THE EXECUTIVE COMMITTEE RECOMMENDS THAT Toronto and Region Conservation Authority (TRCA) accept the donation from William and Judith Wilder of 6.845 hectares (16.914 acres), more or less, of vacant land being Part of Lots 6 and 7, Concession 6, designated as Part 1 on Plan 40R-23924, Township of Uxbridge, Regional Municipality of Durham , located on the west side of the 6th Concession Road, south of Albright Road;

THAT the donation be on the following basis :

(a) Income tax receipt is to be issued in the amount of $380,000 in accordance with the guidelines set out by Canada Customs and Revenue Agency ;

(b) TRCA is to be responsible for appraisal and legal fees ;

THAT TRCA receive conveyance of the land required free from encumbrance , subject to existing service easements :

THAT the TRCA extend their appreciation and thanks to William and Judith Wilder for their generous donation;

THAT the firm of Gardiner Roberts LLP , Barristers and Solicitors , be instructed to complete the transaction at the earliest possible date . All reasonable expenses incurred incidental to the closing for land transfer tax , legal costs and disbursements are to be paid ;

CARRIEDBACKGROUNDResolution #A260/05 at Authority Meeting #9/05, held on November 25, 2005, approved the Greenlands Acquisition Project for 2006-2010.

William and Judith Wilder own a major farming operation located in northern Pickering and southern Uxbridge and they were looking for additional farmland for their operation. In late 2005, the Wilders acquired 450 acres of land located south of Albright Road, between Brock Road and the 6th Concession Road in the Township of Uxbridge. Of the total 450 acres approximately 181 acres located on east side of Brock Road is usable for farming purposes. In 2001 the Wilders donated a conservation easement on 711 acres of their lands in this area. TRCA was a signatory to the conservation easement agreement.

The subject property is an existing, undeveloped lot of record with frontage on the east side of the 6th Concession Road and is separated from the remainder of the Wilders holdings by an unopened road allowance.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Duffins Creek watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. It is located in the headwaters of the Duffins Creek and in a provincially significant Area of Natural and Scientific Interest (ANSI). The property is designated as Natural Core Area under the Oak Ridges Moraine Conservation Plan. The addition of the subject parcel will compliment TRCA's holdings in the Glen Major area.

DETAILS OF WORK TO BE DONEApproval of appraisal is to be obtained from Environment Canada in compliance with the Ecological Gifts Program.

TAXES AND MAINTENANCESince this property has been designated as a provincially significant ANSI it will be eligible to receive a property tax exemption. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

FINANCIAL DETAILSExpenditures related to this acquisition will be charged to account 004-11-502. Funding is available in TRCA's land acquisition capital account.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 94.07 hectares (232.46 acres), more or less, of land together with a small cabin being Part of Lots 6, 7 and 8, Concession 5, Township of Uxbridge, Regional Municipality of Durham , located west of the 6th Concession Road, south of Albright Road, be purchased from William and Judith Wilder and 1671934 Ontario Ltd.;

THAT the purchase price be $1.7 million;

THAT acquisition by Toronto and Region Conservation Authority (TRCA) is conditional on the availability of all necessary funding ;

THAT William and Judith Wilder will have the right to harvest wood for a 2 year period from the acquired land following good environmental forest management practices in consultation with TRCA;

THAT William and Judith Wilder will have the right to farm any farmlands included in the lands being acquired for as long as they operate a farm on the adjacent lands ;

THAT TRCA will fence the limit between the lands being acquired by TRCA and the lands being retained by William and Judith Wilder ;

THAT TRCA receive conveyance of the land required free from encumbrance , subject to existing service easements ;

In 2001 the Wilders donated a conservation easement on 711 acres of their lands in this area. TRCA was a signatory to the conservation easement agreement.

Since the purchase of this property, TRCA staff have had ongoing discussions with Mr. Wilder relating to the 270 acres of the property fronting on the 6th Concession Road. The Wilders are proposing to donate a 17 acre parcel of this land which is located on the east side of the 6th Concession Road and is separated from the remainder of the 450 acre holdings by an unopened road allowance. Based on the discussions staff are recommending a transaction on the following basis:

a) TRCA will acquire 232.46 acres of the Wilder property for a purchase price of $1.7 million;

b) William and Judith Wilder would retain two-10 acre lots which they would sell. The value of the lots has been taken into account when the purchase price of the 232.46 acre parcel was determined;

c) William and Judith Wilder will have the right to harvest wood for a 2 year period from the acquired land following good environmental forest management practices;

d) William and Judith Wilder will have the right to farm any farmlands included in the lands being acquired for as long as they operate their farm on the adjacent lands. The right is for the Wilders personal use only and is not transferable. We estimate that there is approximately 7 or 8 acres of farm land included in the lands being acquired by TRCA; and

e) TRCA will fence the limit between the lands being acquired by TRCA and the lands being retained by William and Judith Wilder.

Attached is a plan showing the location of the subject lands.

