The Chairman referred to the recent visit to Rayleigh by HRH The Princess Royal, Princess Anne when she had toured the new Citizens' Advice Bureau offices at the Civic Suite and met their Committee members and staff.

The new Bishop of Bradwall The Reverend Dr. Laurie Green had recently been installed at Westminster Abbey and on behalf of the Council the Chairman wished him well in his office.

Following on from the recent Seminar on Unemployment the Chairman said he had visited the various training centres within the District and had been encouraged to see the extent of the facilities available to assist unemployed people in retaining existing skills or retraining for new ski&:

a Finally he thanked Members for their involvement in the tree planting ceremony at Sweyne Park and all those who had participated in the community hedgerow planting venture at Plumberow Mount.

Resolved (1) that the Minutes of Committees be received and the recommendations contained therein as amended be adopted.

(2) that the Common Seal of the Council be affixed to any documents necessary to give effect to decisions taken or approved by Council in these Minutes.

Minute 57: Rochford Sports Councia

m Councillor D.R. Helson declared a non-pecuniary interest by virtue of being the Council's representative on the Sports Council but remained in the Meeting and participated in the discussion and voting thereon.

Council accepted the proposition of a Member that the question of grant aid to this organisation should be referred back to the Committee for further consideration.

Resolved that Minute 57 be not adopted but that the question of grant aid to the Rochford Sports Council be referred back to the Leisure Services Committee. (897)(DF,ACE)

pinute 84: Grant Aid to Outside Bodies

NOTE: Councillors M.J. Handford, Mrs. E.M. Hart, D.R. Helson, Mrs. A.R. Hutchings, Miss B.G.J. Lovett, R.A. Pearson and R.E. Vingoe declared a pecuniary interest by virtue of membership of the Rochford District and Haltern Twinning Association and left the Meeting while that organisation's application for grant aid was discussed as did the Chief Executive.

It was formally moved from the Chair and accepted by Council:

(0 that recommendation (4) be amended by the deletion of the Rochford District and Haltem Twinning Association.

(ii) that a new recommendation (6) be added to read ­

That the Rochford District and,Haltern Twinning Association be informed that the Council will underwrite any loss on this year's visit of the German Minesweepers up to a maximum of f500.

Further reference was made to other organisations which some Members regarded as worthy of consideration for grant aid or as meriting a greater sum than had been agreed. The South East Essex Business Enterprise Agency, the Warehouse Project and Great Wakering youth facilities had already been identified as falling into the first category, and an additional vehicle for Dial-a-Ride (as referred to under Minute 9/92) in the latter to which was added Relate and May Day Mobile. Other Members were mindful however that Council had given considerable thought to devising a system whereby applications for grant aid were categorised to determine their priority and new applications were vetted by the appropriate service Committee. Council saw it as inappropriate for it to deal with requests in respect of individual applications in isolation from the Committee process and accepted a suggestion from a Group Leader that

the simplest method would be for Members to exercise their right to include an item on a Committee Agenda. An amendment which had been moved in respect of Relate and May Day Mobile coupled with Minute 85 was accordingly withdrawn but Council accepted the proposition of a Member that the grant to the Ashingdon and Hawkwell Memorial Hall be reduced from f1,500 to f1,OOO.

Resolved that Minute 84 be adopted subject to the inclusion of the guarantee against loss of up to f500 to the Rochford District & Haltern Twinning Association, the reduction by f500 of the grant to the Ashingdon and Hawkwall Memorial Hall and a further report being made on Dial-a-Ride. (211) (W

Minute 88: Seminar on Unemolovment

Council noted a report from a Member that Southend-on-Sea Borough Council had made application for Assisted Area Status for the Southend travel to work area and that the Group Leaders had been asked to lend their weight to the application. The Chairman advised that the second recommendation should be amended so as to refer to other South Essex Authorities and following nominations by the Groups it was

Minute 91: Park School - Joint Use

m: Councillors~, C.R. Morgan and S.A. Skinner declared a non-pecuniary interest by virtue of Governorship of Park School and remained in the Meeting and participated in the discussion end voting thereon. Councillor Skinner asked for it to be noted that he had made a similar declaration at Committee also.

The Minutes of the Policy and Resources Committee having been adopted and in accordance with Minute 80(C) relating to the Asset Management Review Board, the Chief Executive and Director of Finance jointly repeated their earlier presentation to the Meeting on 10th February as reported under Minute 6.

The Chief Executive explained that although Council had been extremely successful in reducing its overspend and building up its balances this achievement had been substantially eroded by the effect of the recession on income from from fees and charges and the progressive reduction in the interest rate. But for the very favourable SSA settlement -an increase of f440.000 - the Council would have been looking for further budget economies. In the event the Council was now only some f200,OOO above SSA The economic situation left the Council in a precarious position and he was convinced that the downward pressure on public expenditure would become even more severe with the recent intervention of the International Honetary Fund and the review of public spending by the First Secretary of the Treasury. Under the Government's new financial regime there would be no July public expenditure statement and no annual budget; public expenditure policy would be set out in an autumn statement and it would not be until that time that the Government's intentions were known. The provisional SSA would be publicised shortly after but this revised

timescale would render it difficult for the Council to predict expenditure levels for estimate preparation He and the Director of Finance had therefore prepared forward projections of the Councfl's budget over the next three financial years all of which demonstrated the need to use balances,

Whilst the asset management policy had not produced the solutions sought, some asset sales remained of vital importance, The Council's budget strategy had therefore to rely on the availability of its balances but these would have to be used judiciously because of the way in which the capping rules were applied on the budget of the previous year. If the Council supported its budget from balances and exhausted its reserves it would be faced with heavy cuts in essential services. There was no margin for error as evidenced by the draconian measures being taken in some other Essex authorities. In addition to the downward pressure on spending Parish expenditure might be brought within SSA and changes might occur in Housing Revenue Account procedures which could add substantial costs to the General Fund.

The present budget strategy was aimed at reducing the budget to below SSA by the time the Local Government Commission arrived to review Essex in 1995/96 but that timetable was not certain and the Council would not wish to have used all of its balances by then only to find the programme delayed to a later year when it "as setting a crisis budget. Under the Commissio& present guidelines the Council would be submitting a bid for unitary status but it did not follow that this would remain the case as the new structure for Local Government began to emerge from earlier t-ranches of the Review. If the District Council were not in a position to bid it would no doubt want to pursue a different budget strategy. !Jhilst one of the Commission's criteria for unitary status was financial viability the Chief Executive questioned whether the Council actually needed to reduce the budget to within SSA. In 1992/93 when its budget was 27% above SSA its position would not have been credible but if the Council were able to maintain the overspend at 3% above SSA that was entirely acceptable, The Council could easily argue about the vagaries of the SSA formula and its low needs assessment, that it was poorly served by the formula and that the External Auditors had coumended the Council's response to its budget difficulties.

Taking account of all of those uncertainties the Chief Executive stressed that a flexible approach to financial planning was absolutely essential. The bal&ces had to serve several purposes. They had to support the budget as a cushion against an adverse SSA settlement; they were there to avoid capping if there was a change in the rules; they were needed to meet the many commitments which must be honoured before reorganisation; and they were there to prevent capping in future years. It was a fact that they could only be spent once and balances had to be seen as a temporary respite. If they were exhausted Council would return to financial crisis because there would be nothing left to cut other than essential services. The Council's position demanded a prudent approach with the budget being maintained at the 1993/94 level marginally above SSA. It was vital to continue with strict financial management policies. The Council must carry forward its search for savings. It would need to 'work smarter' in looking for ways of using the reserves to best advantage. It would need more effective programming and introduction of cash limits and to investigate the use of funds. It would have to minimise spending from balances. This would have to be a last resort policy unless it was

possible to identify genuine economies. A deliberate policy to underspend the budget would present opportunities to replenish the balances during the year. The Council must retain flexibility to change direction so that it could spend more if unitary status ceased to be an option. It was of the utmost importance that the Council should maintain current levels of SSA or improve the position and it must pursue vigorous representations in this respect.

Finally, the Chief Executive emphasised that the Council would still need income from interest on asset sales to support the revenue budget and that there were still a number of opportunities available. The recommendations of the Asset Management Review Board were designed to concentrate on those opportunities where a degree of certainty remained.

The Director of Finance then presented a number of slides showing how the level of expenditure could progress for the years 1994/95 to 1996/97. Assumptions in respect of inflation were that selary awards would continue to be held at 1.5% and other costs would inflate by 4% per annum. The projections showed that, whilst it was anticipated that substantial savings from contract renegotiation and future voluntary redundancies would aocrue in 1994/95, this would not be the case in later years.

With regard to the level of SSA, the Director of Finance explained that the increase in the 1993/94 level was attributable to the greater population identified by the 1991 census. When the 1994/95 SSA was determined, further data from the 1991 census would be utilised and this would affect the All Ages Social Index which would probably have a detrimental effect on Rochford's allocation. In view of this, three scenarios were presented: at best a 2% increase; middle assessment zero increase; at worst a 2% reduction. Over the three-year period, this would mean, if the Council wished to set a budget at SSA, utilising balances on the best scenario to the sum of f260,OOO and on the worst scenario f917,OOO.

The Director of Finance then went on to examine the level of balances. He explained that, whilst the current balances of f2.272m. might appear high, a number of items needed to be taken into account. Firstly, it was necessary to maintain a proper level of working balances, estimated at f500,000. Secondly, flm. needed to be set aside in order that the Council could meet a number of commitments prior to reorganisation. The Council's External Auditors acknowledged those factors and had commented favourably on the level of balances. After setting aside f1.5m.. the remaining f772,OOO could be utilised to enable the Council to set a budget at SSA On the best scenario, there would still be f512,OOO available at the end of 1996/97. On the worst, all of the balance would be utilised and it would be necessary to take sums from the amount set aside to meet commitments.

Turning to the two threats of redefining the Housing Revenue Account and Parish expenditure being included in capping, this showed that, if both these occurred from 1994/95 onwards, the Council would not be able to set a budget at SSA and would not be able to meet Its commitments. In concluding, the Director of Finance emphasised that the balances should only be used on the basis of the revised budget strategy outlined by the Chief Executive in order that, if problems arose in the future, the solutions could be managed rather than resorting to haphazard cuts in services.

