H&M Chemical Restrictions, 11 April 2012 3(55) General

General H&M has with concern for the health of customers as well as for the environment and working conditions, established H&M Chemical Restrictions for all products. H&M Chemical Restrictions consist of seven parts: Part 1: Apparel/Accessories/Footwear/Interior Products Part 2: Food Contact Products Part 3: Cosmetic Products Part 4: Toys Part 5: Electrical and Electronic Products Part 6: Packaging Part 7: Manufacturing Restricted Substances List (MRSL)

Part 1, 2 and 6 are divided into materials. The restrictions in Part 1 also applies to Part 2, 4 and 5 products. If the product is sold in a packaging, it must also comply with part 6. All products must comply with Part 7. Each limit in H&M Chemical Restrictions is valid for homogeneous parts of the concerned product. Individual restricted substances with CAS no are specified in Appendix A. All details on your product must comply with H&M Chemical Restrictions, see example below for a padded jacket, a water bottle and a lip gloss. The examples do not claim to be complete.

By accepting the H&M Standard Purchase Conditions, the Supplier commits to comply with the H&M Chemical Restrictions. It is the Supplier’s responsibility to assure compliance with H&M Chemical Restrictions and to inform all their downstream suppliers and subcontractors about the content of the H&M Chemical Restrictions. By accepting the H&M Standard Purchase Conditions, each Supplier acknowledges that H&M reserves the right to:

Inspect and test any product, any part of production and/or packaging, by any listed or appropriate method, at any time or at any stage of production.

Cancel the Order, or, if the products are already delivered, return the

products to the Supplier if the product, production and/or packaging do not correspond to the H&M Chemical Restrictions.

Hold the Supplier responsible for any damage caused by the ordered

product if the product, production and/or packaging do not correspond to the H&M Chemical Restrictions.

Receive the Material Safety Data Sheets (MSDS) for all substances and

preparations (dyes, colorants, solvents, chemicals etc.) used in the production of a specific Order.

In the case of contradictory test results, the H&M test result will prevail.

Abbreviations and definitions

CAS no Chemical Abstracts Service number, an identification number for chemicals in this database.

CFR Code of Federal Regulations

cfu Colony forming units. The content of bacteria, mould and yeast in a product is measured by counting the number of colonies formed in the sample. This is the unit for this counting.

CI no Colour Index number

cl Centilong

cSt centiStokes, which is the same as 1mm2/s. This is the unit used for kinematic viscosity.

GMP Good Manufacturing Practice

Homogeneous Uniform composition throughout, i.e. a material that cannot be mechanically disjointed into different materials.

IU International Unit. A unit used when measuring vitamins.

Kinematic viscosity

Describes how fast a fluid is spread on a flat surface in relation to its mass, i.e. weight.

MRSL Manufacturing Restricted Substances List

Organoleptic Refers to any sensory property of a product, including smell, taste, colour and feel.

PDRC H&M Production and Documentation Requirements for Cosmetic products

PDRF H&M Production and Documentation Requirements for Food contact products

ppm Parts per million, which is the same as mg/kg.

REACH Registration, Evaluation, Authorisation and restriction of CHemicals SML Specific Migration Limit in food or in food simulants.

SML(T) Total Specific Migration Limit in food or in food simulant. SML(T) is

the maximum permitted amount of a given substance originating from the release of several given substances from a material or article into food or a food stimulant.

Limits of Restricted Substances As defined below, substances may be restricted according to the specific limits: banned, not detected, concentration limit or usage ban. A substance may be restricted for use in production and/or as a component in the finished product. Reporting Limit Concentrations of specific substances can be measured by using different kinds of methods. These methods can be technically different and depend both on which type of substance that is to be measured and on the type of sample. However, none of the methods can determine concentrations down to zero. There will always be a lowest concentration below which the methods can’t determine the quantity of a specific substance. The lowest limit at which a substance is reported is called the reporting limit. Whenever technology is improved and implemented as standards, the new improved method will be applied and the reporting limit in H&M Chemical Restrictions will be changed accordingly. Banned When the restriction limit for a substance is expressed as “banned”, the substance must not be added to the product and it must not be used in production. The source of such substances may be as impurities in raw materials or they may be formed in the product. These substances must not be present in the finished product at concentrations above the reporting limit. Not Detected When the restriction limit for a substance is expressed as “not detected”, the substance must not be present in the finished product at concentrations above the reporting limit. The source of such substances may be as impurities in raw materials or they may be formed in the product. Also, some substances can be safely handled and are allowed to be used in the production process but must not be present in the finished product at concentrations above the reporting limit. Concentration Limit When the restriction limit for a substance is specified as a definite concentration, this means that the substance must not be present in the product at concentrations above this limit. The reason for a specific restriction limit may be for example legal requirements, environmental concerns, health concerns, etc. Usage Ban When the restriction limit for a substance is expressed as “usage ban”, the substance must not be used in production and it must not be added to the product. Impurities at low concentrations of these substances may be accepted only if technically unavoidable due to e.g. raw materials, formation in the manufacturing process, storage or packaging.

Glass & Crystal For children (0-14 years): Glass or Crystal may not be used in baby’s and children’s wear according to the “H&M Safety Requirements for baby’s and children’s wear size 44-170 cl” For adults: Glass or Crystal that exposes humans to unsafe amounts of Lead (Pb), considering worst case scenario, i.e. if swallowed, may not be used.

Recycled Material For recycled materials26, the restrictions are the same as for other materials, with below mentioned exceptions. These exceptions are only valid for orders where H&M explicitly specify on the product that recycled material is used.

Chromium (Cr) Provided that no additional Chromium dyes have been used after the collection of the waste, the restriction about total chromium does not apply. The restriction for extractable Chromium applies, regardless of waste type.

Part 2: Food Contact Products The following restrictions and requirements are additions to the EU legislation. If a group of substances is marked with an asterisk* in the table below each included substance is specified in Appendix A.2. Test methods and reporting limits are listed in H&M Production and Documentation Requirements for Food Contact Products27.

All Food Contact Products must comply with EU Framework Regulation concerning Food Contact Products no 1935/200428 and all regulations, directives and amendments under this framework regulation29.

H&M Production and Documentation Requirements for Food Contact Products30 (PDRF)

Production must follow H&M PDRF which includes requirements for: good manufacturing practices (GMP), testing of food contact products, test methods, documentation and declaration of compliance.

Part 1 of H&M Chemical Restrictions All Food Contact Products must fulfil Part 1 of H&M Chemical Restrictions, but in the case of differences this Part 2 prevails.





Sensory properties (smell and/or taste of food)

No change in sensory properties (smell and/or taste) of food. Shall be controlled with Sensory test.

Cat 1. Objects which can be filled and objects that cannot be filled, whose internal depth measured between the lowest point and the horizontal plane passing through the upper edge is less than or equal to 25 mm. Appendix B – Permitted Colorants in Cosmetic Products All substances listed below are permitted as colorants in Cosmetic Products under the specific restrictions and requirements laid down. The numbers under the column “Field of application” mean:

1) Colouring agents permitted in all cosmetics products.

2) Colouring agents permitted in all cosmetics products, except those intended for use in the area of eye (eye lid, eye lashes and area below the eye down to the cheek bone).

3) Colouring agents permitted only in externally applied cosmetic products. They should not intend to come into contact neither with the mucous membrane (includes the intimate/genital area and the oral cavity of the mouth) nor with the lips.

4) Colouring agents permitted only in externally applied cosmetic products, except those intended for use in the area of eye. They should not intend to come into contact neither with the mucous membrane nor with the lips.
