    Mansfield firm fined after man is seriously injuredThe Health and Safety Executive (HSE) today urged companies to takeworker safety seriously after a man had his fingers crushed when theygot drawn into machinery at a Mansfield transport engineering factory.

    W H Davis Ltd of Langwith Road, Langwith Junction was fined 5,000and ordered to pay 2,380.75p full costs by Mansfield magistrates todayafter breaching Sect ion 2 (1) o f t he Heal th and Safety a t Work e tc . Ac t 1974 for failing to ensure, so far as is reasonably practicable,the health and safety of its employees

    On 19 September 2007, while working on a three roll bending machine,Matthew Parker, 19, of Mansfield Woodhouse had his hand crushed afterhis left hand glove was drawn into a rolling machine.

    The injuries to Mr Parker were so severe they resulted in multiplefractures to all four fingers and the amputation of the tip of the little fingeron his left hand. The first three fingers were crushed so badly they weresplit open to the bone while the thumb was split on one side. Mr Parkerwas detained in hospital for five days and had two operations to hisfingers. He has been unable to work since the accident and will beundergoing further treatment in the New Year.

    Maureen Kingman, principal inspector of Health and Safety for

    Nottingham, said: "For a young man who works with his hands and needsdexterity, these are the most debilitating of injuries which could havebeen avoided if the company had safe systems of work in place.

    "All companies should ensure that work is risk assessed and appropriatemeasures are put in place so that workers' safety is not compromised.There were a number of failures in WH Davis' safe systems includingfailure to train a new member of staff and failure to ensure that themachine stopped immediately when the emergency trip device wasactivated."

    Christmas Tree Inferno Warning

    Firefighters have released dramatic footage of a Christmas tree going upin flames as a warning to homeowners.

    The video shows faulty fairy lights sparking a blaze which then tearsthrough the room and furniture.

    The entire living room is engulfed within 10 seconds.

    Greater Manchester Fire and Rescue Service released the footage towarn people about the dangers of leaving trees and lights unattended.

    It shows a real tree which has been in a dry warm home for several dayscatching fire.

    Firefighters said the the speed of the blaze spreading would mean thateven if a person were awake in the room they probably would not escape.

    After 45 seconds the room is blackened by smoke and completely gutted.

    County Fire Officer Barry Dixon warned people to be extra careful duringthe Christmas period.

    He said: "Before placing fairy lights on your tree make sure the wiring hasbeen checked for splits and always switch them off when you leave thehouse or go to bed.

    "But most importantly of all make sure you test your smoke alarm and ifyou haven't already got one why not buy one as stocking filler?"

    He added that each home should have an alarm fitted on each floor.

    The Manchester brigade said that last Christmas the service attended121 accidental fires in the home.

    Invisible danger w arning after potentially lethal gasreleasedThe Heal th and Safety Execut ive (HSE) is warning companies toconduct suitable risk assessments and provide safe systems of work,after toxic carbon dioxide (CO2) was released into a basement substation where it had little likelihood of escape.

    Denso Manufacturing Midlands Ltd, of Minworth, Sutton Coldf ie ld ,was fined a total of 28,000 and ordered to pay costs of 5,278 byBirmingham Magistrates Court on Friday 12th December 2008, afterpleading guilty to breaching sections 2(1) and 3(1) of the Heal th andSa fe ty a t Work e t c Ac t 1974 and Regulation 3(1) of theManagement o f Heal t h and Safety a t Work Regulat ions1999 .

    The court heard that Denso Manufacturing Midlands Ltd wasdecommissioning the fire suppression system in the basement substationof its old works in Shaftmoor Lane, Hall Green, Birmingham. As part ofpreparing the site for clearance, on 31st October, 2007, two employees of

    the company released carbon dioxide from 11 large cylinders into thesmall basement room, unaware that it was heavier than air and would notbe able to escape.

    Completely unaware that the gas had been released, a contractelectrician re-entered the substation but decided to leave immediatelybecause he noticed an unpleasant taste to the air. Once outside, he feltweak, was taken to hospital and treated for gas inhalation.

