    1 Project Synopsis

    Project Title: Land transport safety and security

    Project Number: EuropAid/126786/C/SER/Multi

    Country: Armenia, Azerbaijan, Georgia, Kazakhstan, the Kyrgyz Republic,Moldova, Tajikistan, Ukraine, Uzbekistan.

    Overallobjectives:

    To improve the transport safety and security environments in the EC Neighbourhoodand Central Asian countries in line with European standards in the field of landtransport

    Specificobjectives:

    To strengthen the institutional and human resource capacities of the nationalauthorities charged with regulating the transport safety and securityenvironments

    To support the elaboration and enforcement of a legal and regulatoryframework for transport safety and security harmonised with international andEuropean standards and best practises

    To raise awareness of land transport safety and security regulations andstandards.

    Plannedoutputs:

    Legal, institutional and organizational assessment of the situation in landtransport safety and security in the beneficiary countries and definition of arelated regional Regional Action Plan in coordination with specialized EUagencies

    Support to rule-making and to the establishment of legal standards for safetypractice (including for freight services and the transport of dangerous goods),institutional capacity building and awareness raising activities in line withrequirements of European standards; support to the creation of working linkswith related European agencies

    Technical assistance to the national security authorities and main securityoperators in the sector of land transport in order to establish Road and RailTransport Security Guidelines and customs-related guidelines for drivers andoperators carrying or handling dangerous goods

    Provision of technical expertise and on-the-job training for the development ofinspection, training programmes and certification structures to ensureimplementation of the safety and security legislation

    Implementation of a safety, security and environment awareness programme

    The Interim progress report is prepared every six months during the period ofexecution of the contract.

    The report consist of a narrative section and a financial section. The financial sectionmust contain details of the time inputs of the experts, of the incidental expenditureand of the provision for expenditure verification.

    No report or document is to be distributed to third parties prior to the approval by theProject Manager of the European Commission.

    2 Summary of project progress since the start

    2.1 Act ivit ies undertaken during Inception Phase

    1) Activities related to Project Management:

    9 The Contract between the Commission Services and the Consortium led by Safegewas signed on the 28

    thNovember 2008.

    9 A k ick-off meeting was held in Brussels on the 5th March 2009,9 t was agreed that the main focus of the project should be upon road transport safety.

    The possibility that at some point during the implementation of the project issuesrelated to rail transport safety might be addressed was not excluded.

    9 the project should also tackle road safety issues, where possible and where resourcespermitted.

    9 The Team Leader mobilised to the region at the beginning of March 2009.9 The Base of Operations has been defined as Tbilisi, Georgia, as per the Terms of

    Reference.

    9 Three long-term junior regional coordinators were appointed in March 2009 andare located in each of the regional offices.

    9 The proposal for the use of the Incidental Expenditure budget line was accepted bythe EC Project Manager and the methodology for use of the IE budget line was agreed.

    9 The newTeam Leader arrived on September2009.9 The Short Term Road Safety Expert started activities on October 20099 An increase on the Incidental Expenditure budget of Euro 300.000 is being discussed.9 The Kick off meeting took place on the 3rd of December 2009 in Baku, the

    presentations and the relevant conclusions of that meeting are attached inAnnex VII.

    9 A second mini Kick off meeting only for the Armenian Delegation took place in Tbilision the 21

    stJ anuary 2010. Relevant information is also included in Annex VII.

    2) Activities related to Project Implementation:

    9 A review of the Terms of Reference (objectives, results, risks and assumptions)

    9 A preliminary review of the structures responsible for land transport and roadsafety in the beneficiary countries and familiarisation with the current institutional andlegal frameworks.

    9 Meetings with the various beneficiaries, A complete list of persons/institutions metis attached as Annex 4;

    9 Visibility Actions.The webpage has been translated to a Georgian server and now isfully operational.

    9 Coordination activities The Team Leader met with the TRACECA PermanentSecretariat in Baku and other relevant Structures of the Beneficiary countries duringthe kick off meeting at Baku.

    9 Translation and dissemination activities.

    3) Missions to beneficiary countries

    J oaquin Rodon (Team Leader) in November to Armenia, in December toAzerbaijan for the kick off meeting. The Mission to Armenia had as objective tosecure the participation of the Armenian counterpart in the project activities and todiscuss on the presence of Armenian representatives in the kick off meeting inBaku. On that occasion it was agreed to perform a dedicated kick off meeting inTbilisi for the Armenian Delegation.

    Menno Langeveld (Legal expert) in September to Georgia and Azerbaijan, inNovember to Kazakhstan and Georgia, and in J anuary 2010 to Georgia. Themissions to Georgia, Azerbaijan and kazahkstan were aiming at building upconsensus on the training schemes to be provided by the projet. The expert wasalso present in the Kick off meeting in Azerbaijan and in a team managementmeeting in Georgia.

    Neville Weeks (Land Transport Safety Expert) in September to Georgia andAzerbaijan. This mission had as objective data collection and identification andfamiliarisation with Beneficiaries in those countries.

    Alaster Barlow (Short Term Road Safety Expert, based in Georgia October toDecember), in November to Armenia, in December to Azerbaijan and Belarus.The mission to Armenia had as objective to identify and familiarise with therelevant representatives of NGOs in the country, the mission to Azerbaijan isrelated to the Kick off meeting and the meeting to Belarus, was aiming atdeveloping regional contacts on Road Safety.

