I n this action, the plaintiff contends that the plaintiff erroneously filed satisfactions of mortgage for :‘icii o f the hundreds defendants named in this action. The plaintiffs motion papers indicate that each dcfcndant who was served with the summons and complaint was also served with a letter authored by :ounsel tor the plaintiff. According to the plaintiff, this letter permitted the defendants to consent to the :-clici’requested in the complaint by signing the letter and returning it to counsel. If you consent to vacate the release and for the Suffolk County Clerk’s records to be corrected kindly sign this letter, print your name below your signature, print your address where appropriate and mail back this letter to this office using the self addressed envelope. In addition this letter shall serve as a Notice of Appearance in said action and I waive all documents in this proceeding except the signed order vacating the satisfaction of record that was erroneously recorded.

111 support of its motion, the plaintiff annexes several of these letters, purportedly signed by the ,-cspectivc defendants, as their presumed consent to the relief requested in the complaint. The Court, n o w ever, finds these submissions to be unreliable as proof that the particular defendants do, in fact, consent !o the requested relief. First, the language contained in the letter, which states “this letter shall serve as a hot ice of‘ Appearance ... andlwaive all documents in this proceeding,” is nebulous and may be misleading. For example, it could reasonably be interpreted by the reader to constitute a waiver by the plaintiff bank, w t a waiver on the part of the defendant.

Second, some of the purported mortgagee signatures are actually signatures by others, allegedly “on iwhal f of’ the mortgagor. Third, some signatures add qualifying language, such as “formerly known as” ) I “a: kia” after the signature. Fourth, and most importantly, none of the signatures are notarized, nor does the letter prepared by plaintiffs counsel provide a space for any signatures to be notarized. Therefore, none )t‘the signatures may properly be relied upon by the Court to establish that any of the defendants consent

Based on the foregoing, the Court will afford all defendants an opportunity to be heard on the dates .et tort11 herein, as to whether or not the plaintiff is entitled to the relief requested in the complaint.