    The court also heard that the concentration of carbon dioxide in the airwas well above the level liable to cause lack of consciousness. Had thecontract electrician lapsed into unconsciousness it is unlikely that hewould have been found for some considerable time and this would havemade the chances of him being revived increasingly unlikely.

    HSEs investigation revealed that no risk assessment had been carriedout by the company to identify the risks arising from the move toMinworth and decommissioning of the Shaftmoor Lane factory.

    HSE inspector Ed Fryer said:

    "Quite clearly the lack of any risk assessment whatsoever enabled a verydangerous situation to develop. Management arrangements for the healthand safety of employees and non-employees were grossly inadequate. Itwould be too frightening to speculate what the consequences might havebeen, not only for the two employees or the contract electrician but foranybody who unwittingly entered that basement after the gas had beenreleased."

    Council fined after 90-year-old lady diesThe Heal th and Safety Execut ive (HSE) is warning health andsocial care organisations and other employers to ensure that they carryout suitable risk assessments to determine the safety of equipment usedin everyday tasks.

    This warning follows an incident that occurred in June 2007 outside thehouse of a 90-year-old lady. As a service user of the Wombourne DayCentre she was sitting in a wheelchair when it fell from the back of avehicle operated by Staf fordsh i re County Counci l . She suffered

    internal injuries and died 3 days later in Russell's Hall Hospital.

    HSEs investigation found that the wheelchair used at the time of theincident had defective brakes and there were no footrests fitted. Itappeared that the wheelchair footrests were lost several years ago yet,despite their absence, the wheelchair continued to be used daily totransport service users.

    No daily or weekly checks were carried out on this wheelchair as a matterof routine, despite the Council having legal duties. Combinations of tyrewear from several years' use, poor adjustment of brakes and lack offootrests all contributed to the incident. Following the accident the Councilfound other regularly-used wheelchairs with defects and of the 47 in usein 16 centres around Staffordshire six were found to have defects,

    including the brakes.

    The investigation also found that Staffordshire County Council had nosystem to audit that procedures were in place for the necessary checkson the wheelchairs used in its transport vehicles to convey service users.

    Staffordshire County Council was fined a total of 83,000 and ordered topay costs of 21,000 at Stafford Crown Court, on 12th December,2008,after pleading guilty at an earlier Magistrates hearing on 31 July tobreaching section 3(1) of the Heal th and Safety a t Work etc Act 1974 .

    HSEs investigating inspector Ian Williamson said: "Lack of maintenance,lack of routine safety checks and the absence of a system for the

    management of wheelchair safety were all major contributory factors.

    Explosion rattles Montgomery County chemical plantAn explosion at an east Montgomery County chemical facility brokewindows at the plant and rattled a few neighbors, but no one was injuredand the damage was quickly contained, a company official said.

    The explosion occurred about 8:40 a.m. at Huntsman PerformanceProducts on Jefferson Chemical Road, said plant manager Joe Castagna.

    The blast blew the top off an empty tank that normally holdsmethyld ie thanolamine , a nonhazardous chemical used indetergents and fabric softeners, Castagna said.

    Company officials are investigating why the blast occurred, he said.

    The explosion shattered some windows and shook some ceiling tilesloose, Castagna said, but there was no fire or chemical release.

    Employees were evacuated as a precaution until emergency crews coulddetermine that the situation was under control. Surrounding units alsowere shut down while the tank was examined, but the plant later resumednormal operations, Castagna said.

    The all-clear siren was sounded at 11:15 a.m., he said.

    The explosion was strong enough to raise concerns among some nearby

    residents, who called to ask what had happened, Castagna said.

    Members of the Granger land Volunteer Fire Department cameto the plant as a precaution, he said, and the hazardous-materials teamfrom the Woodlands Volunteer Fire Department also responded.

    The company produces chemicals that are used in a wide range ofproducts, including cosmetics, lubricants, fuel additives, paint andcoatings.

    Tis the season for stress to strikeWith worries over the Christmas credit crunch, job security and the lateshopping rush during the Festive season, employers are being warned tokeep an eye out for seasonal stress in their staff.