Council congratulated the Officers concerned for the manner in which the financial problems had been addressed, for advising them of the progress made and outlining to them the proposed budget strategy for the foreseen future,

Planning Services 18th February 1993 94 - 102

Referring to Minute 98 Para.D2 a Member recalled that there had been specific debate about the days and hours of use of the existing floodlights to the car park which were to be governed by a Legal Agreement but other Members ware concerned that what was being advocated was not appropriate to the operational needs of the Club and it was accordingly

The number of new trees planted to reflect the population of the District. That the Council identify sites and funding opportunities for this community woodland project."

"That Rochford District Council, aware of the fact that unemployment is rising faster in this constituency than any other area in Essex, and conscious of the long overdue resolution of inadequate road systems in the District, requests that the County Council and Government accelerate the programme for the construction of the Rochford District By-Pass. Many shops are closing down and such a situation can easily lead to a further decline, to the detriment of all - shoppers and traders alike. Whilst accepting the financial difficulties of Rochford District Council it is felt that the Council should take steps to assist. Accordingly ­

It is proposed that from 1.00 p.m. to 6.00 p.m. on Monday of each week the charges for parking cars in the Council owned car parks be suspended, on the basis that the loss of revenue would not be great and the facility might well encourage shoppers from out of town if well publicised".

111. HONITORING OF PERFORMANCE- MEETINGS OF 2ND JULY & 5X.H NOVEMBER& SPECUU,0 NEETING OF 1OTH DECEMBER1992

The Committee were satisfied that all necessary action had been taken. Minute 532/92(SOL) was carried forward. Under Minute 533/92: Health of the Nation a Member was advised that representations had been made to the Secretary of State for Health about smoking at work and that a response was awaited.

112. SOUTHENDHF.ALl'H CARE TRUST.

Tha Chairman welcomed Mr D. Brackenbury, the Chief Executive of Southend Health Care Trust who had been invited to make a presentation to this Committee regarding the development of Southend Hospital. Mr. Brackenbury began by outlining with the aid of viewfoils that services were being centralised at Southend Hospital first to enable them to be brought up to modern standards and secondly to avoid duplication and the need for transport between hospitals thereby reducing peripheral costs. It was estimated that the schema would cost f27m and take three years to complete and when that was achieved in 1995 there would be savings of f1.6m par annum in running costs which could provide additional funds for patient care.

The scheme would provide not only for a new three-storey nucleus block but also for the complete refurbishment and upgrading of the existing tower block including the conversion of the wards from 28 to 35 beds. The programme would be phased to enable conversion to proceed without disruption to the hospital operation. As a result of the centralisation there would be a loss of 31 bed spaces but that would be offset by the provision of an hotel capable of housing 50 patients in the transition between in-care and return to home without additional charge. Car parking provision would also be expanded to provide spaces for a further 200 cars. The scheme would be funded by the sale of half the Rochford Hospital site and although services ware being concentrated on Southend some residual facilities would remain, details of which were given. Both Southend and Rochford currently provided accommodation for medical and nursing staff but in the main it was the intention for the Westcliff Hospital site to serve as the residential campus.

- The reduced scope of the scheme by comparison with the earlier proposal.

- The need to ensure that adequate transport facilities existed for out­patients particularly from outlying rural areas to travel the greater distance involved to Southend Hospital.

- The possibility of providing additional cut-care through existing medical facilities.

- The problem for Health Care Trusts of funding being exhausted before the and of the financial year.

113. DELEGATED AUTHORITIES

The Committee considered the report of the Chief Environmental Health Officer regarding the need to review the powers delegated to Officers under the Health & Safety at Work etc. Act 1974 in respect of powers of entry and under the Environmental Protection Act 1990 in respect of Local Authority Air Pollution Controls and noted action already taken under the latter legislation.

114. CARAVANSITE LICENCES (Minute 63/90)

The Chief Environmental Health Officer reminded Members that following the earlier issue by the Government of new Model Standards and consultations with the site operators, residents and the Fire Authority a standard condition had been agreed by the Council to minimise the risk of fire involving sheds and other buildings between caravans

Since then Essex Fire & Rescue Service had re-assessed the technical requirements relating to such structures and revised their recommendations to the Council which would allow more flexibility and overcome some operational difficulties. Members noted the revised wording of the licence condition, that consultations with the operators of two sites who appealed against the previous changes had not yet been completed and that a further report would be made thereon in due course.

Resolved (1) That notice be given to the holders of Caravan Site Licence numbers 1, 4, 6, 11, 22, 24, 27 and 53 that the Council intends to vary the conditions attached to the Licences, as specified in the report, in accordance with the Caravan Sites and Control of Development Act 1960.

(2) That, subject to there being no appeal, the variations become effective and the Chief Environmental Health Officer be authorised to amend the Licences accordingly.

(3) That a further &sport be made in due course regarding Caravan Site Licence numbers 2 and 26. (246)(CEHO)

0115. NATIONAL SPRING CLEAN CAMPAIGN1993 (Minute 54/92)

The Assistant Chief Executive reported that as in previous years the Tidy Britain Group would be organising a Spring Clean Campaign, to run from 16th to 28th April and that the Council's Litter Consultative Panel would be meeting on 15th March to plan and co-ordinate the actions for this year's events.

117. GARDENING SERVICES TO COUNCIL TENANTS

The Committee considered the joint report of the Director of Development and Chief Housing Manager regarding advice from MAFF concerning the use of persistent weed control chemicals which was already in hand and the potential for implementing the aspect of the Corporate Plan relating to tree planting by providing planting within Council estates and individual tenants' gardens.

RECOMMENDED(1) That the Council adopts the use of glyphcsate and ceases to use persistent herbicides.

(2) That tenants be offered trees for self planting.

120. WINDOW REPLACEMENT PRMXAMME (Minute 42/93).

Arising out of the earlier decision of the Committee to release some of the Housing Revenue Account reserves to accelerate the repairs programme and following consultation with the Tenants Associations the Director of Development reported that it was proposed to concentrate the f50,OOO additional funding on window replacement mainly in properties occupied by the elderly. Members noted details of the properties proposed for 1993/94 and 1994/95. Reference was made to Bedlces Corner where a current traffic scheme could generate additional noise and the Chief Housing Manager said the matter would need to be taken up with the Highway Authority in that event.

RECOMMENDED(1) That the report be noted and that a further report be made in due course in the light of the outcome of the County Council's deliberations on the free parking area outside Nos. 61 to 81 High Street, Rayleigh.

(2) That in the meantime further consideration be given to the provision of an additional taxi rank in the Eastwood Road alongside the entrance to the King George V Playing Field. (897) (GE)

RECOMMENDEDThat the Assistant Director of Community Services be asked to make arrangements on the foregoing basis for signs displaying the new Rochford Logo to be carried on Hackney Carriage and private hire vehicles within the District. (897) (ADCS)

129. DISTRICT PIAN WORKING PARTY

The Committee considered the appended Minutes of the District Plan Working Party held on 25th February 1993 containing the following recommendations:-

RECOMMENDED(1) That this Council do not support the proposal for the provLsLon of two areas of public open space one on either side of Brays Lane coupled with residential notation to the north of King Edmund School and that the Green Belt boundary in this location and PoliEy LTl, both as set out in the Rochford District Local Plan, remain unaltered. (2081)(DD) (Minute 232: Brays Lane - Informal Public Open Space and Childrens Play Area).

(2) That the following new policy be included in Chapter 2 of the Review of the Local Plan, together with an appropriate preamble:-

IN CONSIDERING APPLICATIONS FOR THE ENCLOSURE OF GRASS VERGES, AMENITY AREAS OR OTHER OPEN IAND WHETHER PART OF THE HIGHWAY OR OTHERWISE, THE LOCAL PLANNING AUTHORITY WILL NORMALLY RESIST PROPOSALS THAT DO NOT HAVE REGARD TO THE FOLLOWING GENERAL PRINCIPLES:-

IN CASES WHERE IMPORTANT STREET TREES EXIST ON GRASS VERGES, THE LOCAL PllWNING AUTHORITY WILL EXPECT THOSE TREES TO BE RETAINED AND TREE PRESERVATION ORDERS WILL BE SERVED IN APPROPRIATE CASES.

The British Horse Society recommend a floor area of 12 square metres per horse with ancillary storage of 50% of that area

(Cl STABLES SHALL BE CONSTRUCTED TO A GOOD STANDARD OF DESIGN AND MATERIALS AND THE SIZE OF THE PROPOSED STABLES SHALL BE ASSESSED AGAINST THE SIZE GUIDELINES PUBLISHED BY THE BRITISH HORSE SOCIETY. THE SITING OF THE BUILDINGS AND LANDSCAPING SHALL ENSURE THAT ALL STABLES WILL BE VISUALLY UNOBTRUSIVE.

130. VALUE FUR MONEY STUDIES (Minute &?O(a)/931

As requested by the Policy & Resources Committee, Members had before them the appended report of the Director of Development commenting in detail on the recommendations set out within the two VFM reports, namely "Development Control 1992" and "Making Good Use of the Census". They were pleased to note that the external auditors had endorsed a number of existing areas of good development control practice and that initiatives were currently in hand to restructure the Directorate. With regard to the further improvements suggested they accepted the action which was being taken to address certain of the issues but recalled that further delegation to Officers had been considered already and ruled out. They noted that a further report would be made on the organisation of the current appeals process and on the resources available for enforcement action.

As regards action to deal with the 1991 Census data the Committee were mindful that the recommendations of the District Plan Working Party as earlier adopted included provision for a Census Working Party to consider the issues raised.

RECOKKENDEDThat the two VFM reports and the comments thereon be noted and that a further report be made on the organisation of the current appeals process and on the resources available for enforcement action. (31669) (DD,SOL)

Members had before them a feasibility report of the Director of Development and adcepted the need for a longer progrsmme and the suggestion of a Member that there should be community fnvolvement. With the concurrence of the seconder of the Motion it was amended accordingly and then

In support of that proposition it was argued that although the County had already accepted the need to provide an outer by-pass a considerable period would elapse before its construction could be programmed and that in the meantime there was a pressing need to accelerate the sector between Brays Lane and Sutton Road as the first phase. It was clarified by the mover that the motion should be amended to refer to the Rochford Town by-pass.

