A. GENERAL INFORMATION

Office Open for Election The office open for election is District Representative, Edmonton District. In accordance with Association bylaw 73(1), the term of election for the position will be effective upon the date the candidate is elected. If elected by acclamation that date would be 2016 01 19; if elected by ballot it would be 2016 02 12. The term would have the same end date as that of the current Provincial Executive Council, June 30, 2017.

Edmonton District is one of 11 ATA geographic districts. It encompasses five school jurisdictions whose teachers are represented by five local teachers’ associations, referred to as ATA locals.

District representatives (DRs) are elected for two-year terms by Association members in their geographic district. The role of the DR is to represent Association members employed by the school jurisdictions within their respective districts, ascertaining members’ views, issues and concerns. Another primary role is to act as a resource for ATA locals (local teacher associations) within their district.

About Provincial Executive Council Provincial Executive Council is the body responsible for transacting the business of the Alberta Teachers’ Association. It meets at least nine times each year, including at the Annual Representative Assembly, which also is attended by more than 400 teacher delegates who debate and set Association policy.

Council is made up of five table officers (the Association’s president, two vice presidents, past president and executive secretary) and 15 DRs. General elections are held every two years for president, vice president and DR positions. By-elections for those positions are held when vacancies occur before the two-year Council term ends.

The current term of Council ends 2017 06 30.

B. NOMINATION INFORMATION

Eligibility Criteria

NOMINEES

To be eligible to run in the 2016 Edmonton District By-Election you must not be in receipt of an Alberta Teachers’ Retirement Fund pension and you must either • hold an active ATA membership in good standing and be employed by any of the five school

boards in the geographic district of Edmonton District, • hold an associate ATA membership in good standing and be employed by a school authority in

the geographic district of Edmonton District, or • hold an associate ATA membership in good standing, be employed by an employer without a

local and reside in the geographic district of Edmonton District.

NOMINATORS

To be eligible to officially make or support a nomination, an individual must • be either an active or associate member in good standing with the Association and • be employed in the geographic district represented by the nominee.

Nomination Submission Requirements Each nominee is required to submit a set of fully completed nomination papers consisting of 1. a nomination form, 2. a list of nominators and 3. a nomination acceptance form.

NOMINATION FORM

Nomination forms must be completed by one nominator on behalf of all the other nominators and signed by a witness.

LIST OF NOMINATORS

The list of nominators must contain the names, signatures and specified information of at least 25 nominators.

Nominees may want to secure more than the minimum number of nominators to ensure that at least 25 have the required membership status.

For the purposes of elections, an active member is defined as a teacher employed by at least one school jurisdiction within the relevant geographic district. The Association grants associate member status to persons meeting the prescribed bylaws. Visit www.teachers.ab.ca and search “associate membership” for a definition of that status.

Nomination Confirmation The nominee and nominating signatory receive written confirmation of the nomination from the Returning Officer once 25 of the nominators have their eligibility status confirmed.

Nomination Deadline All nomination and nomination acceptance forms must be received by the Returning Officer by 2016 01 19 at 1700. All required nomination forms are contained in this package and posted on the Association website at www.teachers.ab.ca.

C. ATA ASSISTANCE TO CANDIDATES The ATA provides the following forms of assistance to candidates: 1. Grants 2. Grant advances 3. Publicity 4. School mailing of campaign materials 5. Printing of mailing labels or addressed envelopes (fees apply)

1. Grants To assist candidates with campaign expenses, the Association makes available funding in the form of grants. Grants are available on a one-time basis and issued only upon submission of proof of expenditures and completed campaign expense claim forms.

2. Grant Advances Candidates may request 50 per cent of their grant amount in advance. Requests for an advance must be e-mailed to the Returning Officer and accompanied by an invoice confirming proof of expenditures or expenditures to which the candidate has committed.

3. Publicity for Candidates The Association promotes awareness of the election through its traditional and social media channels (eg, the ATA News, the Association website, its YouTube channel, and its Facebook and Twitter accounts). Publicity afforded specifically to candidates includes • announcement of candidates, • publication of candidate biographies and platforms, and • video recording and posting of candidate campaign speeches.

