TARIFF FORMAT

A. Sheet Numbering - Sheet numbers appear in the upper right corner of the sheet. Sheets are numbered sequentially. However, new sheets are occasionally added to the price list. When a new sheet is added between sheets already in effect, a decimal is added. For example, a new sheet added between Sheets 14 and 15 would be Sheet 14.1.

B. Sheet Revision Numbers - Revision numbers also appear in the upper right corner of each sheet.

These numbers are used to determine the most current sheet version. For example, the 4th Revised Sheet 14 cancels the 3rd Revised Sheet 14. Consult the Check Sheet for the sheet currently in effect.

C. Paragraph Numbering Sequence - There are nine levels of paragraph coding. Each level of

coding is subservient to its next highest level.

D. Check Sheets - When a price list is changed, an updated Check Sheet accompanies the price list filing. The Check Sheet lists the sheets contained in the price list, with a cross reference to the current revision number. When new sheets are added, the Check Sheet is changed to reflect the revision. All revisions made in a given filing are designated by an asterisk (*) on the Check Sheet. The price list user should refer to the latest Check Sheet to find out if a particular sheet is the most current.

SECTION 1 - TECHNICAL TERMS AND DEFINITIONS Access Line - An arrangement which connects the customer’s location to the carrier’s location or switching center. Application for Service - A standard order form which includes all pertinent billing, technical, and other descriptive information which will enable the carrier to provide the communication service as required. Authorization Code - A numerical code, one or more of which are assigned to a customer to enable him/her to access the carrier, and which are used by the carrier both to prevent unauthorized access to its facilities and to identify the customer for billing purposes. Authorized User - A person, firm, corporation, or other entity authorized by the customer to receive or send communications. Billed Party - The party responsible for payment of charges applicable to intrastate calls placed using the carrier’s services. Busy Line Interruption - A service that provides operator interruption of voice conversation in progress on a called line. Busy Line Verification - A service that provides operator assistance in determining if a called line is in use. Commission - The term “Commission” refers to the Public Service Commission of Georgia. Company or Carrier - Windstream Communications, Inc. Customer - The person, firm, corporation or other entity which orders service and is responsible for payment of charges due and compliance with the company’s price list regulations. Day - From 8:00 a.m. up to but not including 5:00 p.m. local time Monday through Friday. End User - The term “end user” denotes an individual who places and/or accepts calls placed over the carrier’s services. The end user may or may not be directly responsible for billing of calls, depending upon the payment method selected by the end user. SECTION 1 - TECHNICAL TERMS AND DEFINITIONS Evening - From 5:00 p.m. up to but not including 11:00 p.m., local time Sunday through Friday. Holiday - The Company’s recognized holidays are New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. No holiday discounts are included. Local Call - Any call which, if placed by a customer over the facilities of a local exchange telephone company, would not be rated as a toll call. Measured Charge - A charge assessed on a per minute basis in calculating a portion of the charges due for a completed call. Measured Use Service - A charge assessed on a per minute basis in calculating a portion of the charges due for a completed call. Message Telecommunications Service (MTS) - Regular telephone service comprised of Direct Distance Dial and Operated-Assisted calls. Basic long distance service. Mileage - Airline miles between calling areas. The airline mileage distance between the origination and termination of a telephone call. Night/Weekend - From 11:00 p.m. up to but not including 8:00 a.m., local time Sunday through Friday, and 8:00 a.m. up to but not including 5:00 p.m. local time, Saturday. Payment Method - The manner which the customer designates as the means of billing charges for calls using the company’s service. Payphone Surcharge – A surcharge that applies to completed intrastate, interstate and international long distance calls placed from any domestic payphone used to access the Company’s services. This includes calling card service, toll-free service, and prepaid calling card service. The Payphone Surcharge is in addition to any other applicable service charges or surcharges. The Payphone Surcharge does not apply to calls placed from pay telephones at which the Customer pays for the service by inserting coins during the progress of the call. Points of Presence (POP) - Point-of-Presence is the physical point where the LEC facilities and the carrier’s leased facilities interconnect or where the T-1.5 digital facility interconnects with the carrier’s leased facilities. Service Agreement - Company’s standard form for the ordering and acceptance of a customer’s request for and commitment to take the company’s service offerings pursuant to this price list. SECTION 1 - TECHNICAL TERMS AND DEFINITIONS Switched Access - If the customer’s location has a transmission line that is switched through the LEC to reach the carrier’s POP, the access is considered switched access. Telecommunications - The transmission of voice communications or, subject to the transmission capabilities of the service, the transmission of data, facsimile, signaling, metering, or other similar communications. Toll Call - Any call extending beyond the local exchange of the originating caller which is rated on a toll schedule by the local exchange telephone company. Travel Card Service - A billing mechanism which enables a subscriber or customer to access the services of the carrier while away from home or office. SECTION 2 - RULES AND REGULATIONS