Against that it was pointed out that the Council already had a policy in this regard namely to support the provision of the B1013 relief route es the means of alleviating traffic congestion in the short term It was moved by Councillor D.F. Flack and seconded by Councillor Mrs.L. Walker:-

In support of that amendment it was argued that the case for en outer by­pass bisecting the District was flawed and should be rejected. Rochford's need was for a local by-pass which served the area in a sympathetic manner and relieved traffic congestion on existing routes with minimal impact upon the environment That could be achieved by the Cherry Orchard Lane link coupled with the construction solely of that part of the route advocated by the earlier motion. The provision of the remainder was therefore opposed. The new road proposed by County would not serve the District because it would not run between existing centres of population but was clearly designed to be part of the wider road network. Inward investment would not be enhanced nor would employment be created and local trade would in fact suffer. There would be an adverse effect upon the Green Belt to the detriment of the character of the District whose residents wanted its rural nature to be preserved.

On a requisition pursuant to Standing Order 14 voting on the amended motion was recorded as follows,-

"That reduction in services on the London/Liverpool Street to Southend Victoria railway line, recently announced by British Rail to take effectl from 17th May 1993, will have a deleterious effect for residents in the Rochford District - particularly those needing to travel to work early in the morning. This Council therefore resolves to send a letter of objection to this reduction in train services to British Rail and to seek the support of the local M.P. in this matter."

The Committee considered that every endeavour should be made to resist the withdrawal of commuter train services and accepted the suggestion of a Member that the Transport Users Consultative Committee should be advised of their view.

The Working Party welcomed Mr H. Squier the landowner concerned and his agent Mr A. Blackwell of Andrew Martin Associates who had been invited to give a presentation on their proposals relating to the above provision.a

Members had before them the report of rhe Director of Development to the * previous Meeting and his subsequent more detailed report which is appended

setting out the various factors involved together with a set of proposals which had been circulated direct by the agents.

Hr Squier thanked Members for the opportunity to present the proposals and said he hoped that there could be a constructive discussion on them in the same way as with other current involvement with the District Council on the provision of horse riding routes and on the land and pond at Doggetts Mr Blackwell said the earlier document he had presented identified the local environmental problems which could be addressed by the scheme put forward for the site which he suggested was surrounded on three sides by the school, Spencer Gardens and Brays Lane. Serious local traffic congestion was caused at peak times in the narrow residential roads leading to the school by 11 coaches and the volume of cars transporting pupils. That had been confirmed in writing by the school administration who advised that the situation had given rise to many complaints in the past and that there was concern for the safety of pupils. Furthermore County Highways had stated that rhe roads were not suitable for access He considered therefore that there would be real planning gain in the provision of a new access road to the school.

Turning to the concerns which had been expressed about the implications for the Green Belt Mr Blackwell said it was apparent from his Report that at the 1987 Public Inquiry the Inspector had been concerned about the land to the east of the whole length of the Ashingdon Road. He had in fact questioned the inclusion of the Nelson Road/Canewdon View Road site as an Area of Special Restraint but his view had not been heeded by the Council. Mr Blackwell said he considered therefore that if the current scheme was regarded as having no exceptional justification to merit notation for residential development then the same applied to the H8 site. In fact the proposed new access road to the school would create a hard edge to the Green Belt and he commended the scheme to Members as providing in addition public open space and low cost housing. He reminded them that what was being sought was not a planning permission which contravened the District Plan but the achievement of a composite scheme for the area in co-operation with the Council.

Mr Squier and Mr Blackwell then responded to questions from Members as follows:

(i) it was accepted that the proposed residential development could not be substituted for the H8 Nelson Road/Canewdon View Road site and that was not now being suggested. Rather it would appear that there were land assembly problems to be overcome which could frustrate the satisfactory development of the latter scheme and the current proposals could provide an achievable alternative in the meantime -either pre or post 1995.

(ii) it was too early to define the nature of low-cost housing to be provided but the agents were prepared to consider a design brief.

(fif) the land had never been in the ownership of the County Council but they did possess a strip adjacent to Great Brays.

It was clarified that the site fell outside the boundary of the Roach Valley conservation zone. A Member commented that the Nelson Road/ Canewdon View Road site was a plotland area of loose scrub and that it was far more appropriate for residential development than an area of farmland. Having ascertained that the Members had no further questions to address to the landowner or his agent the Chairman then invited the Director of Development to address the Meeting.

Amongst other things the Director of Development said the Working Party were being asked to consider whether the planning gain as outlined was sufficient to justify making an exception to Green Belt policy and if so whether the boundary should be amended as part of the Local Plan First Review Process. He reminded Members that the Plan had been the subject of public consultation and had then been considered by an Inspector at a Public Inquiry His subsequent report had been considered by the Council and the Plan had then been adopted in accordance with statutory procedures The merits of the Plan were not therefore in dispute and the Green Belt boundary contained therein was intended to stand the test of time and not to be altered but for the most exceptional circumstances. Furthermore any proposed alteration would be subject to scrutiny when the Public Inquiry was held into the First Review and the Inspector concerned would then need to be satisfied that it was well founded

He remlnded Members that a number of potential housing sites had been considered prior to the 1987 Public Inquiry and one had been weighed against another to arrive at a distribution across the District which

satisfy foreseen housing needs. That exercise remained viable and the argument that a new housing site should be provided because the Green Belt boundary in this area needed to be strengthened was not legitimate. It was a fact that throughout the District the boundary contained a series of enclaves and castellations all of which were more open to challenge but their defence was the Green Belt itself. The strategy in formulating the Local Plan had been to identify stoppers which would seal the Green Belt at its most vulnerable points but it was highly unlikely that an appeal on the site under consideration could succeed and there was therefore no justification to relax the Green Belt boundary in this location. It had been claimed that to do so would provide addi,tional protection but the proposal was flawed because such protection would apply only to a contrived element which was not necessary and its adoption would challenge the boundary elsewhere.

Referring to the discrepancy as to the level of coaches serving the school the Director of Development advised that the information had also been received in writing from the Education Authority and reported in good faith. It was claimed that there was a problem of traffic congestion but coaches had been in usa since 1966 and there had been no sign in the intervening period of any recognition by the County Council that remedial action needed to be taken. If there was a problem it was a matter for the County Council to resolve and the fact that they had not acted over a period of several decades detracted from the argument that there was justification for making an exception to Green Belt PolLcy. The problem of access to the school could in fact be resolved without altering the Green Belt boundary and there was no naed to pay a price of the development of current Green Belt land to secure the "planning gain" that had been offered.

As regards phasing he said that whilst it had been argued as possible to defer the development of another site in order to accommodate the scheme it had also been conceded that it was not possible to substitute a new site for an existing site. The programme for development of the Nelson Road/Canewdon View Road site was between 1995 and 2001 which was a more than adequate time scale for any land assembly problems to be resolved. A visit to that vicinity would demonstrate a demand for housing and the site was ideally located for development when the housing market recovered.

In conclusion the Director of Development said as the Council's professional Officer he would advise as strongly as possible against the requested variation which would have an adverse effect upon the setting and amenity of bordering residents. The Plan had to be certified by County as conforming with their Structure Plan and both they and the DOE would need to be convinced of the exceptional circumstances to justify an alteration to the existing Green Belt boundary but neither of those requirements could be satisfied if the Plan were altered to accommodate the scheme.

In response to questions from Members the Director of Development and Solicitor advised

- that the Council could use compulsory purchase powers to facilitate development but that was seen as the option of last resort.

- that the release of the land for development would be indefensible because there was insufficient weight to justify an exception to Green Belt policy and that would create an undesirable precedent which could be used to justify other departures elsewhere.

Some Members considered that the proposal should be supported and that there was sufficient planning gain to justify departure in terms of both an improved access to relieve traffic congestion and enhance road safety and the provision of public open space and play area facilities which were lacking in that vicinity. The school was looking to expand and increasing use was being made of it for ancillary activities and it was therefore seen as imperative to accept what was on offer. The majority of Members however whilst acknowledging that there were traffic problems in that area accepted that the case made was not sufficiently exceptional to justify altering the Green Belt boundary and that there was no need for additional land to be provided for residential development. It was accordingly

RFXOMWENDEDThat this Council do not support the proposal for the provision of two areas of public open space one on either side of Brays Lane coupled with residential notation to the north of King Edmund School and that the Green Belt boundary in this location and Policy LTl, both as set out in the Rochford District Local Plan, remain unaltered. 233. REFERRED PLANNING MAmERS

Members had before them the report of the Director of Development regarding three matters which had been referred from the Planning Services Committee for consideration which were dealt with as follows:

fi) Enclosure of Grass Verges (Minute 399/92 Para. 61

Members accepted the suggestion of the Chairman that the preamble to the proposed policy should be amended by deleting the words ".. will treat each proposal on its merits but will have regard to . .." and substituting the words "... normally resist proposals that do not have regard to . ..I'. Some Members had reservations about sub-paragraph (iv) in that a two metre strip could become regarded as the norm and the view was also expressed that there was a need to ensure that boundary fences were of a high standard and that worthy tree specimens were not lost. The Working Party were advised of the way in which the proposed new policy could be strengthened to meet their wishes and it was

In response to points raised by Members the Director of Development said that planning permission was not required to graze horses or sub-divide fields, only to construct stables and controls already existed in that respect which it was proposed to strengthen by having greater regard to their size. Members were concerned however that any recommendations should also address the need to avoid an excessive concentration of such facilities and to have regard to their impact upon the landscape. It was accordingly

RECOMMENDED(1) That the following paragraph be inserted as preamble end that Policy LTlO be amended by the revision of clause C:

6.11.3 Excessively large stable buildings can have an adverse impact on the landscape and proposals for new stables will normally be considered against the size criteria provided by the British Horse Society. The British Horse Society recommend a floor area of 12 square metres per horse with ancillary storage of 50% of that area.

