General Rules and Regulations As revised May 2, 2021

• Any and all exterior modifications to the units require the submission of Architectural Review Form and subsequent approval of an Architectural Variance before proceeding with work. Modifications made without submission and approval are subject to restoring the exterior to the original conditions as required by the Gwynedd Pointe Homeowners Association.

• No person who is an agent for an outside commercial interest will be allowed to solicit in person within the Gwynedd Pointe development.

• The term “unit owner” as used in these Rules and Regulations shall be considered to apply to

tenants and/or occupants of unit owners.

• Sidewalks and walkways in Gwynedd Pointe cannot be obstructed in any manner or used for any purposes other than pedestrian traffic.

• Bicycles, scooters, baby carriages, toys, basketball stands or other personal articles are not allowed to stand unattended on any part of sidewalk or traffic ways.

• Temporary structures, trailers, tents, playhouses, swing sets, swimming pools and the like are not to stand unattended or overnight in or about the common areas & homeowner’s driveways without prior Board approval.

• No person will make or permit any soot, odor, noises, loud foul language or vibrations (e.g. playing late at night, stereos, televisions, vehicles, etc.) that will unreasonably disturb, disrupt, or annoy the occupants of any of the other unit, or do or permit anything to be done which will unreasonably interfere with the rights, comfort or convenience of the other unit owners.

• No noxious or offensive activity (including but not limited to the repair of engines) shall be carried out on, in or upon any Lot or Common Elements (Area) nor shall anything be done therein which may be or become unreasonable annoyance or a nuisance to any other Unit Owner. No loud noises or noxious odors shall be permitted on the Property, and the Executive Board shall have the right to determine in accordance with the Bylaws if any noise, odor, or activity producing such noise, odor or interference constitutes a nuisance. Without limiting the generality of any of the foregoing provisions, no exterior speakers, horns, whistles, bells or other sound devices (other than security devises used exclusively for security purposes). Noisy or smoky vehicles, large power equipment or large power tools, unlicensed off-road motor vehicles or other items which may unreasonably interfere with television or radio reception of any Unit Owner in the Property, shall be located, used or placed on any portion of the Property, or exposed to the view of other Unit Owners without the prior written approval of the Architectural Committee. (see EXHIBIT N – page 23)

• No commercial vehicles or trucks, except non-commercial pickup trucks or vans of a one ton capacity or less, shall be parked on or about any Lot, Common space or Association Roadway.

• No boats, trailers or recreational vehicles, including but not limited to snowmobiles and all-terrain vehicles, shall be stored on or about any Lot, Common Space or Association Roadway. Exception, the listed vehicles may be stored out of view within the garage of the Townhouse.

• Parking violations by guests will be treated as a violation by the unit owner and subject to the

same fines applicable to the unit owners.

• Parallel parking next to islands, curbside on the courts, or in front of other parked cars is prohibited at all times. Overnight curbside parking by unit owner(s), tenant(s) or guest(s) is not allowed in courts, cul-de-sac areas, and Association property. (see EXHIBIT A – page 9)

• All persons driving a motor vehicle on the property will obey all traffic rules and regulations set

forth in the Pennsylvania Motor Vehicle Code. The speed limit within the traffic ways and common areas is 15 MPH unless otherwise posted. Compliance with the laws assures safety, comfort and convenience of our residents.

• The repair or dead storage of vehicles or equipment (including but not limited to: cars, boats, motorcycles, motorbikes, trailers, etc.) shall not be permitted on the Association property, common designated open space, driveways and lots, including patios. Vehicles that do not have a valid registration and inspection sticker, and are required by state law to have such, are considered abandoned vehicles and are to be removed from Association property. The Board of Directors reserves the right to remove abandoned vehicles from the property after reasonable notice to the unit owner at vehicle owner’s expense. All motorized vehicles are to be parked within the courts. No motorized vehicles are permitted to be parked on lawns or patios.

• No owner or resident shall park, store, or keep on any court or street, any commercial type vehicle or truck (e.g. dump truck, cement mixer truck, delivery van, oil or gas truck, et al) or any recreational vehicle (e.g. camper unit, RV, trailer, motor home, boat, et al) or any vehicles deemed to be a nuisance by the Board of Directors. The above excludes trucks or vans up to and including one-ton trucks when used for personal, non-commercial transportation.

