    Roofer fined for dangerous workingA Barnsley roofer has been f ined 2,000 after he was caughtw orking on a shop roof without adequate protection by a passingsafety inspector.

    John Hartshorne was spotted by the Heal th and SafetyExecu t i ve inspector on January 23 as he carried out repairs on theroof of the Walmsley's Furniture Superstore.

    He was undertaking the work with two employees.

    Mr Hartshorne today pleaded guilty to a breach of the Work at HeightRegulations at Barnsley Magistrates' Court.

    HSE Inspector David Bradley said: "This particular project was verypoorly planned, and there were no controls in place to prevent fa l lsf rom the roo f where in areas there was potential to fall 10m to theground.

    "Thankfully no-one was injured on this occasion but had we not beenpassing and taken action, the outcome could have been quitedifferent, and even tragic."

    Mr Hartshorne was also ordered to pay 500 costs.

    Five workers killed in Malaysian store fireKuala Lumpur - Four Bangladeshis and one Burmese worker wereki l led Wednesday when a fire broke out at a furniture store in thecentral Selangor state, the official Bernama news agency said.

    The victims were believed to have been trapped in their bedroom onthe first floor of the store during the pre-dawn blaze, district policechief Arjunaidi Mohamed said.

    A total of 43 firefighters managed to put out the f i re after one hour,when the bodies of the victims were discovered, he said.

    Twelve other foreign workers who were sleeping at the store escapedunhurt, state fire and rescue chief Ramli Yusoff said.

    Ramli said authorities were still investigating the cause of the blaze.

    It is believed he was suffering from shock and the effects of w a t e r inha la t ion , but is not thought to be badly injured. Today staff at theRainbow International Hotel in Belgrave Road, who helped in theattempts to resuscitate the guest, were said to be shocked after whatthey are describing as a 'tragic accident'.

    Emergency services were called on Saturday evening and anambulance dispatched to the Belgrave Road hotel.

    The initial report was one young man had suffered a head in jury in

    the indoor pool.

    Paramedics used cardiopulmonary resuscitation at the poolside, butat 8.20pm the young man was taken to Torbay Hospital where he wasofficially pronounced dead .

    An ambulance spokesman said: "The paramedics used CPR on thedrowned man to give him the best possible chance of resuscitation,but sadly it was too late."

    Hotel manager David Dabbs said: "At this time, I really don't knowexactly what happened.

    "It has come as a shock to our staff, who did a brilliant job. Obviouslywe will cooperate with police in their investigation, but I see it as atragic acc iden t ."

    Police were called at 7.45pm by the ambulance service after reportsthe man had got into difficulties in the pool.

    The death is not believed to be suspicious, police say.

    The man's next of kin are being informed and he is not thought to belocal.

    Police say the Heal th and Safety Execut ive is being notifiedabout the incident.

    One dead as crane topples onto rail line in Iow a,USAI o w a - A railroad in western Iowa has been shut down because of aconst ruc t ion c rane that topp led onto the tracks and k i l l ed thecrane operator.

    The crane was moving a beam in a construction zone on anInterstate 80 bridge near Adair on Tuesday. The machine toppled

    through a hole in the bridge deck and onto the tracks below.Authorities say rail traffic is being rerouted.

    The operator worked for A.M. Cohron & Son Inc. of Atlantic. He was27-year-old Dustin Flinn.

    Crews at the site about 50 miles west of Des Moines are replacingthe bridge over the railroad.

    Binman killed after being run down by friendBy Jonathan Stayton.

    A binman died after he was crushed under the wheels of a dustcart

    driven by his best friend.

    Residents watched in horror today as the dust cart reversed up aresidential road, knocking Horsham District Council refuse workerJason Maguire to the ground and k i l l i ng h im ins tan t l y .

    Mr Maguire, 34, was working as part of a team of three working inAndrews Road in Southwater, near Horsham, when the accidenthappened at about 9.20am.

    The road was closed until 12.50pm while police tried to work outexactly how the crash happened.

    Mr Maguire was an avid fan of Liverpool footba l l c lub , who

    idolised Steven Gerrard . His family plan to hold a Liverpool-themed funeral and then later scatter his ashes at the team's Anfieldground.

    Liz Kitchen, the leader of Horsham counc i l , said: "This is atremendous shock to everyone and our deepest sympathies go to hisfamily and colleagues."

    "Jason had worked for the council since 2005."