2.1 Undertaking of Company

Company’s services and facilities are furnished for intrastate communications originating at specified points within the State of Georgia under terms of this Price List. Company installs, operates, and maintains the communications services provided hereunder in accordance with the terms and conditions set forth under this Price List. It may act as the customer’s agent for ordering access connection facilities provided by other carriers or entities, when authorized by the customer, to allow connection of a customer’s location to Company’s point-of-presence. Company’s services are provided on a monthly basis, unless ordered on a longer term basis, and are available twenty-four hours per day.

2.2 Limitations 2.2.1 Service is offered subject to the availability of facilities and the provisions of this Price

List. 2.2.2 Company reserves the right to discontinue furnishing service, or limit the use of service

necessitated by conditions beyond its control, or when the customer is using service in violation of the law or the provisions of this Price List.

2.2.3 All facilities provided under this Price List are directly controlled by Company and the

customer may not transfer or assign the use of the service or facilities, except with the express written consent of Company. Such transfer of assignment shall only apply where there is no interruption of the use or location of the service or facilities.

2.2.4 Prior written permission from Company is required before any assignment or transfer.

All regulations and conditions contained in this Price List shall apply to all such permitted assignees or transferees, as well as all conditions for service.

SECTION 2 - RULES AND REGULATIONS

2.3 Liabilities of the Company 2.3.1 Company’s liability for damages arising out of mistakes, interruptions, omissions,

delays, errors, or defects in the transmission occurring in the course of furnishing service or facilities, and not caused by the negligence of its employees or its agents, in no event shall exceed an amount equivalent to the proportionate charge to the customer for the period during which the aforementioned faults in transmission occur.

2..3.2 Company shall be indemnified and held harmless by the customer against: Claims for libel, slander, or infringement of copyright arising out of the material, data,

information, or other content transmitted over the Company’s facilities. All other claims arising out of any act or omission of the customer in connection with

any service or facility provided by the Company. 2..3.3 Acceptance of the liability provisions contained in this price list by the Commission

does not constitute its determination that the limitation of liability imposed by the Company should be upheld in a court of law, but the recognition that, as it is the duty of the courts to adjudicate negligence claims and rights to recover damages therefor, so it is the duty of the courts to determine the validity of the exculpatory provisions of this price list.

SECTION 2 - RULES AND REGULATIONS 2.4 Interruption of Lease Facilities Service 2.4.1 Credit allowance for the interruption of leased facilities service which is not due to the

Company’s testing or adjusting, negligence of the customer, or to the failure of channels or equipment provided by the customer, are subject to the general liability provisions set forth in 2A.3.1 herein. It shall be the obligation of the of the customer to notify the Company immediately of any interruption in service for which a credit allowance is desired. Before giving such notice, the customer shall ascertain that the trouble is not being caused by any action or omission by the customer and connected to Company’s facilities.

2.4.2 For purposes of credit computation for leased facilities, every month shall be

considered to have 720 hours. 2.4.3 No credit shall be allowed for an interruption of a continuous duration of less than two

hours. 2.4.4 The customer shall be credited for an interruption of two hours or more at the rate of

1/720th of the monthly charge for the facilities affected for each hour or major fraction thereof that the interruption continues.