• Turf Area Obstruction – Due to mowing operations, homeowners must not obstruct the turf area. Obstructions include but are not limited to toys, pools, dog chains, etc. and other personal items. If an obstruction exists, the homeowner will be responsible and required to maintain property in obstructed area. This includes grass mowing, line trimming, etc. The homeowner is responsible to remove any obstruction from the turf area so as not to inhibit mowing operations. The landscaper shall not be responsible to remove, relocate or reposition any personal items left in the turf area.

• REAL ESTATE “FOR SALE” SIGN REGULATIONS – (see EXHIBIT B – page 10)

• No bird feeder(s) with the exception of hummingbird feeders.

• Feeding of squirrels and other wildlife is not permitted.

• Trash – Trash must be placed in a suitable sealable container. Wet garbage shall be deposited in the unit owner’s garbage disposal whenever possible. Removal of all large items is the unit owner’s responsibility. Contractor will remove a maximum of one (1) bulk item per month per dwelling unit. Arrangements should be made prior to placing the item out for removal by calling the waste removal service. Refuse shall not be put out for removal until dusk the day preceding scheduled pickup. Unit owners are responsible for assuring that all refuse and recyclables are secure from dumping or blowing out of their containers. (see EXHIBIT S – page 25)

o Owners and residents are responsible for returning trash cans and recycle bins to

their proper storage location as soon as possible on collection day.

o Trash, garbage and rubbish receptacles shall be permitted to be stored and maintained only in the rear yard of a Lot or a garage.

• Retractable Awning Regulation – Awnings shall not be installed or used on any unit except by

prior written approval of the Architectural Committee. (see EXHIBIT C – page 11)

• Ornamental/U.S. Flag – Only one (1) house mounted flag is permitted. The flag, pole, and holder are to be kept in good condition.

• Decorations - Holiday decorations may be displayed between the weekends prior to Thanksgiving

until January 15th (weather permitting).

• Snow removal - Owners shall be responsible for snow removal and cleaning of sidewalk areas and driveways between townhouses and the curb line, whether or not said sidewalk and driveway are located within the right-of-way or of an Association Roadway.

• All Lots and improvements thereon shall be maintained and appear in a neat condition.

• No clothes line, clothes poles, or any outside hanging of clothes shall be permitted.

• Satellite Dish Installation – Homeowners should follow the current rule regarding dish installation.

No other TV or Radio Antennas are permitted. (see EXHIBIT D – page 12)

• Any and all damages caused by a unit owner, their children, tenant or guest to any other unit, unit’s property or common ground or to any other entity owned by the Association shall be paid for by the unit owner deemed responsible for such damages.

• All decks, patios and fences must be maintained by their respective unit owner in a neat and orderly condition at all times.

• Hot tub, spa, Jacuzzi, sauna, whirlpool bath and the like within the patio and deck area is prohibited.

• It is recommended that the rear of each home be marked with the last number of their address. The number is to be 3” in height and to be placed on the right side of their rear ground level entry door, right side as you face the building from the outside. The number should be placed approximately head high and within one foot from the door frame. The number should be black in color and may be either a sticker type or nail on type.

• Shrub and/or Tree:

o No shrub or tree is to be planted in the common area without permission in writing from the Board of Directors.

o No trees or shrubbery may be removed from the common areas without written permission from the Architectural Committee.

o Trees or shrubs planted with permission of the Architectural Committee become property

of the Gwynedd Pointe Homeowner’s Association.

o Trees or shrubs planted without permission of the Architectural Committee are subject to removal at the expense of the violating homeowner.

o Shrubs removed from the unit’s front must be replaced with acceptable foundation

planting within one season.

o It is responsibility of owner to maintain all shrubbery, bushes and trees on their lot. They must be pruned and or trimmed to remove any blocking of walkways and driveways. Lower branches of tree must be removed as well as removing tree growth that touches the unit (s). The Architectural Committee shall determine the maintenance and size requirements for trees.

o Unit owner/resident is responsible for weed control, pruning and maintenance of the

landscaping in their lot.

o The Association is responsible for maintaining all bushes and trees planted in the common areas.

• Planting:

o If unit owners plant in the designated areas around their units, they assume responsibility

for the maintenance of those areas and any damages the plantings may cause.

o Prior approval is not required for the planting of small vegetable gardens (only in the rear of yard close to the foundation bed), flower beds, or up to five (5) additional shrubs.

