    When a man decides to start working

    he does so for two reasons. One rea-son revolves around a career, while

    the other revolves around money.

    Money is a necessity, but when a

    man gets his hands on this necessity,

    the necessity almost inevitably be-

    comes greed. Sadly, man does not

    greed for just money; his greed can

    also extend to power and property.

    Greed, only up to a certain point can

    be justified, beyond that certain point;

    money hungry. In their mind the end

    will always justify the means. And

    soon others will join him in his greed.

    WILL THE REAL “FIRST 100, LLC” STAND UP. 

    Is it First 100, LLC- First One Hundred, LLC

    1st One Hundred Holding, LLC, or1st One Hundred Holdings Investment Pool #1, LLC? 

    Which one is the real estate investment firm and debt ser-vicer the Association of Poinciana Villages (APV) had con-tracted with to collect past-due homeowner assessment ac-

    ounts? 

    You'll know in a moment. But for now the rest of the story. 

    Lets start with, someone loves to use variations of “first one hundred.” 

    irst One Hundred LLC, Miami Beach, made a voluntary filing on March 21

    with the Office of the U.S. Trustee in Florida Southern Bankruptcy Court. 

    But according to Jay Bloom, a director with First 100, LLC, thefirm that last had a contract with APV, and is based in Las Vegas,he was more then happy to say that the two firms are separate andunrelated. 

    This is not us, and frankly (the news) may have cost us the contract,” Bloomaid, who noted that the company had already set aside money to re-acquirehe contract to continue working with Poinciana’s past-due holdings. 

    irst One Hundred, LLC, is a Florida Limited Liability Company. First 100,LLC, is a Nevada Limited Liability Company. Two different companies inwo different states.

     

    Bloom is the director of First 100, LLC, of Nevada. The bankruptcy in Flori-a has nothing to do with his company. But hold on the story is not over. 

    Bloom doesn't tell you that there is a company in Florida with the same exactame as his firm in Nevada. He had no need to tell, he wasn't asked. But weave it here for you. 

    Bloom's company, First 100, LLC, is also listed as a foreign (Nevada) limitediability company in the Florida's Department of State, Division of Corpora-ions. This Florida company has the same address as the Nevada company

    nd the same federal tax identification number. 

    According to Florida Statute 605.0902 (1); A f oreign (from outside of Flori-da) limited liability company may not transact business in this state until itbtains a certificate of authority from the department (Florida). 

    What this means is that Bloom's Nevada “First 100, LLC,” could not do busi-ess with the APV unless his company was registered in Florida. Bloom reg-stered his company in Florida on July 10, 2013. However, the Florida Divi-ion of Corporations has revoked its certificate of authorization on September5, 2015. First 100, LLC, can't now do business in Florida anymore. Also ex-ired in Nevada on 4/30/16. Perhaps First 100, LLC, won't be doing business

    his may very well not be bankruptcy. But it looks like a pre- bankruptcy strategy. This may just be a strategy for maging and positioning assets before filing bankruptcy to protect those assets once they do file. This strategy can enabebtor to pay certain creditors that they want or need to be paid over those that they don’t.

    What is going to happen to all the liens against Poinciana properties? Will those accounts now be sold with the addedalues of the outrageously added on fees? Was this the plan from the beginning?

    POINCIANA PARKWAY HAS FINALLY OPENED 

    n April 30, 2016, The Poinciana Parkway finally opened. 

    Parking for the grand opening celebration was at Deerwood Ele-mentary and it overflowed to Koa Elementary. Shuttle vans provid-ed by Osceola County Council on Aging provided transportation. 

    The road was completed in a partnership involving Polk County,Osceola County, the Osceola County Expressway Authority, Ava-tar and the Florida Department of Transportation. 

    But before opening there was a celebration that included a 5k run.resent were many elected officials and political candidates 

    he road will provide drivers with a way to go north from Marigold Avenue to U.S. Highway 17-92. 

    he toll will be $1.75 each way, but for the entire month of May it is free. 

    here are no toll booths on the Poinciana Parkway. 

    oinciana Parkway will feature all electronic tolling, for the greatest customer conveniencend traffic flow efficiency. Motorists will pay their tolls with an E-PASS or via the Pay bylate program for those without a transponder. There will be no cash options. 

    f you need a transponder you go the Central Florida Expressway Authority (CFX) website (www.cfxway.com) to orne, which is provided at no cost.

    ome of the benefits of becoming an E-PASS customer?

     E-PASS customers pay less on most tolls than those paying with cash. 

     Monthly discounts per transponder. 

     Account holders also save when they drive on other toll roads in Florida, saving approximately 23% or more atmost toll plazas.