Credit Formula: Credit = A x B - outage time in hours. - total monthly charge for affected facility. 2.5 Restoration of Service The use and restoration of service shall be in accordance with the priority system specified in

SECTION 2 - RULES AND REGULATIONS 2.6 County - Wide Calling Plan

No long distance (toll) charges will be applied to any call between two telephones within the same county.

2.6.1 Intra county, intraLATA calls are not processed by carrier. 2.6.2 Intra county, interLATA calls will be exempt from long distance charges. 2.6.3 Company will only originate and terminate calls in counties where county-wide calling

is available as established by the PSC in Docket No. 3921-U. 2.7 Contested Charges

Subject to the conditions described in Section 2A.8 below, for consideration of any disputed charge, a customer must submit in writing to Company within thirty (30) days of the date the bill is issued, the call details and basis for any requested adjustment. Company will promptly investigate and advise the customer as to its findings and disposition. Any undisputed charges must be paid on a timely basis. Any disputed charges that cannot be resolved between a customer and Company may be appealed to the Commission.

2.8 Billing Entity Conditions

When billing functions on behalf of Company or its intermediary are performed by local exchange telephone companies, credit card companies or others, the payment of charge conditions and regulations of such companies and any regulations imposed upon these companies by regulatory bodies having jurisdiction apply.

2.9 Returned Check Charge A charge of $10, or applicable state returned check charge, whichever is less, may be applied if a

check or draft presented for payment of service is not accepted by the institution on which it is written.

SECTION 2 - RULES AND REGULATIONS 2.10 Deposit Company does not require a deposit from the customer. (If deposit is accepted, then as specified

by Rule 515-12-1-.05 of the Georgia Public Service Commission’s Utility Rules.) 2.11 Taxes All federal, state and local taxes (i.e. excise tax, gross receipts tax, sales tax, municipal utilities

tax) are billed as separate line items and are not included in the quoted rates. 2.12 Discounts for Hearing Impaired Customers A telephone toll message which is communicated using a telecommunications device for the deaf

(TDD) by properly certified hearing or speech impaired persons or properly certified business establishments or individuals equipped with TDDs for communicating with hearing or speech impaired persons will receive, upon request, credit on charges for certain intrastate toll charges placed between TDDs. Discounts do not apply to surcharges or per call add-on charges for operator services when the call is placed by a method that would normally incur the surcharge.

2.12.1 TDD The credit to be given on a subsequent bill for such calls placed between TDDs will be

equal to applying the rate applicable to the next lower rate period. 2.12.2 TRS

The credit to be given on a subsequent bill for such calls placed by TDDs with the assistance of the relay center will be equal to 50% for the rate for the applicable rate period. If either the calling or the called party indicates that either party is both hearing and visually impaired, the call discount shall be discounted 25% of the applicable rate.

SECTION 2 - RULES AND REGULATIONS 2.13 Special Promotions The Company may offer, after 7 days notice to the Commission, special promotions of new or

existing services or products of limited periods. These promotions will be offered on a completely nondiscriminatory basis with each customer in the classification of service for which the promotion is offered having an equal opportunity for participation, subject to the availability of products, services and facilities.

2.14 Special Arrangements

Arrangements may be developed by the Company and, at the Company’s discretion, offered on a case-by-case basis taking into account special customer considerations including, but not limited to, volume or term commitments, bundled services, in response to a competitive offering, or for a service not generally offered under this price list. ICB rates and terms will be offered to the Customer in writing and a contract entered into between the Company and the Customer.