• Front yard shall not be paved or altered from the original grass sodding. Flowers and plants may

be added among the trees and shrubs of a unit’s area in the area provided, i.e. foundation planting or tree ring planting. No stones.

• Woodpiles – Woodpiles must be stacked neatly and may not be stacked on the ground. (see EXHIBIT E – page 13)

• Exterior lighting – Low voltage and low wattage landscape lighting is acceptable, but must be located in the homeowner’s planting bed. Lighting is not permitted in the turf/grass area. Flood lights of any type, style or size are not permitted. Alterations to any exterior light fixture require written approval from the Architectural Committee. (see EXHIBIT F – page 14)

Property owners shall maintain the paint, fixtures and structural soundness of their units in good condition at all times.

All exterior changes require an Architectural Change Request Form – page 59 submission by unit owners and approval by the Board must be in writing for the Association’s records prior to

work on home. (See all EXHIBITS A-V and Permit & Approval Checklist - page 57)

• Unit owners are responsible for any damage, injury or disturbance caused by pets belonging to themselves, their tenants or visitors

• When outside, pets must be carried or on a leash and be in the control of a responsible person at

all times. No dog chains or lead lines are permitted.

• No electric (invisible fences) are permitted.

• Pets are not permitted to be left outdoors unattended.

• Pets are not permitted to be chained outside to any fixture or secured by any method to the ground with a lead line.

• Pets are not permitted to disturb other unit owners, their tenants or visitors.

• Pet owners are responsible for the immediate removal of their pet’s solid waste from any unit

owner’s property area, deck, patio and/or the common areas. (see EXHIBIT O – page 23)

Enforcement Procedures Reporting Violations All complaints concerning violations of the Rules and Regulations or any provision of the Declaration or By-Laws must be in writing (mail, email, fax). The letter should be sent to the Gwynedd Pointe Homeowners Association Board of Directors. The complaint must be specific in details so that the Board can determine that further investigation is warranted. Any person(s) violating the Declaration, By-Laws, or any Rules and Regulations established for the Gwynedd Pointe Homeowners Association will be subject to the following procedures.

1. The Executive Board will notify the unit owner(s) of any proven, valid violation(s) in writing. In this letter, it will state the appropriate amount of days given to correct the problem/defect in order to avoid a fine.

2. Appeal: A unit owner charged with a violation of the Declaration, By-Laws, or Rules and Regulations of the Gwynedd Pointe Homeowners Association shall have the right to request a hearing by the Executive Board by submitting such a request in writing to the Executive Board within ten (10) days from the date of the original notice of violation.

3. If the violation is not corrected, the Executive Board will impose the following fines:

First Offense Up to $50.00

Second Offense Up to $100.00

Subsequent Offenses Up to $200.00

The unit owner will be notified in writing that their assessment account has been charged and will state the amount of the fine.

4. These fines may be assessed on a per diem or per incident basis at the Board's

discretion depending on the nature and severity of the violation.

5. Legal Actions: In the event a violation is not corrected and/or the fine is not paid, the Board may take legal action to obtain payment of the fine and/or compliance with the regulation. The following costs will be assessed without the ability to waive them thereafter: enforcement costs including court costs, filing fees, attorney's fees, etc. A judgment awarded by the Court, which remains unpaid, constitutes a lien on the homeowner's property.

Exhibit A – Parking Regulations

It is necessary to maintain the Association roadway to promote emergency access. From time to time, emergency service vehicles, i.e., fire, police, ambulance need to enter the Gwynedd Pointe Homeowners Association roadways. In accordance with the Declaration, Article VII, Section 1 (t), a Vehicle Parking Regulation has been established to aid and assist emergency response vehicles.

• There is no curbside parking in community courts – no daily or overnight.

• There is no parking in community thoroughfare which include: - Rolling Hill Drive - Union Court - Colonial Court - Constitution Court - Congress Drive & Court - Plantation Court - Quaker Court - Kenwood Drive & Court - Liberty Court - Evergreen Court - Signal Hill Court - Harvard Drive & Court - Carriage Drive & Court - Old Mill Court - Grist Mill Court

• Private driveways

• Owner’s garage

• Center parking island

Note: Vehicles parked in driveways are not permitted to encroach upon the lawn or sidewalk areas.

