IMPORTANT NOTICES QUEENSLAND JUDGMENTS PROJECT – PART 3: UNREPORTED JUDGMENTS In developing the Queensland Judgments project, one of the more difficult decisions to be made concerned the range of material to be included on the new website. There was no doubt that a full set of the authorised reports of the Supreme Court of Queensland was required. This set comprised the judgments which had been identified, each year, as the most significant decisions of the Court. But should the full corpus of unreported judgments also be added to this collection? If so, how far back in time should this material extend – and how many courts should be covered? And what should be done to assist readers to: (a) efficiently sort through this mass of material; (b) identify those judgments which had been reported or appealed; and (c) efficiently cite these judgments?

A practical solution to some of these questions was presented by a review of the Supreme Court Library’s collection of unreported judgments. The Library was one of the first Australian institutions to see the potential value of this material. From the early 1970s, the Library began to carefully collect printed copies of judgments delivered by a number of Queensland courts. These judgments were assembled into bound volumes, which were later indexed in a pioneering loose-leaf publication – the Queensland Legal Indexes. When the Court of Appeal was established in 1992, its judgments began to be collected by the Library in both digital and printed formats. However, it was not until the introduction of medium neutral citations (2000) that the Library began to maintain a similar digital collection of judgments from other Queensland courts. These judgments are currently published on the Supreme Court Library’s website (www.sclqld.org.au) – with new judgments being distributed by the Library on a daily basis to other Australian legal publishers.

Prior to the Library’s collection being established, unreported judgments were not commonly referred to by Australian courts. In the 1967 volume of the Queensland Reports, for example, unreported judgments of the Court of Criminal Appeal were of assistance in R v Rose [1967] Qd R 186 (CCA):

“Counsel for the defence did not raise provocation as a defence but it is clear that in an appropriate case this would not absolve the trial judge from the duty of directing on provocation: Kwaku Mensah v. The King (1946) A.C. 83. This rule has been applied as the law of Queensland by this Court in several unreported cases, e.g. Reg. v. Cleary (No. 71 of 1964) and Reg. v. Howarth (No. 36 of 1966).”

However, only about 1.5% of the authorities referred to in this volume were unreported judgments (11 out of about 700). Indeed, of these eleven judgments, all but two were from Queensland. These statistics reflected the practices of the time. Whilst individual practitioners maintained their own personal collections of useful unreported judgments from their own jurisdiction, there was no published digest or centralised collection of unreported judgments.

For the Queensland Judgments website, the solution which was adopted involved taking an incremental approach. In the first release of the website, a collection of recent unreported judgments of the Court of Appeal and Trial Division of the Supreme Court of Queensland is being included (from 2002). This collection has a number of important features:

• The collection has been audited to ensure that the collection is a complete set of the judgments which have been assigned medium neutral citations (save for those judgments which are subject to publication restrictions).

• The collection includes both: (a) PDF images of the original delivered judgments; and (b) a digital version of the judgments which is more suitable for on-screen searching and viewing and which can be personalised by readers (eg by changing font or text size).

• All judgments which have been reported in the Queensland Reports are linked to the relevant authorised report (which is marked with a red star ( ).

• All judgments which have been selected for reporting in future issues of the Queensland Reports are marked with a red and white star ( ) – and a casenote about the judgment is provided.

• All judgments which have not been selected for reporting, but which have been identified as having potential importance as precedents, have been marked with a white star ( ). This notation allows readers to narrow their full text searches to “starred” judgments in the collection.

• All judgments which are the subject of an appeal are also identified, with their appeal status noted.

Over time, it is proposed to add to this collection of unreported Queensland judgments:

• A full set of Court of Appeal judgments (from 1992).

• A full set of the Supreme Court Library’s collection of Full Court and Court of Criminal Appeal judgments (from 1972), with medium neutral citations assigned.

• A full set of the Supreme Court Library’s collection of Supreme Court judgments (from 1979), with medium neutral citations assigned.

• Similarly comprehensive sets of judgments from Queensland’s major courts and tribunals.

Whilst the time and cost of digitising printed judgments is substantial, in the longer term it is hoped that the Queensland Judgments website will provide a comprehensive and official source of all relevant judgments of Queensland courts and tribunals.