    The Inst i t u t ion of Occ upat ional Safety and Heal th (IOSH),Europes largest professional health and safety body, has highlighted thatthose working in shops, pubs and restaurants are likely to findthemselves under greater pressure than normal, with many enticingpeople with cut price offers in a desperate bid to boost sales figures.

    "The last few weeks before Christmas are traditionally busy times aspeople go out to buy last minute presents," said Nattasha Freeman,IOSH's president.

    "This rush places extra demands on employees who are already likely tobe working at capacity, so employers need to watch out for signs thattheir employees are unable to cope.

    "This extra pressure, coupled with fears over their personal finances and,in some cases, job security, could leave some people more susceptible toexcessive pressure and the illnesses that can result from this. Employersshould remember that personal stress factors can also impact onperformance at work and this increases the potential for accidents."

    She added:

    "All employers need to remember that they have a duty to ensure thehealth and safety of their staff."

    In the UK, recent statistics indicate that work-related stress accounts forover a third of all new incidences of ill health, with each case leading to

    an average of 30.6 working days lost, and in 2007/8, 13.5 million workingdays were lost to stress, depression and anxiety; it also has a damagingeffect on employee commitment, performance and productivity.

    Nattasha continued:

    "To help relieve the situation, employers should look what minoradjustments they can make. These could include ensuring staff takeproper breaks and have someone they can talk to. It might also meanoffering a bit of flexibility in their working hours, particularly for those withparental responsibilities who need to arrange childcare.

    "Remember to pay particular attention to any temporary workers youemploy. Ensure they are properly supervised and receive support frommore experienced members of staff."

    There are many signs of stress, but some common signs and symptomsinclude:

    increased susceptibility to colds and other infections headaches tiredness and sleep difficulties back and neckache digestive problems wanting to cry

    short temperedness eating when youre not hungry smoking and drinking excessively, and loss of motivation and commitment.

    The campaign is being launched with an information pack providing fleetmanagers with guidance on implementing and managing incentiveschemes to best effect, avoiding potential pitfalls such as under- or mis-reporting of incidents. A wild-west style Reward poster, providingmanagers with an eye-catching opportunity to publicise their ownschemes amongst drivers, is included in the pack.

    Actor In Neck Slash Stage Horror An actor portraying a suicide bid accidentally slashed his own throat on-stage following a prop mix-up.

    Daniel Hoevels, 30, collapsed with blood pouring from his neck afterusing a real blade instead of the blunt stage knife.

    He was taken to hospital after the dramatic scene at Vienna's Burgtheaterin Austria.

    The audience had been in raptures, unaware the actor was facing hisown demise for real.

    But when he failed to greet their applause for the show's spectacularspecial effects with a bow they separated fact from fiction.

    Police are now investigating whether the mix-up was murderous.

    Officers have refused to rule out the possibility that a jealous rival mayhave switched the blades.

    The knife had been bought at a local store and police are asking if propsstaff forgot to blunt the blade for the performance of Friedrich Schiller'splay Mary Stuart, about Mary Queen of Scots.

    "The knife still had the price tag on it," said a police investigator.

    The theatre's props manager has been quizzed by police about theweapon, Austrian daily Osterreich reported.

    The actor recovered after emergency treatment and appeared on stagethe next night with a bandage around his neck.

    "If Hoevels had hit an artery or cut slightly deeper, he would have died onstage," a doctor said.

    Managers of non-domestic premises must also ensure they act upon anyinformation about asbestos, which they may hold.

    The warning follows a serious incident in which at least 15 tradesmenwere exposed to airborne asbestos fibres over almost two months duringa major refurbishment of the former Ballroom nightclub, Carnegie Drive,Dunfermline in 2005.

    Dean Entertainments Ltd, 191 Nicol Street, Kirkcaldy was fined 28,000and Edward Dean Melville a director of the company was fined 7,000 at

    Dunfermline Sheriff Court today (Tuesday 9 December, 2008) after bothpleading guilty to charges under section 3(1) and section 37(1) of theHealth and Safety at Work Act respectively.