CC) STABLES SHALL BE CONSTRUCTED TO A GOOD STANDARD OF DESIGN AND MATERIALS AND THE SIZE OF THE PROPOSED STABLES SHALL BE ASSESSED AGAINST THE SIZE GUIDELINES PUBLISHED BY THE BRITISH HORSE SOCIETY. 1. Outline of the Proposal

The landowner proposes to provide 3 acree of land on the north side of Brays Lane and 2 acres of Land on the south side of Bray8 Lane, together with a new access to ser"e King Edmund School, in return for land use allocation in the Local Plan leading to a planning consent to develop approxuoately 3.5 acres of land to the north of King Edmund School for housing purposes. Ae the site history will show, the land on the south side of Brays Lane was previously the sub]ect of a formal obJection made during the preparation of the now adopted Rochford District Local Plan.

2. Rochford District Local Plan - History

The Rochford Drstrict Local Plan was adopted in 1988, and a five Bore site on the north side of Brays Lane is allocated in the plan as proposed Public Open space. The need for Public Open Space to be provided rn this part of the Distrxt was established during the plan preparation process.

The area of land on the south side of Brays Lane shown on Map One (attached) was prevroualy the subject of an objection made during the preparation of the adopted Local Plan. A proof of evidence was presented to the Inspector who chaired the Local Plan Inquiry in 1987. The proof argued for the release of the land from the Green Belt, primarily on the grounds that the Green Belt in this part of the District was of limited value. The final paragraph of the proof also made reference to difficulties of access to King Edmund School, and argued that a new direct access would constitute a considerable planning gain.

It should be noted that eeveral other sitea on the East side of Ashingdon were also the subject of objections which were considered at the Local Plan Inquiry.

The Local Planning Authority, in making representations to the Inspector argued thatr

.Sufficient land had been allocated to fulfil the Structure Plan Housing Allocation for the period to 2001.

-The release of all the objection sites would create enormous pressure for further developnent to the east.

So I find no grounds for seeking to relax the Green Belt along this admzttedly rather raw edge to the built up area."

The, 80 called, planning gain argued in relation to the provision of a new road into the school site did not figure as a consideration for the Inspector who wae clearly of the opinion, it can be inferred, that this did not constitute eufficient juatxfication for the exceptlana circumstances needed for an alteration to the Green Boundary.

3. Planning Policy Guidance

Planning Policy Quidance Note No.3 entitled Green Belts provides the main policy backdrop for development prcposale in the Green Belt. Paragraph 7 of PPG3 states:

The essential characteristic of Qreen Belts is their permanence and therr protection must be maintained a~ far as can be seen ahead.

In some cases this will mean safeguarding land between the urban area and the Green Belt which may be requzred to meet longer term development needs.

PPG2 iB, therefore, very clear in its guidance. Planning permission for new development should only be granted in cases where there are exceptional circumstances. The issue in this case then is whether or not the provision of a school access constitutes the exceptional circumstances envisaged by the Department of the Environment. The Local Plan Inquiry Inepectcr was of the opinion, as mentioned above, that it did not. Furthermore, the Local Plan has identrfied land for longer term development purposes, and there is therefore no justification in this respect to make further alterations to the Green Belt boundary at this stage.

4. The Department of the Environment Position

The Department has been consulted for its views on this proposal. In a letter dated the 11th February 1993, the Department felt that it was unable to comment in detail on the merits of allocating specific sites in the plan for development. The letter does, however, state as follows:

We can see the attractions of what is proposed but I would simply remind your Council of the advice in PPG2 that once the Qreen Belt boundary has been fixed in an adopted Local Plan it should be altered only in exceptional ciroumstances. If your Council wish to include the proposed alteration in the deposit version of the First Review they will therefore need to be able to show that, at the very least, the change is fully justified in terms of the land use planning benefits it brings and that it would not seriously harm the purposes of the Qreen Belt.

The Department of the Environment is clearly placing a very strong weight on the need to ensure that any proposal for land allocation can only be justified in exceptional circumstances. The Inspector who dealt with the Local Plan Inquiry in 1987 was definitely of the opinion that this eita, and others, should not be released for residential development.

5. The County Counail's Position

The County Planner draws attention to the content of Planning Policy Guidance Note Nc.2, and points cut that the current adopted Local Plan established the detailed Qreen Belt boundaries.

Policy 57 of the Essex Structure Plan First Alteration states that:

Green Belt . ..bcundaries around tcwns and villages will be defined by reference to the foreseen long-term expansion of their built-up areas acceptable in the context of the stated purposes of the Green Belt and of the provisions for development specified in part III of the Plan.

The County Planner goes on to ccsment that Paragraph 11 of PPG2, together with Policy 57, provides the necessary context withrn which the District Council was able to establish ita Local plan mAreas of Special Restraint", actrng aa land which could be considered for future development should a need be proven. He continues:

F Such land was not required for the 'stated purposes of the Qreen Belt".

Therefore, it would be somewhat xnplausible to suggest that five years on some of the Are.%3 of Restraint land should now go into the Green Belt, bearing in mind the Supposed permanence of the Qreen Belt established by your 1988 plan....strategically, the proposition being

satisfaotorily meet the requuwments of the approved Structure Plan Fu%t Alteration and second alteration policies. The Propoeel would set en unweLcome precedent for other supposed "planning gains" in the Green Belt."

The First Alteration (part III) housing allocation to Rochford District, for the period 1986 to 2001, is 4700 dwellings. The County Council considers that, in this case, there does not appear to be sufficient justification to alter the adopted Green belt boundary to allocate further land for residential devalopnent.

The County has provided a detailed breakdown of the housing situation in Rochford III their publication "Housing Land in Essex" published in November 1991. The report identifies a potential dwelling capacity, arising from existing sites identified in the Local Plan plus the capacity of the Areas of Restraint, of approximately 5,100 dwellings. This exceeds the housing allocation, but allows for an acceptable element of flexibility in the land S"PPlY.

The report also states as follower

Within those districts wholly contained wfthm the Qreen Belt there is a strong presumption against =nY further green-field cl1t.s development..... an important feature of the Strategy is that the Netrcpolitan Qreen Belt boundaries in the south and weet of the county will not materially alter. Thus the Strategy contmues the emphasis of succeeszve County plans in provlding for the strict containment of development in Qreen Belt areaa.

6. The Land AvailabilitY Situation - Roahford perspective

As stated above, land for 4700 dwellings must be made available in Rochford District to fulfil the Structure Plan First Alteration allocation. This total can be achieved through the various sitae previously identified in the Local Plan preparation process, the restraint sites now identified for residenti& purposes, together with an allocation for the intensification of the built-up area.

The calculations show that no additional land Fe required to be allocated in the period to 2001 to fulfil the Structure Plan housing allocation to the District. Including an allowance of 360 "nits for intensification of the built-up areas, land IS available within the District for a total of 5289 dwelling "nits. This confirms the County Council's calculations. It is clear then that in strict land availability terms there is no need for additional housing land to be allocated to meet the County housing allocation figure. The argument for exceptional circumstances must therefore boil down to the provision of the Public Open Space and the new school access.

7. ma King Exlmund school

Both the County Education Department and King Edmund School have been approached for information regarding projected changes in the school roll and the way in which the current busing arrangements function.

The currant school role is about 1185 pupils, and it is not expected that thi6 total will change significantly in the next few years. At present, a total of 468 pupils are transported to the school in six coaches and two double deck& buses from Foulness Island, Great Wakering, Little Wakering, Barling, Canewdo"

and Stambridge.

The County Education Department is responsible for organising bus transport for pupils who live more than three miles from the school. The transport arrangements have been in place since approximately 1966. The Pupil, student and Parent Services Manager confirms from the contract file that there do not appear to have been any complaints from residents in the streets surrounding the school.

The School for its part does not expect there to be any increase or reduction in the number of bus movements, since parents are generally well disposed to the school end value the provision of a safe door to door travelling arrangement. The report of the school with regard to complaints from

; surrounding residents is, however, at variance with the view of the Education Authority, which is responsible for making the transport arrangements in the first place. The school agrees that there have been fewer complainta of late, but that in the past there has been considerable annoyance generated by the arrangements. If this is the case, then it is certainly very surprising that the complaints have not been fed directly to the organising authority.

'a It is understood that the buses arrive at short intervals during the morning and decant the children in Oxford Road. In the afternoon all the coaches drive into the school playground, the pupils embark at approximately 3.20, and the buses have departed the area by 3.30. The time period for a nuisance to be caused to surrounding residents is, therefore, very short indeed.

It may be argued that the current arrangements for buses arriving at the school, which have been in place since 1966, are unsatisfactory, but the short periods needed for delivery and collection and the inconvenience this may cause, must be weighed against the proposal to release 3.5 acres of land from the Green Belt. Recall that the Local Plan Inquiry Inspector in 1987 was totally opposed to the release of this site for housing purposes.

8. The Rochford District Local Plan First Review

The Local Plan is currently in the process of being reviewed. The review has included the allocation of a number of the Areas of Speoial Restraint identified =n the adopted plan as new housing sites. (see Policy H2)

;* The housing sites include the Canewdcn View Road/Nelson Road site, centred on a plotland area, and due for release in the post 1995 period. It is argued that part of the Canewdon View Road site is unsuitable for development since it is covered by woodland. This woodland is, in fact, secondary woodland and as has been the case on other sites throughout the District, there will be little difficulty in arriving at a layout for the development of the site

t- which retains any important individual tree specimens.

The land at Canewdon View Road has been included in the Local Plan as a potential housing site since the time of the preparation of the first draft in the early eighties. No objection was lodged to the inclusion of the site for housing at any stage in the preparation process, and the site was therefore retained as an Area of Special Restraint when the plan was adopted in 1988. There le. then a very strong presumption, and understanding, that the site will be developed. Indeed, a recent planning application for residential development was refused on the basis of being premature and the appeal decision, in supporting the planning authority's decision, was related solely to the argument of prematurity, no reference being made to the suitability of the land for development. The landowner in this case ~111 expect that once the

post 1995 period has been reached that planning permission will be forthcoming.

It has been suggested that the wooded part of the site could be substituted for the land adjacent to King Edmund School. The simple fact of the matter is that a substitution would not work, since the inclusion of the site in an adopted Local Plan has effectively identified the site for development.