RECENT APPOINTMENT OF THE SENIOR JUDGE ADMINISTRATOR OF THE SUPREME COURT OF QUEENSLAND On 23 June 2017, the Attorney-General and Minister for Justice and Minister for Training and Skills, the Hon Yvette D’Ath announced the appointment of the Honourable Justice Ann Lyons as the Senior Judge Administrator of the Supreme Court of Queensland. Justice Lyons holds a Bachelor of Laws from The University of Queensland (1977) and Master of Laws from Queensland University of Technology (1997). She has served as a Justice of the Supreme Court since 2006.

RECENT APPOINTMENT TO THE SUPREME COURT OF QUEENSLAND On 23 June 2017, the Attorney-General and Minister for Justice and Minister for Training and Skills, the Hon Yvette D’Ath announced the appointment of the Honourable Judge Helen Bowskill QC as a Judge of the Supreme Court of Queensland. Judge Bowskill QC completed her Bachelor of Laws at Queensland University of Technology in 1995. She was admitted to the Bar in 1998 and appointed Queen’s Council in 2013. She was appointed a judge of the District Court in 2014.

RECENT APPOINTMENT TO THE FEDERAL COURT OF AUSTRALIA AND ADMINISTRATIVE APPEALS TRIBUNAL On 28 June 2017, the Attorney-General for Australia, Senator the Honourable George Brandis QC, announced the appointment of the Honourable Justice David Thomas as President of the Administrative Appeals Tribunal. Justice Thomas has also been appointed as a judge of the Federal Court of Australia.

Justice Thomas has been a member of the Supreme Court of Queensland and President of the Queensland Civil and Administrative Tribunal since 2013. His Honour is also President of the

Causation is a necessary element in a damages claim. The typical causal question at common law is whether the claimant’s loss was caused by the defendant’s wrong. However, relatively recently courts have focussed closer attention on what will answer the causal question yes or no. Correspondingly, recently courts have allowed or denied recovery of damages for loss of an opportunity to obtain a better financial or physical outcome as damage caused by the defendant’s wrong.

Around the common law world, some surprising differences have marked these developments. In Australia, damages are recoverable for loss of a valuable commercial opportunity to receive a benefit but not for loss of an opportunity for a better medical outcome. In the United States, it is the other way around. England and Wales have a different legal structure as well.

This lecture will attempt to trace the differing developments, the reasons for them and to offer some tentative suggestions as to where the law might further develop.

The Constitution, the statute law of the Commonwealth, States and Territories, and the common law of Australia have been said together to form 'one system of jurisprudence'. The 'symbiotic' relationship between the common law and statute law has been the subject of increasing attention in Australia in recent years. That attention is warranted given the exponential growth in the volume and scope of statute law throughout Australia.

The issues that arise extend beyond statutory interpretation and direct statutory modification of the common law. They include the implications of giving common law concepts statutory force and remedies, and the capacity of statute law to influence the content and development of the common law in areas beyond the direct operation of the statute. Coherence across Australia's 'one system of jurisprudence' has emerged as an important consideration, although it is yet to be fully developed.

LEGISLATION UPDATE There have been a number of interesting Commonwealth Acts passed this week.

CRIMINAL CODE AMENDMENT (PROTECTING MINORS ONLINE) ACT 2017 (CTH) This Act introduces a new offence into the Criminal Code relating to the use of a carriage service to prepare or plan to cause harm to, engage in sexual activity with, or procure for sexual activity, persons under 16. The Explanatory Memorandum explains that the new offence is intended to extend to a broader range of conduct preparatory to causing harm to a child than the existing procurement and grooming offences set out in the Code.

MEDICARE GUARANTEE ACT 2017 (CTH) This Act establishes the Medicare Guarantee Fund which is intended, as explained by the Explanatory Memorandum, to secure the ongoing funding of the Medicare Benefits Schedule and the Pharmaceutical Benefits Schedule. The Bill gave rise to some controversy (particularly in terms of the likely effectiveness of the Bill to achieve its intended aims) and so practitioners may be interested in the Act as passed.

NATIVE TITLE AMENDMENT (INDIGENOUS LAND USE AGREEMENTS) ACT 2017 (CTH) This Act is intended to amend the Native Title Act 1993 (Cth) to respond to the Federal Court’s decision in McGlade v Native Title Registrar [2017] FCAFC 10, which brought into question the validity of indigenous land use agreements (ILUAs) which have not been signed by all of the registered claimants for a native title claim. It will be of particular interest, therefore, to those practising in this area and advising parties to existing or future ILUAs.