ANNOUNCEMENT OF CANDIDATES

Upon the close of nominations, the Association announces all acclaimed and contested candidates on its website and, when time frames allow, in the ATA News. Candidates are asked to submit a headshot photo to accompany the announcement. Photos must be submitted to the Elections Administrative Officer by e-mail in a digital format such as JPEG or TIF. Preferred graphic specifications: 2 inches by 3 inches in size and 300 dots per inch (dpi) resolution.

BIOGRAPHY AND CAMPAIGN PLATFORM

Candidates wanting to ensure all members have access to information on which they may base their votes are asked to submit a brief biography and campaign platform summary for publication in the ATA News and on the Association website. Rules for biography and campaign platform submissions are as follows: • bio and platform are to be contained in a single MS Word file; • maximum 500 words for combined bio and platform of candidates for president; • maximum 300 words for combined bio and platform of candidates for vice-president or

district representative; • word count is determined by word count function available in MS Word and • all submissions are edited by the Association for spelling, grammar and length as required. Candidates are to e-mail submissions to the Elections Administrative Officer.

VIDEO RECORDING OF CAMPAIGN SPEECH

As with the publication of biographies and campaign platforms, video recordings of campaign speeches afford all members access to information on which they may base their votes. Candidates have the opportunity to have their campaign speeches recorded and posted on the Association’s website and YouTube channel.

Guidelines

• Candidates will be notified of scheduled recording dates following the close of nominations. • Speeches must not exceed five minutes in length. • Each candidate is provided a 15-minute time slot in which to record his or her speech.

Process (Within the 15-Minute Time Slot)

• Candidate is allowed time to become familiar with the equipment and setting, and to practise the speech.

• Candidate indicates when he or she is ready to begin recording. • A five-minute timer is started when the candidate begins speaking. • Candidate is provided with a visual cue during the take when one minute remains and again

when 20 seconds remain. • Candidate is allowed only one opportunity to restart once recording starts.

4. School Mailing of Campaign Materials The Association coordinates and covers the cost of one school mailing of campaign materials. School mailings go to ATA school representatives and/or school principals at every school in Edmonton District. Participation in the school mailing is optional and the following guidelines apply: • Materials must be prepared for packaging in a 9 inch by 12 inch envelope when delivered,

as no folding, stapling or other services are provided to candidates by the Association. • Candidates may submit a maximum of two items for mailing, eg, a poster and a brochure. • Candidates will be advised as to the quantity of materials required to reach schools in their

geographic district. School mailings are based on the following formula: • one set of materials for schools with 1–15 teachers, • two sets of materials for schools with 16–35 teachers and • three sets of materials for schools with 36 or more teachers.

C. ATA ASSISTANCE TO CANDIDATES Costs of delivering campaign materials to Barnett House are reimbursed to candidates upon submission of relevant invoices to the Elections Administrative Officer and are not charged against the candidate’s grant amount.

DEADLINES

Participation in the school mailing must be confirmed by e-mail with the Elections Administrative Officer by the date stated in the Candidate Responsibilities and Deadlines section. Materials must be delivered to the Elections Administrative Officer at Barnett House in Edmonton by the date stated in the Candidate Responsibilities and Deadlines section.

5. Mailing Labels or Addressed Envelopes By request and for a cost, the Association will supply candidates their choice of either mailing labels or addressed envelopes for the purpose of mailing campaign materials to any or all of the following groups: local presidents, school representatives, associate members and active members on leave of absence. Postage required to mail items is the responsibility of the candidate. Costs for labels and envelopes, along with approximate mailing quantities by geographic district, are posted in the Elections section of the Association website to provide candidates with a guideline for costs associated with purchasing labels or envelopes.

Candidates must inform the Elections Administrative Officer of their requests by the date stated in the Candidate Responsibilities and Deadlines section.

E. CAMPAIGN GUIDELINES

Guidelines regarding campaigning and campaign financing were established in 2009 and apply to both the Association’s provincial elections and its by-elections.

Campaigning 1. Candidates for Council office shall conduct themselves during the campaign in a manner

consistent with the Code of Professional Conduct and Section 23 of the Teaching Profession Act. 2. Candidates and their supporters may campaign on site at teachers’ conventions on the

condition they do not disrupt convention sessions or activities.