Another very important point to consider is pressure that the release of a new Green Belt housing site in this location will have for the release of adjacent sites and indeed for the release of other sites elsewhere in the District. As indicated above, a number of other sites on the east side of Ashingdon were also considered as objections at the Local Plan Inquiry in 1987. The release of the Brays Lane site would create enormous pressure for the future release of these other housing sites, unless the Local Planning Authority could convince the next Inquiry Inspector that the school access constituted an exceptional circumstance justifying the Brays Lane site. Even were this to be the case it is contended it is unlikely that the resultant pressure could be resisted.

There are many other sites across the District which were the subject of l ob]ection at the Inquiry, Wellington Road, Rayleigh and spring Gardens, Rayleigh are town sensitive examples. In these cases, unlike the Brays Lane site, the Inspector actually recommended that these sites be allocated for development. The Local Planning Authority was not convinced, in these cases, of the Inspector's argument, and the sites remain in the Green Belt. Nevertheless, these sites must be considered as very sensitive, and any proposal to release Green Belt sites from elsewhere in the District would undoubtedly create an undesirable precedent and unrelenting pressure for the release of these and other sensitive sites across the District.

9. Public open space Prevision

The adopted Local Plan allocates approximately 5 acres of land on the north side of Brays Lane for Public open Space purposes. The legal position here is that if the owner of an allocated site refuses to sell to the Council for the intended purpose, and bear in mind that in this case the landowner specifically requested the Council to allocate this land for POS purposes, then the option to proceed to a Compulsory Purchase is open to the Council. The creation of an open space on the north side of Brays Lane is, therefore, a l practical possibility.

10. Discussion and Recommendations

There are several issues to consider with regard to this proposal.

In the first instance, the need for additional residential land in the current plan period to 2001 is not proven. The land availability position has been explained, and it is clear that more than sufficient land was identified in the preparation of the Local Plan through the identification of the Areas of Special Restraint to satisfy the Structure Plan housing allocation to the District.

There is a need for Public Open Space in this part of the District, but the allocation on the north side of Brays Lane together with the ability of the council to acquire this land by compulsory purchase if required means that there is no added benefit sufficient to argue exceptional circumstances, from the offer of a donation of land from the landowner.

l The need for en access to the school, whether this is an essential or not, and the evidence clearly leaves a considerable element of doubt in this respect, is definitely not considered to be an exceptional circumstance sufficient to

3. override Qreen Belt policies.

The argument in respect of substitution of pert of the Canewdan View Road site for the Brays Lane site is not persuasive. The Canewdon View Road site has been properly allocated as part of a local plan preparation process, and to remove this, as the County Planner comments, would undermine the intent of the Local Plan in creating a permanent Green Belt boundary.. Fxaally, en undesirable precedent would be created through the allocation of this land that would make it impossible to resist the pressures for the release of many other sensitive urban edge sites throughout the District. In effect, the whole integrity of the Local Plan, reflecting the proper planning

n for the future of the District, would be undermined.

In conclusion, the Director emphasises as strongly as his position allows that

l if there is a problem it is one for the County Council to solve themselves. However, the existence of a problem has not been well made and has been lived with for many years. It cannot, in any event, be of such exceptional import as

h to justify altering the boundary of the Green Belt to permit a further 3.5 acres of unneeded residential development. This, in itself would create an undefendable precedent for additional variations to the approved plan and would be wholly inconsistent with decisions adopted by the Local Planning Authority and supported on appeal elsewhere in the District i.e. Alexandra Road, Great Wakering.

District, including 4 sites of national importance which are scheduled as Ancient Monuments are recorded on the Sites and Monuments Record (SMR) maintained by Essex County Council. The Ancient Monuments are:

7.6.2 Archaeological remains are a Bnite and non-renewable resource. In many cases the remains are highly fra ile and vulnerable to damage or destruction. The remains contain 1 2 ormation about our past, are part of our national identity and are valuable for their own sake and for their role in education, leisure and tourism. As a result it is important to ensure that l

archaeological remains are not needlessly or thoughtlessly destroyed. The sites included in the SMR may be only a small fraction of the total and

l many important sites undoubtedly remam undiscovered and unrecorded.

7.6.3 Under the Ancient Monuments and Archaeological Areas Act 1979 it is an offence to carry out or ermit to be carried out any works which would have the effect of demolrs .K*mg, destroying, dama in removing, repairing,

Lfaltering, adding to, flooding or covering up a SC e uled monument without the consent of the Secretary of State for the Environment.

c 7.6.4 The known archaeological sites are variously of re ional and local

l importance and range from scatters of prehistoric and i!ater finds to the more readily visible evidence for Roman and Mediaeval settlements. Mediaeval sites are most numerous and there are at least 30 moated sites within the district. The distribution of Bronze Age finds suggest that the area was of some importance in the prehistoric period and the place names

t of the settlements in the district suggest that many are of Saxon origin.

7.6.5 The settlements of Rochford and Rayleigh are the most important in archaeolo ical terms. They are two of twen four towns in Essex which existed in i axon or Mediaeval times and Rot ?i ord is ranked third in a list of priority towns in Essex based on the type and scale of projected development and its archaeological importance.

7.6.6 The local planning authority considers that it is imperative to avoid any form of development which would have a detrimental effect on the integrity or settin of an Ancient Monument or important archaeolo ical site. Planning f; olicy Guidance Note No.16 (PPG16) provides nation at guidance in relation to archaeology and planning. Paragraph 27 states:

7.6.7 For sites with remains of lesser importance where preservation in sitz4 is not justified and where planning permission is to be granted for development which will affect the integrity of an archaeolo$cal site, the local planning authority will seek a legal agreement requiring the developer to give reasonable access to the site for archaeologists to observe the progress of all earth moving stages and record finds as appropriate. In the absence of such an agreement excavation and recording will be secured by means of planning conditions. It should be borne in mind that planning permission will only be granted, notwithstanding the above comments, where the develo ment proposed complies with all other policies, articularly those relate B to the Green Belt, contained in this local plan. 3.5.0 Ministry of Defence Operations

3.5.1 When approving the Essex Structure Plan in 1982, the Secretary of State stated in his decision letter dated 30th March 1982 that it would be appropriate

“‘to include in the Green Belt most of the urea (but not Foulness Island) lying between the River Crouch and fhe River Thames, in order to give proper profection to the equally sensitive areas north and east of Rayleigh and Hock&‘:

No s ecific reasons were iven for excluding Foulness and Rochford decl ed not to Include the Is and in its initial Local Plan which was adopted 2 B in 1988, primarily because it was under the control of the Ministry of Defence over whose operations the Local Planning Authority had little l Influence and it was not therefore thought appropriate to include polices or proposals in the Ian concerning that area. Nevertheless, the ap roved Green Belt boun x ary did include land in MOD ownership on both 5 otton. and Rushley Islands and no conflict had previously been raised as a result of that designation.

3.5.2 Under the provisions of the Pltin and Compensation Act 1991 however, .local plans are required to have %.IstrIct wide coverage and it is now

necessary to include Foulness in the First Alteration. Furthermore, there are roposals to bring Crown land within lannine controls and there would be i ii e need to cover the situation shoul B the h4mistry interests be altered or completely withdrawn.

3.5.3 Faced with this necessity, it appeared to the Council that it would be ap ropriate and logical to include Foulness within the Green Belt and fol owmg consultation, the Department of the Environment and the Essex P

6 County Planner confirmed their agreement to this course of action.

3.5.4 The Council therefore proposes to include the whole of the area south of l the River Crouch and eastwards to the North Sea, in the Green Belt, including Foulness Island, as an eastward continuation from the boundary at the River Roach and The Middleway shown on the adopted Local Plan.

n 3.5.5 In extending the Green Belt boundary eastwards to cover Foulness Island

the Local Plannmg Authority is conscious of the continuing operational requirements of the various Ministry of Defence tnstallations includingestablishments organisations such as the A & ). up to 1000 people are loyed on the Island, and it is not intended that the Green Belt works from bein undertaken which are directly required in connection with these instal ations. Such works f: would include any development proposed by the MOD, its Agencies and any other bodies authorised by it. The same consideratlous would apply to other MOD installations on Potton and Rushley Islands where Green Belt restrictlons currently apply. In any event, it IS understood that,

f notwithstanding the Imminent change in Crown immunity, development of this nature IS hkely to continue to be exempt from planning controls.

3.5.6 The Council is, therefore, committed to the conttnuation of MOD operations on Foulness Island, Potton Island and Rushley Island. substantial majority of the land in MOD ownership is presently farmed an 9 despite the transient nature of many of the test rigs used by the MOD, these are,. in the main, set-u in areas which have been tradttionally used for testmg over a period o P many years. 3.5.7 All other roposals for development which are not of an operattonal nature, sue R as proposals for new housing, would be subject to the extsting stringent controls available under the Coastal Protectton Belt Policy (see Chapter 8, section 8.6.0) and to the Green Belt pohcy restricttons detailed in Policy GE%1 above.

At the meeting of the District Plan Working Party on 25th February 1993, whilst agreeuq that the inclusion in Policy LTlO of an amendment relating to the size of stable buildings was necessary, Members were nevertheless concerned about the impact that the fragmentation of land holdings and the over concentration of stables in particular areas could have on the visual appearance of the Oreen Belt. A further report wee therefore requested to consider these particular issues.

The fragmentation of land holdings through change of ownership is not within the control of planning legislation. The purchaser of an area of land in the countryside is antltled to erect fences to delineate his boundaries without the need for planning consent. The current wording of clause A(ii) of Policy LTlO explicitly attempts to control this form of fragmentation, and LII all cases of applications for stables where subdivision is an issue, the policy will be rigorously applied. It should, however, be clearly understood, that the subdivision of land is not the issue. The issue, in these cases, is the unpact that subdivision may have, taken together wLth the construction of stables, on the character, natural landscape or rural appearance of open agricultural land or meadows.

The subdlviaux of land could lead to many applications for stables in a small area. This potential overconcentration of stables would certainly be contrary to the policy as it now stands, since the buildings are required to be sited to ensure that there is no visual intrusion in the landscape. Similarly, the overconcentration of stables as a ribbon form of development would also fall foul of the need to ensure that there is no visual intrusion and that the appearance and character of the countryside is unharmed.

Nevertheless, lt is considered that there is positive merit in making explicit reference to these matters in the policy, since one of the purposes of the policy is to make very clear to potential applicants the attitude that the authority will have to their proposal.

