1. Call to Order and Roll Call.

Chair Phillips called the meeting to order at approximately 10:00 a.m.

Commissioners Present: Jeanetta Phillips (Chair), Burt Collisn, Ed Drechsler and Kathleen Leavitt (on the phone). Commissioners Absent: Ruth Sellers County Staff/Departments Present: Steve Engfer from the Planning Applicants/Members of the Public Present: Applicant team including- Monica Martinez (CASA) and Kristen Fiester (MT Crisis).

2. Election of Officers.

By Motion of Drechsler, seconded by Leavitt, the Historic Sites and Records Preservation Commission tabled the Election of Officers until the next meeting. Motion moved.

RESULTS: ADOPTED [ 4 to 0]

3. Approval of Minutes: Meeting of November 9, 2020

Corrections to the minutes are noted as: Page 2, first paragraph, correct spelling Dreschler to Drechsler.

By Motion of Collins, seconded by Leavitt, the Historic Sites and Records Preservation Commission approved the minutes of November 9, 2020 as corrected. Motion motived.

4. Review and Recommendation to Planning Director for Action: Historic Design Review Application No. 2020-186 for signage for five businesses located at 5075 Highway 140, Suite ABC, Mariposa; APN 013-142-0020; Monica Martinez, applicant. ACT Holding, owner. (Kaitlyn Casner, Planner II)

Steve Engfer, Senior Planner, presented the project for signage for 5 business which include:

Also, directional and parking signage. Clarifications: The commission discussed concerns regarding the Ethos signage and while the logo isn’t a historic font, it is their logo/branding. Concerned that the signage didn’t appear finished. Suggested putting a border on it and have background be off white or muted color instead of a stark white. Engfer summarized the Commissioner’s concerns as: 1) Border on the Ethos sign either wood trim, contrasting color or painted border. 2) Signage background to be off white or muted color instead of the bright white.

Engfer reminded the commission that procedurally these recommendations can be made to the Planning Director which she could review before making her determination. He also noted that the applicants are here for any questions.

Discussion with the applicant representatives that were present and the Commissioners regarding signage and lighting.

By Motion of Drechsler, seconded by Collins, the Historic Sites and Records Preservation Commission recommended that the Planning Director approve Historic Design Review

Application No. 2020-186 as presented with the following recommendations: • that the off white or muted background be used on the marquee sign and on the individual business signs; and • The Ethos signage be trimmed with a border

5. Non-agenda items (for discussion only, no action), including persons wishing to speak

on any item of interest within the subject matter or jurisdiction of the Commission that is not on the agenda: Several Commissioners expressed concern about signage issues in town and the lack of compliance. Engfer described some past efforts to bring non-conforming signs into compliance, however, the process has been challenging. Engfer reminded the commission of an effort last year to change the compliance code provisions and it was met by community concerns and opposition. Also, that the Board decided at that time to wait until the new Board was in place and to have more community engagement in the code change process. Signage is definitely a part of this effort. Currently we have a staff of two for the entire county and they are working

on Building and Planning compliance issues and assisting the Sherriff’s department with Marijuana compliance. Our staff needs the proper codes in place in order to have the authority for enforcement. Collins expressed appreciation regarding efforts towards providing options for audio for the hearing impaired.

Topic: Agenda Item 4: Recommendation to Planning Director- Historic Design Review Application No. 2021-014; 5053 Hwy 140 APN 013-144-0140; Jerry Wagner, applicant. Mariposa Fruit & Nut Co., LLC, Owner

Project and Background The Mariposa County Planning Department has received Historic Design Review Application No. 2021-014 for a proposed exterior remodel of an existing single-family residence in the located within the Historic Design Review Overlay.

Location: The project site is located at 5053 Hwy 140. APN 013-144-0140. (Attachment A - Vicinity Map) Zoning: General Commercial, Historic Design Review Overlay (HDRO)

• Conditional Use Permit Application No. 2020-043 was approved by the Planning Commission on July 24, 2020 allowing the residential use in the General Commercial zone.

• A Design Review was not a part of the Conditional Use Permit at that time and therefore the proposed exterior changes required this Design Review application.