Exhibit B – Real Estate “For Sale” Sign Regulation

In accordance with the Declaration, Article VII, Section 1 (m) and (t), a real estate “For Sale” sign regulation has been established in order to not impede the service of or create unnecessary obstruction to the lawn area and maintain grass cutting in all common open space and in any area on the lot that is fenced by the owner, the following real estate “For Sale” and “Open House” sign regulations had been adopted.

1. Each homeowner lot will be permitted to display only one (1) “For Sale” sign. 2. A “For Sale” sign not exceeding six (6) square feet in size may be erected on

homeowner’s lot.

3. The “For Sale” must be placed on homeowner’s lot and must be positioned in an existing planting or shrubbery bed.

4. “For Sale” signs are not permitted in common areas in either the front or rear

of house.

5. “For Sale” sign must be removed from homeowner’s lot within one (1) week after an agreement of sale has been signed.

1. “Open House” signs are permitted to be displayed only if the day of open

house event is on a weekend. 2. “Open House” sign on homeowner’s lot must be positioned in an existing

planting or shrubbery bed.

3. Permitted locations of “Open House” sign for display on common areas:

- Sign within ten (10) feet of the village entrance, i.e. Fairbourne, Somerset, Newcastle, and Whitford.

- Sign within ten (10) feet of courtyard entrance.

Exhibit C – Retractable Awning Regulations

Design: Alutex Retractable Awnings Models: Madera, Eclipse Color: Grey #79, Beige #14, Green #15

The color of the awning will depend on the color of the townhome’s aluminum siding. The approach is to give each village a uniform appearance. No stripes or flowers will be permitted. Siding/awning color as follows:

Exhibit D – Prioritized Satellite Dish Locations

1. Dish antennas that are one meter (39.37”) or less in diameter and are designed to

receive direct broadcast satellite service, including direct-to-home satellite service, video programming services via broadband radio service (wireless cable) or to receive or transmit fixed wireless signals other than via satellite.**

2. Dish antennas larger than one meter in diameter are not permitted.** 3. All wires shall be concealed and secured to prevent any type of safety hazard.

1. Primary and preferred location of installation is on the ground and as close as possible to townhouse foundation. Placement in a foundation planting bed next to building is

Placement in a foundation planting bed next to the building is recommended and will keep the unit from being damaged by landscaping service.

2. Secondary location (only in the event the primary location cannot be obtained) for the

installation of a satellite dish is on the main roof of the townhouse. Placement as close as possible to the chimney or mounted on the roof surface least visible from the street is preferred.

3. All wires shall be concealed and secured to prevent any type of safety hazard.

Architectural Request Form: YES- approval from the Architectural Review Committee is required. Architectural request must be specific as to the size (diameter) and location of the satellite dish. If the request is approved no other size or location will be permitted without homeowner submitting a revised request for a new location. Montgomery Township Permit: NO NOTE: In the event of a total shingle replacement project, any satellite dish installed on the roof surface, the then-current homeowner will be responsible to un-mount it and remove it in its entirety prior to any re-shingle project. The remounting and reinstallation of the satellite dish, after the re-shingling project, will be the sole responsibility of the homeowner. Should you have any extenuating circumstances regarding placement of a satellite dish, please feel free to write to the Architectural Review Committee at the address on the architectural request form.

Exhibit E – Firewood Regulations

In accordance with Article VII, Section 1 (t), detailed firewood regulation has been established. Anyone desiring to have firewood placed on their lot must conform to this regulation.

1. Firewood may not be stacked on the ground. Various firewood holders are available commercially or owner may construct their own. The holder may be either wood or metal and must be maintained properly. A built rack must maintain a minimum of a four (4) inch clearance between the ground and the firewood. A commercial rack holder is required to inhibit the nesting of rodents under the firewood.

2. The maximum amount of firewood allowed per lot is one (1) cord. All firewood must

be stacked in a neat and orderly fashion. When stacking firewood, adhere to the following:

- Maximum four (4) feet in height - Maximum eight (8) feet in length - Maximum six (6) feet in width

3. The firewood must be stacked in the rear of the townhouse within six (6) feet of the

building, but not stacked against the building. The firewood is not permitted to be stored in the front or the side of any townhome or lot.