3. At teachers’ conventions, candidates may leave campaign materials on display at the Association’s booth, but must refrain from conducting campaigning activities at the booth or in the immediate area.

4. Campaign posters shall not be posted at venues hosting teachers’ conventions. 5. Candidates are required to fulfill their obligation to attend their own teachers’ convention. 6. Locals choosing to invite a candidate or candidates to local meetings or forums must extend an

invitation to all candidates running for the same office.

Campaign Financing

1. Campaign contributions from specialist councils and convention associations are prohibited. 2. Campaign contributions from school boards or other organizations having a political or

financial interest in the Association or any of its local associations are prohibited. 3. Campaign contributions by locals are permitted in accordance with the policies of the

contributing locals.

G. ELECTION RESULTS 1. Candidates may attend the announcement of voting results, or appoint a scrutineer to attend on

their behalf.

2. Candidates running in contested races are to inform the Returning Officer as to whether they will attend the announcement of voting results, appoint a scrutineer to attend or completely forego representation.

3. A candidate defeated by a candidate receiving 95 per cent or more of the vote may, within 14

days of the election date, appeal to the Executive Secretary for an audit of the online voting system.

H. ATA ELECTION BYLAWS AND ADMINISTRATIVE GUIDELINES Related Association Bylaws

35(1) The Provincial Executive Council shall consist of the officers of the Association and at least ten district representatives. The officers of the Association and the district representatives shall hold office from the time of their installation until their successors have been installed in office.

(2) Edmonton McMurray District and Calgary City District shall have three district representatives each and other districts shall have one district representative each.

36(1) Subject to ratification by the Annual Representative Assembly, the boundaries of the districts which elect the district representatives shall be determined by the Provincial Executive Council.

(2) The Provincial Executive Council shall review the geographic boundaries of the districts no later than 2020 and no later than every 10 years thereafter and provide a report to the Annual Representative Assembly following each review.

44 Notwithstanding anything to the contrary in the constitution of a local, a member who holds

any elected or appointed office in a local shall cease to hold such office on the date the member’s election to the Provincial Executive Council or as an officer of the Association takes effect and shall not hold any elected or appointed office in a local for the member’s tenure on the Provincial Executive Council or as an officer of the Association.

47 Members of the Provincial Executive Council who absent themselves from two consecutive

meetings of the Provincial Executive Council shall vacate their seats on the Council, unless the absences are sanctioned by resolution at the next regularly called meeting of the Council.

Terms of office 48(1) The members of the Provincial Executive Council shall be elected for a two-year term

beginning the first day of July following their election. (2) The day fixed for the election shall be during the 30-day period following March 21.

70 Notwithstanding any other provisions in these bylaws with respect to ballots and voting procedures for Provincial Executive Council elections and by-elections, the Provincial Executive Council may determine that voting may be done by electronic means, in whole or in part, in accordance with procedures in an Administrative Guideline approved by the Provincial Executive Council.

in the office of the president or vice-president as a result of a resignation effective in the first 19 months of the term, a by-election shall be held to fill such vacancy for the unexpired term, and the person so elected shall take office on the effective date of the resignation or when declared elected, whichever is later.

(2) Should a vacancy occur for any other reason in the district representation on the Provincial Executive Council or in the office of the president or vice-president during the first 19 months of the term, a by-election shall be held to fill such vacancy for the unexpired term, and the person so elected shall take office on being declared elected.

(3) Should a vacancy occur in the district representation on the Provincial Executive Council or in the office of the president or vice-president after the first 19 months of the term, a by-election, if required, shall be held for a two-year term and the person so elected shall take office effective on July 1 following or as soon thereafter as the person is declared elected.

(4) District representatives who, in the first year of their terms, file nomination papers for the office of president or vice-president, are deemed, as of the date fixed for the receipt of nominations, to have submitted their resignations, effective June 30 following, and a by-election shall be held pursuant to subsection (1).

Related Administrative Guidelines

11. ELECTIONS

11.1 Notices of elections and notices calling for nominations that go to locals and to schools shall be sent by first class mail and such announcements shall also be published in an ATA publication that goes to all members.