    Dean Entertainments Ltd contracted Ainslie Homes Ltd to act as PrincipalContractor for the project at the Ballroom. Ainslie Homes Ltd and DeanEntertainments Ltd both share the same business address and MrMelville is a director for both companies.

    This was a major refurbishment, which required the involvement of anumber of different trades. The work included the demolition of existingpartitions, the installation of a new stairway, an extension to an existingmezzanine level and the installation of a new lift. All of this work involvedsignificant disturbance of the fabric of the building.

    Work continued on the project despite concerns being raised by thetradesmen about the possible presence of asbestos within the building.Work was stopped by HSE after they were contacted directly by one ofthe site workers.

    HSE Principal inspector Jim Skilling commented after the case:

    "This was a very serious incident which allowed a significant number oftradesmen to be exposed to airborne asbestos fibres over an extendedperiod.

    "The effects of exposure to asbestos fibres can take as long as 20 to 30years to manifest themselves. Almost 4,000 people are dying every year

    due to unrecognised exposure to asbestos early in their working lives.Legislation came into force in May 2004, which requires the person incontrol of any non-domestic premises to identify and assess asbestos inthose premises.

    "Dean Entertainments Ltd and Mr Melville failed to establish if asbestoswas present within the Ballroom prior to allowing work to commence,despite being informed on at least two occasions that a survey had to becarried out. Mr Melville was unable to provide any evidence to support hisargument that there was no asbestos in the building. He also failed todeal correctly with concerns, voiced on a number of occasions, fromthose working within the building about the possible presence ofasbestos.

    "He used a contractor, who did not have an asbestos removal licence, toremove almost a quarter of a tonne of material from the Ballroom site.Even then the material was identified on a waste disposal site documentas asbestos."

    Suspended sentence for hotel owner w ho flouted thelaw The Health and Safety Executive (HSE) today (Thursday 11) warnedcompanies to comply with their notices after a Lincolnshire hotel ownerwas sentenced for a number of offences.

    Kulwinder Bola, owner of the Royal Renaissance Hotel in Skegness, wasfound guilty on Tuesday 28 October of ignoring a prohibition noticeissued by the HSE.

    He was also found guilty of employing an unregistered gas fitter to installpipework and gas catering appliances and failing to appoint a planningsupervisor in respect of the project to refurbish the hotel.

    Today (Thursday, 11 December) at Skegness Magistrates' Court, Mr Bolareceived a 12 week custodial sentence, suspended for 1 year for ignoringthe HSE prohibition notice. He was also ordered to carry out 200 hours ofcommunity service within the year and to pay the full court costs of20,623. Mr Bola received a conditional discharge for the other twocharges.

    The three charges resulted from an HSE inspector's site visit in July 2006.

    Mr Bola was found guilty of breaching Regulation 6 (1) of theConstruction (Design and Management) Regulations 1994; Regulation 4of the Gas Safety (Installation and Use) Regulations 1998; and section 22of the Hea lth & Sa fe ty a t Work e tc Ac t 1974.

    HSE inspector Judith McNulty-Green said:

    "It is extremely important that gas appliances and pipework are installedby a CORGI-registered fitter. Always use a registered fitter. It is easy tocheck if a fitter is registered as there is a free phone number to call or youcan check on the CORGI website. Never be tempted to cut corners orsave money - you will be putting your health, or even your life, at risk.Every year 20 people lose their lives from carbon monoxide poisoning.

    "When the inspector visited the hotel on 4 July 2006 a number of itemswere found to be immediately dangerous, including the gas supply toappliances. Four appliances were fitted with flues and required extractionbut no extraction system was operational. Due to the danger of carbonmonoxide, those appliances were disconnected from the gas supply anda prohibition notice was served banning their use.

    "However, the defendant told his chefs they could use the bannedequipment.

    "HSE takes very seriously breaches of notices. Ignoring the ban wasextremely dangerous and posed a serious risk to employees at the hotel.I agree with District Judge Blake's comments that notices are issued tokeep people and places safe and this sentence sends out an importantmessage."

    Warning over 'kidnapping phenomenon'Kidnapping for ransom is becoming a "global phenomenon", leavinginternational businessmen at an ever greater risk of being kidnapped, areport has suggested.