TAXES AND MAINTENANCESince this property has been designated as a provincial significant ANSI and contains a portion of the provincially significant Glen Major Wetland Complex, it will be eligible to receive a property tax exemption. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

FINANCIAL DETAILSThe subject property was identified on the list of properties approved by the City of Toronto to be funded from the city's Land Acquisition for Source Water Protection Reserve. The city will fund up to 50% of the costs of the acquisition for properties on the list located outside of the city boundaries. The reserve presently contains funding of $500,000.

Oak Ridges Moraine (ORM) Foundation staff have indicated during preliminary discussions that they would support a contribution by the ORM Foundation to this purchase. Other potential funding sources are the Township of Uxbridge, Regional Municipality of Durham and the Ontario Heritage Trust under the Natural Spaces Land Acquisition & Stewardship Program. Expenditures related to this acquisition will be charged to account 004-11-502.

The Conservation Foundation of Greater Toronto will be requested to fund the balance of the required funding for the acquisition.

Vinklers Surveying Ltd ., under their Project No. 05604B, City of Vaughan, located on the east side of Clarence Street , south of Mounsey Street - Woodbridge, be purchased from The Rock Community Church ;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements ;

THAT the firm of Gardiner Roberts LLP , Barristers and Solicitors , be instructed to complete the transaction at the earliest possible date . All reasonable expenses incurred incidental to the closing for land transfer tax , legal costs, and disbursements are to be paid ;

THAT upon completion of the acquisition the subject parcel be licensed for nonexclusive use for a nominal sum of $1.00 to The Rock Community Church for a period of 40 years and the tenant be responsible for all realty taxes , liability and maintenance of the property and any other conditions deemed appropriate by TRCA 's solicitor to satisfactorily protect TRCA 's interests;

THAT the appropriate TRCA officials be authorized and directed to execute all necessary documentation required;

AND FURTHER THAT Resolution #A64/06 at Authority Meeting #3/06 held on April 28, 2006 be rescinded and replaced with the above recommendation .

Resolution #A260/05 at Authority Meeting #9/05, held on November 25, 2005, approved the Greenlands Acquisition Project for 2006-2010.

Negotiations have been conducted with the owner's agent, Mr. C. Y. Lee of C.Y. Lee Architect. The Rock Community Church presently uses the existing pond located on the subject lands for baptism ceremonies. At the time the original report was considered by the Executive Committee the proposal was for a 20 year exclusive lease of the subject lands for church-related activities. This term was not acceptable to the church trustees and they were proposing a substantially longer term. To resolve this issue, staff are recommending a nonexclusive licence of the property to the church for a 40 year period. The church trustees are in agreement with this proposal.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. Through the review of Site Plan Control Application DA.05.001, TRCA staff established the limits of the open space lands (i.e. Part 3 on draft Plan of Survey) which are coincident with the Regional Storm flood plain of the Humber River at this location.

TAXES AND MAINTENANCEAs stipulated in the nonexclusive use agreement, the owner will continue to be responsible for taxes and maintenance for the 40 year term of the agreement.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. Through the review of Consent Application B0108/05NY to sever the existing property and create two residential lots, TRCA staff established the limits of the Open Space lands (i.e. Part 3 on draft Plan of Survey) which are comprised of a portion of the valley corridor of a tributary of the West Don River at this location.

THAT Toronto and Region Conservation Authority (TRCA) utilize, as required, the services of Sartor and Susin Ltd. for the supply of operated heavy construction equipment and dump trucks for the period August 1, 2005 to July 31, 2006, it being the proposal that best meets TRCA's requirements at the lowest overall cost;

AND FURTHER THAT staff be authorized to use the next lowest tender if the need arises.

In preparation of the original tender documents, staff included a provision whereby the successful bidder could request a one year extension to the contract at a specific maximum percent increase or decrease to the unit prices bid.

Sartor & Susin Ltd. have requested, in writing, a one year extension to their contract with an overall year two increase, in the unit rates, of 5 percent.

RATIONALETRCA and Sartor & Susin Ltd. have worked together on numerous successful projects over many years and through the tendering process, Sartor & Susin Ltd. have consistently provided the lowest unit rates with a broad spectrum of equipment and fully experienced operators.

Staff has reviewed the proposed new rate structure, in conjunction with a performance review, and are satisfied that the requested 5 percent increase is indicative of overall industry operating cost increases and are warranted.

FINANCIAL DETAILSThe value of this contract is estimated to be approximately $900,000, based upon a review of similar workloads in previous years. An increase or decrease in workload will have an impact on the value of this contract extension. The operated equipment is rented on an "as required" basis with no minimum or maximum rental hours guaranteed.

THAT in addition to the tipping fee , Anpro Environmental Group Incorporated will be responsible for all costs of sediment control , placing soil, fine grading and seeding the site with a basic grass mixture ;

THAT the funds received as compensation for receiving the surplus soil be set aside exclusively to offset project costs for future restoration and habitat enhancements within the property, long term management of the property and general TRCA purposes ;

CARRIEDBACKGROUNDThe Kleinburg Area Ratepayers Association (KARA) requested that Toronto and Region Conservation Authority (TRCA) and the City of Vaughan explore opportunities to enhance the natural habitat potential of a vacant portion of tablelands in the community of Kleinburg. The 14 hectare property located on the east side of Highway #27 and Islington Avenue in the community of Kleinburg consists of grass covered vacant tablelands with areas of recent fill deposition. The 14 hectare property has recently been conveyed to TRCA from the City of Vaughan.