11.2 In compliance with Bylaw 48, the deadline for the close of nominations shall be 1700 on the second Wednesday in January each provincial election year.

11.3 Candidates for Council office shall conduct themselves during the election campaign in a manner consistent with the Code of Professional Conduct and Section 23 of the Teaching Profession Act.

11.4 The listing of candidates nominated for office on the Provincial Executive Council shall be published in the first issue of the ATA News following the closing date for nominations.

11.5 There shall be an election issue of the ATA News, at a suitable time prior to the election of candidates for office on Council, in which pictures, biographical information and the campaign platforms of candidates shall be given front-page coverage, to a maximum length of 500 words for presidential candidates and 300 words for candidates for vice-president and district representative office. Candidates shall be requested to submit these items at the same time that they submit acceptance of nomination to the office. As space allows, other material may be included in this issue. If necessary to accommodate a by-election, a special single-sheet edition of the ATA News shall be issued.

11.6 Candidates for office on Council shall be entitled to the following assistance: .1 The Association shall coordinate one mailing of two items per participating candidate

to all schools in the province or in the geographic district appropriate for the office being contested. This mailing shall be based on the formula of one copy for 1 to 15 teachers, two copies for 16 to 35 teachers and three copies for 36 or more teachers. The Association shall advise each candidate of the date of the mailing, the deadline for receipt of material and quantity of material required. The costs of this mailing and the cost of delivering candidate materials by courier service to Barnett House shall be borne by the Association.

.2 Each candidate shall be supplied, on request, with one or more sets of mailing labels and envelopes for presidents of local associations, school representatives, associate members and active members on leave of absence, in the province or in the geographic district as appropriate for the particular office being contested. Each candidate shall be given the choice as to the size of envelopes supplied and the option to request envelopes prelabeled. Each candidate shall pay the cost of any and all labels and envelopes received.

.3 Except as provided above, Association printing and mailing services shall not be available to candidates for campaign purposes.

.4 Except in cases of election by acclamation, each candidate for the position of president or vice-president shall be entitled to a grant of up to $6,000, with additional eligibility for up to $2,500, to defray travel expenses and each candidate for district representative to a grant of up to $2,000, payable upon submission of proof of expenditure on campaign-related activities. Candidates for president or vice-president who win by

acclamation shall be entitled to a grant of up to $1,000 and candidates for district representative who win by acclamation shall be entitled to a grant of up to $400, payable upon submission of proof of expenditure on campaign-related activities. This grant shall be made available each election on a one-time basis.

.5 All candidates running in an election shall be entitled to apply for an advance against their grant of up to one-half of the grant, such application to be submitted no later than two weeks after the close of nominations and to be accompanied by proof of expenditure or committed expenditure in the form of an invoice.

11.7 After having complied with Bylaw 59, the returning officers shall immediately initiate a release on the results of Council elections.

11.8 The number of votes received by each candidate in a Provincial Executive Council election shall be published in the ATA News.

13. ELECTRONIC VOTING FOR BY-ELECTIONS 13.1 Provincial Executive Council shall set a date for the by-election which shall be held within

120 days of the vacancy, with days in July and August not required to be counted as part of the 120-day provision.

13.2 At least 42 days prior to the date of the by-election, notices calling for nominations in the by-election shall be provided to locals and to schools, in addition to being publicized using Association media including, but not limited to, the ATA News and the Association website.

13.3 The deadline for nominations and acceptance of nominations to be received at Barnett House in Edmonton shall be 1700 on the date set for the close of nominations which shall be at least 21 days prior to the by-election date.

13.4 Notifications and instructions related to the by-election and electronic voting procedures will be sent to Association school representatives at each school within the relevant geographic district(s) at least 14 days prior to the date of the by-election. School representatives shall have the responsibility of making this information available to each teacher at their schools.

13.5 To be a candidate for election to the office of district representative, a member shall .1 be a member in good standing with the Association, .2 not be in receipt of an Alberta Teachers’ Retirement Fund pension, and .3 provide nomination endorsements from at least 25 active and/or associate members

employed within the geographic district he or she represents. 13.6 Additional information packages containing notification and instructions will be made

available to the local(s) affected by the election for distribution to substitute teachers, teachers on leave and associate members.

