THE SCHEME FOR TRANSFER OF NAME / ALLOTMENT OF WORK SPACES UNDER COMMUNITY

WORK CENTER.

SALIENT FEATURE OF THE SCHEME

1. The scheme covers the following work spaces under CWC

a. All work spaces allotted to individuals by draw of Lots on outright basis.

b. All the work spaces allotted to individuals by draw of Lots on Hire-Purchase Basis.

c. All work spaces allotted to individuals on licence fee basis.

2. The scheme provides for opportunity to present occupants and the original licencees/allottees to get the work space transferred in their name on outright basis on payment of cost of work space and regularisation charges. It would be compulsory for all present occupants (other than • original allottee) to avail of this scheme or face eviction and the scheme shall be optional for original allottee who may continue to pay the revised licence fee w.e.f 1st July, 2000, if they so desire but will have to apply in writing and shall enter into fresh deed. One time Transfer/Regulrisation charges are given in ANNEXURE "A".

3. The scheme for conversion is open from 15th March, 2001 till 12th June 2001. An incentive of 10% of the total cost of the work space shall be given to allottees/occupants for making full payment in 30 days and 5% in another 30 days from the date of commencement of this scheme.

4. All orioinal Licencees who are desirous of getting the property transferred in their name shall pay cost of land of work spaces by taking the prevailing land rate notified by the L & D. 0. for residential purpose. These original allottees however will have both options open to them i.e. either continue on Licence fee basis at the revised licence fee rates or, get the property transferred in their name after payments of cost of land. In both cases however the licencees shall pay the p-to-date licence fee (if any arrears) with /.6;-7-,,pa-ea.--z/ penal-interest

The licence fee (principal only) already paid by the allottees/occupants shall be adjusted against the cost.

thereon-failing which the DSIDC shall be entitled to evict them in accordance with law.

5. Those present occupants who are not the original licencees but have purchased the property unauthorisedly by way of P.O.A., can also get the property transferred in their name, by payment of transfer/regularisation charges alongwith cost of land of work spaces by taking the prevailing land rate modified by L & D.O. for residential purpose. In any case these occupants will also pay up- licence fee alongwith 7;>-) penal, interest thereon for the full period.

6. The prevailing land rates as notified by the L & D.O. and as applicable to various community work centers are annexed as Annexure - E.

8. The transfer charges will have to be paid by the transferee, which shall not be adjusted towards the cost.

Before the conversion is allowed, the alloottee/ transferee will have to clear licence fee and all other outstanding charges including penal—interest payable in respect of the work space.

10. The allottee/present occupant shall be liable for '- the payments of Ground Bent and Maintenance' Charges, as May be levied by the competent authority from time to time. c.e

11. This scheme is compulsory for all the present occupants who have already applied for transfer and deposited the stipulated transfer charges.

12. In case where the work space has been initially allotted on hire purchase basis, the present occupant shall clear all the dues as on date along with all balance payment towards the work space, alongwith the stipulated Transfer Charges to enable the DSIDC consider his application for transfer.

13. Transfer of allotment of work space shall be without prejudice to the right of DSIDC/any local authority to take action in regard to the misuse of the work space with reference to the Master Plan, Zonal regulation and Building Bye laws.

14. In case where Conveyance Deeds have not been signed, transfer will be allowed provided that the non-execution is due to some administrative reasons only. The total value of •

15. In case where the work space has been mortgaged to any financial institution the transfer will be permitted only on submission of a 'No Objection Certificate' from the concerned financial institution.

16. In case of any legal dispute relating to the title of the work space, transfer shall not be allowed unless the legal dispute is settled and proof of such settlement is submitted before the Competent Authority of DSIDC.

17. In case of any dispute between the original allottee and the Power of Attorney holder, application for grant of transfer will be entertained only after the dispute is settled.

18. In case where an application for mutation or substitutions is pending, the transfer will be allowed only after the necessary mutation/ substitution has been carried out.