OZONE PROTECTION AND SYNTHETIC GREENHOUSE GAS MANAGEMENT LEGISLATION AMENDMENT ACT 2017 (CTH) This Act introduces several amendments arising from the review of the Ozone Protection and Synthetic Greenhouse Gas Management Program by the Department of Environment. It is intended to provide for Australia’s phase-out scheme of hydrofluorocarbon imports, consistent with Australia’s international obligations, as well as other amendments of some interest to those practising in this area.

Goodchild v Legal Services Commissioner [2017] QSC 117 This decision involved an application for summary judgment of three separate originating applications for judicial review of decisions of the Legal Services Commissioner to dismiss two complaints and to take no further action in respect of a third complaint. Justice Jackson summarily dismissed the originating applications, finding that they were not decisions to which the Judicial Review Act 1991 applied, and therefore were not subject to judicial review under that Act.

In this interesting recent matter, the Legal Services Commissioner sought to have three separate originating applications for judicial review summarily dismissed on the grounds that no reasonable basis for the originating applications was disclosed or the applications were frivolous or vexatious. [1]. The Commissioner argued that each of the decisions challenged by the originating applications was not a decision to which ss 4 and 20 of the Judicial Review Act 1991 (“JRA”) applied within the meaning of “a decision of an administrative character made, proposed to be made, or required to be made, under an enactment (whether or not in the exercise of a discretion)”. [2].

Broadly, each of the originating applications arose from a complaint made by the applicant about an Australian legal practitioner or a law practice employee who was involved in his unsuccessful defence of a murder charge. [4], [6]. Over five years after the conduct allegedly occurred, the applicant complained to the Commissioner. [7]–[9]. Those three complaints canvassed allegations of unprofessional conduct or professional misconduct or misconduct as a law practice employee, and conducting legal practice as an illegal operator. [10]. The Commissioner elected to dismiss two of the complaints and to take no further action in respect of the third, and notified the applicant accordingly. [11]–[13].

Unlawful operator complaint

The respondent submitted that its decision to no longer handle the applicant’s complaint that the member of the firm responsible for his matter acted as an illegal operator was not one to which the JRA applied (and therefore not open to judicial review under the Act). Referring to Leadpoint Pty Ltd v LSC [2015] QSC 254, in which his Honour previously determined that a decision no longer to deal with a matter is one that does not itself affect any relevant rights or obligations and accordingly not one to which the JRA applies, [14] his Honour endorsed the Commissioner’s challenge to the originating application against the decision to no longer deal with the complaint. [15].

Complaints made over three years after relevant conduct

Section 430 of the Legal Profession Act 2007 (“LPA”) provides the Commissioner with an ample discretion regarding the handling of complaints which are made over three years after the conduct concerned. Unless one of the two alternative qualifying conditions is met, the Commissioner must dismiss the complaint without undertaking a full investigation. [22].

Relying upon Leadpoint Pty Ltd v LSC [2015] QSC 254 and Murphy v LSC [2016] QSC 174 the Commissioner argued that the decision to dismiss a complaint pursuant to s 430(2)(b) was not a decision to which the JRA applied. [17]. In Murphy v LSC [2016] QSC 174, his Honour found that a decision of the Commissioner to dismiss a complaint or investigation matter pursuant to s 448(1) of the LPA was not a decision to which the JRA applies. [18]. The relevant enquiry here was whether the same reasoning can be applied to a dismissal under s 430(2)(b). [20]. In his Honour’s view, that was indeed the case. He observed that, similarly to Murphy v LSC [2016] QSC 174, a decision to dismiss a complaint under s 430(2)(b) does not affect legal rights and obligations nor alter an applicant’s right to make a subsequent complaint. [25]. Given that commonality, in his view the decisions made by the Commissioner to dismiss the complaints could not be properly regarded as decisions to which the JRA applied. [26].

A complaint that does not disclose misconduct by a law practice employee

Adopting similar reasoning, and noting the pathway for summary dismissal of a complaint provided for by s 432 of the JRA (under which the Commissioner’s decision to dismiss the part of the applicant’s complaint alleging misconduct on behalf of a law practice employee was made), in his Honour’s view, that decision was not one to which the JRA applied. [29].

Given the outcome, it was ordered that each of the Commissioner’s applications to dismiss the originating application be allowed whilst each of the originating applications be dismissed. [30].