(N) 2.15 Ordering Under the American Recovery and Reinvestment Act (ARRA) Under certain circumstances, funds provided under the American Recovery and Reinvestment Act of

2009 ("ARRA") may be subject to certain restrictions, requirements and reporting obligations. The Company may be subject to some of these restrictions, requirements and reporting obligations when services and service components are purchased with ARRA funds. In order to comply with the restrictions, requirements and reporting obligations associated with the use of ARRA funds (if any), the Company must be apprised of them before provisioning the services or service components. Accordingly, the services and service components provided under this price list shall not be used to support the performance of any portion of a project or program which has been funded in whole or in part with grants, loans or payments made pursuant to the ARRA, without the prior written agreement of the Company and Customer regarding any specifically applicable terms, conditions and requirements. Customer shall provide the Company with prior written notice before placing any order that may be funded in whole or in part with ARRA funds. If Customer fails to provide such prior written notice of ARRA funding; or if the parties cannot agree on the terms and conditions (if any) applicable to an ARRA funded order; or if any terms, conditions or requirements (other than those to which the Company specifically agrees in such separate writing) are found to be applicable, then the Company may, in its sole discretion, reject such order or immediately terminate the provision of any affected service or service component without further liability or obligation. SECTION 3 - DESCRIPTION OF SERVICE

3.1. Message Service

Service that is pre-subscribed to business/residential customers.

3.2. Travel Service Within six months after the Effective Date the Company’s service will allow customer to gain access to their long distance service from anywhere nationally to anywhere nationally via discount service billed back to customer’s office account.

3.3. Timing of Calls The customer’s long distance usage charge is based on the actual usage of Company’s network. Usage begins when the called party picks up the receiver. When the called party picks up is determined by hardware answer supervision in which the local telephone company sends a signal to the switch or the software utilizing audio tone detection. When software answer supervision is employed, up to 60 seconds of ringing is allowed before it is billed as usage of the network. A call is terminated when the calling party hangs up. All calls with fractional durations are rounded to the next higher minute.

SECTION 3 - DESCRIPTION OF SERVICE 3.4. Calculation of Distance

This plan cannot be used for and does not include long distance Internet access, fax machines, softphones or data devices, transcript services, business (whether for-profit or not-for-profit), telemarketing, auto-dialed calling, multi-party conference calls (including 3-way calls), party lines, chat lines, adult entertainment lines, calls to 900 and 976 numbers, and calls to access voice mail or information services. Calls to numbers identified as contrary to or in violation of the above policy will be billed at $0.10 per minute, plus applicable taxes, surcharges and fees.

SECTION 5 - SPECIALIZED SERVICES, RATES AND REGULATIONS 5.1 Business One Business One is a commercial offering for single or multi-location customers using switched or

dedicated services on an inbound and/or outbound basis. Special calling card services are also available with this offering. Business One subscribers may utilize the service according to specific contract terms and conditions as described in section 5A.1.1, section 5A.1.2, section 5A.1.3 and section 5A.1.4 for intrastate service.

5.1.1 Contract Terms and Rates - Plan 1 Customers may select a month-to-month plan, a 1 year $50 plan, or a 1 year $1,000

monthly plan. A Business One Customer selecting a 1 year term must commit to a minimum monthly usage as depicted in Section 5A.1.1.A. This minimum usage threshold applies to every monthly billing period during the selected term, and must be paid regardless of the Customer’s amount of usage during other billing periods. 5.1.1.B Nonrecurring Installation of Service Charges for Dedicated Services 5.1.1.B.1 Installation Postponement Charge

The confirmed due date for installation of service may be postponed by the customer according to the following guidelines.

• Customers will be allowed up to three changes from the

original confirmed due date. The sum of the change requests cannot exceed 30 calendar days from the original requested due date.

• Any request to postpone the due date 30 calendar days beyond the originally scheduled due date will result in the order being cancelled. Standard cancellation fees will be applied and a new order request will need to be submitted.

• Customers may not request a due date change later than 3 days before the scheduled due date. From this time, the due date is considered firm and Windstream will complete the installation of the facilities as scheduled.

• Customers will be charged for each requested change to the due date. The charges will be applied on a graduated scale where the closer to the due date the higher the charge. The charges are to be applied as follows:

5.2.2.A The Windstream Prepaid Calling Card Service is accessed using the Windstream toll-free number printed on the card.