TRCA staff, in conjunction with KARA and the City of Vaughan, has completed detailed design drawings showing how the existing tablelands will be enhanced significantly by importing and strategically placing clean surplus soil. It is the opinion of staff that this is an opportunity to create wetland and interpretive opportunities while creating the foundation for diverse habitat and public features. The soil placement will also provide the desired sound and visual attenuation structures for the neighboring residential community. Upon completion of the fill placement and grading phase of the project and subject to available revenues, TRCA staff will complete all site trails, plantings and associated landscaping as shown on the attached layout plan.

A stewardship agreement between TRCA, KARA and the City of Vaughan has been completed in which TRCA will assume the long term management responsibilities associated with the 14 hectare property. The agreement is similar to the stewardship agreement implemented in 1992 between TRCA and the City of Vaughan for the Foster Woods property in Kleinburg.

An archaeological assessment of the property was completed on behalf of the City of Vaughan in 1987 by Mayer, Pihl, Poulton and Associates Inc. and no sites of significance were found. TRCA staff has reviewed the assessment and concurs that the site is considered cleared from an archaeological perspective.

It is the opinion of staff that multiple sources of clean surplus soil will be available to complete the regeneration objectives and generate the necessary revenue to offset project costs and future costs associated with the management of the property. TRCA will implement a soils quality control program to ensure and confirm that all soils placed on TRCA-owned property meet Ministry of Environment Table 1 criteria.

As per Authority Resolution #A4/06, staff of TRCA were authorized to proceed with the project. An advertisement was placed in the Daily Commercial News requesting tenders from interested parties to undertake the required work. Tenders were received from the following nine contractors:

RATIONALETRCA staff have negotiated similar agreements with developers and/or operated similar operations in other areas with considerable success. Examples of these successful projects include the berming along the new Markham by-pass east of the Ninth Line, berming along Highway 407 at Claireville Conservation Area, berming and wetland complex development at Kortright Centre for Conservation and berming and wetland complex development at Boyd North (along Islington Avenue north of Rutherford Road, City of Vaughan).

Staff see this regeneration work as a benefit to all involved as the surplus soil along with the financial compensation will allow for the creation of habitat opportunities and public features on the property.

DETAILS OF WORK TO BE DONEObtain various municipal permits prior to beginning fill placement.

FINANCIAL DETAILSTRCA staff anticipate that fill revenue from this project will offset direct project operating and restoration costs. The potential gross revenue from this project is approximately $1.2 million dollars. The direct project operating and restoration costs will be deducted from this revenue.

Due to their deteriorated condition, three of the apron slabs at the base of the wingwalls will be removed and reconstructed. The south-west apron slab will remain. The apron slabs are being reconstructed to ensure that the wing walls have adequate scour protection in the future. Works will also include the removal and reconstruction of headwalls.

Works will be completed in the dry, flows will be diverted through a temporary 1200 mm CSP pipe during construction.

Control of Flooding:TRCA engineering staff has reviewed the associated hydraulic modeling and determined that the proposed structure is appropriately designed so that no impact to the control of flooding will result.

Proposal:This proposal involves the placement of approximately 9,000 cubic metres of fill material within a TRCA Regulated Area of the Etobicoke Creek Watershed in order to improve the existing agricultural use of the land. Recently, the TRCA has approved the development of a new residential dwelling and driveway on the subject lands. Please be advised that a TRCA permit was not required for the approved dwelling and driveway, which in the opinion of TRCA staff was unlikely to have an impact on the ecological features associated with this site. Traditional farm practices (i.e., cash crop) occur on the subject lands. However, a deep land depression exists in the area to which fill placement is to occur. Localized drainage from rain events and snow thaw reduce crop production within the depression. The proposed grading work will provide for improved drainage and increased crop production. The area to which this application applies is located within the Regulatory Floodplain. TRCA Water Resources staff has confirmed that this area floods as a result of an undersized culvert beneath King Street, which creates a backwater effect in the area to be filled. Although a loss of storage will occur, TRCA Water Resources staff has confirmed that this section of the floodplain is within an ineffective flow area and that flooding will not be exacerbated upstream and/or downstream of this site. The depression is void of any significant vegetation and is located on the tableland portion of the subject property. As such, no adverse ecological impacts are expected as a result of construction.

Control of Flooding:Due to the flood characteristics in this area, TRCA Water Resources staff has confirmed that no significant impacts to the storage and/or conveyance of flood waters are anticipated as a result of fill placement.

Pollution:The proposed works are setback approximately 120 metres from the nearest watercourse feature. In addition, vehicular access to the land depression will not require crossing of the corridor feature. As such, sedimentation of the nearby Etobicoke Creek tributary is not anticipated. However, appropriate erosion and sediment controls (i.e., silt fence) have been proposed with this application, and will be maintained throughout all phases of construction.