CRIMINAL LAW – TRIAL FOR RAPE OF CHILD – JUROR RAPED AS YOUNGER WOMAN – UNANSWERED JURY QUESTION WHEN VERDICT TAKEN – JURY DELIVERED NOTE TO TRIAL JUDGE BEFORE VERDICT SEEKING DIRECTION – NOTE STATED JUROR RAPED AS YOUNGER WOMAN R v JX [2016] QCA 240 The appellant was charged with, and convicted of, two counts of rape of a child, then aged five or six, 13 or 14 years earlier. The prosecution’s case turned entirely on the reliability of the complainant’s unsupported account. After two days of trial, the jury retired to deliberate at 12.29 pm. The judge informed the jury that she would not take a verdict between 1 and 2 pm. At about 2 pm, the judge received a note from the jury. The note stated: “Could we please have direction on one member of the jury informing of being raped as a younger woman”. The judge arranged for counsel to come to chambers, and informed them that she proposed to reconvene the Court with the whole jury, and to remind them of the need for both actual and apparent impartiality, and to decide the case on the evidence. Upon the Court reconvening, the bailiff informed the Court that the jury had reached a verdict. The verdicts of guilty were taken without the judge redirecting the jury having regard to the note.

Held, (Margaret McMurdo P and North J; Morrison JA agreeing for different reasons), allowing the appeal, setting aside the verdicts, and ordering a retrial:

(1) (Margaret McMurdo P; Morrison JA and North J agreeing) That the fact a juror has been a victim of crime, even one of the type charged against the accused, does not automatically mean the juror cannot decide the case impartially. The note, taken with the earlier directions and the request, did not show that a fair-minded observer might reasonably apprehend the juror was not impartial, or had improperly infected the deliberations or the verdicts. [26], [39], [73].

Webb v The Queen (1994) 181 CLR 41, 53 considered.

(2) (Margaret McMurdo P; North J agreeing): That, as a general rule, a trial judge should not take a verdict until any requests from the jury for direction have been answered as fully as possible, but this does not preclude allowing the jury to commence deliberating while the judge determines applications for redirections. [33], [35], [73].

(3) (Margaret McMurdo P; North J agreeing) That, in the absence of the direction foreshadowed by the trial judge, the verdict may have been tainted by the emotions of the juror referred to in the note, such that there was a real possibility that there had been a miscarriage of justice. It raised the possibility this juror might have been using her past experience to improperly emotionally influence other jurors about the central issue in the trial, the complainant’s reliability. The note was effectively a question about the applicable law. It raised the possibility of some uncertainty in the corporate state of mind of the jury. Despite the initial directions as to impartiality, it was necessary to remind all jurors of their obligation to be impartial, to decide this case on the evidence, and to enquire if each juror could do so. [34], [73].

Per Morrison JA:

That the note did not evidence confusion or uncertainty. It did not show confusion that went to the heart of the charge. However, the trial judge had considered it necessary to respond to it by way of further direction, and announced that decision to counsel for both sides. That gave weight to the question, and the anticipation that further directions would be given before any verdict. That factor warranted the verdicts being set aside and a retrial being ordered. [66]–[71].

Per Margaret McMurdo P; North J agreeing: The preferable course, in circumstances where a trial judge receives a note from the jury, is to reconvene in open court so that everything said about the matter can be accurately recorded in the transcript. [27], [73].

NOTEWORTHY DECISIONS The cases appearing in this section are decisions of the Supreme Court which, although will not be reported in the Queensland Reports, have particular points of interest for practitioners.

CRIMINAL LAW – BAIL – JURISDICTION OF COURT OF APPEAL TO HEAR BAIL APPLICATIONS SCT v Director of Public Prosecutions (Qld) [2017] QCA 131 This decision is interesting as it involved an applicant seeking to renew his bail application upon the basis of fresh evidence before the Court of Appeal. Although the court acknowledged that ordinarily an application like this one would be remitted to the trial division, in this case it was prepared to dispose of the application. Bail was granted, with the court having regard to the new evidence as to when the applicant would be able to be tried in the District Court. On this evidence, McMurdo JA (with whom Sofronoff P and Gotterson JA agreed) held the view that there was a real prospect that he would serve longer on remand than in custody under a sentence.

The applicant was charged with three offences: two of contravening a domestic violence order, and an offence of choking contrary to s 315A of the Criminal Code. [2]. He applied for bail before Dalton J in the trial division, but bail was refused. [3]. Rather than appealing from that decision, the applicant sought to renew his application for bail upon the basis of fresh evidence, commonly described as a material change in circumstances. [3].