    3 Project Progress in Report ing Period Second Six MonthsPhase

    3.1 Project approach

    The basic approach will remain more or less unchanged from the one outlined in theTechnical Proposal, nevertheless two major changes have been agreed.

    1) Now the priority is set to be the digital tachograph

    9 As from June 2010, the Beneficiary Countries have to be ready to implement the

    digital tachograph. It is clear that most countries have to update their transportlegislation to introduce the digital tachograph, and are in the process of doing so,The project team can provide technical assistance on this matter, in the form ofsupport to legal drafting, training and study tours.

    9 The project will facilitate the discussions. between the National Authorities and theAssociations of International Road Transport Operators (IRU members).

    In parallel, the activities related to legal harmonisation will continue:

    9 Comprehensive Gap Analysis, and which will constitute the basis for the elaborationof

    9 A Regional Regional Action Plan.

    2) The second substantive change relates to Component 3,

    9 This Component has been widened to include elements of Road Safety,particularly where there is a cross-over (e.g. drink/drugs driving seat belts speeding).

    In this section we will described ourachievements in comparison with planned results, thedeviations from original planning and reasons and the specific action needed from the localauthorities

    The essential points to are being monitored are:

    Deviations of milestones and deliverables from their planned dates

    Adherence to the work plan in terms of content of the activities actually carried out

    Deviations in effort needed to complete activity/introduction of work not initially planned

    Shifting of the common understanding of the objectives and priorities betweencontractor and recipient

    Appearance of unexpected difficulties likely to require special measures or shift ofproject resources

    The terms of reference provide a large number of issues to be covered by the project.Nevertheless the number of expertise and the volume of incidental expenditure allocated is farfrom being in line with the ambitious objectives.

    During this period DG MOVE made a clear demand to focus all training activities on theimplementation of the AETR Agreement (Digital Tachograph) and on the ADR Agreement(Dangerous Goods).

    EuropeAid requested the project to follow the request of DG MOVE and the result is that thebulk of available incidental expenditure is dedicated to the organisation of Seminars and StudyTours on the AETR and the ADR Agreements. That meaning that a number of actions foreseenin the ToR would not be anymore feasible due lack of available financing.

    This major shift in relation to the specific objectives of the project should be considered in future

    when monitoring the achievements of the present project.

    3.2 Component 1. Institutional and human resource capacitybuilding

    Component 1: Institut ional and human resource capacity building (ToR)

    This Component has the following objectives:

    To review and upgrade the legal, institutional and organisational framework for themanagement of land transport safety and security issues in the beneficiary states

    To develop a Regional Action Plan to improve the safety and security managementinfrastructure and to define the priorities for the land transport safety and security sector inthe region

    To strengthen the institutional and human resource capacities of institutions responsible forpolicy-making and management issues related to land transport safety and security in theregion

    To identify and strengthen the links with the related European agencies

    Following the ToR, the deliverables for this Component are as a minimum the following:

    Report including Individual Country Diagnostic for all Beneficiaries based upon theFunctional Review and Legislative Gap Analysis drafted

    Summary Report on functional review and legal gap analysis drafted and approved

    Regional Regional Action Plan (as a compilation of Individual Country Regional ActionPlans) drafted and approved

    Support to the Development of Harmonised accident and incident database probably oneharmonisation for central Asia region and one harmonisation for south Caucasus therewill be specific tasks for specific countries, like the development of compulsory insurance insome of the countries.

    Training Needs Assessment of the relevant administrations in the area of Land Transportsafety and security done

    Working links with relevant European Agencies and professional organisations established

    TRACECA regional network on land transport safety and security established

    The Project Team Leader is primarily responsible for the implementation of this Component. Heis supported by the three long-term junior regional coordinators, the other two long-term KeyExperts and the Road Safety Expert.

    This component is further divided in four subcomponents. In order to make reporting clear thesubcomponent 1.1 and subcomponent 1.3 haves been divided in four, referring to the differentresponsible for each part of the subcomponent.

    With regard to the deliverables for this Component requested for this component, somecoments should be made.

    The idea of a Regional Regional Action Plan may be abandon as the present level of regionalcooperation is very limited.

    For the same reason the idea of developing an harmonised accident and incident database maynot be feasible.

    The project is willing to establish links with relevant European Agencies and professionalorganisations but this is not always feasible as per political environment in some of thecountries.

    With the present level of access to information the preparation of a Training Needs Assessment

    of the relevant administrations in the area of Land Transport safety and security done seems yetfar from achievable.

    The idea of preparing a report on Functional Review and Legislative Gap Analysis seems tobe still feasible.

    Sub-component 1.1.1: Functional Review of the Land Transport Safety and Securitysector Mr. Menno Langeveld

    9 To ensure that the TRACECA countries are moving into line with international andEC conventions, laws, regulations and standards.

    9 The TA Team will also carry out a Gap Analysis with respect to the existing legal,regulatory and standards framework related to land transport safety and security issues,notably with respect to the digital tachograph, transport of dangerous goods and vehiclestandards.

    The tasks associated to the finalisation of the Regional Gap Analysis are primarily responsibilityof Mr. Langeveld. During the present reporting period Mr. Langeveld has continued collecting

    data for the Gap Analysis.

    The Gap Analysis includes the revision of existing legislation on transport but also the revisionof the existing legislation related to road safety. In this sense the gap analysis is beingcoordinated with the members of the team involved on road safety issues.