2. VALUE FOR MONEY STUDIES

(i) DEVELOPMENT CONTROL 1992

1.MANAGEMENT SUMMARYz-

One of the main tasks of the Council’s external Auditors, Ernst & Young, for 1992 was to pursue the national “flavour” for value for money on Development Control. Their Report acknowledges the several Studies that Develo ment Control has undergone in the last three years. It acce ts that the problems in 199 f were being addressed at that time. Since then, changes have %een made and performance has improved.

A number of findings of “good practice” are endorsed. These should be maintained and built upon. The Authority should aIso continue its current initiatives aimed at reducing

a costs whilst maintainin service levels. A number of specific areas are also suggested where improvement m&t be made.

2. AREAS OF GOOD PRACTICE:-

The Auditors endorse the following areas of good practice which are already in place:-

(i) The Authority has clearly defined and well structured policies and objectives.

The Local Plan is recognised as a dynamic document, which should evolve to meet changing needs and Government poli Committee decisions and Appeal decisions are monitored and fed back into the Local Y lan process, as part of which, the Rochford District Local Plan is now being reviewed.

Departmental Service Level Agreements are used to set aims, objectives, activities and performance measures, which are felt to be adequate and appropriate.

(ii) The organisation of the Development Control Service allows Applications to be decided promptly and at an appropriate level.

As a result of the three levels of the decision making process - Dele ated, WeeMy List and Committee - the Authority achieves decisions on at least 80% o f Applicationswithin 8 weeks on a regular basis.

(iii) The processing and monitorhg of Applications is performed in an effkient and effective manner whilst maintaining a positive approach to the Customer.

This is achieved by using the DCM computer system, through pre-Application l discussions and through structured Enforcement procedures.

Resources only permit the Section to adopt a reactive approach to Enforcement. However, there is a structured rioritised approach which allows cases to be addressed in an ordered consistent manner w Belch promotes effective enforcement.

A system of selective monitoring of Planning Conditions is used. This is an efficient and economical use of resources.

3. CURRENT INITLGMZS :­

In addition, it is recognised that further efforts are being made to maintain and improve the service:-

(i) The Authority is endeavouring to reduce costs whilst maintaining levels of service through voluntary redundancies and restructuring.

This is being achieved by reducing Staff costs through a voluntary redundancy lprogramme and by re-structuring the Department.

Whilst in previous years the costs of Rochford’s service was felt to be high in comparison to Authorities m the same Audit Commission “Family Cluster”, the projected savings will place Rochford below the family average.

(ii) Restructuring the Department in response to Staff changes and to improve efficiency.

In con’unction with the redundancies, the Department is being restructured on a Team basis. his will assist Rochford in maintaining its current good performance.

Vacancies in the new structure have now mostly been filled. The Team working arrangements are almost complete and will be operational by lst April 1993.

4. FURTHER IMPROVEMENTS:-

(i) The Time Log Study should be simplified and extended to a regular procedure.

The original Time Log Study was intended to show where Officers were spending their time and also to estabhsh processing times for typical Planning Applications. The l first of these has served its purpose and showed time spent was comparable to Audit Commission Studies. This is now discontinued in favour of a more simple monitoring exercise for Development Control, but additional information is being gathered for time spent on Enforcement activities.

(ii) The current Appeals process should be reviewed with a view to centralising within the Development Control Section.

Both the Director of Development and the Solicitor feel that the resent arrangements serve the Council well. However, an internal review is being underta ii en and it is anticipated that a Report will be made to Members around late Spring.

(iii) The number of Enforcement cases on hand should be reduced before the proposed reductions in Staff.

A key factor in the new Model Structure is the retention of the existing resource for Enforcements and the organisation of case workers to respond to Enforcement cases, whilst Planning Application levels are low. The re-structuring is based upon some reductions in Staff, but not upon any reduction of resources for Enforcement. A further 0 Report will be made to Members as part of that referred to in (ii) above.

l (iv) Adequate Management training should be provided for Senior Staff.

Individual training requirements are identified as part of the Appraisal process. In addition to this, Corporate training for Chief Officers and Cost Centre Managers is being arranged through Dale Carnegie.

(v) Team Clerks should be used extensively to field enquiries.

A significant part of Staff time is taken up addressing enquiries received. The introduction of Team Clerks provides the opportunity to reduce the amount of time s ent on routine enquiries by professional Officers. The new Job Descriptions for the I?earn Clerks includes this responsibility, although training time will be needed, even for the more simple technical aspects of the job. The function will be reviewed as necessary in the lightof operational experience.

(vi) The Authority should consider producing a more comprehensive Planning Guidance document.

A wide variety of Plannin Guidance documents are used and are available, dealingwith individual policies. The %.istrict Local Plan - current1 bein reviewed, is the comprehensive document. This is assistedby the Essex Design 2.mde a%o currently under review by the Essex County Council. When these are completed, they will be made a generally available and accessible. An Information Folder is now issued with PlanningApplication forms which contains advice on the need for Permission, making a PlanningApplication, Planning fees, how Applications are processed and Enforcement action.

(vii) If performance decreases against the Department of the Environment’s 8 week criterion, an increase in number and types of decisions delegated to Officers should be considered.

The statistics show that Applications going to Planning Services Committee do not always achieve the above target, whilst the other methods do. However, Members have previously considered the question of increased delegation to Officers. Even at the heightof the National peak of Planning Applications, Members were not happy to do so. As a result, the Weekl List was introduced which tempers increased speed with retention of Members’ contra K. No reason is seen to depart from these arrangements, with a Model Structure which has been designed to retain sufficient Development Control case workers to respond to an upturn in Planning submissions if it occurs.

RECOMMENDED:-

a (1) that the VFM Report of Ernst & Young be noted.

(2) that the suggested further improvements referred to above be considered.

(3) that further Reports be made on sub paragraphs 4(ii) and (iii).

[ii) MAKING GOOD USE OF THE CENSUS

As part of their 1992 rogramme, the Council’s external Auditors, Ernst & Young, have; carried out a Study oFthe way in which the Council is addressing the Census issue. The Study concludes that there are several areas where Rochford has adequately addressed the subject. These include:-

(1) Its identification as a major Corporate Plan project commitment

(ii) A Lead Officer has been identified

(iii) The Lead Officer has had full involvement with the County Census Working Groupa (4 The C91 software package has been purchased and will ensure that ability to process and analyse the data

In addition to these conclusions, however, Ernst & Young are suggesting other areas for attention:-

(i) The Chief Executive should take the lead in co-ordinating arrangements to exploit a the information to best advantage and the Census Working Party should be Chaired by the Director of Development as a link to Management Team.

(ii) The Census Working Party should consider user issues in addition to Census handling issues. This will include ensuring Chief Officers awareness of the various data combinations available, internal user requirements, a “Council atlas” with information for each District, external user requirements, licensing and copyright restrictions, visual requirements.

The Auditors feel that if these measures were adopted, there would be various benefits beyond those so far recognised. These would include general awareness of the Census issue prior to receipt of data, avoiding a last minute rush of requests for information, allow prioritising of re uests, make possible economies of scale and enable the co-ordinating Officer to brief ot R er Departments on time scales and progress.

In the meantime, a Report on the setting up of a Census Working Party was approved by the District Plan Working Party on 25th February 1993. This Working Party wrll ensure that the wealth of information available is brought to Members’ attention. An implementation programme for preparation of the information will be prepared in the a early stages, against which progress will be monitored.

RECOMMENDED:- that the Report be noted.

The Group were pleased to note the Corporate Plan which had bean circulated to Members with the Agenda. The Chairman congratulated the Officers concerned on a well presented and attractive plan and stressed the importance of being nine tenths green belt and of the protection of the environment and conservation areas within the Rochford District.

At the suggestion of the Chairman the Group went through the Corporate Plan page-by-page and the following points were msde:-

- To encourage the District Council to achieve 25% recycling by the year 2000

- Supports an environmental survey.

- That a register of potentially contaminated land had been withdrawn by the Government.

- Supports the monitoring of air quality in the District.

- That they would prefer the words "If necessary" before "to monitor discharges from sewage treatment works" on page 10 to be deleted.

- Supports a survey of recreational water and rivers.

- The use of redundant farm buildings be encouraged to generate employment.

- Supports the use of volunteers and local Conservation Groups to improve open spaces.

- Encourage the use of native broad-leaf tree varieties in landscaping.

- Supports the use of Southend Airport as a regional transport facility in its present form.

- Supports a positive car parking policy.

- Supports the Council in pressing for detailed plans to deal with any flooding but express grave concern and would encourage the local Member of Parliament to be more vigilant over the sea defences within the Rochford District.

- l-he use of asphalt to protect sea walls was seen as undesirable.

- Concern was expressed about the development of Rochford Hospital.

pECOHMENDED That the response of the Group of Representatives to the Council's Corporate Plan be noted.

111. ANY OTHER BUSINBSS

(0 Local Nature Reserves

The Group were advised by the Woodlands Officer of the possibility of designating local nature reserves, in conjunction with English Nature, within the District with particular interest in the Hullbridge Foreshore and land at Doggetts, Rochford.

(ii) Grass Seed

A member of the Group advised that a new grass seed had come onto the market suitable for grass verges called 'Lowgrow' which could cut costs to the Council as it only requires two cuts per year.

(iii) Hocklev Parish Council

Councillor Mrs. L. Vingoe of Hockley Parish Council informed the Group of two projects which had recently taken place within Hocklay namely at Marylands Wood and Plumberow Mount. She congratulated the Woodlands Section on their efforts in making these projects so successful.

The Chief Environmental Health Officer reminded Members of the history of this industrial site where over recent years paint spraying had given rise to numerous complaints from neighbours but where despite frequent monitoring by staff no statutory nuisance could be found to exist. Commenting on the findings of the consultant's report referred to in the Schedule he said it was apparent'that the present 5.35 metre stack was inadequate to satisfactorily disperse the solvents and that to overcome the problem there were two options; increasing the stack height to 12.35m, or to fit an efficient solvent recovery and regeneration system with an 8m high stack. Having regard to the future legal requirements the consultants recommended the latter option. This would need to be suitably conditioned with provision for a neighbourhood survey after implementation The Chief Environmental Health Officer advised that it was, important for the stack to be increased to a minimum of 8m without undue delay.