    With recent news of Somalian pirates targeting the shipping industry, andNigerian gangs abducting oil workers, risk consultancy Contro l Risks said that new kidnap "hotspots" will emerge as the number of incidentsaround the world increases.

    Analyst Jonathan Wood said that it is becoming vital for businesses tofully understand the security risks in each country, as more and moreextremist groups are using kidnapping to raise funds.

    He added: "Allowing for differences of motivation and method, kidnap hasbecome much more of a global issue and new hotspots are likely toemerge in 2009.

    "It has never been more important for business to understand thedynamics underlying security issues in each country of operation."

    The countries most affected by kidnapping for ransom are Pakistan,Mexico, Venezuela, Nigeria, India, Afghanistan, Colombia, Somalia,Brazil and the Philippines.

    Control Risks said 2009 would be "a year of profound change andturbulence" due to a combination of factors - including the worldwiderecession, a new President in the White House and concerns over a lackof food - that would fuel uncertainty.

    Buncefield explosion may cost 1bnAccording to the final report on the Buncefield oil depot explosion the cost

    of the incident could reach 1 billion.

    The report, which has been published on the third anniversary of theexplosion which injured 43 people, examines the economicconsequences of the blast at the depot near Hemel Hempstead,Hertfordshire.

    The explosion was caused by an overflowing fuel storage tank at thedepot and forced 2,000 people to be evacuated from their homes.

    Earlier this month the Health and Safety Executive (HSE) made thedecision to prosecute five companies over the incident.

    The report, by the Buncefield Major Incident Investigation Board (MIIB),

    shows that a large part of the cost is "made up predominantly ofcompensation claims against the site operators".

    The board's chairman, Lord New ton of Bra in t ree , said: "This finalreport provides an authoritative summary of the incident and of theboard's role and work, and brings together for the first time our 78recommendations into one place."

    HSE chairwoman Jud i th Hack i t t welcomed the report and said: "Thework of the MIIB has already had a major impact on the way safety andenvironmental risks are controlled at similar sites and in ensuringimproved resilience."

    The Sago Mine, where 12 miners died in West Virginias worst coalmining accident in four decades, will be closed permanently early next

    year, its owner said Friday.

    for more than 40 hours in an atmosphere poisoned with carbonmonoxide. Only one man from the second team, Randal McCloy Jr., wasfound alive.

    The tragedy was compounded by initial reports that rescuers had found12 survivors, before the hopes of family members were dashed by wordthat only McCloy was alive.

    Fridays announcement brought back painful memories for John Groves,whose brother Jerry was one of 12 men who died in the mine.

    Groves said he "felt like someone punched me in the gut" and thoughtnot only of his brother, but also of the Utah miners whose bodies haveremained entombed in the Crandall Canyon mine since its collapse lastyear.

    "Im sure there are a lot of people who will be happy that its beingsealed," Groves said. "But thats the first thing that popped into my mind."

    "Our men are out, and they got the proper burial," he said. "But in a way,their spirits are still there."

    McCloy, through a family spokeswoman, declined comment Friday.

    The explosion, along with two other high-profile accidents, prompted

    sweeping federal and state mine safety legislation that is still beingimplemented in the industry.

    Mines now are required to build far stronger seals at openings toabandoned sections where methane can accumulate and store extrasupplies of emergency air underground, among other things.

    "Its a part of our history now and a very big part of the culture of our lawsand regulations," said West Virginia mine safety chief Ron Wooten."Sago is not a name that will be forgotten by anyone who was living inWest Virginia...on Jan. 2, 2006."

    Tesco takes rap after w orker loses fingertipsA Tesco employee had part of two fingers chopped off when he put hishand inside a faulty dough-dividing machine.

    The incident happened on 22 February 2007 at the in-store bakery in aTesco store in Cheltenham. An employee put his hand inside the hopperof the machine, in order to clear some dough, but the power supply hadnot been cut and the machine activated, slicing the top section from twofingers on his right hand.