    Due the need for internal coordination related to the objectives of the Gap Analysis it has takenadditional time to clearly define the list of areas in which the project will perform the legal gapanalysis.

    Furthermore, it should be clear that some work on the legal gap analysis has been done alreadyin the Inception Phase, when the project team concluded that two legal instruments, naming theAETR Agreement on driving times and rest periods and the ADR Agreement on road transportof dangerous goods need special attention in our project.

    Based on this preliminary gap analysis and the short training needs assessment, we concludedto implement a special training programme for these legal instruments, which will beimplemented in 2010/2011.

    Below it is presented the table of legal instruments which will be used as tool for the legal gapanalysis.

    Within the EU the UN/ECE Agreements have been addressed by specific directives which candiffer slightly from the agreements. For the legal gap analysis we only mention the UN/ECEAgreements, and not all the EU Directives covering the same issues (for instance all theDirectives and Regulations covering driving times and rest periods and road transport ofdangerous goods).

    Sub-component 1.1.2: Functional Review of the Land Transport Safety and Securitysector Mr. Neville Weeks and ST non key - Land Transport Road Safety

    9 As a part of the functional review there is a need to establish what is the currentsituation regarding road safety in each of the Beneficiary countries.

    9 Process of acquiring detailed information concerning the transport policies,institutional arrangements and legislative and regulatory frameworks in the variousbeneficiary countries.

    9 Functional Review of the Ministries and National Agencies in charge of these issues.The initial purpose of the Functional Review will be to determine whether there is aclear separation of policy-making, administrative and enforcement functions and

    to identify clearly, which institutions are responsible for which functions. The FunctionalReview will be implemented at individual country level and brief country diagnosticreports will be prepared.

    The tasks associated to the Functional Review of the sector are primarily responsibility of Mr.Weeks.

    As a part of this functional review a baseline number of road accidents need to be established.

    3.2.1 Data Collection Existing Situation

    The logical framework mentions two basic indicators of the achievements of the project:

    a) % reduction in road traffic accidents and resultant injuries and fatalities per millioninhabitants

    b) % reduction in the direct and indirect costs of injuries, fatalities and damage to thephysical infrastructure resulting from transport safety and security issues

    Therefore up-to-date general in formation on road safety is being collected for each of theTRACECA Member States. This general information consists of updating, when possible, to2009 the data that WHO hashashas collected and published for 2007. A Situation (progress)

    Report on the data collection activities in all TRACECA countries has been prepared toDecember 31 2009. For additional information see the Annex IX .

    3.2.2 Data Collection on Regulatory Framework

    The project has identified three National experts:

    Legal Expert - Asmat Abesadze (Georgia) 15

    Legal Expert - Samir Akhmedli (Azerbajan) 15

    Legal Expert - Gagik Makarian (Armenia) 15

    These experts finalised the screening of all the legislation related to road safety and roadsecurity in their respective countries.

    The results of the analysis of the legislative framework is now available (these reports areattached to this report asAnnex VI).

    In the next reporting period more Short Term National Experts will be contracted to obtainrelevant information on the state of play on Road Safety and associated legislation in eachcountry.

    3.2.3 Information on Transport Policies and Regional Act ion Plans

    This part has not yet been started in the present reporting period and it is foreseen that there isa need to establish the suitable contacts at country level.

    In the future it may be necessary to involve some National Short Term experts to finalise thetasks related to this section.

    The project much relies on the outcomes of the project "Development of coordinated nationaltransport policies in Central Asian countries (May 2007-December 2008.www.centralasiatransport.comDuring the present reporting period the project team has been fully engaged in preparing therelevant seminars and study tours and no expertise has been allocated to identify suitable

    counterparts at country level to obtain information about the regional action plan. It is expectedthat this activity will be carried out during the next reporting period.

    In the view of compiling the necessary information during the present reporting period theTerms of Reference for Short Term National Experts have been prepared an approved by theEuropean Commission services.

    The Terms of Reference state as specific objectives for these experts

    a) Gather information on the Institutions involved on the management of the national andinternational legislation on land transport safety and security.

    b) Gather information on the relevant legislation, such as the implementation of the AETRconvention on digital tachograph and the ADR convention on carriage of dangerousgoods.

    c) Gather information and disseminate it on Road Safety, notably accidents/incidentsdatabase and Road Safety Awareness Campaigns.

    It is expected that during the next reporting period the Experts will be identified and contracted.

    9 The Review will also address technical issues (accident database for example),communications capacity (existence of a communications policy/communications tools)and staffing levels (are sufficient staff allocated to deal with safety and security issues).It will not address skills levels or training needs at this stage.

    The ST non key - Land Transport Road Safety expert will be the responsible for this task.

    Sub-component 1.2: Elaboration of a Regional Act ion Plan Team Leader

    9 prepare a draft Regional Action Plan. The work will be carried out in close consultationwith Advisory Group, and with experts in the TRACECA Permanent Secretariat in Baku.

    The tasks related to the preparation of the Regional Regional Action Plan have started and weare now in the phase of collection of information. We are conscious that we are at the month 8of implementation and that the Regional Action Plan should be ready in the next 8 months tocome.

    Nevertheless there are major obstacles to achieve the deadline mentioned in the terms ofreference and in the inception report. One is related to the lack of willingness of the Beneficiary

    Countries to invest efforts on that Plan and the other is related to the limited RegionalCooperation in Land Transport Safety and Security.

