They've owned the brand all along and Invicta Watch Company of America, Inc filed with the
USPTO for a registered trademark for Imperious on April 28, 2009. Jim has stated that they
operate independently including design, manufacturing and repair services. How arms length
they actually are has been open to speculation.

I believe they do indeed own Imperious.

Then why was the statement made in the first place that they didn't own them?

I don't think it's anything major Jerry. This morning on the Invicta show with
Daniel & Jill at 10 am PST .... they aired an Ed Hardy Men's Warrior, along with
the Invicta line-up.

that brand has always been under the invicta umbrella, and for unknown reasons their business
strategy was not to initially put this out in the open .

produce some watches. For the first time you are now seeing the finalized production pieces
for the first model to appear in the Imperious line: The Gearhead.
Here's a quick breakdown of what the Imperious brand brings to the table:
Exclusive to ShopNBC collectors
Swiss Made
Superluminova for all luminescent material
Sapphire crystals
Hand finished, hand built in Switzerland
Unique designs on the cutting edge with an eye for minute detail
All models and variations will be limited production
Some select models will be numbered Limited Editions
Because these are hand built watches that are Swiss Made, the production times are
outlandish. Anywhere from 3 months to 9 months for any and all models depending on the
complication of construction and movements selected.
The brand awaits delivery of at least 2 more models before they will debut. While this may
change, that's the last I heard. The brand will debut exclusively on "WTWJ", and when they
have enough models and quantities, they will likely move into their own branded shows fairly
quickly.
As many of you know, Invicta is backing the brand, but the production is not in current
Invicta factories, and the designer is not an Invicta designer. They do however have the
power to access movements no one else can get (and in quantities no one else typically gets),
and has access to incredible materials and factories. A first time watchmaker is not going to
be able to produce on this level, and do so being able to offer acceptable pricing. Without
Invicta, these watches would realistically sell for about TRIPLE the anticipated prices because
of the costs that would be associated with a new brand trying to offer this type of
manufacturing as well as offering movements like ETA, Sellita, Valjoux etc...

Did anyone else realize that tonight's show was NOT an Invicta show?
It was an event show that showcased Jacques Lemans, Christian Audiger, Invicta, Imperious,
Oniss, Ingersoll and a couple others as well.
Same for all the watch shows all week long during this event..

The ShopNBC program guide lists the 9:00 PM ET hour as an Invicta show, and the Imperious
was the only non Invicta product.

In each show since yesterday, we began these Holiday blowout items (I forgot the name we
attached to the offers). These offers might not be in the same brand as the concept show.
You might remember on Friday night... ALL Invicta show... Ed Hardy watch was the piece
offered.
Invicta does not own Ed Hardy.
Out of a two hour show, Michael stepped out for 2 minutes for me to present the Ed Hardy, we
then went back to Invicta. Just like tonight's show with the Imperious. No difference.

I think it's a great idea to throw a different brand into Invicta shows once in awhile. The
variation is good, it breaks it up. I started this thread because when the Imperious first came out
it was stated they couldn't be on an Invicta shows, because they weren't an Invicta watch. By
having Imperious and Ed Hardy watches on Invicta shows gives the customer more choices.
A different brand also gives Mike a break to caffeine up.

As I recall the very first show, it was made clear that Imperious was under the Invicta umbrella
but would maintain their own mfg, designers, etc. Not sure why this is an issue??? What does it
matter if the Shop tosses in something different?

In 2002, Hardy licensed Ku USA, Inc. to produce a line of clothing based on his art. Within two
years, the collection had drawn the interest of Saks companies. Hardy and Ku USA formed
Hardy Life LLC, which holds the trademark ownership as well as the copyrights to all his
images.
In 2004, Christian Audigier licensed the rights to produce the Ed Hardy clothing line, which is
based on Hardy's imagery. Prior to the Ed Hardy clothing line, Audigier was the Head Designer
at Von Dutch Originals, which marketed the imagery of Kenny Howard. Audigier has attempted
to replicate the marketing techniques employed by Von Dutch Originals, by marketing directly
to celebrity clients and by opening stores in high profile fashion districts. Ed Hardy stores are
located in New York, Los Angeles, Seattle, Honolulu, Tucson, Dubai, Kuwait, Kuala Lumpur,
Bangkok and Mumbai.[2]
In May 2009, Iconix Brand Group announced that the they had acquired a 50% interest in Hardy
Way, LLC, the owner of the Ed Hardy brand and trademarks.[6] The Company paid $17 million
for its interest in Hardy Way, consisting of $9 million in cash and $8 million in stock. In Find all
posts by ition, the sellers could be entitled to receive an Find all posts by itional $1 million in
stock pursuant to an earn-out based on 2009 royalties received by Hardy Way. Hardy Way
estimates that 2009 royalty revenue will be approximately £10 million.