     

     E-PASS saves time enabling motorists to drive at posted highway speeds rather than stopping at the toll plazas.

     Account holders can use their transponders to pay for parking at Orlando International Airport. 

    unPass transponders also work, but if people use E-Pass the tolls go directly to the expresswayuthority. 

    oinciana Parkway is projected to carry 6,500 vehicles a day initially, but traffic is expected to grow to 10,700 ehicles a day by 2020. 

    nder the terms of an agreement CFX, the regional authority will take over toll collections, operations, and manage-ment of Poinciana Parkway.

    What about Poinciana Parkway in Polk County? here is a road in Polk County Poinciana Village 7 called Poinciana Parkway. It connects the southern part of Marigvenue with Lake Hatchineha road. Same name but different road. The road will be renamed Marigold Avenue.

    What impact will these project have on Poinciana Property Values? ews reports have indicated that these projects are already causing Poinciana property values to increase. Some repo

    ven as much as 25%. 

    The positives are overwhelming," said Tony Iorio, an executive with AV Homes, Poinciana's develoand a company formerly known as Avatar. 

    He said his company had originally planned to open the road by 2008, but scrapped their plans whenthe recession hit. By then they had already spent about $50 million securing right of way and permitfor the project, which crosses a portion of the Reedy Creek Swamp. 

    As part of the deal AV Homes gave Polk County a 9.8 acres parcel of land designated as a "public sty site" in Poinciana's village 7. Polk county is currently constructing a firehouse at that location.

    FOUL ODOR FROM TOHO WATER TREATMENT PLANT NEEDS ATTENTION 

    The residents of Poinciana's village 7 are mad as hell because of TOHO Wate

    Authority. Mad and upset because of the putrid foul odor from the TOHO La

    Marion Waste Water Treatment Plant or because of the plant. 

    The residents of Poinciana are calling on our elected officials and TOHO to e

    nate this condition. The residents of Poinciana should not have to live with th

    awful situation. We are also concerned because of the impact on the schools  parks. 

    o make matters worse TOHO currently has an application for approval with Polk County to increase the plant’s cap

    he plant’s capacity will increase from a current capacity of 1.5 million gallons per day (MPD) to 3 MPD by 2018 an

    om 3 MPD to 6 MPD by 2030 to accommodate growth in the area. 

    OHO's plans do not include a system for reducing the foul odor and with each expansion the situation may get wors

    n many nights the foul odor permeates the neighborhood. Residents have to go indoors and

    ose their doors and windows. The residents driving into the area already know to roll up their

    ndows and shut off the air conditioning to avoid the nauseating stench. 

    OHO's project is on a fast track to being approved by Polk County. To make matters worse cur-

    ntly the county does not require or even recommend an odor abatement system. 

    his condition, caused by TOHO, reduces the property values of homes in the area. But more important, it can be a h

    zard to the residents. 

    o one can argue with the fact that methane gases decrease the amount of available oxygen in the

    . Nor can anyone argue against the fact that human lungs are only designed to intake oxygen to

    liver fuel to your body's cells. The lungs are not designed to process methane, smoke, water or

    ything else. Methane can act as a simple asphyxiant by displacing oxygen in the blood. Miners

    eviously placed canaries in deep mines to check methane gas levels. Reportedly, when canarieseled over it was time to leave. 

    ccording to the American Conference of Governmental Industrial Hygienists (ACGIH 2004), methane has the poten

    r cardiac sensitization (ACGIH, 2004) and central nervous system depression. Cardiac sensitizers may cause the sud

    set of arrhythmias (irregular heartbeats) and possible death due to over -sensitization to adrenaline produced by the

    dy. 

    ethane may or may not cause cancer or birth defects. The National Institute for Occupation Safety and Health states

    information is currently available on methane's potential to cause cancer or birth defects. 

    hese days, methane is often in the news because it is prone of the primary “greenhouse gases.” It is second only to c

    n dioxide in its contribution to global warming and every effort should be made to reduce methane emissions. 

    he county should encourage TOHO to come up with a system to reduce emissions, advance recovery, and use oppor

    s. 

    OHO should reduce methane emissions, advance the abatement, recovery, and use of methane as a valuable clean en

    urce –  a potential sources of renewable energy. 

    OHO must address this quality of life situation and has a fiduciary duty to the residents to mitigate this problem. 

    hn Perez, the president of HACER, and others have filed complaints with TOHO and the Florida Department of En

    nmental Protection. Polk County Commissioner Todd Dantzler and TOHO Executive Director Brian Wheeler will

    o this matter and hopefully resolve the problem.