    Indeed the next issues were mentioned either by the Beneficiary Countries and the TeamLeader in the Baku Kick Off meeting.

    a) The Beneficiary Countries expressed their willingness to have National Action Plansrather than a single Regional Action Plan and that due the disparities of thedevelopments related to Land Transport Safety

    b) To achieve a Regional Action Plan there is a need to have already finished a RegionalStrategy on Land Transport Safety and Security and this one is based on the existence

    of Regional Vision an Goals, which are non existing at present.

    To agree in a common vision and goals it may be necessary to establish a regional workinggroup and to finance a number of regional meetings on the issue. For these activities the projecthas no funds, therefore, at the best, the project will be able to prepare a Draft Regional Visionon Land Transport Safety and Security.

    Sub-component 1.3.1: Strengthening of Institutional Capacity ST non key - LandTransport Road Safety

    9 The Regional Regional Action Plan is likely to throw up a series of issues related to

    strengthening the institutional capacities of the beneficiary institutions. Two areaswhere we believe that we might contribute to institutional capacity building: the firstrelated to developing consultative and communication tools. This matter is dealtwith below in paragraph. The second concerns the development of improvedaccident / incident data collection, analysis and reporting tools .

    This sub-component can only be dealt with once the results of the Regional Action Plan havebeen agreed by all parties.

    Sub-component 1.3.2: Strengthening of Institutional Capacity Mr. Menno Langeveld

    9 The Regional Regional Action Plan is likely to throw up a series of issues related tostrengthening the institutional capacities of the beneficiary institutions. Theintroduction of the digital tachograph will represent a challenge for most of the NationalAdministrations concerned. The TA Team will ensure the identification of potentialweaknesses in the administrative structures.

    This part will be dealt in those countries where the implementation of the digital tachograph willbe a reality.

    At present the degree of advancement of the AETR agreement in the different BeneficiaryCountries is quite different, but in all of them is still far to be fully implemented.

    Azerbaijan, Bulgaria, Kazakhstan, Moldova, Romania, Turkey, Turkmenistan, Ukraine andUzbekistan are signatories of the European Agreement concerning the work of Crews ofVehicles Engaged in International Road Transport.

    But whilst some countries have started timid actions to start implementation, like Ukraine,Moldova, Kazakhstan and Turkey other countries are still in the embryo phase, likeUzbekistan.

    Georgia, Tajikistan, and Kyrgyzstan are not even signatories of the Agreement.

    Sub-component 1.3.3: Strengthening of Inst itut ional Capacity Mr. Neville Weeks

    9 The Regional Regional Action Plan is likely to throw up a series of issues related tostrengthening the institutional capacities of the beneficiary institutions. Variousareas related to road safety are in need for strengthening of the Institutional capacity.

    This part will be responsibility of the Land Transport Safety Expert.

    This part may be based on delivery of regional trainings and at present the project lacks of anyresources to finance those regional trainings.

    9 Training Needs Analysis in parallel with the work being done on the Functional review.Based on the outcome of that Training Needs Analysis and the contents of the RegionalRegional Action Plan, other issues may also be included into the generic trainingprogramme.

    9 Af ter the Training Needs Analysis it will be decided if there is a need for generictraining or for Train the Trainers. In this case the TA team will prepare in-servicetraining materials.

    The tasks related to the preparation of the Training Needs Analysis have not yet started.

    In future a network of Local Short Term Experts may be established and based on theirexperience the project may be able to identify areas for future training.

United Nations Economic Commissions for Europe Transport Section (UN/ECE) which is responsible for AETR and ADR Agreements. TheConfederation of Organizations in Road Transport Enforcement (CORTE).

    9 Close contacts are established and maintained with the leading Europeanstructures involved in road and land transport safety and security issues: DGTREN, the European Road Safety Observatory, the CARE database, the EuropeanRoad Safety Charter, the Global Road Safety Partnership (GRSP), and the World Bank

    (ECA Department).

    3.2.5 CORTE

    During this period there have been contacts with CORTE, to involve this organisation in theimplementation of the training programme on digital tachographs (AETR) and transport ofdangerous goods (ADR).

    As a result of these contacts a full Technical Proposal has been prepared. The proposal is

    attached asAnnex IV to the present report.

    3.2.6 Monitoring Regional Conferences

    3.2.6.1 First Global Ministerial Conference on Road safety

    A high-level Conference and Exhibition on Road Safety took place in Moscow during November2009, under the sponsorship of the World Bank Global Road Safety Facility, World HealthOrganisation (WHO), and the FIA Foundation. The resulting Declaration from the Conferencehas been obtained and is included as an annex to the Situation Report on road safety forTRACECA countries. See Annex IX.

    3.2.7 Contacts with other Donors and IFIs

    3.2.7.1 Road Safety Projects in TRACECA Member States.

    Research has also been started on recent, ongoing and planned road safety projects in theTRACECA Member States.

    This has obtained information about ongoing World Bank-funded road safety projects inGeorgia, Armenia and Ukraine, together with plans for a new road safety project inAzerbaijan start ing in late-2009.

    Information is also being sought about other, similar projects in other TRACECA MembersStates, with funding provided by the World Bank, ADB, EC/EAR, and possibly bilateral

    agencies, which include a specific road safety component, or have elements which addressidentified safety and/or security issues within the context of the LTSS Project.

    The World Bank hosted a Road Safety Workshop in Georgia on September 18th 2009 andthe LTSS Regional Coordinator attended and obtained relevant information, includingGeorgias Road Safety Law, and reports on the Road Safety Strategy and Act ion Plan.

