in the Plymouth Church. Dr. Beckwith then became Prin cipal of the Oakland College School for Roys. In 1SGS Mrs. Reckwith's health failed and Dr. Beckwith went east and took charge of the Congre- gational Church in Waterbury, Conn. For ten years ho served most acceptably this largo and in- fluential Church. In 1S7S the Beukwitlis returned once more to California and went back to the old Third Congregational church. Here he built a now church and dedicated it free of debt. He served his church for nine-years- , coming to Honolulu in 1S.S7. At this time Bethel church and the old Fort Street church wanted to unite. Dr. Beckwith was unanimously called as Pastor.. It was Dr. Beck- with who built, the present Central Union Church and though it cost more than 12.ri,()00 he dedicated it free of debt, Every man, woman and child in the congregation, had a hand in raising the. money. Dr. Beckwith feeling the burden two great for him during these years, came to Maui in 18!) 1 and for eleven years ho endeared himself to all on Maui as' tho Pastor of the Makawao Union Church. Messrs. Bazata and Turner have since fol- lowed Dr. Beek.vith as pastors of this church. Dr. Beckwith was. universally be- loved by all who knew hiin amicus friends were legion among every nationality. His death removes one of the land marks of our Islands. Rev. Edward Griflin Beckwith, 1). fD. died Wednesday morning March 3rd, shortly after midnight, lie had been in failing health for some months, 'although his death was wholly unexpected. Ten days previous to his death", he was taken to the Paia Hospital where he had every care and atten tion. While Dr. Beckwith had for some years had a weak heart his death was duo to other complica- tions. His passing was peaceful just as was fitting such a beautiful character. Mrs. M. B. Hair, his only daughter was at his side when ho passed away. An Important One of tho most important measures now beforeMeasure. the Legislature is tho bill introduced by Representative E. H. Carloy for the relief of the drouth stricken districtof Kula. Kula is the district of independent homes. A districtwhere many residents own their own lands and till the same and

selves and their families. Here is the nucleus of a large numberof independent homes occupied by families whose in thecommunity are tixe1. and permanent. Hero were conditions that

are held up by the press as ideal. The politicians have advocatedthe assistance iy the government of various com tn unities in thehope of bringing about such conditions and even the ministers look

to this class for better citizenship.In the course of time it is found that, there is not sullicient, water

for the people In that community. The Republican party of thewhole county goes on record as favoring tho building of a pipe line

for the relief of the community. The Supervisors of the County

appropriated sufficient funds for tho purpose of having the line

surveyed and the matter was then presented to the Legislature. Ifthere is any apathyshown on the part of any member trom theCounty of Maui after the needs of the residents of that strickendistrict have been thoroughly explained such a member from eitherbranch need never attempt to run for office again in the Oounly.

tended that as long as the deputysheriffs are to bo subordinate toand responsible to tho Sheriff theyshould be nominated by him andso appointed that he may removethem for cause without having tosecure an impeachment before theBoard of Supervisors.

If this bill passes it will meanthe throwing out of the present billto create confusion in police affairsby giving the deputy sheriffs theright to appoint the police officersserving under them, the men to beapproved of by the Sheriff, or, if

his approval is withheld, by theBoard of Supervisors. This billwould extend petty politics stillfurther into the police forces of thecounties and under such conditionsis prevail at present in Oaim v:uldthoroughly disorganize the countrypolice force.

Tliero is now before tho Senatea bill introduced by RepresentativeM. P. Waiwaioleof Wailuku, thatis being most bitterly denouncedby soms of the leading citizens ofMaui as being most detrimental tothe welfare of the laboring men ofthe county. This is bill number41. No possible good can comefrom the enactment of the bill forthe simple reason that in no casecan the laborers get their pay morefrequently nor in a shorter periodof time under tho proposed law

than they do under the presentlaw.

The bad feature of the law isthat the date set for the Joardmeetings is such that it will be animpossibility to get the pay rollsand bills in time for the boardmeetings under the proposed lawand as a consequence there will bono pay for the laborers for theouter districts such as liana andMolokai at such times as the lirstWednesday falls on or near thelirst of the month.

Maui County is composed of sevoral islands and is not so situatedin respect to r6ads and other meansof conveyance as are the othercounties. For this reason therewas a special request by the lastBoard of Supervisors for the enactment of tho law as it now stands.This request was a unanimous request by the whole, board andthrough their efforts a bill that wasfathered by Coelho was killed andthe present law was enacted.

Just why Waiwaiolo .came tolend his name to such a viciousscheme is hard to see. It is notthought here that RepresentativeWaiwaiole either drew up, or fater- -

ed tho bill as one of his own measurers but that it is more likelythat he has introduced the bill atthe request of some. one whom hebelieved to be a friend when rife amatter of fact it is a caso of thehand of Esau but the voice ofJacob.

At tho April meeting of theBoard of Supervisors in 15)07 thefollowing resolution was unanim-ously passed that is aw true to dayas it was then.