    "Full details of the incident are being investigated and we are workingwith the police and Heal th and Safety Execut ive in relation totheir enquiries."

    British yachtsman killed on Australian tripA British yachtsman was killed on Sunday after being s t r uck onthe head by a boom during a sailing trip along the east coast ofAustralia.

    His distraught wife had to be rescued from the vessel by a helicopterafter spending several harrowing hours adrift with her husband sbody, authorities said.

    The 48-year-old woman, who had very limited sailing experience, wasairlifted to Hervey Bay, Queensland, after her 67-year-old husband

    was ki l led by t he boom .

    The accident happened about 80 nautical miles east of Fraser Islandafter the British couples 45ft yacht, the Dj Vu, got caught in nine-foot high swells and strong winds.

    Another boat in the area managed to reach the yacht but poorweather conditions prevented them taking the woman on board.

    Conditions were pretty terrible, it was really windy and the waveswere big, said a spokeswoman from Australian Maritime SafetyAuthority.

    Police were not naming the couple until their relatives in the UK were

    informed of the accident.

    The woman sent out a mayday call signal at 6.30am local time. Twohelicopters were scrambled from bases in Queensland and she waswinched off the boat a few hours later.

    China crackdow n on work accidentsDozens of Chinese officials are to be prosecuted or punished overfatal accidents in the workplace - where 100,000 Chinese die eachyear.

    Works Minister Wang Wei announced that prosecutors wouldconsider cases against 78 managers and officials, and 105 hadalready been disciplined.

    The move comes after inquiries into five incidents where 189 peopledied.

    Meanwhile, officials say they are willing to investigate reports that 10workers have died at an Olympic site.

    Senior safety official Li Yizhong said those responsible would bepunished severely if the claims - made by UK newspaper theSunday Times - turned out to be true.

    The newspaper cited unnamed witnesses to the deaths and alsoclaimed that families had been paid to keep quiet.

    Earlier, the organisers of the 2008 Olympic s had denied the story.

    'Loopholes'

    China's work safety record is poor - Mr Li announced that more than100,000 people die every year in workplace incidents.

    "The death toll is still too big and the occurrence of major accidentshas not been effectively curbed," Mr Li said.

    "There is still uncertainty in work safety situations in some regionsand industries and we also have many weaknesses and loopholes in

    Blackburn teen critical after Garstang fork lifttruck accidentA teenager was today in a critical condition in the Royal PrestonHospital after being injured in a fork lift truck accident.

    The Blackburn teen, who has not been named, sustained seriousback injuries when he was thrown from a fork lift truck.

    Police said the vehicle had overturned at welding firm AustinWalmsley Ltd, Leach Field Industrial Estate, Garstang, at around1.15pm on Tuesday.

    An investigation has been launched by police and the Health andSafety Executive into the incident.

    Tiger Injures Toledo Zoo KeeperA yet unidentified Toledo zoo keeper was taken to the hospitalyesterday after a tiger reached across the double mesh barrier andscratched his chest, a zoo spokesman said.

    The zoo keeper was doing his everyday job, cleaning and feeding thetigers around 8:30 a.m. Sunday, when the tiger s paw apparently

    made it through the barricade at an odd angle and came in contactwith his chest.

    20 dead, dozens missing as ferry capsizesA FERRY c apsized overn ight o f f t he coast o f Hai t i ,k i l l ing at least 20 people, inc lud ing f ive ch i ldren, andleav ing dozens m ore miss ing.

    "Haitian police and peacekeepers from the UN mission in Haiti haverecovered the bodies of some 20 victims. The search continues,"police inspector-general Fritz Jean said.

    "Five children aged two to five perished in the shipwreck," said EvilLavilette, mayor of south-western Pestel, from where the fer ry setout for Port-au-Prince.

    "Among the victims, 11 bodies have been deposited at the capital'suniversity hospital morgue," the mayor said, adding that other victims'remains were taken to a hospital in nearby Gressier.

    "There are some survivors, but we lack precise information on the

    number of people travelling aboard the ferry at the time of theaccident. There is no authority controlling maritime transport," MrLavilette said in Port-au-Prince.

    More than 100 people were aboard the vessel, according to police.

    Member of parliament Accluche Louis-Jeune said there were as manyas 200 passengers aboard the ferry when it sank about 11pmyesterday, a few kilometres from Port-au-Prince.

    "At the moment, no survivors have been rescued," the MP said.