    In general, IFI agencies are expressing cooperative attitudes towards maintaining contactand sharing information to help develop an appropriate LTSS Regional Action Plan .

    3.3 FIA Aff iliated clubs meeting. Minsk

    The meeting was organized by the FIA federation international de automobile and theBelarusian Auto Moto Touring club.

    The objective of the meeting is to raise regional public awareness and to increasecooperation between the countries in the region. Representatives of Armenia, Azerbajan andMoldova have already confirmed their participation.

    This meeting was a good opportunity to increase our contacts related to the component 3 of ourproject at regional level.

    Mr Barlow was invited by the PRS to attend a conference in Minsk, Belarus organised by theBelarus Automobile Club in December. He made a presentation to the attendees about theLTSS project and this produced an enthusiastic response, leading to many more contacts withinthe region and other UK and European organisations with interests in the road safety situation

    in the region.

    3.4 104th

    session of the UNECE SC1. Geneva

    The Secretariat UNECE suggested to beneficiary countries to hold a seminar regarding thenecessary issues for practical implementation of digital tachograph in countries which are not apart of EU on October 22, 2009 in Geneva.

    This meeting took part under the aegis of UNECE and was connected with 104th

    session ofSC1. It was organized and held by experts of CORTE working under EU MIDT project(monitoring implementation of digital tachograph).

    The session provided with the valuable support to countries preparing tachographimplementation until J une 2010.

    The Project financed the participation of two experts of the Kazahk Administration in the specialsession on the implementation of the digital tachograph by the non-EU Contracting Parties tothe AETR in Geneva (Switzerland) on the 22nd of October 2009.

    The experts were, Marat BAGRAMOV, Key expert of Strategical Planning at the InternationalCooperation Department and Bolat ALDABERGENOV- Key expert of Transport at theCommunications Complex Department.

    3.5 Component 2. Strengthening the legal, regulatory andstandards framework for land transport safety

    Component 2 Strengthening the legal, regulatory and standards framework forland transport safety (ToR)

    This Component has the following objectives:

    To provide policy advice and technical assistance to the establishment of a legal, regulatoryand standards framework for road and land transport safety and security;

    To strengthen human resource capacities with respect to legal and regulatory drafting and

    enforcement;

    To establish and implement Land Transport Security Guidelines

    Following the ToR The deliverables for this Component are as a minimum the following:

    Support provided to legal drafting with respect to AETR, ADR Agreements

    Beneficiary states assisted to meet June 2010 deadline of implementation of Tachograph

    Support provided to those beneficiary states wishing to sign the AETR and ADRConventions

    Training Programme on AETR and ADR designed and delivered

    Study tours on AETR and ADR organised and delivered

    The different tasks of this component are leaded by the Legal Expert who has the support of theTeam Leader and various National Short Term experts to be identified.

    During the present period the project has focus on the preparation and delivery of the trainingsand study tours related to the AETR Agreement.

    All information concerning those activities has been regularly published in the project dedicatedwebpage.

    Therefore the only activity related to support the countries with new laws and regulations is thedocument called Why Georgia shall joint AETR Agreement. Here presented inAnnex 7.

    The project is designed to provide support to the Beneficiary countries to meet the deadline ofJ une 2010 to implement the digital tachograph, nevertheless in some countries the relevantnecessary legislation is not yet in place and this Project or the European Commission Serviceshave no power to interact on the internal dynamics of the legislative and administrative processof the TRACECA Countries.

    during the Inception Phase, it became clear that two issues, the introduction of the digitaltachograph and the road transport of dangerous goods will certainly need to be tackled duringthe lifetime of the project and support provided to legal and regulatory drafting and thedefinition of relevant standards.

    9 A comprehensive legislative and regulatory drafting Work Programme for 2010 and2011 will be defined following the adoption of the Regional Regional Action Plan. It is clearthat the project cannot cover the vast range of Directives/Regulations/Standards and thepurpose of the Regional Regional Action Plan will be to define and agree on the priorities ofwhich the digital tachograph (corresponding to the AETR Agreement) and road transport of

    dangerous goods (corresponding to the ADR Agreement) will be the main pillars.

    9 Several of the beneficiary states are not as yet signatories of the AETR and ADR. The TATeam will, if requested, provide advice and technical assistance to those nationalauthorities, which wish to seek membership and ratify the Conventions and Protocols.

    3.5.1 Digital Tachograph

    Mr. Langeveld, The Key Expert 2 started to work on support the introduction of the DigitalTachograph and together with the long-term regional coordinators has begun the necessary

    preparatory work for the implementation of the specialist training programme. Contact withUN/ECE were established (Ms. Virginia Tanase).

    3.5.2 Road Transport of Dangerous Goods

    The legal and regulatory framework for the ADR agreement will be tackled later on the projectimplementation, including a specific training workshop and study tour. See also section 3.3.5

    3.5.3 Vehicle Standards.

    The legal and regulatory framework for the vehicle standards will be tackled later on the projectimplementation. The issue was discussed during the Baku Conference, where it was agreedthat this will be of lower priority to our project.

    A letter was sent to all the TRACECA National Secretaries on December 2009 in order toassess which of the countries were in need of particular assistance on the issue. At the end ofthe preparation of this report, May 2010, there has not been any reaction from the beneficiarycountries.

