    As the April federali n c o m e t a x fi l i n g deadline approaches,millions of Americansare sitting down andsorting through dozens offorms to determine howmuch money they oweUncle Sam or, howmuch of a refund theywill get this year. One oft h o s e f o r m s , t h eM o r t g a g e I n t e r e s tStatement Form 1098,can mean big savings forhome owners at tax time.

    Form 1098, which homeowners receive from theirlenders, shows the total

    a m o u n t o f h o m emortgage interest paidduring the year. Homeowners who itemize theirf edera l i ncome taxdeductions can deduct100 percent of theirm o r t g a g e i n t e r e s tpayments on a first orsecond home for up to $1million of mortgagedebt. They can also

    deduct the interest paid on up to $100,000 ofhome equity loans.

    For most home owners, this means they candeduct ALL of the mortgage interest theyvepaid on their home each year.

    The ability to deduct home mortgage andhome equity loan interest isnt the only taxbenefit for home owners.

    The three most important sources of taxsavings for home owners are:

    Deductions for mortgage interest

    Deductions for real estate taxes

    The capital gains exclusion for the sale of aprincipal residence

    Home owners are also able to deduct the stateand local real estate taxes they pay each year onan owner-occupied home.

    When it is time to sell a home, in many cases

    home owners dont have to pay capital gains taxon the profit from the sale. Under present law,married couples who have owned and occupiedtheir principal residence for at least two of thepast five years do not have to pay any taxes onthe first $500,000 in profits from the sale oftheir home. Single filers earn up to $250,000tax free.

    Another deduction home owners may be ableto take is for mortgage insurance premiums.Generally, people who purchase a homewithout putting 20 percent down have to buymortgage insurance, and those premiums canalso be deducted from taxable income.

    Even home owners who dont use the home astheir principal residence and rent it out may beable enjoy some tax benefits, including interestand depreciation deductions.

    Buying a home offers tax savings that can addup to tens of thousands of dollars over severalyears. Home owners rely on the mortgage

    interest deduction each year to helpoffset the costs of homeownershipand prospective buyers take thededuction into consideration whenchoosing homeownership overrenting.

    But the mortgage interest deduction,which has been included in the taxcode for about 100 years, is ind a n g e r. A n a t i o n a l d e fi c i t

    commission has proposed reducingor eliminating the deduction as partof a restructuring of the tax code.

    Local Housing & Economic Forecast Seminar

    On February 1st, HBAR hosted its annual Local

    Forecast Seminar at the Holiday Inn Koger Center.

    The event was well attended and included

    presentations by David Crowe of the National

    Association of Home Builders and Lloyd Poe of

    LifeStyle Builders. This years speakers provided

    I am often asked by NAHB

    members and non-members

    a l i k e w h a t v a l u e t h e

    assoc iat ion provides formembers. So today I want to

    go right to the numbers on the

    bottom line of the ledger and

    tell you how NAHBs advocacy

    efforts save money for builders.

    Of course, membership in

    NAHB is about a lot more

    than just dollars and cents. Its

    about networking. Its about

    industry-specific education

    programs you cant findanywhere else. And its about

    knowing that there will always

    be someone there to help you

    when you need assistance. Its

    very difficult to put a dollar

    value on benefits like that, but

    we can put a dollar value on

    advocacy. And let me tell you,

    its a very big number - $5.7

    billion. Yes, thats billion with

    a capital B. NAHBs advocacy

    efforts in 2011 on Capitol Hill

    and with regulatory agencies

    will provide members with $5.7

    billion in either reduced costs or

    increased revenues this year.

    Those savings fall into eight

    broad categories:

    FHA loan limits

    Environmental Protection

    Agency actions

    Building codes

    OSHA

    Building materials

    The tax code

    HUD multifamily programs

    Fish and Wildlife Service

    Let me give you just a fewexamples of the savings.

    Restoration of Higher FHA

    Loan Limits

    Ill begin with reinstatement of

    FHA loan limits. This represents

    the largest share of savings for

    builders -- $1.9 billion. In late

    2011, Congress allowed higher

    FHA loan limits that were in

    effect in 2010 and 2011 to

    expire. Later, after an intense

    campaign by NAHB, the higher

    FHA loan limits were reinstated.

    Home builders would have lost

    more than 6,000 new home

    sales this year if the higher loan

    limits had not been reinstated.

    In all, NAHBs action on the

    FHA loan limits saved builders

    just over $1.9 billion.

    Environmental Protection Agency

    The next largest savings $1.4 billion

    are due to NAHBs actions related to

    regulations and requirements imposed

    by the Environmental Protection

    Agency. Following regulatory and legal

    challenges by NAHB, the Environmental

    Protection Agency admitted that thegovernment did not have sufficient data

    to support a numeric limit for

    stormwater discharges. EPA then

    withdrew its proposed numeric limit, an

    action that will save builders $1.2 billion

    this year. A different EPA action

    affecting remodeling will save $240

    million this year. EPA proposed a

    requirement that a third-party test for

    lead be conducted following professional

    remodeling of homes built before 1978.

    NAHB argued that EPA had already

    imposed a regu la t ion that a l l

    professional remodelers must be trained

    in lead abatement procedures, so the

    sw ipe t e s t r e qu i r e me nt was

    unnecessary.