13.7 Notification and instructions related to the election and electronic voting procedures will be accessible through the Association’s website.

13.8 Members eligible to vote shall be individuals who are active and associate members in good standing at any time within 30 days prior to the election date.

13.9 The period in which members may register online to vote shall commence at least 14 days prior to the election date and close no more than five days prior to election day.

13.10 The period in which members may vote online shall commence at least 14 days prior to the election date and close at 1700 the day prior to election day.

13.11 As part of the voting procedure, members will acknowledge that they are members in good standing and agree to cast votes only on their own behalf.

13.12 Members may not vote for more candidates than there are vacancies. 13.13 The online voter registration system shall be developed and managed by the Association. 13.14 The online voting system shall be developed by the Association, evaluated and operated by

an independent agent guaranteeing that .1 online votes are tabulated and monitored in such a way that maintains the anonymity of

individual voters, and .2 information concerning the progress of voting prior to the tabulation of results on

election day remains available only to the independent agent and is used solely for monitoring system operation.

13.15 Results of voting shall be provided by the independent agent to the Association on election day. 13.16 The scrutineers committee shall consist of returning officers, the Association’s Information

and Technology Services Director and the candidates or their authorized agents. 13.17 The scrutineers committee shall witness the retrieval of the final vote tabulation as

performed by the independent agent selected to manage the electronic voting system. 13.18 The returning officers shall, upon assessment of the results retrieved, and in consultation

with the Association’s Information and Technology Services Director and the selected independent agent, decide whether or not the results are valid.

13.19 The returning officers shall tender to the president a statement signed by them documenting the number of votes cast for each candidate.

13.20 The candidate or candidates receiving the largest number of votes shall be declared elected.

13.21 In the case of a tie vote, one of the returning officers shall leave the room while the second returning officer writes the name of the tied candidates separately on blank sheets of paper of the same size, folds the papers so the names are not visible, and places the two sheets into a box. The second returning officer shall then return to the room and shall blindly draw one of the sheets from the box. The returning officers shall declare as elected the candidate whose name is on the drawn sheet.

13.22 The results of the voting shall be announced by the president. 13.23 After the final tabulation of votes, the voting and voter registration data shall be retained

for a period of not less than 30 days following the election for the purpose of evidence in an appeal of the results. Following the 30 days, the data may be destroyed.

13.24 The following process shall be followed in the event of an appeal of the election results: .1 Any defeated candidate for office, in favour of whom the number of votes counted was

equal to or greater than 95 per cent of the number counted in favour of the elected candidate for the same office, is entitled to appeal for a system audit.

.2 An appeal for a system audit shall be initiated, not later than 14 days after the day fixed for the election, by the appellant filing with the executive secretary .a a notice of appeal for system audit, and .b a statutory declaration setting forth that, in the opinion of the appellant, the votes

were inaccurately tabulated. .3 Within 14 days of receipt of the notice and statutory declaration, the executive

secretary shall: .a appoint a committee consisting of not fewer than three members of the Provincial

Executive Council, none of whom were current candidates for election to the office that is the subject of the appeal,

.b arrange for an audit of the voting and voter registration systems within a reasonable time, and

.c notify by registered mail the appellant and all affected candidates of such time and place.

.4 The committee facilitating the systems audit shall satisfy itself that the foregoing procedures have been complied with.

.5 The persons entitled to make representation and receive reports concerning the systems audit shall be the committee members of the Provincial Executive Council, the appellant or the appellant’s agent appointed in writing, and all other candidates who may be affected thereby or their agents appointed in writing.

.6 The committee facilitating the audit shall determine whether the election results generated were accurate and the committee decision with respect to the matter shall be determined by the majority vote of the committee and its decision shall be final and binding.

.7 The result shall be communicated to the executive secretary who shall thereupon announce the result of the appeal and shall cause the said announcement to be printed in an issue of an Association publication which is distributed to all members.

.8 An appellant who is successful shall assume the office which was subject to the appeal.