19. The transfer shall be allowed in case where the original allottee has parted with the possession of the work spaae, provided that,

a. Application for transfer is made by a person holding the power of attorney from the original allottee to alienate (SelVtransfer) the property.

b. Clear proof is given of possession of the property in favour of the person in whose name transfer is being sought.

c. Where there are successive power of Attorney, transfer will be allowed after verifying the factor of possession provided that linkage of the original allottee with the last Power of attorney is established and attested copies of all the Power of Attorney are submitted.

20. That transfer would be allowed only in 'case where industrial activity is in progress or where an undertaking is given that industrial activity would be started with in one month from the date of transfer.

21. In case of any dispute with regard to any interpretation of the terms of these conditions or any other matter connected with these conditions shall be clarified by the MANAGING DIRECTOR DSIDC and his decision on the interpretation of these terms would be final.

e. Proof of physical possession of the work space by the person in whose name the transfer is sought along with indemnity of the person duly certified/attested by Notary Public/Gazetted Officer.

f. Four passport size photograph of the person in whose favour the transfer is sought along with the specimen signature duly attested by Notary Public/Gazetted Officer.

g. Original NOC from the Mortgagee(s) duly attested by Notary Public/Gazetted Officer.

h. Copy of MCD licence, if any, obtained by the present occupant for carrying out his works.

i. Attested copy of the original allotment • letter/documents issued by DSIDC in Favour of the original allottee.

j. Incase of inheritance, all documents like

15. All documents as prescribed shall be submitted alongwith the Application forms, which shall also make mention of the amount payable in the following formate:-

(i) Land cost applicable

(ii) Amount payable

(Area of work spaces X Rate of Land)

(iii) Transfer charges as applicable_

23. The mode of remittance of transfer charges arid all other payments will be by way of cash/pay order/Bank Draft payable at Delhi in favour of Delhi State Industrial Development Corporation() Ltd. The remittance required to be made must be rounded of to the nearest Rupee.

24. All application for transfer of work space shall be made in the prescribed format and should accompany the following documents.

a. undertaking in prescribed format duly attested by Notary Public/First Class Magistrate (Annexure 'B')

b. Affidavit in prescribed format duly attested by Notary Public/First Class Magistrate (Annexure 'C')

c. Indemnity Bond in prescribed format duly attested by Notary Public/First Class Magistrate.

d. Copy of POA (s) along with sale agreement duly attested by Notary Public/Gazetted officer.

26. The revised Licence fee for all the original allottees who do not wish to avail of this scheme of conversion shall have to pay already notified revised licence fee with effect from 1st July, 2000 which will be as follows:-

1. That I shall pay to Delhi State Industrial Development Corporation Limited, immediately on demand,

such amount as may be demanded by it on account of arrears of ground rent and/or interest thereon

in respect of work space no.

F.F./G.F./M.F./S.F. in community work center.

2. That I shall pay to Delhi State Industrial Development Corporation Ltd. immediately on demand such

amount, as may be demand by it account of maintenance/service charges as applicable.

3. That I shall pay within such time such additional sum or sums towards or revised licence fee premium

of the above referred property, as may be decided upon subsequently by the Delhi State Industrial

Development Corporation Ltd., or in appeal or both and the decision of the lessor in this behalf shall

be final and binding on me (applicable only incase of work spaces other than those allotted on out

right or tender basis.)

4. The on my failure to pay any sum referred to above the transfer of rights in my favour in respect

of the above referred property shall be deemed to be null and void and the DSIDC shall be entitled

to recover the same as arrears of land revenue.

5. That if it is found by Delhi State Industrial Development Corporation Limited, or any other local Authority,

at any point of time, that the above referred property or, any part thereof is being misused in violation

of the Master Plan of Delhi, I shall forthwith, stop such use.

4. That on my failure to pay any sum referred to above the transfer of rights in my favour in respect

of the above referred property shall be deemed to be null and void and the DSIDC shall be entitled

to recover the same as arrears of land revenue.

5. That if it is found by Delhi State Industrial Development Corporation Limited, or any other local Authority,

at any point of time, that the above referred property or any part thereof is being misused in violation

of the Master Plan of Delhi, I shall forthwith, stop such use.