    An investigation into the incident revealed that the interlock switch hadbecome unattached from the side of the machine. Tesco was aware ofthe fault and the interlock was re-attached to the machine by tying ittogether with a plastic bag. This allowed the device to operate when thelid was open and meant that the power supply was live when the

    Tesco pleaded guilty at Cheltenham Magistrates Court on 8 December tobreaching s2(1) of the HSWA 197 4 and was fined 15,000. It alsopleaded guilty to breaching reg11(1) of the Provision and Use ofWork Equipment Regulat ions 1998 and was fined 5000. The firmwas ordered to pay 20,000 costs to Gloucester City Council, whichprosecuted the case.

    In mitigation, Tesco said it deeply regretted the accident and said it wasan isolated incident. It told the court that the machine has now been

    taken out of service and employees have been retrained on how to usesimilar machines.

    Gloucester City Council senior environmental health officer, Ed Pomfret,told SHP: We hope this will serve as a warning to other businesses;interlocks are there for a reason and should not be by-passed. As thiscase shows, accidents unfortunately still happen even in largercompanies with policies and procedures where such failures are found.

    Worker crushed by giant ovenA worker was seriously injured after an industrial oven weighing overthree-quarters of a ton fell on him.

    Newcastle-under-Lyme Magistrates Court heard that a 22-year-old manwas working at an industrial oven manufacturers factory in Rowhurst

    when the accident occurred on 18 January 2008. He and threecolleagues were moving a partially-built oven using two pallet trucksunderneath the narrow side of the oven.

    Once the oven had been transported across the workshop it was loweredon to steel blocks for support. The workmen noticed that the leadingpallet truck was trapped underneath a second oven, but were unable todislodge it. The trailing pallet truck was moved to the front of the firstoven so that the other pallet truck could be removed.

    One of the workmen stood behind the first oven to steady it, while hiscolleagues tried to dislodge the leading pallet truck. While the secondpallet truck was being placed underneath the oven, its forks struck a partof the unit, and caused it to become unstable and topple backwards. The

    oven fell towards the employee who was steadying it and struck a muchlarger oven, before sliding down and landing on top of the workman.

    The mans left foot was broken in three places and all of his toes weredislocated. He was rushed to hospital and has since made a full recovery.

    Caltherm (UK) Ltd, who employed the man, pleaded guilty on 9December to breaching s2(1) of the HSWA 1974 . Magistrates fined thefirm 10,000 and ordered it to pay costs of 3377.

    In mitigation Caltherm told the court that it deeply regretted the incidentand introduced a safe system of work following the accident. It also saidthat it had no previous accident history and the HSE had never takenaction against it before.

    HSE inspector Wayne Owen told SHP: The lack of a risk assessment,suitable instruction, information, training or planning, together with theuse of unsuitable equipment, all contributed to an unsafe system of work,which led to the accident.

    The HSE produces a wide range of free and priced guidance to assistcompanies who carry out lifting and moving operations. If followed, thesepublications contain guidance, which would have prevented the accident.

    Explosion at Russian Arctic mine kills 12At least 12 people died in an overnight blast at a Soviet-era mine in ArcticRussia that extracts raw materials for fertiliser production, theEmergencies Ministry said today.

    "At the moment we know that 12 people died. Five were injured and theyare in hospital," said Irina Gretskaya, spokeswoman for the ministry in theArctic city of Murmansk.

    "There were 18 people in the mine when the accident happened, so wedo not know about one miner. The reasons are still being investigated."

    The mine is operated by a company called Apatit, a major Russianproducer of the phosphate mineral apatite used in making fertiliser. Apatitis part of the PhosAgro fertiliser group.

    Russia's mining safety watchdog said it had begun an investigation intothe explosion at the Rasvumchorrsky mine. A recovery operation toretrieve bodies is under way.

    Last year 110 people died in a blast in a Siberian coal mine - Russia'sworst mining accident in recent years.

    Years of neglect after the 1991 collapse of the Soviet Union have madeRussia's mines, which employ a quarter of a million people, among themost dangerous in the world.