4. In the event a homeowner has elected to erect a fence on the rear of the lot, please

refer to the Association’s fence regulation, the firewood must be stacked within the fenced area.

5. Firewood is not permitted on common ground.

Exhibit F – Outdoor Light Fixtures

All outdoor light fixtures must meet the following specifications. Rules and regulations are adopted to govern the style selection and installation of all outdoor light fixtures. Location: Replace on original location used by the builder (location when home was built). Color: Brass, black, brushed nickel or white (copper is not permitted).

Style: Wall mounted:

• Coach Light

• Contemporary

Ceiling – Front door area, must be flush mounted and match the above wall mounted style.

No outdoor light fixtures that are suspended from chains or cords are permitted.

Glass Panes: Clear or frosted glass. No colors. Wattage: Not to exceed 60 watts. Color Bulbs: Not permitted except during the Christmas holiday season. Exhibit H – Attic Fan Rules & Regulations An attic fan is defined as a “specifically designed fan for exhausting hot air from attic space”.

1. Only one (1) attic fan may be installed per home.

2. All attic fans must be positioned on the roof. 3. No side wall or gable installation is permitted. 4. Attic fans should be low profile and centered on the rear side of the roof, within 5 feet

of the ridgeline of the roof. The exterior fan housing cannot be more than twelve (12) inches high and twenty-four (24) inches in diameter.

5. For appropriate air exchange, attic fan should be thermostatically controlled and

appropriate size for the attic square footage as larger is necessarily better.

6. Fire stats are recommended but not required. A fire stat senses when there is a house fire and shuts off the attic fan so that it doesn’t draw fire/smoke into the attic.

7. Homeowner is responsible for any damage to roof or interior of home incurred during

or after installation of fan. 8. “Free spinning” turbine fans, wall fans, or whole house fans are not permitted. 9. It is recommended that homeowners contact a contractor/roofing specialist to

determine the attic fan best suited for the size of the home.

Exhibit I – Window Replacement/Upgrades RULES, REGULATIONS AND SPECIFICATIONS

Homeowner may replace and/or upgrade individual window sections or complete assemblies. If a homeowner prefers to replace and upgrade with a model and manufacturer other than originally installed, the window (s) must be purchased and installed in strict accordance with the following specification:

1. Window(s) must be constructed of all white vinyl.

2. Window (s) must include internal grid pattern or dividers between the window thermal panes. The horizontal and vertical pattern of the dividers must be the same as the original window (s). These internal dividers must be white in color and fabricated from “flat stock”, with a width of 5/8”.

NOTE: Snap in dividers are never permitted. (See picture next page)

3. Windows must be installed in the same manner as the original window (s). Nail fin

flange should be integral to window frame and attached to exterior wall. A New Construction installation is recommended.

4. All trimming material around exterior window must be replaced with the original size,

style, and color materials. 5. Exterior of window(s) must look similar to those originally installed. Original windows

have a beveled or tapered edge profile around exterior frame. A square design profile is also acceptable.

6. Any windows originally installed in series (side by side) must be replaced with the

windows in this manner and must be connected or attached with the matching mullions as originally installed.

7. Window (s) can be either single-hung or double-hung. Windows must operate in

vertical (up and down) movement as originally installed. 8. Any screens installed in the window frame must be all “half-height” in the lower

section of the window or all “full-height” and maintained. 9. “Low E Glass – Argon Filled” windows are permitted when replacing complete

window assemblies only. Because this Low E Glass gives a “shadow” effect, it is recommended that this style only be used when replacing all windows on one or more sides of the house.

When replacing the complete door assembly with a model and manufacturer other than originally installed, the door must be models approved by the association (see picture). Installation must be in strict accordance with the following specifications:

1. Door and frame assembly must be white vinyl construction.

2. Door glass must include internal grid pattern or dividers between the glass thermal panes.

Exhibit T – Fence Regulations

Specifications, Option 1, Color. If a storage shed is attached to the rear wall of the townhome, the length of the fence, including the length of the storage shed, must equal twelve (12) feet. The rear portion of the fence, connecting the two twelve (12) foot side pieces, must be three (3) feet in height.

2. Side fences separating two adjoining townhomes must be placed on the original

property line. 3. The side fence, on an end unit townhome, must be parallel with the end of the

building and cannot extend beyond the side of the building. 4. Only the full width of the townhome rear yard may be fenced in.