The Director of Development advised the Committee that although the temporary permission had expired the report made it clear that the problem could be overcome and the applicant had indicated his willingness to comply with the findings. The Officers were accordingly recommending that the applicant should be enabled to incorporate the provision of a higher stack into the application and that a further temporary permission should then be granted.

The Committee were also advised that if they decided on the other hand to refuse the present application as submitted it would be inappropriate in the circumstances for enforcement action to be taken without a prior comprehensive report including the legal implications of such action.

Some Members accepted the Officers recommendation as representing the best way forward but others were not convinced that the activity could be adequately controlled so as to avoid a continuing nuisance in this predominantly residential area and argued that it would be mcare appropriate to relocate the paint spraying process

It was moved by Councillor Mrs J Fawell and seconded by Councillor Mrs. H.L.A. Glynn.

"That the application be refused on the grounds that despite continued efforts with the applicants and consultants since 1989 they have been unable to effectively restrict odour and nuisance to adjoining residents. To permit this use to continue would result in an unacceptable and continued environmental nuisance and its intensification would be likely to give rise to further nuisance and smells to the detriment of adjoining residents."

With the consent of the Chairman purSua.nt to Standing Order 26.2 the Director of Development advised the Committee that work had commenced to extend the car park at the above site without the benefit of planning permission, that it might be possible to regularise the matter but since the extent of the works was unclear and there were trees on site the subject of a Preservation Order, it was

140. HR. T. MANIUNG

The Director of Development advised Members that Mr. Terry Manning, the Planning Services Manager, was retiring at the end of the month having joined the authority in 1975 during which time he had gained Chartered Town Planner status. The Committee expressed their best wishes to him on his retirement and happiness for the future

REPORT:

This applxation seeks to regularise the position whereby the first floor of a vacant shop is being used for the teaching of ballet, tap and modern dance for children ranging from 3 to 16 years old. Previously this floor was used for the storage of goods, etc. in connection with "se of the ground floor as a supermarket although a8 many Members will concur this unit has been vacant for a good number Of years now ("15 years plus" according to one neighbour). Despite this dance use commencing some months ago and wide notification of the application, no letters of objection have been received from nearby

3PROPERTIES.

The applicant states that the only music sources are a piano and a amall tape recorder. With a maximum of 10 children at any one time and only one or two other helpers (including the pianist) she notes that noise levels are inaudIble outside the building. Apparently most parents walk to the premises with their children leanng them at the studio;

THE HSSEX COUNTY COUNCIL FIRE AND RESCUE SERVICE has no observations against the change Of use. It suggests, however, the applicant ia advised of the requirements of the Building Regulations (Building Inspectors have made contact with the applicant wrth a view to ensuring compliance with the Regulations).

THE CHIEF ENVIRONMENTAL HEALTH OFFICER reports that there is potential for noise from the proposed development greater than exists at present.

A practxcal assessment of the noise has been carried out and this has ndlcated there is unlikely to be a problem affecting nearby residents. There LB however also potential for noise to effect the ground floor of the application buLlding. This aspect is however difficult to assess aa the ground floor has been vacant for many years and the possibility and degree of any n"~.sa"ce wrll largely depend on the nature of the occupancy of the ground floor If & when this occ"rs. Certainly some degree of noise insulation is likely to be required in the future but the exact nature and extent cannot be assessed at this stage.

Members should be aware that powers do exist under other legislation, principally the Environmental ProtactFc" Act 1990 tc deal with any problems of noise should they arise.

He therefore concludes that on balance no objections are raised against the proposal subject tc:-

1) an informative to the effect that sound insulation measures may be necessary in the future; and 2) conditions 1 and 2 being Imposed.

Whilst a start time of 3.30pm was originally suggested by the applicant and carried into the Chief Environmental Health Officers Condition no. 2, ahe has subsequently suggested a" earlier time of 2.00pm to allow for the use by the most jmuor customers, 3 to 4 year olds. In view of the limited effect on the area this does not seem unteasorlable and has been recommended in the revised Conditlo" 2 above.

As stated above no objections have been received from NEIGHBOURS, in fact two letters of support have been received from properties I" Malyons Lane:-"Joloma" and "Beejay". However, one letter of objection has been received l from a STAQE SCEOOL OF DANCINQ, which operates from the Hullbridge Community centre, on the followng grou"da:-

The parking on this aita and that of the adjacent shops Fe certainly limited in comparison with modern day standards although it was acceptable when proposed to serve the shops granted permission in the 1960'8. The plans indxated parkIng for at least 9 cars with space for parking and turning of at least 3 dellwring vehvzlee. Modern standards would have required 8cme 20 lspaces although it would appear u"teaso"able to seek to "back date" such prcv1slc". Furthermore, bearing in mind the limited nature of the we, the =g= of the customers, the member of staff involved etc., the proposal would not greatly exacerbate the situation particularly when the number of adjacent streets and Condition no. 4 above are taken rnto account.

REPORT:

This proposal follows an arson attack at thla depot recently and seeks to improve security by the erection of a 2m. high fence and additional floodlighting. FOU?Z floodlights have already been placed on the existing workshop building and an additional three columns have been proposed to be sited along the eastern boundary. By lightng the site =n thLs manner the bulk of any glare will be directed away from existing and proposed housing in this vrcin~ty. In view of concerns regarding thre all night lighting the applicants have recently agreed to reduce the height of the columns from 11.5m. (37’8”) approx. to 9m. (29'6") to further alleviate light glare and reduce the effect on the sky line.

THE RAYLSIGH CIVIC SOCIETY was surprised at the (originally) proposed height Of the lighting columns, suggesting that at 11.5m. not only would they be intrusive but light densrty would be lower than If the lamps were set at a lower level. It raised no objection to the fencing on the eastern side on the assumption that the planted bund "111 eventually grow higher than the fencing. The Socrety was unable to comment regarding fencing on the western side.

Preamble

The report below sets out the policy & cncumstances of this application. The full chalet design falls outside a strict interpretation of the policy although the shell of the building is no higher than the approved bungalow type chalet (without dormers). Also the existing property has first floor accommodatux in the roofspace. The site is not open to significant public views.

The agent has presented a case for an exception to be made to poluzy which may prevail if taken to appeal.

In the circumstances Member view will be welcomed on this proposal. The recommendation below is fashIoned from application of strict policy.

REFUSE%

01 GREEN BELT - STANDARD REASON PLUS.....Polxy QBS of the Rochford District Local Plan First Review ~111 allow the replacement of an existing dwelling in the Green Belt, but subject to stringent controls over the materials, design, locatxon and landscaping.

The proposal is considered to be contrary to this polxy, in that the proposed dwelling would appear substantially different to the existing bungalow on the site, and if allowed, would create a precedent for similar development in the district, the cumulative effect of which would cause severe harm to the appearance of the rural area and would seriously undermine the alms and objectives on the Green Belt.

REPORT:

The application site comprrses an existing bungalow on the frontage to nontefiote Avenue which has benefited from various extensions over the y&3X* and has limited accommodation at first floor level within the roofspace of the bungalow lit by gable end windows and a rwflight. The area is allocated for green belt purposes in the Rochford District Local Plan First Rev+" and

a Policies GBl and GBB are relevant.

Planning permIssion was refused on green belt grounds in 1985 for a new roof incorporating dormer windows over the existing bungalow. In 1986 planning permission wae granted for a single storey side extension subject to conditlons, inter-alia, removing all Permitted Development rlghts. An application to form a pItched roof over the flat roofed extension at the rear Of the bungalow was subsequently withdrawn but the site visit revealed the roofspace of the exrsting bungalow was in use for habitable purposes.

Following a preliminary enquiry as to the possibility of a replacement dwelling being agreed at the site, a planning applxation was submitted under reference F/0366/91/ROC proposing a chalet style dwelling with dormer wIndowe to the front and rear and a prolacting gable at the front with a first floor "Indow "ithIn it. Although the subject of a report to the Planning Services Conunittee on 4th July 1991 with a recommendation of refusal, the application was "Lthdrawn from the meeting at the agent's request and formally withdrawn on 10th. July 1991.

A revised application was subsequently submItted under reference F/0565/91/ROC, and approved after appearing on Weekly List no. 78, showing a replacement bungalow style chalet of similar sne and character to the ensting dwelling with first floor accommodation within the roofspace lit by gable end windows and rooflights at the rear. The floorspace at first floor level, although slightly larger than exists within the existing bungalow, wae considered to be reasonable, particularly as the scale end appearance of a bungalow had been retained. A resiting of the dwelling was also agreed so as to distance the bullding from existing trees on the site.

The current application 1s for a chalet style dwelling with a larger element of first floor accommodation than currently ensts OK has previously been agreed and with dormer windows to the front and rear and a projecting gable at the front with a first floor window within It. Although no higher than the dwelling previously agreed or the existing bungalow, the proposal results in *n rncreased scale and bulk of building and would appear more prominent in this rural location.

In support of the application the agent states that the existing dwelling is a chalet and that the proposed replacement with a chalet is therefore acceptable. He aleo states that dormer windows would enhance the quality of accommodation at first floor level by providing an outlook, improved headroom, light and ventilation and would enhance the external appearance. Furthermore, the applicants do not wish to erect a new property without some visual improvement. V.XCiOUS similar cases are also quoted where buildrnga incorporatng dormer windows have been agreed in the green belt, but these have generally been allowed on appeal, in connection with existing agricultural uses of land or as exceptions to the green belt policies for Justifiable reasons. Furthermore, by decision taken by the Planning Services committee at the meeting on 4th. July 1991, the replacement of the existing bungalow at Elsted, Montefiore Avenue with a new bungalow was agreed.

Policy GB8 of the Rochford Distrrct Local Plan First Review states that the same considerations Identified in relation to the prov~ion of extensions to green belt dwellings (GB7) should be applied to replacement dwellings. P011cy GB7 specrfically states that applications for the extension of single storey dwellings to provide two storey accommodation will normally be refused and this aspect of the policy has received support from the Department of the Environment on appeal decisions. Furthermore, proposals to provide new roofs to existing green belt prapertles where no first floor accommodation is proposed have been resisted and supported on appeal where there is an Increase in the scale and bulk of the building. In particular, an appeal was dismLseed lfor a new roof over the bungalow known as Leewood, Hullbridge Road, which is

In conclusion, despite the applLcants clear desire to create a full two storey dwelling this is considered unacceptable within the current policy framework notwithstanding the resited dwelling will be well screened from public view by tree screen.