Conservation of Land:No significant vegetation will be removed as a result of construction. There are no geotechnical and/or fisheries related concerns associated with this proposal.

PlantingsCompensatory planting is not required. The proposed fill placement is located within an area that is actively farmed.

This is to involve the construction of a concrete headwall, 0.6 m deep plunge pool and a swale to connect to the creek. At the foot of the newly created embankment is to be a recreational trail which will run parallel to the new road between the watercourse and the road.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The proposal consists of the construction of a 450mm diameter sanitary collector sewer along the north limits of the existing 16th Avenue right-of-way between Longwater Chase East and Bridle Walk. The application includes a crossing under Eckardt Creek which will be installed using a Jack & Bore method. A working shaft will be excavated on each side of the creek, 10 metres away from the watercourse.

Control of Flooding:The working shafts will be backfilled and restored upon completion of the work, therefore there will be no negative impacts to flooding.

Pollution:Standard erosion control measures (silt fence) will be implemented to ensure that sediment will not enter the watercourse.

Conservation of Land:There will be no in-stream works associated with this project. Dewatering for the construction of the working shafts is expected to be minor in nature. In the event that unanticipated dewatering conditions are encountered, the Environmental Management Plan for the 16th Avenue Trunk Sewer will mitigate any potential stress to the creek. The activities associated with the proposed works will be included as part of the 16th Avenue Phase 2 Monthly Monitoring Reports.

Proposal:The applicant seeks to place fill within a Regulated Area, alter a watercourse and construct in the Regional Storm Flood Plain in order to repair erosion scars and stabilize the banks of a watercourse. The proposed works are located within the Holy Cross Cemetery in the Town of Markham south of Highway 407 on the east side of Yonge Street. A watercourse traverses the centre of the cemetery and is crossed by three bridges within the cemetery lands. Due to high flood waters that took place during the August 19, 2005 storm, the embankments of the watercourse were eroded at the location of the bridge crossings. The proposed works involve the placement of fill within the erosion scarred areas and then stabilization and planting of both sides of the banks of the watercourse.

The application was submitted and reviewed under Ontario Regulation 158, (Fill, Construction and Alteration to Waterways Regulation). The application was also reviewed for consistency with Ontario Regulation 166/06 (Development, Interference with Wetlands and Alteration to Shorelines and Watercourses), which came into effect May 8, 2006 and replaced Ontario Regulation 158.

Control of Flooding:As the proposed filling will return the banks to their original condition, the control and storage of flood waters will not be affected by this proposal.

Pollution:Sediment fencing is to be installed pursuant to the proposed drawings to separate the areas to be disturbed during construction from the watercourse.

Conservation of Land:All areas to be disturbed during construction are to be stabilized with a seed mix. Plantings of native trees and shrubs are to take place as part of this proposal. There are no geotechincal issues associated with this proposal. This proposal is not located in an area with significant natural heritage features. In-water works will not be required for this proposal. Staff will issue a letter of advice on behalf of Fisheries and Oceans Canada (DFO) with this permit, as a DFO authorization pursuant to the Fisheries Act (Canada) was not required.

The property is located within the Settlement Area of the Oak Ridges Moraine, in accordance with the Oak Ridges Moraine Conservation Plan. The property is within 20 metres of an Oak Ridges Moraine Wetland but is separated from the wetland by existing residential development. TRCA Ecology staff has reviewed the application and have determined that given the property location and that the existing dwelling is within an approved existing residential subdivision, no additional impacts on the adjacent wetland are anticipated.

Control of Flooding:The proposed works are not located within the Regional Storm Floodplain of the Humber River Watershed and therefore will not affect the storage and conveyance of flood waters.

Proposal:The Town of Richmond Hill, Parks, Recreation and Culture Department seeks to place fill within a Regulated Area and construct in the Regional Storm Flood Plain in order to implement improvements to the Phyllis Rawlinson Park and Foster House. The Phyllis Rawlinson Park is an outdoor recreation and interpretive park located on the east side of Leslie Street south of Stouffville Road in the northeastern portion of the town. The park contains several buildings of heritage significance. The town is seeking to improve the park by restoring the heritage buildings and providing additional landscaping and pathways. Portions of the heritage buildings are adjacent to a watercourse which traverses the eastern portion of the parklands. As part of the landscaping and additional pathways, the town proposes to place fill within the Regional Storm Flood Plain.

Control of Flooding:The proposed placement of fill is minimal and will have a negligible impact on the control and storage of flood waters. An existing wooden bridge structure and debris is to be removed from the adjacent watercourse which will help to remove impediments to flood flows.

Pollution:Erosion and sediment control plans have been prepared which adequately separate areas to be disturbed from the watercourse to prevent sedimentation.

Conservation of Land:All areas to be disturbed during construction are to be stabilized. Plantings of native trees and shrubs are to take place as part of this proposal. There are no geotechincal issues associated with this proposal. This proposal is not located in an area with significant natural heritage features. In-water works will not be required for this proposal. Staff will issue a letter of advice on behalf of Fisheries and Oceans Canada (DFO) with this permit, as a DFO authorization pursuant to the Fisheries Act (Canada) was not required.