5. Fence may not be installed over a permitted easement. If an easement exists in the

rear yard of a townhome, the owner cannot install a fence. 6. When an enclosed fence is installed, owner is responsible for maintaining the

Section 1. Approval Procedures

(a) Homeowner must provide a written proposal, hereinafter referred to as “Plans”, to the

Architectural Review Committee which must include but is not limited to the

following:

1. Complete Architectural Review Form.

2. Detail drawing of the proposed patio and/or deck, materials for construction

as defined in Amendment I, Section 3 & 4, all relevant dimensions,

approximate ground elevation, location of doors, existing patio (s), heat pump

/ air conditioner, and modifications or townhome or lot.

3. Proposed method of transportation and storage of materials as defined in

Amendment I, Section 2.

4. Estimated construction start and finish date.

(b) Upon review and approval from the Architectural Review Committee, a “Letter of

Acceptance and Approval” will be provided to the Owner. The Owner must then

apply with Montgomery Township for a Building Permit. The Township will require

the “Letter of Acceptance and Approval” along with a copy of the patio/deck Plans to

determine if a township permit is required.

(c) Any patio and/or deck design is subject to final inspection and approval by

Montgomery Township based on local building codes and zoning requirements. The

construction of patios and/or decks may be restricted on certain lots due to property

easements and boundary setback constraints. Owners and/or contractors must

conform to any township ordinances regarding construction time allowance, noise,

etc.

Section 2. Transport and Storage of Materials

(a) Owner and/or must devise a method of transporting materials used for, or resulting

from, the patio/deck construction, hereinafter referred to as “Materials,” through or

around the townhome. If a neighboring owner’s lot may be affected in any manner, a

written statement of approval is required by neighboring owner. A Letter of

Acceptance and Approval from the Architectural Review Committee shall be deemed

as permission granted to transport materials over Common ground.

(b) No vehicles (contractors too) are permitted on common ground. Wheelbarrows will

be permitted for Material transport. Owner is liable for any damage to the

neighboring lots, Common Ground, or Properties and must repair or replace and

damaged property to its’ prior condition within a period of ten (10) days or the time

allowance specified by the Architectural Review Committee if deemed necessary.

(c) Storage of Materials must be confined to the boundaries of the Owner’s Lot. Storage

of Materials will not be permitted for more than ten (10) days prior to the start of

construction and seven (7) days after project completion, with the exception of

Materials stored in the garage or out of view from the community.

Section 3. General Design Specifications

a) Patio and/or deck surface must be constructed within the dimensions specified for

that of permitted fences as described in “Use Restrictions”, Article VII, Section 1 (1),

with the exception of the maximum surface area restrictions of concrete as specified

in Amendment I, Section 4, Class1.

b) Stairs, if constructed, may extend beyond the patio/deck the patio/deck surface but,

the entire structure must be within Montgomery Township patio/deck minimum

setback requirements. c) Patios and/or decks are restricted to the rear of the yard. d) Patio/deck may be confined within a privacy fence.

e) Patio/deck surface height (elevation) must be flush or below the elevation/level of the

bottom of the exterior townhome door. f) To eliminate washout and premature deterioration, rain water from down spouts must

be diverted under and/or away from patio/deck surface, substructure and

neighboring lot. g) If removal and reinstallation of the heat pump or air conditioner is necessary, this

must be performed by experienced personnel in accordance with the acceptable

industry codes and manner which retains continuity with its’ original positioning and

other neighboring townhomes. h) Lumber used in the construction of patios and/or decks must be pressure-treated or

Cedar suitable for “ground contact”. Wood polymer composite materials are

acceptable for non-load-bearing applications (decking) and must match in

appearance to the lumber specified above. For color stain see Exhibit U - Patios &

Decks page 29. Fasteners must be corrosion resistant. i) Wood decks, as specified in Amendment I, Section 4, must be designed with 5/4 x 6

or 2 x 6 deck boards. If deck surface is elevated in excess of 10” above ground AND

accessible to the rear lot, stairs are required at the access. If the deck surface is

raised above the ground by two or more steps, a privacy fence or hand railing is

required. Fences must be in accordance with the current Use Restrictions as defined

in Article VII, Section 1 (1). The hand railing must be constructed in accordance with

the following: Hand Railing Design Specifications:

1. Railing support posts shall consist of 4 x 4 vertical posts spaced

approximately four (4) feet apart. Attached flush on top of the posts is a 2 x 6

top cap rail which must be 36” – 39” from the deck surface.

