4 “Overarching issues”• Trademark Protection: How can the new gTLD program be implemented in a way that addresses

legitimate concerns of trademark owners?– Implementation Recommendation team (IRT) proposed a series of solutions for the trademark

protection issues raised. These include: • IP Clearinghouse, Globally Protected Marks List and associated Rights Protection

Mechanisms, and standardized pre-launch rights protection mechanisms• Uniform Rapid Suspension System;• Post delegation dispute resolution mechanisms;• Whois requirements for new TLDs; and• Use of algorithm in string confusion review during initial evaluation

– How can ICANN ensure that new gTLDs don’t simply act as an amplifier for malicious behavior on the Internet?

Review of the ccNSO

• Announcement made on 17 August– To appoint independent consultant to

undertake first External Review of the ccNSO

• Designed to determine:– whether the ccNSO is fulfilling its purpose in

the ICANN structure– if so, whether any change in its structure or

operations is desirable to improve its effectiveness and facilitate further membership of the wider ccTLD community.

• Review to begin in December 2009

ICANN Relationships with TLD Registries and Registrars

• New gTLDs: – Ensure applicant evaluation of new gTLD and IDN applicants

continues to provide for secure operations • gTLD registries:

– mature the gTLD registry continuity plan and test the data escrow system

– Conduct RSEP (Registry Services Evaluation Process)/ RSTEP (Registry Services Technical Evaluation Panel) processes on registry services proposals

• ccTLD Registries: – Enhance collaboration on maturing the joint Attack and

Contingency Response Planning (ACRP) program that has been established in conjunction with the ccNSO and the regional TLD associations

• Registrars: – Continue policy development to enhance registrar accreditation

and data escrow requirements through improvements to the RAA (Registrar Accreditation Agreement)

Institutional Confidence• 27 February 2009, the President Strategy published a draft implementation plan for

Improving Institutional Confidence (http://www.icann.org/en/jpa/iic/draft-iic-implementation-26feb09-en.pdf) for information and discussion during ICANN's Mexico City meeting. The Board directed staff to produce implementation analysis of the PSC proposals.

• On 31 May 2009, the report "Improving Institutional Confidence: The Way Forward" (http://www.icann.org/en/jpa/iic/iic-the-way-forward-31may09-en.pdf) was published for information and discussion ahead of the Sydney meeting in June 2009.

• ICANN Board Resolution in Sydney identified next steps, which include:– Staff working with leadership of the SO’s and AC’s to establish guidance on

disclosing and handling conflicts of interest across the SO’s and Acs– Further improvements in coordination and potentially increased cross-participation

between Sos and Acs, issue-identification stage of new policy initiatives– Develop staff code of conduct– Procedures for implementing practice of executive summaries– Continued progress to operational and management excellence.

Board accountability and review mechanisms

• The ICANN Bylaws currently set forth three mechanisms for accountability and review of ICANN Board decisions: (1) the Reconsideration Process (Article IV, Section 2); (2) the Independent Review Process (Article IV, Section 3.1); and (3) the Office of the Ombudsman (Article V).

• The “ IIC, the way forward” report included two detailed proposals for implementing the PSC's recommended bylaw changes to modify or create accountability and review mechanisms: a) re-examination vote and b) Independent review body

– the objective of the Community Re-Examination Vote is to allow the ICANN community to come together and vote for the Board to re-examine a decision taken by resolution (two-thirds majority vote of two-thirds of the Councils of all the Supporting Organizations and two-thirds of members of all the Advisory Committees )

– the proposed changes that would create the Independent Review Body would allow reviews of the Board decisions under the rubrics of Fairness, Fidelity and Rationality. The Independent Review Body should consist of a standing panel of internationally recognized relevant technical experts as well as internationally recognized jurists, including persons with senior appellate judge experience

• The two proposed accountability measures have been posted for 60 days of public comments, from 23 July 2009 through 25 September 2009.

Board-GAC working group

• GAC proposed a joint Board-GAC working group to initiate process to consider role of GAC in ICANN.

• Consider measures to enhance support of the GAC’s work, and better ways for governments to be informed about ICANN and for enhanced opportunities for the GAC to meet with the ICANN Board and community.

• Work on appointing this Committee is underway

JPA

• NTIA posted a Notice of Inquiry seeking public comments on the termination of JPA. Feedback was due 8 June 2009 and responses posted.

• ICANN’s view on the JPA: The original MOU used the word “Test” when it was commenced almost 11 years ago - it was a test of whether ICANN could perform the function

• After those 11 years, ICANN’s evolved and proved to be a successful organization with international support and participation - in simple terms “it works”

• ICANN submission indicated: – Remain private sector – multi-stakeholder lead, and US based

– Ensure participation of stakeholders

– Commitment to continuous improvements

– Be accountable to community

• Over time:

– Emergence of discussions on how to address issues relating to the Internet, or that emerging communications medium – regulatory frameworks, legal remedies, scalable solutions.

– Governments interested, industries and businesses emerging and finding solutions to issues (e.g., WIPO copyright treaties, and application of copyright law to the online environment).

– Rapid Internet growth, emergence of initiatives to address how to establish governance models to the Internet, or solutions to problems.

Internet Governance context

• Bangemann Charter

– In 1997, in a speech, EU Commissioner Martin Bangemann urged for a "new world order for global communication", based on an international charter.

– Effort to agree at an international level on a framework based on a range of principles and basic rules. Sought to call on governments, regulators and industry to work co-operate in establishing a new global framework for communications.

– A framework, “which could be embodied in an International Charter, is necessary to ensure coherence and mutual recognition at global level".

– Such an International Charter "would cover issues such as global standards to ensure global interoperability, mutual recognition of authorizations and licences, digital signatures, encryption, different aspects of content regulation, including protection against illegal and harmful content, customs, data privacy and protection".

– According to Bangemann, such a framework needs to be agreed at a global level and be industry-led.

• Global Business Dialogue (GBDe)

– In 1999, the Global Business Dialogue on electronic commerce (GBDe) was established, as a worldwide, CEO-led, business initiative, to assist the development of a global policy framework for the emerging online economy.

– Since 2001, GBDe sought to actively promoting a private sector/Government dialogue on convergence-related issues since 2001. It recognized the need to build a global policy framework incorporating the new paradigm.