Proposal:The proposal is to place and remove fill within a Regulated Area and construct within the Regional Storm Flood Plain in order to facilitate the rehabilitation of an existing bridge on Church Street, over Etobicoke Creek, and construct a new retaining wall. The existing concrete deck and sidewalks will be replaced and minor concrete rehabilitation will take place on the existing spalling and girders. A sealer will be applied to all exposed surfaces of the new sidewalk and parapet walls. New retaining walls will be constructed at the ends of the bridge, within the concrete lined bank. The existing stormwater pipes below the deck will be removed and new 150mm diameter subdrains constructed on the inside face of the retaining wall. The existing span and height of the bridge will remain the same. No in-stream works are proposed.

This application was submitted and reviewed under Ontario Regulation 158 (Fill, Construction and Alteration to Waterways Regulation). The application was also reviewed to ensure consistency with Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourses), which came into effect May 8, 2006 and replaced Ontario Regulation 158.

Control of Flooding:TRCA engineering staff has reviewed the proposal and determined that the proposed works will have no impact to the control of flooding.

Pollution:Standard sediment and erosion control measures (silt fencing) will be implemented in order to prevent construction generated sediment from entering the watercourse.

During construction the contractor will provide temporary scaffolding which will be located outside of the watercourse and which will contain plastic sheeting to collect debris. The plastic sheeting will be maintained for the duration of construction.

Conservation of Land:With erosion and sedimentation plans in effect, the potential for a harmful, alteration, disruption and destruction (HADD) of fish habitat will be mitigated and a Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). There are no proposed in-stream works for this application however, this application is subject to the Ministry of Natural Resources (MNR) warmwater fisheries timing window and any instream works must be completed between July 1 and March 31, unless directed otherwise by MNR in writing.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The proposal consists of the widening of Torbram Road (Sandalwood Parkway to Countryside Drive) from 2 lanes to 4 lanes. There are two watercourse crossings of the Humber River in this study area .

The first crossing of the Humber River (H3) is located at station 2+290. The existing structure at this location is a concrete closed box culvert (26.4m x 10.5m x 3.0m). The size of the structure will accommodate the road widening, the Regional Storm and has a remaining service life of 20 years. Therefore, the structure does not require replacement or extension. However, modifications are required to the road embankment to construct the road. Two armour stone retaining walls will be built on the north and south side of the watercourse on the west side of the Torbram Road.

The second crossing of the Humber River at Station 3+000 is not part of this permit application and will be reviewed under a separate application related to the adjacent subdivision.

The project was reviewed by TRCA staff during the Environmental Assessment process and conforms to TRCA requirements.

However, it is noted that the lands are proposed to be developed as part of the Block 11 Master Environmental Servicing Plan (MESP).

Planning Block 11 is bounded by Major Mackenzie Drive to the north, Bathurst Street to the east, Dufferin Street to the west and Rutherford Road to the south.) Previously, top soil stripping/grading approvals were received for Planning Block 11 (O.Reg. 158 Permit No. C-04301). The proposed siltation control pond will receive stormwater flows from the proposed school block, which is approximately 6.10 ha in size. This will allow for the removal of sediment from these flows before they are discharged into the west tributary of the East Don River.

Control of Flooding:The subject works are located outside of the Regional Storm Flood Plain and as such, the storage and conveyance of flood waters will not be impacted.

Pollution:Erosion and sediment control measures including sediment fencing will be installed prior to the start of works and maintained for the duration of construction on the site.

Conservation of Land:There are no geotechnical/slope stability issues associated with the works as the proposed pond is located away from the valley corridor. Furthermore, no in-water works are expected for the subject application. However, a Letter of Advice will be issued on behalf of Fisheries and Oceans Canada (DFO) for the flow of treated stormwater into the watercourse. No other significant natural features will be impacted by the proposed works.

The proposed stormwater facility is located on the east side of Pine Valley Drive, north of Rutherford Road. In discussions with the Region of York, representatives of the applicant and in consultation with TRCA technical staff, it was determined that the associated storm outfall would ideally be suited for development on the west side of Pine Valley Drive. The storm outfall headwall will be located within the Region of York right-of-way for Pine Valley Drive. It is noted that a cobble stone drainage swale conveying flows from the outfall to Marigold Creek is located within lands owned by the TRCA. As such, a temporary working easement/permission to enter will be required for the subject works. These approvals will be issued by staff within the Conservation Lands and Property Services Department and will be required prior to the issuance of the subject permit.

This permit application for servicing fulfills a condition of draft approval issued by the TRCA staff. Authority staff has received and reviewed detailed technical submissions relating to the proposed works and has commented appropriately. The agent, Ander Engineering & Associates, on behalf of the applicant, is in the process of addressing Authority comments. At this time, there remain minor issues relating to landscaping for the outfall and water management. TRCA staff is confident that these issues can be resolved shortly. It is noted that these issues in no way affect the location of the proposed works. The permit will not be released until such time as these issues are satisfactorily resolved.