5.2.2.B A Customer’s call will be interrupted with an announcement when the

balance is about to be depleted.

5.2.2.C All calls must be charged against an Windstream Prepaid Card that has a sufficient available balance.

5.2.2.D Calls in progress will be terminated by the Company if the balance of

the Prepaid Card is insufficient to continue the call.

5.2.2.E The Customer shall not indicate or suggest to any other party, including the Customer’s own subscribers if any, that any business relationship exists between the Customer, its agents, distributors, or subscribers and Windstream, except that the customer may inform its subscribers that calls placed using the Windstream Prepaid Card account number will be carried over the Windstream network. 6.1. This section contains rates for Intrastate Message Telecommunications Service for current customers at their current locations only.

6.2. Service Charges and Surcharges

A Service Charge is applicable to Customer dialed Calling Card Station, Operator Station and Person-to-Person calls and for Busy Line Verifications and Busy Line Interruptions. This charge is in addition to the per minute charges applicable to a call. When a call is subject to more than one service charge, only the highest service charge applies.

6.4.B Certification - The written certification of the speech or hearing impairment must be presented to the Telephone Company’s Business/Residence Service Center which serves the residence of the certified person. The Telephone Company’s Business/Residence Service Center, upon request, will provide a certification form for use by the applicant.

6.4.C Limitations - The adjustment is provided for use only by the speech or hearing

impaired Customer. It is only applicable to IMTS charges for calls originated from and billed to the Exchange Service number of the residence of the certified speech or hearing impaired person. Only one Exchange Service number at a residence is authorized this rate adjustment.

6.5 Intrastate MTS

6.5.1 Dial Station

6.5.1.1 General

Calls placed between central offices that are 16 miles or less apart will not include a toll charge. The only exception to this would be calls originating in one Central Office and reswitched by a customer or third party served by an office located within 16 miles and terminating to a telephone served by a Central Office greater than 16 miles. These calls will be rated and billed to the originating party as a toll call.

Applies a surcharge to Operator Station and Person-to-Person rated calls when the Customer has the capability of dialing all the digits necessary to complete a call, but elects to dial only the appropriate operator code (A0) and requests the operator to dial the called station.

In addition to any service charges, the surcharge applies to intrastate calls. The surcharge does not apply to:

- Calls where a Customer cannot otherwise dial the call, due to defective equipment or

trouble on the Telephone Company Network, - Calls in which a Telephone Company operator places a call for a calling party who

identifies himself/herself as being handicapped and unable to dial the call because of his/her handicap, or

Windstream Communications, Inc. Formerly STC 800 Service rates and charges apply to calls completed from calling stations in the entire state or from Customer’s selected NPAs within the state to the Customer’s station. Calls from points outside the customer’s selected NPAs will be blocked.

Windstream Communications, Inc. Formerly STC 800 calls are dialed and completed without the assistance of a operator. Windstream Communications, Inc. Formerly STC 800 consists of an Windstream Communications, Inc. Formerly STC 800 telephone number associated with a Customer’s station. Access to the customer’s station is not obtained under this price list.

6.14.B REGULATIONS

6.14.B.1 Provision of Windstream Communications, Inc. Formerly STC 800 Service Windstream Communications, Inc. Formerly STC 800 Service is offered under this price list subject to the availability of suitable service components furnished by this Company or obtained from others.

6.14.B.2 Engineering

Windstream Communications, Inc. Formerly STC 800 Service will be engineered to meet its transmission parameters.

6.14.B.3 Installation

Installation of Windstream Communications, Inc. Formerly STC 800 Service will usually be made during normal working hours.

6.14.B.4 Maintenance

The Company will maintain and repair the service which it provides.

6.14.C Transfer or Assignment Windstream Communications, Inc. Formerly STC 800 Service, including any associated Windstream Communications, Inc. Formerly STC 800 Service number, may be transferred or assigned to a new Customer.