    Moreover, the higher costs associated

    with the test would cause some people

    who would otherwise use the services of

    a professional trained in lead paint

    remediation to do the work themselves

    or hire an UNcertified contractor.

    In response to NAHBs concerns, EPA

    later withdrew the proposal.

    At $260 per remodeled room, requiring

    the test would have cost professional

    remodelers $240 million this year.

    Tax Code

    The expanded 1099 reporting requirement in the tax code would have required companies to file a 1099 form for

    every corporate purchase over $600. NAHB strongly objected to the reporting requirement, and it was removed,

    saving members $140 million.

    Conclusion

    Theres no question that $5.7 billion is a very impressive number. But that really is just a fraction of the value thatNAHB provides. Members tell us time and again that the three things they value most from NAHB are

    advocacy, education and networking opportunities. From the 20 Clubs to informal contacts with fellow

    members at local and state events and the IBS, NAHB provides superb networking opportunities. Likewise, our

    highly-regarded educational programs are offered by local associations, at events like the Green Building

    Conference, at the International Builders Show and increasingly on the Internet. And I think we all know the

    value of calling the EO at our

    local or state association or

    talking to staff in Washington to

    get answers to the questions that

    keep us awake at night.

    The bottom line is that NAHB

    membership is the best possible

    investment you can make in your

    business and your future. You

    cant argue with the return on

    your membership investment. At

    every level from the local HBA

    to the state HBA to NAHB

    headquarters in Washington

    helping members stay in business

    and thrive is our top priority. You

    have 240 staff working on yourbehalf developing educational

    programs, creating networking

    opportunities and representing

    your interests in very challenging

    legislative and regulatory arenas.

    They are working hard to ensure

    that you can do what you like best

    build homes. Your 80-person

    Advocacy staff at NAHB includes

    lobbyists, lawyers, regulatory

    professionals, economists and

    public affairs specialists deliveringvalue on your member dollars

    every day, every hour. The $150

    of your membership dues that

    focuses on organizing multiple events each year including the Fall

    THE NEWS OF HBAR VOLUME 6 JULY/AUGUST 2011

    HBAV joined the fight "against" the eminent domain

    Constitutional Amendment (HJ 3 and SJ 3) because HBAV

    and many other business organizations and local

    governments interpret it to not allow local governments or

    their water and sewer authorities to use that power to

    expand their public water and sewer systems. The

    proposed Constitutional Amendment also appears to create

    substantial uncertainty as to the viability of major

    transportation and vital public and private infrastructure

    projects in the Commonwealth.

    Also opposing the House Joint Resolution 3, by

    Delegate Rob Bell and Senate Joint Resolution 3, by

    Senator Mark Obenshain are the Virginia Association

    of Realtors (VAR), the

    Northern Virginia Chamber of

    Commerce Partnership, the

    Virginia Association of

    Commercial Real Estate,

    Virginia Beach Vision, the

    Virginia Society of Engineers,

    the American Council of

    Engineering Companies and

    many other local Chambers of

    Commerce and business

    organizations and Economic

    Development based

    associations.

    Ironically, for decades, HBAV

    and the VAR have been the

    "LEADING" defenders of

    personal property rights with

    the members of the Virginia

    General Assembly.

    Despite the business community opposition, this

    week the House of Delegates overwhelmingly

    passed HJ 3 on an 80 to 18 vote, and the

    Constitutional Amendment (SJ 3) passed the State

    Senate on a 23 to 17 vote. Most capitol observers

    broadly anticipated the House passage in the

    more conservative lower chamber, but we were

    hopeful the Amendment could have been stopped

    or amended to correct the flaws in the more

    moderate State Senate.

    Fortunately, progressive builders have the option of

    3rd party expertise. The right Warranty Management

    expert can increase prospect/buyer confidence and

    reduce the substantial costs of providing their new

    home warranty.

    Cost conscious builders CARE (Consistent,Appropriate, Response, Expectations)

    In todays economic environment its more important

    than ever to know exactly what every aspect of your

    A warranty management program should also have

    other benefits to the builders. Once the management

    company begins tracking warranty issues it canprovide the builder information on their most

    common problems and how to identify them. It

    should tell the builder where they have consistent

    issues and where they have problems with

    subcontractors and offer suggested solutions.

    A Coordinated Transfer of Ownership Responsibility

    A well managed Warranty Management system will

    tactfully convey the message; Congratulations, you

    now own the home and not the builder, therefore you

    are responsible for maintenance and normal wear and

    tear on the home. A professional 3rd party WarrantyManagement provider can help establish reasonable

    expectations and provide credibility to both the

    builder and the buyer. Reasonable, documented

    expectations result in fair and equitable resolutions to

    service requests. 3rd party expertise mitigates

    apprehension and encourages a continued positive

    builder/buyer relationship long after the closing. Well

    documented requests and resolutions improve quality

    control, efficiency, and subcontractor management.

    February 23 at the YMCAs Annual Meeting and Strengthening Communities Fund Kickoff.

    The Corporate Leadership Award recognizes a corporation that exemplifies community service. With a focus on