Control of Flooding:The proposed stormwater facility is located away from the valley corridor and on tableland on the subject property. It is also located outside of the Regional Storm Flood Plain of the Humber River. Flows from the stormwater facility will be conveyed under Pine Valley Drive and discharged on the west side of Pine Valley Drive, at the associated storm outfall. It is noted that the proposed outfall will not impact the storage or conveyance of flood waters.

Pollution:Sediment and erosion control measures including sediment fencing will be erected prior to the initiation of works and maintained for the duration of construction, to ensure sediment does not enter the watercourse or the nearby valley system.

Conservation of Land:There are no geotechnical/slope stability concerns associated with the proposed works. The proposed works will not result in a Harmful Alteration, Disruption or Destruction (HADD) of fish habitat. Proposal:The proposal is to conduct site grading, permit the temporary/permanent placement, dumping and/or removal of material within a Regulated Area and to alter a tributary of the Rouge River, in order to facilitate the development of a triple box-culvert crossing within the Grand Cornell residential subdivision, in the Town of Markham.

The Grand Cornell subdivision is located near the southeast corner of 9th Line and Highway 7, north of Highway 407. The proposed works are located on Michelena Terrace and will facilitate the development of the southern portion of the Cornell Community in Markham. The proposed triple box crossing will eventually convey flows from Tributary B within the Cornell Community. Flows from this tributary are to be conveyed through a permanent channel which was created to convey post-development flows from upstream of the proposed works. This reconstructed channel was previously permitted under Ontario Regulation 158 (Fill, Construction and Alteration to Waterways) Permit No. C-05109, which was issued on May 6, 2005.

Permanent flows from Tributary B are to be ultimately conveyed to the new channel. However,Tributary B flows, at this time, are conveyed through a temporary channel leading to the Tributary B stormwater facility, located just north of Highway 407. This is due to fact that a new culvert under Highway 7 which was to be constructed to convey permanent flows from the upstream drainage area of Cornell through the reconstructed and onto the Tributary B SWM facility is currently incomplete. Previously, the Highway 7 culvert was approved under O.Reg. 158 Permit No. C-5212, issued on July 11, 2005. Once these works are completed, flows from the temporary channel will be changed over and conveyed through the Highway 7 culvert and into the new permanent channel.

The proposed culvert crossing will traverse across the permanent channel, which at this time is dry. It is noted that the potential loss of fish habitat within Tributary B of the Little Rouge River was authorized by the Fisheries and Oceans Canada (DFO) as part of Fisheries Act Authorization # 525-1342 (1999). This authorization was provided for the above previously approved works to construct a new tributary channel and to allow for the development of the triple-box culvert under Highway 7. However, given that flows are currently not flowing into the permanent channel, the proposed culvert crossing works will not result in a Harmful Alteration, Disruption or Destruction (HADD) of fish habitat.

Control of Flooding:It is noted that the permanent channel was designed to convey the Regional and 100 year storm event. As such, the proposed triple-box culvert has been designed to convey flows consistent with a Regional Event. Therefore, there will no upstream or downstream flooding impacts resulting from the proposed works.

Proposal:This permit forms the first component of the proposed Honda lands development, located in the Headford Business Park, between Highway 404 and Leslie Street, south of Major Mackenzie Drive, in the Town of Richmond Hill. The current proposal involves the removal of existing barn structures located within the Rouge River valley on lands owned by Honda Canada. These remnant barns are no longer in use, and are being removed to allow for the restoration of the valley corridor, which will be conveyed into public ownership through the planning process for the adjacent tablelands. Subsequent permit applications for other components of this project will be bought forward to the Executive Committee for their consideration in Fall and Winter 2006.

The majority of works to be completed under this permit will occur outside of the Regulatory floodplain, while a small portion of the temporary removal works will be completed within the floodplain. No in-stream works are proposed with this application. All areas in which site alterations are to occur will be stabilized following removal of the structures. Permanent restoration of the disturbed areas will be completed as a component of the larger valley land restoration works, to be completed under a future TRCA permit application.

Control of Flooding:The proposed works are partially located with the Regional Storm Floodplain, however, due to the temporary nature of the works, TRCA staff are satisfied that the works will not adversely affect the flow and/or conveyance of floodwaters.

Proposal:In order to construct a stormwater management pond and associated outfall for a development known as Tresstown Phases 2 and 3, the applicant seeks permission to alter a waterway. The proposed pond is located on the west side of the York -Durham Line in the southeastern portion of the community of Stouffville. The pond is to be located on the present location of three remnant wetlands which had been highly altered due to intensive agricultural uses surrounding them. In order to achieve a net environmental gain as part of this proposal the applicant has submitted an off-site compensation plan which will provide fish habitat improvements to a nearby portion of the Duffins Creek watershed on lands owned by the Greater Toronto Airports Authority. TRCA staff have reviewed the detail design of the pond and its proposed outfall and are satisfied with its design.