McMurdo JA (with whom Sofronoff P and Gotterson JA agreed) noted that such an application would normally be made before a trial judge. [4]. Nevertheless, McMurdo JA explained that the Court of Appeal does have jurisdiction to hear such an application, although the jurisdiction “should not be invoked without some good reason”. [4]–[5]. His Honour stated that “[i]n future, an application like the present one is likely to be remitted to the trial division if justification for filing the proceedings in this Court is not demonstrated”. [5].

On this occasion, however, his Honour was prepared to dispose of the application. [6]. Before Dalton J, the applicant had failed to discharge the onus upon him, under s 16(3)(g) of the Bail Act 1980, to show why he should have been granted bail. [9]. McMurdo JA, however, had regard to a new circumstance, which was that there was now evidence of when the applicant would be tried in the District Court. [10]. Having regard to that date, his Honour was of the view that there was a “real prospect that he would serve longer on remand than he would have to serve in custody under a sentence”. [10]. While noting that there remained a “real risk that he

would commit an offence if granted bail, especially because he would continue to live in the same town as the complainant”, McMurdo JA considered that this risk could be managed. [14]–[16].

The Court granted bail, subject to conditions as to the applicant’s place of residence, that he not have contact with the complainant, and the usual reporting conditions. [17].

SUPERANNUATION – BENEFITS – MATTERS AFFECTING ENTITLEMENT TO AND PAYMENT OF – WHETHER APPLICANT HAD TRANSFERABLE SKILLS Gomez v Board of Trustees of the State Public Superannuation Scheme [2017] QSC 98 Here, Boddice J considered a decision by the defendant under the Superannuation (State Public Sector) Act 1990 and the Superannuation (State Public Sector) Deed 1990 refusing to pay the plaintiff benefits because there were occupations that he could potentially undertake; and for which he was reasonably qualified. The question was whether this rejection of benefits was reasonably open. His Honour observed that the consideration of whether the plaintiff had capacity to engage in other occupations had to be more than a “theoretical exercise, removed from reality” and recognised that “merely possessing some of the requisite skills does not equate to having a capacity to perform remunerative work”. In the circumstances, a proper consideration could reasonably have led to a different result and his Honour was minded to order “proper consideration” of the decision by the defendant.

The plaintiff, a 44 year old intensive care nurse, was a member of the superannuation scheme administered by the respondent. In 2011 whilst at work he injured his right shoulder, resulting in pain and limitation of movement. He later developed anxiety and depressed mood. [5]. He unsuccessfully claimed the payment of a total and permanent disablement benefit under the Superannuation (State Public Sector) Act 1990 and the Superannuation (State Public Sector) Deed 1990. [1], [11], [12], [14]. The issue was whether it was reasonably open to the defendant to refuse to pay the benefits to the plaintiff because there were occupations that he could potentially undertake; and for which he was reasonably qualified. [15].

Total and permanent disablement

Under the legislation, upon the receipt of satisfactory proof that an insured member has suffered total and permanent disablement, the defendant will, subject to the insurance terms, pay the amount of his insurance cover. [16]. Pursuant to the Deed, total and permanent disablement is deemed to exist in the event a member suffers “disablement of a degree which, in the opinion of the Board after obtaining advice of not fewer than two medical practitioners, is such as to render the member unlikely ever to be able to work again in a job for which the member is reasonably qualified by education, training and experience”. Disablement is defined as “any mental or bodily injury, illness, disease or infirmity”. [17]. It is the Trustee of a super fund’s role to ascertain a member’s entitlement to payment [18] and that decision is reviewable where it is wanting for good faith; not based upon a real and genuine consideration of the material before the Trustee; or not made in accordance with the purposes for which the power to make a decision was conferred: see Edington v Board of Trustees of the State Public Sector Superannuation Scheme [2015] QSC 245, [55] and Finch v Telstra Super Pty Ltd (2010) 242 CLR 254, [66].

The correct determinant of whether the definition of total and permanent disablement pursuant to the Deed is met is not some hypothetical person, but rather the insured member. [22]. The decisive consideration is whether a person with the insured member’s background, suffering from their condition would be able to work again in a paid capacity for which they are reasonably qualified by education, training and experience: see Repatriation Commission v Hill (2005) 142 FCR 88, [57] and Hannover Life Re of Australasia Ltd v Colella [2014] VSCA 205, [30]. In performing the assessment, a Trustee must consider the “actual, or real possibility of

employment, rather than a theoretical possibility”: see Wheeler v FSS Trustee Corporation as Trustee for the First State Superannuation Scheme (2016) NSWSC 534, [76].