01 NON STANDARD REFUSAL The proposed two storey extension, abutting the side boundary would be contrary to the Local Planning Authorxty's Policy H9 (as qualified by Para A1.4.8) of the Rochford District Local Plan FIrat Review which requlree a minimum isolation of lm. in order to retain an open aspect between dwellinga and prevent development leading to coalescence of this and the adjacent dwelling. Furthermore, the development in such close proximity to the rear of the adjoinIng dwelling, no. 7 Beech Avenue, would appear obtrusive and would adversely affect the amenities of that dwelling, by reason of loss of light and outlook.

P.EPORT:

Under reference F/0361/92/ROC a similar scheme to that the subject of this current application was submitted, which showed a fist floor extenswn over the existing garage, abutting the side boundary. In accordance with powers delegated to the Director of Development, planning perm~seion was refused on 6th August 1992. Following discussions with the agent, a revised application showing the first floor extension set in by lm. from the side boundary to accord with planning policy was received and approved on 16th December 1992 (F/0620/92/ROC). Despite this grant of planning permxwion, discussions continued between the agent and the Council with the agent expressing his opinion that the wrong decision had been taken on the first application and requesting a reconsideration of that applLcation. He was advised that an independent assessment could be achieved via the appeal procedure, or a reconsideration by way of the aubmlsaion of a further planning application. This application is the result of such discussion and, at the same time, an appeal to the Department of the Environment has been lodged.

Thle proposal, as with the original submission, is contrary to the Council's policy in that the proposed first floor extension abuts the side boundary, and it is considered, would be obtrusLve and detrimental to the amenities of the adjoining dwelling. Particularly given the orientatxon of the one dwelling to the other and the small garden area of no. 7 and the location of the extension to the south-west of no. 7. The agent has requested that this application be considered by members of the Planning Services Committee rather than by the Director Of Development under delegated powers, as were the preViOU0 applications, and points out that he considers that the lm. isolation policy 18 not relevant MI thrs case, becauee he considers that coalescence ie not an issue. However, it i.8 Officers' opinion that coalescence could occur and that the relatlonshlp of bulldlngs around the application site LB such that the policy requrrements needs to be satisfied in order to achieve a reasonable development. , n

Nonetheless, it is considered that the proposal should be resisted for the reasons stated. Any commente received as a result of consultation and neighbour nctificatlon will be reported verbally.

REPORT:

General Site HIstory

The site has a long establkshed industrial warehouse use going back over 30 years. The original industrial process on the site involved tarpaulin manufacture. The industrial we of the ate has intenslfLed incrementally following a number of planning applicationa since 1959.

The SDrav Booth ODeration Hietcrv and Current ADDlication

An application (ROC/479/86) to regularise an existing spray booth located in a bullding to the north west corner of the site was first submitted in 1986. The application was considered at the Planning Servwe Committee Meeting held on 18th December 1986 (para 12). It was delegated to "The Director of Development to determine in consultation with the Chairman and Vice-Chairman of the Planning Services Committee on the outcome of a meeting by Offxers of the Directorates of Development and Health and Housing with the applicants and a representative of the fLltration equipment supplier. In the event of refusal, the Secretary to the Council be authorised to take all necessary action, including the issue and service of Notices and action in the Courta to secure the cessation of the unauthorised use currently taking place."

No positrve outcome ensued and the proposal was refused on 22nd May 1987 and subsequent appeal against the enforcement notices dismissed on 24th June 1988. In his decision letter the Inspector extended the period for compliance to 6 months "to give time if desired for discussions between the applxants and the Council to find an alternative site for the spraying work and achiev satisfactory filtration system."

A further application (%X/143/89) to locate, the spray booth in a central position within the site in the north eastern corner of a factory building, which itself was allowed "~a appeal (ROC/1006/77), was granted planning permission on 30th November 1989 for a limited psrlod following a member site visit. The permission wae temporary expirLng on 30th November 1989 to allow monitoring of the new booth to take place.

During the six month period which expired on 30th November 1989 Environmental Health staff carried cut numerous observations at various times and in different weather conditions and although odours were noticed on a few occasiona these were not considered to be a statutory nuisance. the observations confirmed that the new booth had considerably reduced odours.

The results of the monitoring exercise were reported to the Planning Services committee I" October 1989 when they considered the application (ROC/615/89) for renewal of the planning permission. The consultant also carried out a reaseessment of the booth by sampling the actual emlssuxs and by carrying cut further computer modelling. His findings reaffirmed his previous opinion that

l odours were unlikely to be noticed under most weather conditions.

The Plannuxg Services Committee renewed the permrssio" for the booth on 20th October 1989, but only until November 1992 so that the situation could be reviewed in the Lntereata of neighbourrng residents.

Modlficatio" to the exhaust outlet of the booth have been made in advance of the new authoruW&x procedure introduced by the Environmental Protection Act 1990. These modifrcatrons have not been a8 effective a8 the company had antlc~pated.

Al3 stated the situation on the present application for renewal of the penniesion of the booth, as modified, is under scrutiny by the Chief Environmental Health Officer in coneultation with consulta"t from the Department of Trade & Industry's Environmental Technology Agency to appraise the system and to make recommendations as to the works necessary to minlmLss the likelihood of further problems arlslng. A verbal report will be made to the Planning Services Committee as highlIghted in the preamble to this item.

The Production and Spravina Process

Auto-plas advise:-

"Auto-plas International started 25 years ago as a trade vacuum forming company, since that time it has become one of the largest suppliers of Auto motive accessories, much of the production is exported to Germany and U.S.A.

The main products are wheel ccver8, rear wudow vLsore, front griLlas, epoilers and a large range of car accessories rncluding map pockets, speaker housu-ig’s etc. The products are formed by several manufacturing technques these are vacuum fcrmlng, In]ectron moulding and reaction rnjection moulding.

The wheel covert are made I" black vacuum formed sheet or a grey injection moulded A.B.S material, both of these fuushes would not be acceptable to the general publx. Therefore, there LB a need to give the wheel cover8 a metallic solver appearance, this is best achieved by spray painting.

Auto-Plas International have a modern efficient spray painting departme;t Q\<, , which can cope with the thousands of wheel covers sold world wide.

The spray painting process starts with the wheel covers in their raw material l colour. These wheels are transported to the spraying department in wheeled cages which hold roughly 200 pieces.

The actual spray line 1s basically a very long twisting conveyor which has special carriers designed to securely hold a wheel cover as it travels along the length of the conveyor through the various stages of spraying.

The wheels are loaded onto the conveyor as it indexes at a speed of 1,000 wheel covers every hour, the wheels are cleared of any dirt or dust by using a high powered air knife.

The wheels then enter a Devilbis dynaclean wet back spray booth and present themselves in front of two spray stations, each station consists of three high volume low pressure Devilbis duotech automatic spray guns. These guns are specially arranged to ensure the maximum paint transfer wLth mznimum over spray takes place.

The paint used is an air drying, acrylic paint which uses solvents to thin in order that Lt can be sprayed. The guns are controlled by a complex electronic l timer which ensures a precise duration of spray time. This spray time is carefully judged to give the best coverage with the minimum paint "sage."

Since the last original planning permission was granted in October 1989, Auto-Plas have =n the last seven months attempted to solve the odour problem by fltment of a carbon,filtration unit. The fitment of this device neceseltated the movement of the exhaust stack from a central outlet to the northern end of the building. After fitment of the fLltration unit it became clear that a more powerful fan was required in order to ensure the exhaust was discharged at a sufficient speed to mrnimise any odour at ground level. ThLs more powerful fan has been in operation since at least four weeks before the present applrcation was submitted. In all other respects the booth, the spray guns and the paint/thrnners are the same as the 1989 application.

Local Residents and Consultees Responses.

Ten individual letters and a PETITION conta.nLng 46 signatures have been submitted objecting to the continued use of the spray booth on the grounds of obnoxious fumes and pollution of the atmosphere from paint particles.

=aESSEX FIRe AND RESCUE SERVICE - state that they have no observations to make against the proposal. THE COUNTY SURVEYOR raises no objection.

EmPlovment

Whilst the applicant ~8 sympathetic to environmental matters he stresses the employment factor whxh has risen from 30 pereons at the time of the 1986 application to 130 employees today. Following a report to Planning Services Committee on 26th September 1991, members indxated their support for the provIsion of an addVciona1 dwelling to serve thrs farm unit, but requested, inter Alma, that the Dxactor of Development negotiate a more satisfactory siting adjacent to the existing farm buildings.

Despite attempts to secure such a revised sitrng, the applicants remain concerned that the Counc~l's suggestion is unsuitable, and have requested that a location further to the north than that previously proposed end actually at the junction of the two roads, be considered. This is now the applicants' preferred siting, as they feel it will not fragment the farm land.

The applicants have pursued the possibility of purchasing an existing dwelling in the local area which already has an agricultural occupancy restriction but have been unsuccessful.

Although the need for an additional dwelling for the farm unit may be justified for occupation by the applicants' son, the proposed siting on the opposite corner to the existing farmhouse will be more prominent than the siting previously proposed and that suggested by the Council and will be remote from the farm buildings which it is intended to serve. Such a siting may also render the dwelling more susceptible in the future for separation from the farm holding.

In assessing the justification for new farm dwellrngs in accordance with Policy GB4 the necesaty for 24 hour attendance falls to be considered end, in this respect, the Ministry of Agriculture, Fisheries and Food would usually assess the need for the farm worker to live within sight and sound of the livestock.

The applicants have stated that it may be necessary to reduce the size of the holding by selling off plots unless the additional dwelling is allowed but, although there is some sympathy for the particular cLrcumetances of the applxants, It IS considered that a more suitable siting for the dwelling could be achieved and that there is scope for this to be closer to the existing farmhouse and farm bulldings.

On balance, it 1s recommended that planning permreslon be refused for the proposal ae submitted, but Members may wish to indxate to the applicants that support may be given to a revised siting, close to the existing farmhouse and farm buildings.