    HSE warns of dangers after man loses part of his legThe Health and Safety Executive (HSE) is warning constructioncompanies to ensure they provide safe systems of work after part of amans leg was amputated when a tipper truck fell onto him, trapping himagainst a pile of brick rubble.

    M.J.Curle Ltd, of Naird Lane, Shifnal, was fined 5,000 and ordered topay costs of 7,500 at Shrewsbury Crown Court on Friday 5th December2008, after pleading guilty to breaching section 3(1) of the Heal th andSa fe ty a t Work e t c Ac t 1974 .

    Principal site contractor Anthony Wilson Homes Ltd, of Park Street,Shifnal, pleaded guilty, at an earlier hearing, to breaching sections 2(1)and 3(1) of the Heal th and Safety a t Work etc Act 1974 andRegulation 3(1)(a) of the Management o f Heal t h and Safety a t Work Regulat ions 1999 . The court imposed a fine of 25,000 withcosts of 10,000 on Anthony Wilson Homes Ltd for its greaterresponsibility for the lack of site safety and heard that the company hadgone into liquidation.

    The HSE investigation commenced after an incident on 24th May 2005,when a tipper truck carrying tar-covered road-rubble on the JerninghamArms site in Park Street, toppled onto its side trapping a workman by hisfoot, necessitating amputation of part of his left leg.

    HSE inspector Katharine Walker said:

    "All employers have a responsibility to ensure that safe working practicesare in place and that suitable risk assessments are undertaken becausefailure to do so could cost lives, as well as result in enforcement actionfrom HSE. In this instance a man lost part of a limb and his life has beendramatically affected because of these failings."

    HSE announces tyre handling w orkshopsA countrywide series of workshops to draw attention to the dangers ofhandling tyres is being staged by the Health and Safety Executive (HSE)in conjunction with the tyre Industry.

    HSE, working with the Nat ional Tyre Dist r ibut ors Associa t ion (NTDA ) and the Br i t ish Tyre Manufact urers Associa t ion (BTMA), will run six workshops about tyre handling during January toMarch 2009. NTDA Director Richard Edy said: [1]

    NTDA research shows that back injuries caused by lifting tyresincorrectly are responsible for a huge number of lost man-hours in our

    sector and we are delighted to be working with the HSE to highlight thedangers to the trade.

    Abid Dost, BTMAs Health, Safety and Environment Director said:BTMA has worked in partnership with HSE to reduce manual handlinginjuries for more than 10 years. These seminars are a golden opportunityto benefit from the distilled knowledge and experience gathered over theyears, and acquire the tools to reduce the costs of manual handlinginjuries.

    HSEs Terry Aston, who is also Chair of RUBIAC (Rubber IndustryAdvisory Committee), said:

    Moving and fitting tyres involves a lot of manual handling; back and othermuscular injuries are common. The cost to employers is considerable sowe are pleased to work with the industry to have the opportunity topromote best practice. Well reacha wide audience in the UK.

    The number of injury accidents has reduced by 6.3% compared with2006/07, and the overall injury rate per 100,000 employees hasdecreased by 6.2%, reflecting the maintained levels of activity offshorelast year and the reduced numbers of over-3-day injuries.

    Second Person Dies after Refinery ExplosionAn explosion and fire on Nov. 20 at a refinery in Tyler has claimed a

    second life.Jim Hammett of Tyler died Thursday at Parkland Memorial Hospital inDallas, one day before he would have turned 53.

    Parkland administrative assistant Connie Booth confirmed the death toThe Associated Press, but provided no other details.

    The Nov. 20 explosion at the Delek Refining Ltd. plant is underinvestigation.

    James Dale Sharman, 49, died the day after the explosion.

    Refinery manager Frank Simmons, in a statement released after

    Hammett's death, said he and others were "deeply saddened by thepassing of our dear friend and colleague."

    Simmons said Delek is working closely with the Occupational Safety andHealth Administration to fully investigate the cause and origin of theaccident.

    He said Delek's top priority remains the safety of staff and contractors.

    The mans 20-year-old son, who was standing at the rear of the truckwhen it exploded, told firefighters that his father was welding the tankwhen the blast occurred.