    At the end of the second interim period, the bulk of the incidentals are committed to delivertraining on AETR issues and all the remaining working days will be committee for Short TermNational Experts as requested by the TRACECA National Secretaries during the kick offmeeting. Therefore with the present budget and the present availability of expertise this activitymay be disregarded.

    Nevertheless once the activities related to AETR agreement finished the project may seek foradditional resources to appropriately focus on this part of the assignment.

    Sub-component 2.2.1: Strengthening human resource capacities Mr. Menno Langeveld

    To provide training for the officials involved in the implementation of the digital tachograph(AETR) and road transport of dangerous good (ADR). training will be provided in the followingareas:

    the digital tachograph;

    the road transportation of dangerous goods;

    The participants of the training programmes and study tours will be selected in closeconsultation with the project partners and the TRACECA Permanent Secretariat in Baku.

    3.5.4 Digital Tachograph

    The project is working to define the training programme on digital tachograph. A planning isbeing prepared.

    The AETR training will be done in a very tight timeline with materials in Russian and it shouldclearly be training from the EU, financed by the Commission. 6 workshops will be organized; 3in Almaty for the Central Asian countries and 3 in Tbilisi. These 3 workshops will be thematicand require the attendance of different participants, see below:

    Workshop 1 and study tour 1 will

    deal with following issues:

    1. Type approval

    2. Security policy3. Card issuing4. Data Exchange5. Data protection6. Risk managementWe look for experts involved in the tachograph cardissuing, from the type approval of these cards to theirend delivery

    Study tours will be organised following the same methodology than the trainings, i.e. organisedtaking into consideration the specificities of the issues to be covered.

    This training programme is to be implemented urgently as the deadline for the mandatoryapplication of the digital tachograph Is 16

    thJune 2010.

    3.5.5 Road Transport of Dangerous Goods

    The project is working to define the training programme on ADR regulations. For this 1workshop will be organised in Almaty and 1 workshop in Tbilisi, both covering the same issuesbut for different beneficiary countries. Additionally 1 study tour will be organised.

    Sub-component 2.2.2: Strengthening human resource capacities To be identified

    To provide training at those involved in legal and regulatory drafting andmetrology/certification/accreditation and enforcement. training will be provided in the followingareas:

    vehicle standards (EURO 3-4-5)

    The participants of the training programmes and study tours will be selected in closeconsultation with the project partners and the TRACECA Permanent Secretariat in Baku.

    3.5.6 Vehicle Standards.

    No Training is yet defined for the implementation of the legal and regulatory framework relatedto vehicle standards. During the Baku conference in December 2010 this issue was regarded tobe of a lower priority according to the beneficiary countries.

    But due the limited resources available and the lack of interest of the Beneficiary Countries onthe issue is highly probable that the project will not have any involvement on the issue.

    Sub-component 2.3: Establishment and implementation of ADR Guidelines Mr. MennoLangeveld

    9This activity aims to assist the Beneficiary Countries become party to the UN/ECE ADRAgreement.

    To date the project has not been called to assist on the implementation of the ADR regulations.

    The drafting of the Road Transport Security Guidelines mentioned in the technical offeris not considered of actuality.

    3.6 Component 3. Awareness raising and disseminationmeasures Land Transport Safety/Road Safety

    Component 3: Awareness raising and dissemination measures (ToR)

    The objectives under this Component are:

    To assist in the preparation of awareness campaigns in the field of road and land transportsafety and security;

    To implement a communications strategy;

    To identify and disseminate best practice, with respect to land transport safety and

    security

    To assist with specific aspects of road safety identified on a national basis.

    The deliverables for this Component are as a minimum the following:

    Create a webpage with relevant materials and resources and relevant links.

    Best practice identified and disseminated

    One study tour organised and delivered (provisional)

    Support provided to prepare and broadcast a television series on road and land transportsafety issues (provisional)

    Public authorities, private sector and Civil Society Organisations networked with otherbodies.

    3.6.1 Best Practices

    As mention in the inception report a Road Safety Short Term Non Key Expert, Mr. Barlow, wasidentified and started activities in October 2009. Mr. Barlow has started to identify organisations,both locally and internationally, who would be prepared to allow countries within TRACECA touse their publicity and educational materials, and also whether it would be possible to sharethese materials via the LTSS Website. He is also compiling a list of resources from international

    organisations which give guidance on best practice in Road Safety Engineering and RoadSafety Audit. These documents will also be available through the project website.

    Sub-component 3.1: Assisting the responsible national authorities to prepare awareness andcommunications strategies linked to road and land transport safety and security ST non key -Land Transport Road Safety

    9 Implementation of a web-based awareness and communications programme. this wouldmake available examples ofbest practice from EU Member States and from the TRACECAcountries. It would also communicate information and progress, seek feedback withrespect to road and land transport safety and security issues and will be targetedprincipally at the public authorities responsible for road land transport safety/security issues. Itwould also include the translation and dissemination of European and International policydocuments, regulations and standards.

    9 to advise and assist the National Authorities in each of beneficiary countries to use

    their own websites as tools for disseminating information to Transport Associations,transport users and the general public and for receiving comments on draft legislation /regulations / standards.

    9 To use the website to disseminate materials on four different types of best practise: first,examples of legislative and regulatory drafting; second, tools for collection and analysis ofaccident / incident data and its incorporation into policy and infrastructure design decision-making; third, modern enforcement tools and practices; and finally, awareness materialstargeted at getting the safety and security message over to the general public and transportusers.