2. Balusters (or “spindles”) are required and must be 2 x 2. Balusters are

attached to the 2 x 4 top and bottom rails with a maximum vertical spacing of

4 inches on center. Rails are attached to support posts with the top rail flush

with the bottom of the top cap and the bottom rail flush with the deck surface.

3. Gates are permitted to be installed on the deck level and must maintain the

design continuity of the fence or the hand railing and baluster design as

specified above. If an access gate is constructed, the opening shall be 36”

wide.

Section 4. Construction Specification

Class 1. Patios Constructed “On-Grade” with Impervious Materials

(a) Impervious: definition – where seepage can occur. i.e. concrete patio.

(b) Patios which are impervious to rain water, such as concrete, must be limited

to the maximum total surface area of 12 x 12 square feet (total of property

line) with the exception of concrete patios originally installed by developer.

(c) Impervious materials/concrete patios must be constructed in accordance with

local building codes.

(d) Impervious materials/concrete color shall match the existing patio color.

Class 2. Patios Constructed “On-Grade” with Non-Impervious Materials

(a) Non-impervious materials include concrete pavers, bricks, stone, slate and/or

patio blocks and shall be referred to as “Pavers”. Pavers shall be installed in

a 1” sand and 4” thick stone base.

(b) Typical earth tone colors are acceptable, preferably matching existing patio or

siding colors. Acceptable earth tone colors include the following: cement/slate

gray, brick red, sand tan, or clay (Terra Cotta).

(c) A sturdy and durable boarder must be constructed to retain the patio

materials. The preferred boarder is typical deck and framing lumber as

specified in Amendment I, Section 3 (h), which is retained by stakes not

visible after patio completion.

(d) Pavers can be installed on top of and/or next to existing patio (s). Pavers

must be placed on a prepared surface. The prepared surface may be

either/or the existing patio and/or a suitable ground base consisting of 4”

tamped/compacted fine crushed stone (grit), followed by a 1” layer of sand,

followed by the layer of Pavers in which gaps are filled with sand. Allow for

approximately ½” of stone settlement when measuring depth.

(e) Patio surface should slope away from the rear of the townhome to facilitate

rain water drainage.

Class 3. Wood Decks Constructed “On-Grade”

(a) “On-Grade” decks must be installed on a prepared surface. The prepared

surface may be either the existing concrete patio and/or suitable ground

base. A suitable ground base consists of 4” tamped/compacted fine crushed

stone. A sturdy and durable boarder must be constructed to retain the stone.

The preferred boarder is typical deck framing lumber as specified in

Amendment I, Section 3 (h), which is retained by stakes not visible after deck

completion. Allow for approximately ½” stone settlement when measuring.

(b) The deck substructure framing should consist of 2” x 10” joists securely

attached with headers. Joists must be 12” on center for 5/4” x 6” deck boards.

The deck substructure framing should be no less than 3” above ground level.

All concrete patios are to be removed if they prevent the 3” clearance to the

underside of substructure framing (as of 2011 Montgomery Township). The

deck must be constructed on the substructure in accordance with

Amendment I, Section 3 (i). Each structural case will be determined by grade

level of the Property with adjustments to Township requirements.

Class 4. Wood Decks Constructed “Above-Grade”

(a) “Above-Grade” decks are for lots where the patio/deck will be elevated above

10” off ground level.

(b) The deck substructure framing should be basic “Post and Beam

Construction” which meets Montgomery Township building code

requirements. To allow for elevation requirements specified in Amendment I,

Section 3 (e). The deck must be constructed on the substructure in

accordance with Amendment I, Section 3 (i).

(See Rules and Regulations for more details).

If approved and changes are not completed within 120 days of approval, a new request form must be submitted. Submission of this form and its approval or disapproval by the Directors does not replace the resident’s obligation to abide by all local ordinances and permit requirements by Montgomery Township. I understand that if I proceed with the above work before I receive written approval from the Directors that I will be required to restore the changes to their original condition at my expense and an automatic fine will be assessed. (Association approval required before filing for township permit.)