Land Use: General Commercial within the Mariposa Town Planning Area Specific Plan Proposed Work Remodel exterior of an existing single-family residence of approximately 1,400 square feet. (Attachment B – Application Materials). Proposed work includes:

• Exterior siding– siding change to board and batten, slate blue color (Hardiplank) • Trim features- natural wood color • New covered front porch area with ribbed metal roofing of a metal-silver-gray color • Replacement of doors–natural wood color. • Windows replacement to double hung dark (black) framed window • Refuse storage area shed enclosure- to match building color scheme • Rebranding the existing wood sign with new lettering and paint

• Landscaping • Water feature • Lighting changes • Existing architectural composition shingle to remain (gray color) • HVAC system screened or paint to match

APPLICABLE DEVELOPMENT STANDARDS

The project is subject to the following HDRO development standards:

• Zoning Ordinance §17.336.060.B.2 – Buildings shall incorporate functional elements of the historic buildings of the region, such as porches and roof overhangs for shade and weather protection, durable and fire resistant building materials and limited site excavation. The historic design review overlay architectural theme and development guidelines shall provide specific information regarding historical buildings;

• Zoning Ordinance §17.336.060.B.6 – Base color for buildings (largest building surface) should generally be light colors in warm tones. Trim may be brighter or darker colors to compliment architectural features. Natural finishes such as stone, wood, brick, and tile are encouraged. Painted surfaces shall be harmonious with the natural finish. Quality and longevity of exterior finishes will be an important consideration in the design review;

• Zoning Ordinance §17.336.070.B.7 – All exterior mechanical equipment on roof, building and ground should be enclosed or screened from public view either by utilizing materials compatible with the building or locating them away from public view. Refuse storage areas, service yards and exterior work areas shall be screened from public areas such as streets, sidewalks and parks;

• Zoning Ordinance §17.336.070.A.1 – All construction within the historic overlay zone shall comply with historical Mariposa architecture defined as architecture generally utilized in the region from the years 1850 to 1920 and which is exemplified by the buildings outlined in the list of historical resources in Mariposa contained in the Mariposa TPA specific plan. Spanish style construction is included as historically significant.

• Zoning Ordinance §17.336.070.A.2 – Buildings shall be constructed of wood, brick, adobe, or

stone. Modern materials which closely resemble the historic materials are allowable.

• Zoning Ordinance §17.336.070.A.3 – All buildings shall comply with the style of architecture typical to the region in the period identified above. Such architecture typically included design features such as gabled or shed roofs, tall narrow windows and doors, dormer windows, functional iron or wood shutters, balconies, porches, awnings, detailed scroll work, ornate functional elements such as vents, railings, support posts, etc.

• Historic Sites and Records Preservation Committee Policy on Windows (No. 13-01),

Applicable policies: 4. Use of vinyl framed or metal framed windows or any alternative framing material for projects involving new or replacement windows for a non-historic structure within the HDRO shall be considered by the Commission on a case-by-case basis.

a) Dark and non-reflective colors are required for framing, if vinyl or metal framed

windows are approved for use. b) Color of window framing shall be considered so as to not be contrasting. c) In no event shall artificial divided lights on the inside of the window or between dual

panes be used. 5. When considering proposed alternative materials, the term “closely resembles” shall be reviewed considering an objective of achieving “indistinguishable from” the original natural material. 6. Use of natural materials for framing for new or replacement frames for non-historic structure and new construction within the HDRO shall be a defaulting preferred position.

• General Plan:

Goal 11-1: Conserve the natural and scenic resources, and open space lands to protect and enhance the County’s quality of life and character ensuring a viable economy.

Policy 11-1d: Ensure that light sources in new development are compatible with rural

character and that the light sources do not produce glare that interferes with vision.

Implementation Measure 11-1d(1): Include as part of the comprehensive development standards include;

lighting standards established by the International Dark Sky Association: and

require that building materials have a low reflective index.

ENVIRONMENTAL REVIEW The project is exempt from environmental review pursuant to California Environmental Quality Act per Section 15303(a), CEQA Guidelines, New Construction or Conversion of Small Structures. (a) One single-family residence, or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences may be constructed or converted under this exemption. The proposed house is no greater than 1,700 square feet, served by adequate access and the Mariposa Public Utility District for water and sewer utilities that functions similarly to lots in an “urbanized area”. RECOMMENDATIONS FOR CONDITIONS TO THE PLANNING DIRECTOR

1. All lighting shall be directional lighting and shall not create off-site impacts.

2. Color scheme shall be as proposed (Attachment B – Application Materials, OR as amended by the

Commission). (Slate Blue with Natural Wood Trim)

3. The proposed porch roofing final design details shall require Planning Director approval and shall include ribbed metal roof with metal/grayish color and paint and trim scheme to match building.

4. All windows shall be framed with dark and/or non-contrasting, non-reflective colors.

5. All HVAC equipment shall be screened and/or painted to match the house or roofing colors

6. Building Permit shall be required prior to any work. Planning Director approval of the building permit plans is required prior to building permit issuance.

7. Final landscape plan shall be State Water Model Efficient Landscape compliant. The proposed

water feature may require approval by MPUD prior to Building Permit issuance.

8. Final approval of this design review is subject to a final Planning Department inspection of the completed project.

9. Final signage shall require Planning Director approval prior to Building Permit issuance.

PROCESSING The Planning Director is the final approval authority for this historic design review application.

RECOMMENDATION Staff recommends that the Historic Sites and Records Preservation Commission review the project and provide a recommendation to the Planning Director.