    9 To continue discussions with television producers to determine whether or not the projectmight participate in and contribute to the preparation and broadcasting of the television series.

    9 The TA Team would be available to provide advice and assistance to implement theirawareness and communications strategies.

    3.6.2 Website

    9 We intend to identify and provide support to non-governmental organisations in theTRACECA countries. The support will take the form of advice, training and theprovision of materials. The goal will be to energise these NGOs and to assist them to

    undertake further awareness campaigns amongst schools and local businesses.

    9 We have provisionally budgeted for a Study Tourto the United Kingdom for both publicauthorities and NGOs to witness how the public sector and civil society organisationscombine their efforts in order to raise awareness of road and land transport safetyissues. The selection of the UK as a destination is contingent upon the agreement ofthe beneficiaries

    9 Networking. For example, it would be important for the national authorities, privatesector organisations and civil society structures to network with agencies (both publicand non-governmental) in their Countries and, if possible, in EU Member States.

    3.6.3 Non Governmental Organisations

    Mr. Weeks, Land Transport Safety Expert, has established contact with the NGO Partnershipfor Road Safety (website www.safedrive.ge), whose main focus is on improving publicawareness of road safety in Georgia, including campaigns (seat belts) and safety education inschools. The NGO is involved in the World Banks road safety activities in Georgia andreceives funding from USAID, FIA and others. Mr. Weeks is providing ongoing assistance, onan as required basis, in support of the NGOs advocacy programme to increase the use of seat-belts in Georgia.

    Mr Barlow, Short Term Road Safety Expert, has also met with the Partnership for Road Safety(PRS) in Georgia, as well as representatives from the National Road Safety Council in Armenia,National Road Safety Council in Moldova and HAYAT the NGO responsible for road safety in

    Azerbaijan. He has also made contact with the Director General of the FIA Foundation who hasprovided contact details for the Automobile Clubs in the region, many of which haveresponsibility for road safety projects within their countries.

    Mr Barlow was also invited by the PRS to attend a conference in Minsk, Belarus organised bythe Belarus Automobile Club in December. He made a presentation to the attendees about theLTSS project and this produced an enthusiastic response, leading to many more contacts withinthe region and other UK and European organisations with interests in the road safety situationin the region.

    Sub-component 3.3: Supporting the introduct ion o f Road Safety Engineering practices inthe TRACECA Countries Mr. Nevil le Weeks

    9 It is anticipated that local road safety practitioners can be made aware of road safety

    engineering techniques and procedures required for accident reduction (viainvestigations and development of remedial measures at identified accidentblackspots) and for accident prevention (via road safety audits of planned new roads orroad improvements). This will require an assessment of the quality of accidentrecording and databases that is available in the TRACECA countries.

    A Road Accident Database is oriented to record specific data about individual road trafficaccidents in this sense the data collected here (usually by the Traffic Police) is completelydifferent from the general data collected under component 1.

    This will enable local authorities to focus resources on areas with specific problems.

    It is expect that at the end of the project the process of collecting data by local authorities will beself-sustainable.

    Sub-component 3.4: Supporting the introduct ion o f Road Safety Engineering practices inthe TRACECA Countries Mr. Nevil le Weeks

    9 On 19th Nov 2008, the EC issued a Directive (2008/96/EC) aimed at the introduction ofa comprehensive system of road infrastructure safety management for the trans-European road network, including the formalization of procedures for road safety

    impact assessments and for road safety audits.

    Road safety experience is essential in enabling Safety Auditors to identify road safetyproblems and assisting them in making appropriate recommendations. The EC Directiverequires road safety auditors to have specific qualifications and training, which has implicationsfor the introduction of formal audits in TRACECA countries, including harmonisation of laws onroad safety.

    3.6.4 Road Safety Directives for EU Member States

    3.6.4.1 EU Directive on Road Infrastructure Safety Management, Nov 2008.

    On 19th Nov 2008, the EU issued a Directive (2008/96/EC) aimed at the introduction of acomprehensive system of road infrastructure safety management for the trans-European roadnetwork. The Directive focuses on 4 Procedures to be applied in the planning andconstruction of new roads and/or modifications to the existing road network and duringcontinuous operation of the road network. The Procedures focus on measures to achieveaccident reduction and prevention.

    The Procedures measures require:

    Road safety impact assessment

    Road safety impact assessment is needed at the pre-design stage

    Comparative analysis at the strategic level of the impact of planned roadworks andalternatives on the safety performance of the network;

    and

    Road safety audit (RSA)

    Independent systematic safety check of road infrastructure projects, covering eachstage (planning to completion) to identify unsafe features.

    EU has proposed a 3-part schedule for Member States to introduce the Procedures andimprove the Safety Management of Roads:

    (i) By 19th Dec 2010Establish and adopt all laws, regulations and administrative provisions;

    (ii) By 19th Dec 2011Establish and adopt all guidelines required to enable use of the Procedures; and

    (iii) By 19th Dec 2011Establish and adopt training curricula for road safety auditors.

    The Member States must introduce the procedures according to the timetable.General information about the 2008 EU Directive has been passed on during the mission

    9 The Council of European Ministers of Transport in their resolution 93/4 on lorries androad traffic safety (CEMT/CM(93)4/FINAL) stipulated the importance of thedevelopment of ancillary infrastructure (rest and parking areas) to improve the physicalcomfort of lorry drivers and thereby create safer conditions.