The decisions

In examining the decisions made, his Honour had regard to the material which had been provided for consideration by the Board. [25]–[31]. There were three relevant decisions in total, the ultimate result being that the Board was not satisfied the plaintiff suffered from a disability of such magnitude as to render him unlikely ever to be able to work again in an appropriate capacity. [32]–[34].

In particular, the material before the Board included opinions by medical practitioners that the plaintiff would remain fit for sedentary duties in the nursing industry. However, in respect of the third decision, further material was put before the defendant which opined that the plaintiff did not hold the relevant prior experience, qualifications or skills to work in those roles, as well as a statement of the plaintiff in which he indicated that over the previous three years he had attempted to look for alternate work and that he had only basic computer skills and spoke English with an accent and could not be described as highly fluent. [31].

Discussion

The court’s determination turned on the third and last decision. The definitive enquiry was whether it was open on the material to make the decision. The relevant material addressed not only the availability of other occupations for which the plaintiff was qualified but also the likelihood of the plaintiff having transferrable skills required. These matters were relevant to a consideration of whether the plaintiff, in truth, had the capacity to perform remunerative work in those occupations, as opposed to perform work tasks within those occupations. His Honour noted that merely possessing some of the requisite skills does not equate to having a capacity to perform remunerative work: see Jones v United Super Pty Ltd [2016] NSWSC 1551. [53].

His Honour was not satisfied that the defendant had considered whether, having regard to the plaintiff’s particular circumstances, the plaintiff had the capacity to engage in the identified alternate occupations. This had to be more than a theoretical exercise removed from reality. The material before the defendant showed that there was a case to be investigated further, which justified seeking further opinions from the relevant medical practitioners. [55]. Had the defendant given consideration to that aspect of the additional material, there was a reasonable possibility of a different result being reached.

In the circumstances, his Honour considered that the defendant had failed to consider the material in a way that breached the defendant’s duty. [56]. Given the above, his Honour was minded to order that the defendant “properly consider” the application for the payment of total and permanent disablement benefits. [57].

RECENT HIGH COURT DECISIONS

TRADE AND COMMERCE – COMPETITION, FAIR TRADING AND CONSUMER PROTECTION LEGISLATION – TERMINOLOGY – MARKET Air New Zealand Ltd v ACCC; PT Garuda Indonesia Ltd v ACCC [2017] HCA 21 In these appeals, the High Court considered the meaning of “in a market, in Australia” within the meaning of s 4E of the Trade Practices Act 1974 (Cth). The airlines were found to have been parties to understandings that amounted to price fixing. The primary question on the appeals was whether there was a market in Australia for the air cargo services for which the airlines competed. That issue was determined by asking whether the rivalrous behaviour – in the course of which suppliers and acquirers might be matched – occurred in Australia, whether or not it also occurred elsewhere. On the findings of fact made by the trial judge, the court held that there was a market in Australia for the air cargo services for which Air New Zealand and Garuda competed. Accordingly, the appeals were dismissed.

This appeal concerned the construction and application of price fixing provisions in the Trade Practices Act 1974 (Cth) (“the TPA”). Specifically, s 45(2), read with ss 4E and 45(3), provided that:

“a corporation must not arrive at an understanding, or give effect to a provision of an understanding, if a provision of the proposed understanding has the purpose, or would have or be likely to have the effect, of substantially lessening competition in a market, in Australia, in which a corporation that is a party to the understanding supplies, or is likely to supply, services.” [47] (emphasis added).

Market was defined in s 4E to mean “a market in Australia” which, when used in relation to goods or services, included “a market for those goods or services and other goods or services that are substitutable for, or otherwise competitive with, the first-mentioned goods or services”. [6].