Whereas, a meeting of the Boardof Supervisors of the County ofMaui was held on the 15th day ofDecember, 1906, for the purpose ofdiscussing and adopting recomen-dation- s

partments and many of tho pro-mino- nt

citizens of the County ofMaui were present; and

Whereas, at said meeting, amongothers, the following item, by una-

nimous vote of all present, was in-

serted in said list of r'commenda- -

tions to the Legislature, to-wi- t:

That tho County Act bo so amend-ed ' that regular sessions of theBoard of Supervisors be hejd onthe lirst rWednesday after the 5thdtiyofeach month " and

Whereas, a meeting of the Re-

publican County Central Commit-tee of the County of Maui was heldat the Republican Headquarters atWailuku; County of Maui, on the10th day of January, 1907, for alike purpose, at which were presentby invitation members of theBoard of Supervisors and Heads ofDepartments of tho County ofMaui and other prominent citizens,at which meeting the Hon. W. J.Coelho acted as Secrotary; and

Whereas at said meeting, a reso-

lution of the same tenor as thatabove mentioned, to wit: That thoCounty Act be so amended that re-

gular 'sessions of tiro Board ofSupervisors bo hold on tho firstWednesday after tho 5th day ofeach month...." was passed withtho unanimous support of all pre-

Whereas, it is impracticable forthe Board of Supervisors of theCounty of Maui to meet oftener onthan oncb in each month for thereason that then, in such event, theSupervisors from the Districts ofMolokai and liana would "be roquired practically to maintaintheir residences at the County seat,contrary to the provisions of section 17, Chapter 7, of Act 89 Session Laws of 1905; and

Whereas, the temporary expedi'ent adopted by the Board of Super'visors of the County of Maui ofclosing the fiscal month on tli25th day of each month, while imperative under the present Act, isnot satisfactory in that it leads tomuch confusion in preparing reports, payrolls, and bills and re issults in niuehtllssatisfaction amonglaborers, as well as annoyance to ofthose supplying materials to theCounty.

Now Therefore, Be it resolved by onthe Board of Supervisors of theCounty of Maui, in 'regular sessionassembled, that the llonorablomembers of the Senate and theHouso of Representatives and HisExcellency tho Governor of theTerritory of Hawaii be and theyhereby are respectfully petitioned ofto prepare, pass and sign, respec-tively such an Act or an amend-ment

Your Chairman has requested anopinion from mo relative to the fol-

lowing questions.Can a Supervisor legally act as

Road Overseer under the provisionsResolution No. 82 passed at the

last meeting of your Board, eitherthe District of Makawao where a

Road Overseer has been appointedin the several Districts wherein a

road" overseer has not been appoint-ed? I would answer all these questions in the negative, and I take itthat the District of Makawao is inthe same position that the other,Districts are at the present time, by

reason of the fact that although aroad overseer was appointed, suchoverseer could not up to the presenttime assume the duties of his office

account of thojaet that said re-

solution No. 82 provides, that be-

fore entering the duties of his office,each olficial shall give bond to theCounty, the sufficiency of whielshall be approved by the Board ofSupervisors. No such bond havingbeen given, and approved by theBoard to the present date, the over-- .seer appointed for the District ofMakawao could not legally act assuch under the law. It then followsthat no road pverscor is qualified toact within the County of Maui, andthat this state of affairs has existedsince the adoption of said Resolution No. 82. And the office of RoadOverseer created by said' Resolution

bonds of the officials be approv-ed by tho Board of Supervisors bechanged, and that such bonds bemade approvable by some othercounty official for the reason thatthe Board might not bo in sessionwhen these bonds arc submitted andthe oHice then would have to re-

main vacant until nnother meetingtho Board, which might greatly

delay the road overseers in takingoffice, ,

The matter of a county telephonesystem for the island of Molokai wasdiscussed. The question of installing a line frolirKaunukakai to Wai- -

alua for the exclusive use of thocounty ollicials is what is desired.The distance that the line will have-t-

be built is about twenty miles.The County Engineer was instruct-ed to prepare specifications for thenext meeting.

at this time for use on the publicroads was received. The Governorstated however that in about sixmonths from now, on completion ofthe volcano road, that it would pro-

bably be possible to grant the request.The board authorized the leasing

of the offices over the bank for theuse of the County Engineer and theroad clerk. The offices formerlyused by the County Engineer will beused by the County Attorney.

The meeting adjourned in ampletime for the supervisors for a dis-

tance to get to their respectivesteamers.

The late rains have done wondersfor Lahaina district. The reeivoirs,ditches and streams of Pioneer plan-

tation are still full of water. Hun-

dreds of dollars are saved now whichin a dry season would have beenspent in pumping. Tons and .tonsof cane are rushed down the flumesfor long distances by tho force ofwater. The plantation never lookedbetter.

Beyond this plantation the twocattle ranches show signsof a revival'of living beef and bone. Tho bigllonolua ranch is green again andthe three thousand' head of cattle aregetting in good condition. On ac-

count of abundance of water, careand the extent of the ranch, veryfew cattle suffered in llonolua dur-ing the. past dry season.

Mr. It. C. Searle manager of thellonolua ranch is now taking off hiscoffee crop. High wages and cheapcoffee have ruined many plantationsin Hawaii but Mr. Searle is not theman to throw up an industry thatmay yet pay handsomely. Ho hasone hundred and twelve acres nowred with beautiful large berries. His,mill is one of the most modern inthe islands. He aimcs at producingfirst class coffee which he ships '.