The subject lands are traversed by the Little Rouge Creek and one of its tributaries. On the table land surrounding these watercourses and associated valleylands, an industrial and commercial development is proposed. In order to begin to establish the servicing and to establish the required pre-grades, the applicant proposes to grade within the Regulated area associated with the watercourses on the site.

In addition, the applicant has proposed to undertake a balanced cut and fill of a portion of the Little Rouge Creek Regional Storm Flood Plain on the southern portion of the site. The applicant has satisfied TRCA staff that the proposed filling and cutting is balanced and will have a neutral effect on the conveyance and storage of flood waters. Additional valleyland restoration is to be provided within the areas that are to be cut and filled and will be included as part of a future permit for the proposed road crossings of the Little Rouge Creek.

The lands on which the pond is proposed to be built are owned by TRCA. The owners have entered into an agreement with TRCA to provide a permanent easement to permit the construction of the pond on these lands. The location of the proposed culvert works is within the Oak Ridges Moraine (ORM) and Greenbelt. Section 41 of the Oak Ridges Moraine Conservation Plan indicates in Subsection 5 that transportation and infrastructure may be permitted to cross hydrologically sensitive features (i.e. watercourses) subject to the tests and best management practices described in section 41(5)(a to e). Proposal:The proposal involves the construction of a single detached dwelling, in-ground pool, cabana and septic system and the extension and improvement of the existing driveway at 1280 15th Sideroad in the Township of King. A tributary of the Humber River lies to the west of the subject property and flows south from Eversley Lake. The lake encompasses the northern portion of the property and includes portions of the Eaton Hall-Mary-Hackett Lakes Wetland Complex. The subject property was previously located within an area identified in the TRCA's Fill Line Extension Program and is now regulated under Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation), which came into effect on May 8, 2006.

Staff addressed the TRCA's interests in the proposed works through our review of Site Plan Development Application SPD-05-75 submitted under the Planning Act. Under the Township of King’s Oak Ridges Moraine (ORM) Conformity By-law, Site Plan Approval is required if development is proposed within an ORM Feature Protection Zone or an Environmental Protection Zone and its corresponding 120 metre area of influence. The applicant must demonstrate that the proposed development will not adversely affect the ecological integrity of the ORM plan area. In this instance, development is proposed within the ORM Feature Protection Zone.

The applicant is maintaining appropriate setbacks between the proposed development and the adjacent natural features, including the wetland, watercourse, lake and woodlands. Further, the applicant will implement a restoration planting plan to the satisfaction of TRCA Planning Ecology staff.

Control of Flooding:The proposed development will not be located within the Regional Storm Flood Plain. There will be no impact on the storage or conveyance of flood waters.

Pollution:Sediment and erosion controls will be installed and maintained throughout construction to prevent sediment from entering the adjacent natural features.

The gas service will be installed by open cut in the driveway embankment. The driveway, by means of a culvert, traverses a tributary of the Humber River. An application to facilitate the driveway construction, which included the installation of the culvert, the placement of fill, and the construction of armourstone retaining walls in the vicinity of the culvert was approved by the Executive Committee on May 5, 2006. The construction of the single detached residential dwelling, garage, septic system and access driveway on the property was previously approved by the Executive Committee on September 9, 2005.

The current application was submitted and reviewed under Ontario Regulation 158, (Fill, Construction and Alteration to Waterways Regulation). The application was also reviewed to ensure consistency with Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation), which came into effect May 8, 2006 and replaced Ontario Regulation 158.

This application is for section of pipe that connects the existing Etobicoke Creek sewer system with the new Fletchers Creek sewer system, from Tomken Road to just west of the Etobicoke Creek. This section will be installed by open cut.

The project was reviewed by TRCA staff during the Environmental Assessment process and conforms to TRCA requirements.

Control of Flooding:Fill placement will be minimized within the Regional Storm Flood Plain with this infrastructure project and staff has no concerns with loss of storage or conveyance.

Pollution:Standard erosion control measures (heavy duty silt fencing, erosion control mat) will be implemented for the duration of construction and until the site is restored in order to prevent construction generated sediment from entering the watercourse.

Conservation of Land:With erosion and sedimentation plans in effect, the potential for a harmful alteration, disruption or destruction (HADD) of fish habitat will be mitigated and a Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO).

PlantingsAll disturbed areas will be restored to existing conditions or better with native/non-invasive species following construction.

The purpose is to site grade, place fill and construct a structure (sanitary sewer) in a Regulated Area and alter a watercourse through dam and pump around during the revised warm water timing window (July 1 to February 28) to facilitate the construction of a sanitary trunk sewer.

The permit will be issued for the period of July 7, 2006 to July 6, 2008 in accordance with the following documents and plans which form part of this permit:

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The proposal consists of the construction of a 1200mm diameter gravity trunk sanitary sewer pipe between the existing Fletcher's Creek trunk sewer system and the Etobicoke Creek sewer system. The alignment of the pipe generally follows the boundary between the City of Mississauga and the City of Brampton on the south side of the Hydro One easement, south of Highway 407. There are a total of four permit applications for this project. This application is for Crossing #1 in the study area of Hurontario Street to Kennedy Road. The sewer will be installed in the dry by dam and pump method at this location.