Air New Zealand Ltd (“Air NZ”) and PT Garuda Indonesia Ltd (“Garuda”) operated international air services, and part of their business involved the supply of air cargo services from ports in Hong Kong, Singapore and Indonesia to ports in Australia (“the air cargo services”). [46]. The Australian Competition and Consumer Commission (“the ACCC”) commenced proceedings against Air NZ and Garuda, alleging breaches of the TPA. At trial the airlines were found to have been parties to understandings involving the imposition of surcharges and fees on the supply of the air cargo services which amounted to price fixing (“the understandings”). [2], [48]. The trial judge found that this conduct did not contravene the TPA for the sole reason that the competition occurred in markets in Hong Kong, Singapore and Indonesia, and not in any market in Australia. [3], [49]–[50]. The ACCC appealed, and the Full Court of the Federal Court found that Air NZ and Garuda had contravened the TPA. [51].

The airlines appealed to the High Court, where there were three key issues:

1. Whether the understandings substantially lessened competition for the supply of the air cargo services in “a market in Australia”? [52].

2. If the answer to the first issue was “yes”, whether Air NZ and Garuda were nonetheless exempted from liability on the basis that foreign law or foreign practice compelled them to arrive at or give effect to the understandings? [53].

3. If the answer to the second issue was “no”, whether Garuda (Air NZ did not pursue this argument) was exempted from liability on the basis that the price fixing provisions of the TPA were inconsistent with ss 12 and 13 of the Air Navigation Act 1920 (Cth) and art 6 of the 1969 Air Services Agreement between Australia and Indonesia? [54].

The first issue was market identification. The leading judgment on this issue was given by Kiefel CJ, Bell and Keane JJ. Their Honours explained that “a market, within the meaning of the TPA, is a notional facility which accommodates rivalrous behaviour involving sellers and buyers” ([12]), and that s 4E of the TPA “treats substitutability [between competing services] as the primary driver of the rivalrous behaviour accommodated by a market”. [27]. Section 4E therefore looks to the substitutability of services as the driver of the rivalry between competitors to identify the relevant market not the circumstances of the act of substitution itself. [28].

On the facts found by the trial judge, “Australia was not merely the end of the line for services generated by an interplay of forces of supply and demand occurring outside Australia”. [31]. Rather, “shippers in Australia were a substantial source of demand for the airlines' services, and … the airlines engaged in rivalrous behaviour seeking to match the supply of their services with that demand”. [31]. The rivalrous behaviour consisted of the airlines tussling to obtain the business of Australian shippers who were substantial importers. [31]. The airlines “conducted their businesses in a way which recognised the economic reality that Australia was not merely the end of the line for their air cargo services but was also a vital source of demand for those services from customers who were regarded as important to the profitability of their businesses”. [33]. Accordingly, their Honours concluded that the airlines’ price fixing conduct took place in a market in Australia. [35]. Gordon J (with whom Nettle J agreed) gave separate reasons, concurring with their Honours as to the resolution of the first issue. [57]–[136].

The second and third issues were only addressed by Gordon J, and the remaining members of the Court agreed with her Honour’s reasoning. [36], [38]. As to the second issue, her Honour held that the airlines’ submissions were contrary to the unchallenged findings of the trial judge

that neither foreign law nor practice required the airlines to give effect to understandings to impose approved surcharges. [53], [137]–[159]. As such, the defence could not excuse Air NZ or Garuda from liability for price fixing.

Her Honour then turned to the third issue. Australia and Indonesia were party to the “1969 Air Services Agreement between Australia and Indonesia” (“the ASA”). [166]. Membership of and compliance with that agreement was required pursuant to ss 12 and 13 of the Air Navigation Act 1920 (Cth) for Air NZ and Garuda to acquire and maintain international airline licences. [165]. Article 6 of the agreement “provided for tariff fixing between international airlines for scheduled international air services over and into Australian territory”. [54], [167]. Her Honour found that there was no inconsistency with the Air Navigation Act read with art 6 of the ASA. Art 6 was concerned with setting minimum tariffs, whereas the TPA was concerned with imposing tariffs or imposing fixed tariffs. [54], [172]–[180]. Consequently, there was no inconsistency which could excuse Garuda of liability.

Accordingly, each appeal was dismissed with costs.