    Mayor Lavilette said: "The ship's captain waited in vain for the Haitiancoast guard to come to the rescue" of his passengers, many of whom

    were shop owners and their families.

    He said the fer ry was named Praise t he Lord .

    The accident comes a little over a year after the May 4, 2007capsizing of a sailboat ferrying immigrants from Haiti to the US.

    Fifty-nine people drowned and 78 survived in that accident in shark-infested waters near the Turks and Caicos archipelago.

    Risks from redundant solid fuel back boilersThe following is an alert from the Heal th and Safety Execut ive :

    1 Who is a f fect ed?HSE is issuing this safety alert for the attention of individualhomeowners, tenants, landlords and the plumbing/heating industry.This is to raise awareness of the potential dangers of lighting a solidfuel fire when a redundant solid fuel back boiler has been left withinthe fireplace.

    2 What is t he r isk?The alert follows several incidents in the last five years, three of whichresulted in serious injury, and sadly in one case, a fa ta l i t y . Theredundant solid fuel back boiler had been left in a sealed conditionand sometime later, when a coal or wood fire was lit in front of theboiler, the unit heated up sufficiently for the internal pressure to cause

    the boiler casing to explode.

    3 Where can t he r isk ar ise?Situations to consider will include where a solid fuel back boiler hasbeen drained down over winter in vacant premises, or where it mayhave been left in place after conversion of the property s heatingsystem - often to a gas or oil fired system with a new remote centralheating boiler. Due to the disruption of removing a back boiler fromthe fireplace they may have been left in place for the decorative effectof the fire-grate, or covered by a panel or other feature.

    4 What c auses the prob lem?The back boiler unit typically consists of a fire grate, which carries thecombustible material e.g. coal, and a water chamber surrounding it.

    This water jacket is generally behind the fire but may also be at thesides and partially above the grate with the flue passing through it.Thus heat input to the water is gained from the hot flue gases as wellas radiated from the coals. As the units are difficult to draincompletely there is likely to be residual water in the redundant boilerwhich will turn to steam when heated. This exacerbates thepressurisation if the unit was left in a sealed condition.

    In one explosion case a fire had been set, in the grate in front of theboiler on an early autumn evening to warm a lounge; in another, thepanel cover had been removed to bring the fire back into use to heatthe lounge and reduce the use of the oil fired central heating. In eachcase it was the first time a fire had been lit since the conversion.

    In tests carried out in 2002 it was found that the top and sides of asolid fuel back boiler, without circulating water, reached temperaturesin excess of 700C. Within 2 hours the temperature in some areashad reached around 480C. This compared with normal systemmaximum operating temperatures of 124C.

    5 Indust ry recomm ended ac t ion to c on t ro l the r i sk Previous advice recommended that a redundant back boiler left in situmust be in a condition such that an unsafe level of pressure cannotbuild up in the unit. Thus, at the decommissioning stage the systemshould have been drained and redundant pipework removed alongwith, ideally, the back boiler itself. If not removed the boiler shouldhave been left in a vented or open condition. If the pipe connectionswere plugged, at least one 6mm diameter hole should have beendrilled in the water jacket, preferably in a vertical or near vertical face.

    In some cases the decommissioning may have been carried out by anindividual, or heating or building organisations that were unaware ofthe potential problem, or had not seen the advice.

    Other longer term potential dangers can arise with continued use of afireplace and redundant back boiler even if appropriately vented:

    If connected pipework is left in situ, corrosion/cracking of the waterjacket sidewalls may allow flue gases to enter the pipework and beconveyed to other areas of the property with potentially dangerousconsequences. The high temperature of the pipework may alsopresent a fire risk.Continued use of an open fire has potential for structural damagethrough repeated expansion and contraction of the boiler casing,which is significant due to the high temperatures involved.Additional note: the flue of a retro-fitted gas fire must not pass throughthe redundant water jacket.HETAS, the independent UK body recognised by DEFRA for the

    official testing and approval of domestic solid fuels and solid fuelburning appliances, advises:

    The only positively safe and reliable way to proceed, when a solid fuelback boiler is no longer needed and the customer wants to continueusing the fireplace, is to totally remove the back boiler installation bybreaking up the chamber that used to carry the hot water system andremoving any pipe work. When an open fire is left in use (or could bebrought back into use) a replacement Milner fire back needs to beinstalled to ensure that the fire can be safely used.