    The victims son suffered minor injuries. He told firefighters that his fatherwas an experienced welder and he was working with his him as anapprentice.

    Witnesses said the explosion was so severe that parts of the truck wentthrough the air and landed in front of the building.

    No other injuries were reported.

    Lt. Arnold Piedrahita of Miami-Dade Fire Rescue said the cause of theexplosion is under investigation.

    Boots in court over toddler's fractured skull High street chemist Boots has been handed a 6500 fine after a toddlerwas hit by a rolling pin falling from the window of one its stores.

    The incident happened at the retailer's store in Dundee city centre in Aprilthis year. An employee on the third floor of the building was washing upthe rolling pin, which weighed at least two kilograms, when she dropped itand it fell out of the louvred window.

    The rolling pin struck a 20-month-old girl in the street below and she

    suffered a fractured skull and internal bleeding.

    Harry Boyle, for Boots, told Dundee Sheriff Court the window openingwas only slightly wider that the rolling pin "so it was extremely unlucky".

    "It slipped very gently out of the employee's hands and was on thewindow sill for an agonising second. She reached for it but didn't getthere in time. It unfortunately fell and struck the pram."

    Boyle said the incident was due to an organisational failure and was notthe employee's fault. He noted that Boots - which operates 2400 storesand has 70,000 staff - has had only four health and safety convictions inthe past 10 years.

    Imposing the 6500 fine, Sheriff Elizabeth Munro accepted that theretailer's safety record was "relatively good".

    She added: "It is appropriate to record the fact that no criminal penaltyshould be putting a value on the trauma caused to this girl's family. Thatis a job for the civil courts."

    The family of the injured girl has launched a civil claim against Boots,which has admitted liability.

    HSE adds new sample risk assessments

    As part of its ongoing efforts to simplify basic health and safety forsmaller firms, the HSE has added to its stock of example riskassessments for different types of premises.

    A charity shop, a motor vehicle bodyshop and factory maintenance workjoin the list of free sample assessments, which employers can adapt andexpand for their own workplaces.

    The HSE says the assessments are intended to show businesses what a"good enough" risk assessment looks like, but stresses they areexamples and should not be adopted wholesale without thought aboutthe particular conditions in individual workplaces.

    Teenager falls from scaffold while working at moorhotelAn injured teenage worker had to be rescued by fire crews after fallingdown scaffolding at a hotel near Plymouth.

    The boy suffered a broken leg when he fell from the second to first flooron scaffolding outside the Devon Tors Hotel in Yelverton at 3pmyesterday.

    It is believed he was working on the exterior of the building with others.

    The ambulance service was called and paramedics attended to thepatient, who was about 10ft from the ground.

    One fire crew from Yelverton and one from Crownhill attended andrequested the aerial ladder platform from Camels Head to gain access tothe casualty.

    A spokesman from the Crownhill crew said: "The young lad, who wasabout 16 or 17 years old, was stuck about 10 feet up on scaffoldingplanks.

    "He was conscious and did not seem to be in a lot of pain. Theparamedics placed his leg in a splint and, for safety, we requested the

    Man seriously injured in 50ft fallA teenager was rushed to hospital after falling 50 feet from scaffolding.

    An Air Ambulance helicopter was scrambled to the scene at SussexManor Business Park, Manor Royal, where the man had sustainedserious injuries to his back, hip and wrist.

    But the 19-year-old Mattison Scaffolding employee was instead taken toEast Surrey Hospital by a standard 'land' ambulance at around 11amtoday (Wednesday December 3).

    Andy Webber, a project manager for Monier UK which leases thebuilding, said: "We think the gentleman has fallen through the roof. "He'sfallen a long way and we can only assume he has suffered seriousinjuries.

    "Obviously the company's thoughts are with the gentleman and we hopehe will be okay. We will carry out an internal investigation after the policecomplete theirs."

    "The government's Health and Safety Executive (HSE) has beeninformed.

    A Sussex Police spokeswoman said: "Police are investigating thecircumstances leading up to a man sustaining injuries at a unit on theSussex Manor Industrial Estate.

    "It is anticipated that a joint Sussex Police and HSE investigation willfollow."
