    SECTION 1. SHORT TITLE. 3

    This Act may be cited as the Internet Freedom 4

    Act. 5

  • 2 SEC. 2. LIMITATION ON AUTHORITY OF FCC. 1

    (a) IN GENERAL.The rule adopted by the Federal 2

    Communications Commission in GN Docket No. 1428 on 3

    February 26, 2015 (relating to broadband Internet access 4

    service) shall have no force or effect, and the Commission 5

    may not reissue such rule in substantially the same form, 6

    or issue a new rule that is substantially the same as such 7

    rule, unless the reissued or new rule is specifically author-8

    ized by a law enacted after the date of the enactment of 9

    this Act. 10

    (b) EXCEPTION.This section does not apply to any 11

    rule that the Federal Communications Commission deter-12

    mines necessary 13

    (1) to prevent damage to the national security 14

    of the United States; 15

    (2) to ensure the public safety; or 16

    (3) to assist or facilitate any actions taken by 17

    a Federal or State law enforcement agency. 18

    (c) RULE DEFINED.In this section, the term rule 19

    has the meaning given such term in section 804 of title 20

    5, United States Code. 21

Limitation on authority of FCC (a) In general The rule adopted by the Federal Communications Commission in GN Docket No. 1428 on February 26, 2015 (relating to broadband Internet access service) shall have no force or effect, and the Commission may not reissue such rule in substantially the same form, or issue a new rule that is substantially the same as such rule, unless the reissued or new rule is specifically authorized by a law enacted after the date of the enactment of this Act. (b) Exception This section does not apply to any rule that the Federal Communications Commission determines necessary (1) to prevent damage to the national security of the United States; (2) to ensure the public safety; or (3) to assist or facilitate any actions taken by a Federal or State law enforcement agency.
