Inrecentyears,theinternationallegalsystemhasbeenchallengedathomeandabroad.Growingnationalism,shiftsingeo-politicalpower,deepeningeconomicinequality,climatechange,andaglobalmigrationcrisishavegeneratedcracksintheestablishedinternationalorder.Theseschismshavebeenexacerbatedbyotherfactors, includingthepower of private corporations over speech platforms and personal data and the rapid progression of newtechnologiessuchasartificialintelligenceandmachinelearning.Evenourdisciplineisbeingchallengedtomeetthegrowingcalls for inclusivityofdiversevoices.Can the international legal systemadapt toaddress theseprofounddevelopments?ILW2019willaddresstheseissuesandexplore international law’scapacitytopreservetheruleoflaw,promotebothpeaceandjustice,andmaintainstabilityinthefaceofgrowingfaultlines.Theworldischanging.ILW2019seekstoanswerwhetheritstheme—TheResilienceofInternationalLaw—isaquestionoranaffirmation.

ForgingaConventionforCrimesAgainstHumanity
In August 2019, the United Nations International Law Commission completed Draft Articles andCommentary for a crimes against humanity convention. The Draft Articles will be sent to the U.N.GeneralAssemblythisfall,whichwilldecidewhethertousethemforanewglobalconventiononthepreventionandpunishmentofcrimesagainsthumanity,perhapsbyconveningadiplomaticconferenceor by negotiating a final textwithin theAssembly itself. This panelwill discuss the need for such atreaty and highlight the core elements of the Commission’s Draft Articles. Among other things, thepanelwill considerwhether sucha treatywouldassist in atrocity crimeprevention, complement thework of the International Criminal Court aswell as international human rights bodies, and promoteinter-Statecooperationonmutuallegalassistanceandextradition.Finally,thepanelistswilldiscusstheprospectsforadoptinganewglobaltreaty.

HotTopics:BeyondExceptionalism:TheUnalienableRightsCommissionandtheRedefinitionofInternationalHumanRightsDespite remaining largely outside formal human rights treaty systems, the United States has fordecades engaged in a foreign policy that takes human rights into account. CorporateFamiliesinInternationalLaw
Thispanelwillexaminetheroleofinternationallawinregulatingmultinationalcorporations(MNCs)aswellastheroleofMNCfamilies inshaping international law. Manyof thecorporateregulatoryconcernsthatwehave–thelackofjurisdictionforextraterritorialhumanrightsviolations,theabilitydodgetaxlawthroughtheinternationalmovementofassets,theabilitytoshopforinvestmenttreatyprotection, and theavoidanceof environmental regulation throughmanufacturing relocation–areprimarily possible due to the corporate family structure that permits almost unlimited subsidiary“children,” each with their own separate legal personality (for jurisdictional purposes) and limitedliability. The panel will discuss how the subsidiary structure is central to the MNC governancechallenge. Itwillalsoconsiderhowjudicializeddomainsof international lawhaveprovenunabletoeffectively grapple with corporate families, as in the case of investor-State dispute settlement.Ultimately, this panel aims to refocus attention to the family nature of MNCs – particularly theirability to create a family of separate legal entities on demand, and discuss how to address thisconcernwithdomesticandinternational law.
