Declaration for Exemption relating to Businesses (articles 60C and 60O of the Financial Services and Markets Act 2000 (Regulated Activities) Order 2001)

I am/We are entering this agreement wholly or predominantly for the purposes of a business carried on by me/us or intended to be carried on by me/us.

I/We understand that I/we will not have the benefit of the protection and remedies that would be available to me/us under the Financial Services and Markets Act 2000 or under the Consumer Credit Act 1974 if this agreement were a regulated agreement under those Acts.

I/We understand that this declaration does not affect the powers of the court to make an order under section 140B of the Consumer Credit Act 1974 in relation to a credit agreement where it determines that the relationship between the lender and the borrower is unfair to the borrower.

I am/We are aware that, if I am/we are in any doubt as to the consequences of the agreement not being regulated by the Financial Services and Markets Act 2000 or the Consumer Credit Act 1974, then I/we should seek independent legal advice.

I, the Customer, agree that:

1. The information supplied above is correct and I realise thatyou may rely upon it to decide whether you should make thisagreement.

2. I have not paid to any broker or intermediary who may haveintroduced me to you any fee, commission or other payment inrespect of its services.

3. I have, to the extent I think necessary, taken advice from anindependent source as to the performance fitness and qualityof the Goods. I have considered the need to obtain remedieselsewhere and have obtained those I require. Accordingly, I agreethat such exclusions are fair and reasonable.

4. I have read and understood the Terms and Conditionsof the Agreement at haydockfinance.co.uk/HP.Sep20 and theData Protection Notice at haydockfinance.co.uk/DPSep20.

5. Any telephone conversations may be monitored and recorded aspart of our efforts to further improve our service to our Customers.

This Agreement comprises this schedule, and the Terms and Conditions which are available in our online broker area and at haydockfinance.co.uk/HP.Sep20. References to conditions by number are to the numbered conditions of the Terms and Conditions.

This Agreement may be entered into and signed by the Customer and the Owner by way of electronic signature or advanced electronic signature, as defined in section 7(2) of the Electronic Communications Act 2000 or Articles 3(10) or 3(11) of the Regulation (EU) No 910/2014. Any such signature will still be effective and binding on the Customer or the Owner, as applicable.

By signing this Agreement, you agree that we may obtain from you and others (including credit reference agencies (CRA’s)) information about you, your business, your directors or partners in the business. You may be treated as financially linked (“financial associates”) and will be assessed with reference to “associated records”. If you are making a joint application or inform us of a financial association, you must have their consent to share information about them and supply this notice to them. We reserve the right to make reasonable enquiries to verify that consent has been provided.

The information detailed in this Agreement and additional information about this Agreement and your account with us may be given to one or more finance companies, other companies within our Group, the Supplier of the Goods, service providers, insurers, assignees, CRA’s, any person to whom we assign our rights under this Agreement and to any person acting on our behalf for any of the following purposes:

a) to assist us and other lenders to make credit decisions, which may include Credit Scoring or other automated decision-making systems, about you and other members of your household and for fraud prevention and the tracing of customers.

b) to record with licensed CRA’s the existence of this Agreement and how you conduct your account. The agencies will retain a record of the searches we, or others, carry out about you and the other information we record with them. It is therefore important that you give us accurate information. When CRA’s receive a search from us they will place a search “footprint” on your credit file whether or not this application proceeds. If the search was for a credit application the record of that footprint, for the applying entity only, (but not the name of the organisation that carried it out) may be seen by other organisations when you or your financial associates apply for credit in the future.

c) matters relating to the administration of the Agreement or to theGoods.

If you are provided with a finance facility and do not repay in full and on time, we may tell CRA’s who will record the outstanding debt. These records will be shared with Fraud Prevention Agencies, other organisations and may be used and shared by us and them to:

a) consider applications for credit and credit related services or otherfacilities, for you and any associated person; and

b) trace debtors, recover debts, prevent or detect money laundering andfraud and to manage your account(s).

Records shared with CRA’s remain on file for up to 7 years after closure whether settled by you or defaulted. For further information about how we handle your personal information in accordance with data protection legislation, namely the Data Protection Act and the General Data Protection Regulation (or the equivalent in England and Wales) including any amendments, please see the Privacy Policy on our website or a copy will be provided upon request.

If you are an individual, you have various rights under data protection legislation including the right to obtain a copy of your personal records held on our computer files and to ask us to correct incorrect data which we may hold about you.