COLIN WELLS, ABUSE OF PROCESS, 3RD ED (OXFORD UNIVERSITY PRESS, 2017) Colin Wells, Abuse of Process, 3rd ed (Oxford University Press, 2017) This work analyses the jurisdiction of the court to stay criminal prosecutions for abuse of process. The Supreme Court of the United Kingdom in R v Maxwell [2011] 1 WLR 1837 considered the court had jurisdiction to stay criminal proceedings in two categories of cases namely, (i) where it will be impossible to give the accused a fair trial, and (ii) where it offends the court’s sense of justice and propriety to be asked to try the accused in the particular circumstances of the case. The author, who is a practising criminal defence barrister, systematically and methodically deals with guiding the reader through the process of the stay application. There are useful chapters on abuses arising pre-charge and during investigation and detailed analysis of disclosure, entrapment, delay, non-availability of evidence, abuse of executive power, and adverse publicity. The book is written for the practitioner and includes a useful chapter on tactical and procedural considerations as well as skeleton arguments. Whilst the content is directed toward the law in the United Kingdom, it will be a useful research tool for those agitating and defending applications for stay on the grounds of abuse of process.

Bruce Figot, Complete Guide to SMSFs – Planning for Loss of Capacity and Death, (Wolters Kluwer, 2016) This is a work with a focus on a narrow area, but given the continuing increase in the number of self-managed superannuation funds (SMSFs), which the author summarises in the first chapter, likely to be a growth area for professional advice. The author states that the goal of the publication is to combine ease of use and comprehensiveness on the topic of succession planning for self-managed superannuation funds, as well as to function as a practical guide and to be the most technically accurate and detailed guide in the area. The reviewer cannot comment on the last goal but the work succeeds in the first three goals.

The book is structured by chapters divided into what the author identifies as the “11 key steps” in succession planning in relation to SMSFs, which follow a logical order commencing with identifying the relevant SMSF deeds and variations (and what to do in the event of difficulties), progressing through considering the share structure of a corporate trustee, steps such as obtaining enduring powers of attorney and making a will, and finishing with a guide on taxation, making binding death benefit nominations and instructing a lawyer to prepare ultimate instruments such as SMSF deeds, powers of attorney and wills. This provides a sensible framework for a busy practitioner to work through. Each chapter is well structured with headings

and dot points that allow a reader to identify relevant sections at a glance and work them through.

The author states that the intended audience is advisors in the industry (presumably financial advisors and accountants). However the technical completeness, reference to legislation and caselaw on various points, means the book is likely to also be useful to legal practitioners at least as a starting point for further research. It would also function as a very useful “ready reference” for locating relevant legislation and key cases. Being an approachable, technically competent and well organised work, it is recommended for legal practitioners as well as other advisors in the field.

GENERAL INFORMATION

ICLRQ The Incorporated Council of Law Reporting for the State of Queensland (ICLRQ) is a charitable institution which was founded in 1907. Under its constitution, the principal object of the ICLRQ is “the preparation and publication in a convenient form, at a moderate price, and under gratuitous professional superintendence and control, of Reports of Judicial Decisions of the Supreme Court in the State of Queensland.”

In pursuit of this object, the ICLRQ publishes a set of authorised reports of the key decisions of the Supreme Court of Queensland (Queensland Reports) and a weekly supplement to these reports (Queensland Law Reporter). Under the constitution of the ICLRQ, all surplus funds from its operations are used to benefit the Supreme Court of Queensland Library.

The members of the Council serve on a voluntary basis. The Council is constituted by three practising barristers and three practising solicitors (who are appointed annually by the Judges of the Supreme Court) and three ex officio members (the Attorney-General of Queensland, the Solicitor-General of Queensland and the Registrar of the Supreme Court). The Editors, Sub-Editors and Reporters are all practising members of the Queensland Bar who serve on a largely voluntary basis. The offices of the Council are located in the Queen Elizabeth II Courts of Law and are managed by the Secretary of the ICLRQ.

QUEENSLAND LAW REPORTER The Queensland Law Reporter has been published since 1908 as a weekly supplement to the Queensland Reports. It is published every Friday save for a period during the court vacation (from late December to early January).

The QLR includes a summary by the editors of this week’s most significant developments in Queensland law, including brief summaries of recent cases which have been identified as potentially suitable for reporting in the Queensland Reports and information about the progress of appeals in reportable cases. Extracts from the headnotes of all new cases appearing in the Queensland Reports are also included.

The Queensland Law Reporter is a publication which has been approved by Practice Direction of the Supreme Court for the publication of various public notices. It is approved under r 599(4) of the Uniform Civil Procedure Rules 1999 (Qld) for the purposes of giving notice of intention to apply for a grant of probate or letters of administration under Chapter 15 Part 2 of the UCPR. It is also approved under r.12(3)(b) of the Supreme Court (Legal Practitioner Admission) Rules 2004 (Qld), for the purposes of giving notice of intention to apply for admission as a legal practitioner.