SECTION 7 – INTRASTATE SERVICE OFFERINGS – Formerly CTC Long Distance Services 7.1 Basic Service

Basic Service is that of furnishing toll connections between two exchange access lines or access line equivalents.

7.1.1 Class of Calls, Service Charges, and Surcharges

Basic Service is offered on a Direct Dial basis.

7.1.2 Timing of Calls

(A) Basic Service rates are quoted in terms of initial and additional minutes.

(1) The initial minute is the first minute or any fraction thereof after connection is made.

(2) The additional minute is each minute or any fraction thereof after the initial minute.

(B) The time of day at the calling party rate center determines whether day, evening, night, weekend, peak, or off peak rates apply.

7.1.3 Charge Determination

The rates and charges applicable at any given time are as specified in this Price List and will be furnished as an informational filing to the Commission by the Carrier. Prior to the effective date of any changes in the rates and charges, the Carrier will furnish the Commission a new price list reflecting changed rates and charges.

(A) The charge for Basic Service is determined by the:

- distance between applicable rate centers - time of day and day of week - duration of call

- class of call

(B) County-wide calling is toll-free regardless of the distance of the call.

(4) If a call begins in one discount period and ends in another, the initial period

discount is the discount in effect at the time the call is established. The charge for each additional minute of usage is the additional minute billing rate for the rate period in which the beginning of each additional minute occurs.

7.1.4 Determination of Airline Mileage

(A) Basic Service rates between points within the state of Georgia (cities, towns, or

localities) are based on the airline distance between rate centers. In general, each point is designated as a rate center; certain small towns or localities are assigned adjacent rate centers with which they are closely associated for communications purposes or by community of interest.

(B) Airline mileages are determined by using vertical and horizontal grid lines which have

been established across the State of Georgia. The spacing between adjacent vertical grid lines and between horizontal grid lines represents a distance of one coordinate unit. A four-digit vertical (V) and a four-digit horizontal (H) coordinate are computed for each rate center from its latitude and longitude location on a map. The intersection of the horizontal grid and the vertical grid identifies the V and H coordinates. The distance between any two rate centers is the airline mileage computed between their respective coordinate intersections, with fractional miles being rounded up to the next mile. The rates applicable to mileage bands are provided in section 3.1.3 (B) preceding.

(C) V and H coordinates for rate centers may be found in the National Exchange Carrier

(D) To determine the rate distance between any two rate centers proceed as follows:

(1) Obtain the "V" and "H" coordinates for each rate center.

(2) Obtain the difference between the "V" coordinates of the two rate centers.

Obtain the difference between the "H" coordinates.

NOTE: The difference is always obtained by subtracting the smaller coordinate from the larger coordinate.

(3) Divide each of the differences obtained in (2) by three, rounding each quotient to

the nearest integer.

(4) Square these two integers and add the two squares. If the sum of the squares is greater than 1777, divide the integers obtained in (3) by three and repeat step (4). Repeat this process until the sum of the squares obtained in (4) is less than 1778.

(5) The number of successive divisions by three in steps (3) and (4) determines the

value of "N". Multiply the final sum of the two squares obtained in step (4) by the multiplier specified in the following table for this value of "N" preceding:

7.2.1 General

(A) Personal 800 & 888 Service is a Wide Area Termination Service (WATS) allowing the originating party to place toll free Intrastate and/or Interstate Calls. The customer is assigned a ten digit "800", "888", or any other toll free number and all calls to this number are routed to the customer's predetermined local number.

(B) Each call is timed with a thirty second initial period and six second increments.

7.2.2 Rates and Charges

The fixed monthly rate following is billed in advance. There are no volume discounts applicable.

7.3 Account Code Service 7.3.1 General

(A) Account Code Service is an optional feature for customer dialed station-to-station

(C) The initial service period is one month. Customers who retain service for less than

one month will be billed the full monthly service charge in addition to any usage billed at the appropriate per minute rate.