    Similarly, a "wet" solid fuel room heater or stove with boiler should notbe operated after the water supply to the boiler has beendisconnected. These appliances are not designed to be used withoutwater circulation and there could be serious safety issues if they aremisused.

    6 In format ion for homeow ners, tenant s, land lords andheat ing professionals The information in this safety alert will help you decide whether youneed to address a potential safety risk within your property or housingstock. Key control measures are either to ensure permanent pro-tection from open fire and heat sources, or to refrain from lighting firesuntil appropriate protection and venting is provided or the unit isremoved.

    HomeownersIf you believe you have a redundant back boiler in the circumstancesmentioned above you should NOT light a fire in the fireplace until youhave sought professional advice*.

    Tenants If you are unsure or believe you could have a redundant back boiler inthe circumstances mentioned above you should contact your landlordurgently. In the meantime you should NOT light a fire in the fireplace.

    Landlords (a) You will need to assess your stock and identify those housescontaining a redundant solid fuel boiler so as to determine an

    appropriate plan of action in consultation with a competent person*(b) In the meantime you should issue instructions to relevant tenantsadvising of the dangers and to NOT light a fire in the fireplace untilfurther notice.

    WINTER PARK - A construction worker died Monday when he fellseveral stories down an elevator shaft under construction, authoritiessaid.

    The man, whose name was not released, fell backward, taking part ofa wall he was building with him, said Winter Park Assistant Fire ChiefPat McCabe. The acc iden t occurred about 2:35 p.m. at Lyman andPennsylvania avenues, where workers are building a private garagefor a condo-and-office development, McCabe said.

    The man, thought to be in his 30s, fell three or four stories and

    suffered massive head in jur ies , officials said. Rescue workerstended to the man, who was alive when they arrived, but he waspronounced dead shortly after he arrived at Florida Hospital Orlando,McCabe said.

    HSE Chair challenges industry leaders to walk thetalkFor the first time ever over 200 industry leaders came together toshare their learning on process safety in the major hazards industrytoday. The Health and Safety Executive (HSE) created a commonplatform for industry leaders to share good practice and learning fromincidents such as those at Texas City, Buncefield and the Thorp plantin Sellafield at its Leading from the top- avoiding major incidentsconference. Discussions at this conference served as a starkreminder to senior managers that the absence of conventional safetyaccidents and injuries in the past few years should not, in itself, betaken as a positive assurance of an overall improvement in process

    HSE warns of robust action after prosecution ofEverest LtdThe Health and Safety Executive (HSE) has issued a stark warningthat companies face robust enforcement action following itsprosecution of Everest Ltd, after workers were found to be repeatedlyexposed to the risk of falling from height.

    Everest Ltd, of Sopers Road, Cuffley, Potters Bar, was fined 6,000with 15,963.25 costs, at Luton Magistrates Court today (April 30),after pleading guilty to breaching health and safety law including WorkAt Height Regulations 2005 (see notes to editors for full charges).

    HSE Inspector, Norman Macritchie said:

    "The level of fatal and serious injuries in refurbishment projectsremains unacceptable. Each death is a tragedy for those involved andthere is no room for any complacency. The challenge for theconstruction industry is to ensure that sensible and effectiveprecautions are in place to stem these deaths.

    "Employers must ensure that safe working practices are developedand followed. HSE inspectors will not tolerate negligence or poorsafety standards on construction sites. Robust enforcement actionmay well be taken, especially where there is serious or repeatedbreach of legislation, or failure to control the lethal risks associatedwith work at height."

    The prosecution arose following inspections on 14th July 2006 and6th November 2006 when a HSE inspector passed neighbouringresidential properties on Crawley Green Road in Luton, whereEverest Ltd was contracted to perform domestic rooflinerefurbishment. The work involved persons working at height frommobile tower scaffolds and associated work platforms, but withoutsuitable protection to prevent them from falling. The Inspector tookimmediate enforcement action and served a Prohibition Notice whichstopped the work at both sites.

    Everest Ltd was also recently fined 4,000 in another case taken byHSE, when a Roofline Installer fell from the platform on which he wasworking.

    Large Govan shipyard crane snapsAn 80 tonne crane at a Govan shipyard has snapped while carryingout routine operations.

    BAE Systems confirmed that three employees were involved in theincident which happened at the company's site on the Clyde at about0800 BST.

    One man is being treated in hospital for minor injuries while twoothers were treated for shock.