The project was reviewed by TRCA staff during the Environmental Assessment process and conforms to TRCA requirements.

The application was submitted and reviewed under Ontario Regulation 158 (Fill, Construction and Alteration to Waterways Regulation). The application was also reviewed to ensure consistency with Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourses), which came into effect May 8, 2006 and replaced Ontario Regulation 158.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The proposal is to conduct site grading, permit the temporary/permanent placement and/or removal of material within a Regulated Area of the Humber River and interfere with a watercourse, in order to implement a comprehensive restoration plan relating to a stream realignment, fish habitat enhancements and combined riparian plantings at 1051 Kipling Avenue (Planning Block 48), in the City of Vaughan.

Site Context:The subject site is located east of Kipling Avenue, north of Teston Road and is approximately 80.91 ha (200 acres) in size. The subject property is accessible from a narrow farm laneway, located off of Kipling Avenue, which leads to a farmhouse set back approximately 1.0 km from the road. There are two existing broken concrete culverts within the aforementioned laneway, which provide access to the farmhouse and allow for the operation of farm equipment, used to cultivate crops on the property. Two tributaries of the Humber River traverse the subject site; the first tributary originates north of Kirby Road, just south of King-Vaughan Road, in an area with numerous small kettle ponds and lakes. This watercourse is a small riverine coldwater system, forming part of the East Humber River and is located closer to the west side of the subject site. The second watercourse, which is considered small, is located further to the east of the main tributary. This tributary is also classified as a small riverine coldwater system and originates near Kirby Road, flowing south and then joining the aforementioned main tributary south of the subject property. Flows within this small tributary are intermittent in nature, providing seasonal or indirect fish habitat.

Background:In October 2003, TRCA Enforcement staff noted that the applicant had conducted significant works which resulted in the alteration of the two watercourses on the subject site. This work was conducted in the absence of requisite approvals from the TRCA (under Ontario Regulation 158 - Fill, Construction and Alteration to Waterways, which was in force at that time) and Fisheries and Oceans Canada (HADD - Harmful Alteration, Disruption or Destruction of fish habitat). The unapproved works included a realignment of the main watercourse on the subject property. Furthermore, a berm was constructed, restricting access to the flood plain. The channel was also widened resulting in laminar flow, and thereby creating a low-flow barrier to fish passage. Lastly, new culverts were installed which were not properly sized or installed correctly to allow for the passage of Regional Storm Flows or fish.

Subsequent to the issuance of a TRCA violation order, the applicant submitted an application for an O.Reg. 158 permit in late October 2003, in order to resolve the violation and conduct restoration works for the two altered watercourses. The proposed works include the removal of the broken concrete box culverts and the installation of new bottom box culverts. This will provide a benefit to fish habitat on the subject site. In addition, the improperly installed culverts are also to be removed. Furthermore, natural channel design principles will be employed to restore the watercourses and re-establish their associated flood plain areas. This will include the implementation of a comprehensive restoration planting plan for the channel banks and the planting of the flood plain areas.

In light of the sensitivity of the watercourses and the degree of disturbance incurred, the proponent will be contributing funds to the establishment of a comprehensive monitoring program for the proposed works. This will include measurements of channel morphology, aquatic biota and riparian vegetation. The program will also define a set of target objectives for channel performance that will be used to determine whether maintenance or modifications to the channel are required during the monitoring time period. Issuance of the subject permit will be contingent upon the receipt of the aforementioned funds for the establishment of this monitoring program.

The above permit application was submitted and reviewed under Ontario Regulation 158. Furthermore, the proposed works were also reviewed to ensure consistency with Ontario Regulation 166/06 (Development, Interference with Wetlands and Alterations to Shorelines and Watercourses), which came into effect on May 8, 2006. It is noted that the issuance of the permit for the works will be provided under O.Reg. 166/06.

Control of Flooding:The proposed works will result in the re-establishment and re-planting of the associated flood plain areas. As such, the works will not impact the storage or conveyance of flood waters and will in fact, reinstate the natural flood plain for the area.

Pollution:Erosion and sediment control measures will be erected prior to the initiation of the subject works and maintained for the duration of construction, to ensure that sediment does not enter the nearby watercourses.

Conservation of Land:There are no geotechnical slope stability issues associated with the proposed works. Given that the subject application is proposed to address an outstanding violation on the property, authorization from DFO will be required. The proposed works will be carried out during the coldwater timing window, between July 1 to September 15.

PlantingsA comprehensive valley land restoration plan has been submitted and reviewed by TRCA technical staff. Plantings of native, non-invasive material will be carried out along the channel banks and throughout the flood plain areas of the affected watercourses.

It was determined that it would be more effective to deliver the stone to the site by triaxle truck due to stringent CN Rail safety requirements. CN Rail requires a flag person to be stationed at the level crossing entering this project for all tractor trailers accessing the site and, according to CN Rail, securing a flag person on a regular basis is unlikely. Given that the window of opportunity to complete this work prior to the park opening in September is quickly closing, staff recommended the low bidder supply the material using standard triaxle truck.