    9 The EU Directive 2008/96/EC on road infrastructure safety management recognisesthat a sufficient number of safe rest areas is important for crime prevention (security)and road safety, by reducing fatigue and tiredness of long-distance drivers.

    3.6.5 Secured Parking Areas

    At present the TA team has initiatedinitiatedinitiated dialogue with National Authorities on theidentification of possible locations considered feasible for the construction of the securedparking areas in the main TRACECA corridors.

    Next to the earlier mentioned EU Directive, the AETR Agreement calls for regulated drivingtimes and rest periods. In order to enable drivers to use the rest periods on a safe and secureway, proper parking spaces have to be present on the TRACECA corridor.

    3.6.6 Mission to Sarp Border Between Georgia and Turkey.

    On October 2009 the Team Leader and the Short Term Road Safety Expert visited the bordercrossing at Sarp between Turkey and Georgia in order to assess the existing resting areas forinternational truckers.

    On that occasion we where told that there where no real rest areas in the vicinity of the bordercrossing, but only some restaurants and bars with dedicated area to truck parking.

    Later on February 2010 we have been informed by the TRACECA National Secretary ofGeorgia that a plan to build eight resting areas on the road Sarp to Azeri border has beenapproved.

    3.6.7 Pilot Project in Kyrgyzstan

    In Oct 2009, the World Bank approved a 'National Road Rehabilitation Project' for Kyrgyz,

    which includes for improvement of the Osh-Batken-Isfana Road Corridor, with the assumption ofEU (and EBRD) contribution on the Kok-Talaa to Pulgon section.

    Pulgon is apparently to be used to showcase road safety planning and pilot demonstrationprojects, which (presumably) could include for safe/secure parking areas for heavy trucks atstrategic (and high risk) locations along the road corridor.

    In the Inception Report of the present project it was mentioned that the project mayProvide technical assistance on safe/secure parking areas p ilot project (Kyrgyz) and roadsafety impact assessments (part of EU Directive on Road Infrastructure Safety Management)(ref: IR para. 3.0.12/13).

    At the end of the second interim period, all the incidentals are committed to deliver training onAETR issues and all the remaining working days will be committee for Short Term NationalExperts as requested by the TRACECA National Secretaries during the kick off meeting.Therefore with the present budget and the present availability of expertise this part of theproject is not feasible anymore.

    At most the socio-political situation in Kyrgyzstan has much deteriorate making non advisable tosend international experts to the country in the months to come.

    4 Project planning for next reporting period

    In this chapter of the report we have tried to summarize the important observations forproject success and we have made proposals for adjustment of overall project planning andtheir consequences

    4.1 Component 1. Institutional and human resource capacitybuilding

    Sub-component 1.1.1: Functional Review of the Land Transport Safety and Securitysector Mr. Menno Langeveld

    4.1.1 Legal Gap Analysis

    The project will continue to concentrate its activities on the Gap Analysis, which may lead to adraft vision for a Regional Action Plan.

    The project will concentrate on assistance with the introduction of the digital tachograph(corresponding to the AETR Agreement).

    From the view of road safety the digital tachograph is however not more than a tool to check thedriving times and rest periods of international truck drivers. As these drivers tend to makelong hours, they can become fatigue and more likely to be involved in road accidents.

    Therefore the Gap Analysis will also look into detail into the legislation covering these driving

    times and rest periods. Additional issues to be analysed will be: Road transport of dangerous goods (ADR Agreement) Speeding, alcohol and safety belts and Roadworthiness

    The works on the legal gap analysis will continue in the next reporting period.

    Sub-component 1.1.2: Functional Review of the Land Transport Safety and Securitysector Mr. Neville Weeks

    4.1.2 Data Collection Existing Situation

    The activities for the next 6 months will continue to be focused on the data collectionactivities, together with follow-up missions as necessary, and analyses to determine anygeneral (i.e. Region-wide) and specific needs within the context of the objectives of the LTSSProject, which are not part of other ongoing or recent road safety projects.

    The timing for this will be dependent on data availability and the speed with which it may becollected and analysed for the 9 countries.

    It is envisaged that the data collection will also identify, via a Gap Analysis and linked to Sub-component 1.1.1, where existing legislation in TRACECA countries requires additions in orderto strengthen road safety strategies and other requirements aimed at addressing identifiedaccident causal factors (e.g. drink-driving, non-seatbelt and/or crash helmet wearing, etc) andfor the introduction of road safety audits as per the EU Directive.

    The works on the accident databases will continue in the next reporting period.

    4.2 Component 2. Strengthening the legal, regulatory andstandards framework for land transport safety

    Sub-component 2.1: Establishment of a legal, regulatory and standards framework forland transport safety and security Mr. Menno Langeveld

    4.2.1 Draft Legislation

    Mr. Langeveld will continue to provide support to prepare draft legislation if so requested by theBeneficiary countries. In matters of accession to international agreements the project will mainlyfocus its activities on the AETR and ADR Agreement.

    Sub-component 2.2.1: Strengthening human resource capacities Mr. Menno Langeveld

    To provide training at those involved in legal and regulatory drafting and

    metrology/certification/accreditation and enforcement. training will be provided in the followingareas:

    the digital tachograph;

    the transportation of dangerous goods;

    4.2.2 Digital Tachograph

    A training and study tour programme will be implemented further. This programme will be fullyimplemented before the deadline for implementation of AETR agreement, which is before J uly2010.
