Welcome to the Gromit Unleashed Auction

Welcome to the Gromit Unleashed Auction, the final step in the incredible journey of these beautiful pieces of art. We’re really looking forward to auctioning all 80 Gromit sculptures, plus a few extras, in aid of our charity, Wallace & Gromit’s Grand Appeal.

It’s been overwhelming to see the amount of people who have taken part in the Gromit Unleashed trail, visiting from Bristol, all over the UK and overseas to see Gromit in so many guises and sample the delights of our beautiful city of Bristol.Each and every one of the sculptures is amazing and unique. I could never have imagined seeing Gromit in so many different forms. It is a wonderful thing to be able to support Wallace & Gromit’s Grand Appeal, the Bristol Children’s Hospital charity, through art. The Grand Appeal is very close to my heart; I am proud to be a Patron of such a crackin’ cause. I encourage you to dig deep at the Gromit Un-leashed auction to support our charity at what is a very important time for Bristol Children’s Hospital. Thank you.

Raising funds for Wallace & Gromit’s Grand AppealThe Bristol Children’s Hospital Charity

Wallace & Gromit’s Grand Appeal is raising £3.5 million to support the expansion of Bristol Children’s Hospital.

Bristol Children’s Hospital is one of only a few children’s hospitals in the UK providing life saving surgery, care and treatment on a local, national and international scale.The Hospital is expanding to include facilities for children’s burns, neurosurgery, neurosciences and major trauma treatment services which are currently located at Frenchay Hospital, to create one of the leading multi-disciplinary children’s hospitals in Europe.

The Grand Appeal is raising £3.5 million to provide state of the art equipment, family facilities and child-friendly artwork to help enhance and save the lives of babies and children from Bristol and around the South West and South Wales.

Specialist paediatric healthcare and pioneering treatment require constant investment. Please help us to save the lives of sick children from Bristol, the South West and beyond.

Treatment unimaginable a decade ago is now within our reach.

Colourful Patch is inspired by the artist’s love of crafts. Some swatches relate to the Wallace & Gromit films, whilst others are vibrant swirls of pattern and colour.

Lot 2. Grant’s Gromit Rosie Ashforth

The artist’s design is inspired by the ‘five a day’ guidelines on healthy eating and the Italian renaissance artist Giuseppe Arcimboldo, who painted people using only the shapes of fruit and vegetables, creating a design that translates to the contours of Gromit’s body.

Jeremy Wade is a writer and TV presenter of the hit TV series ‘River Monsters’. In Jeremy’s design Gromit metamorphosed into a fish, but then that transformed into a special wetsuit, designed to blend in with the underwater environment.

Grant’s Gromit is painted with the markings of a Grant’s Zebra, the smallest of six subspecies of the Plains Zebra, and is inspired by a resident zebra in Bristol! The artist was inspired by Bristol’s links with natural history and zoology.

The artist has designed Gromitasaurus, the blood-curdling predator feared throughout the Aardmassic period. Thankfully, despite his terrifying appearance, his huge fangs were widely used for slicing chunks of Wensleydale.

Lot 6. Zodiac Inkie

The artist’s colourful floral Gromit design was inspired by her unique style used to paint play houses in colour, pattern and flowers, both inside and out.

Lancelot is inspired by the bright, bold signature Paul Smith designs. Sir Paul Smith has designed a happy and optimistic sculpture named in honour of his dog Lancelot.

Inkie is an international artist originally from Bristol and is a key part of Bristol’s graffiti heritage, renowned for his work worldwide, including organising See No Evil and Upfest.

Canis Major is inspired by the night sky and constellations such as Ursa Minor and Ursa Major – the Great Bear and the Little Bear. Gromit’s own constellation, Gromitus Major, can be found on the sculpture.

The idea behind the artist’s design is inspired by everyone unleashing their inner Gromit, depicting colourful characters showing what a good Gromit they’d make, symbolised by each wearing his iconic collar.

Sir Peter Blake is an icon of British Pop Art and his work reflects his fascination with popular culture, and the beauty to be found in everyday objects and surroundings. Renowned for his iconic album covers for The Beatles, Paul Weller and The Who, Hound Dog is inspired by the King himself, Elvis Presley.

Raymond Briggs is an English illustrator and author. He is known around the world for his works The Snowman, Father Christmas, and Fungus the Bogeyman. His sculpture has taken inspiration from his iconic character, the Snowman.

Turner Prize nominee Mark Titchner has created a striking, thought-provoking work in Why Dog, Why? Titchner uses diverse mediums such as digital print, drawing, film sculpture and installation in his artworks.

Peter Lord is an Oscar-nominated film producer, a Founder and Creative Director of Aardman Animations and a Patron and Trustee of The Grand Appeal. Peter’s characters and films are much-loved worldwide, including the hit film Pirates! An Adventure with Scientists, which inspired his sculpture design.

Interpreting ‘unleashed’ to be ‘let loose; wild and free’, the artist wanted her sculpture to encompass both. As a botanical illustrator Ros created the beautiful Dog Rose, rosa canina, and did just that.

Celia Birtwell is a fashion and interiors textile designer. From 1967 to 1973 Celia’s designs have adorned everyone from the Beatles all the way to the British Aristocracy. Celia has been awarded a CBE for her outstanding contribution to fashion and Sugar Plum was inspired by her beautiful fabric of the same name.

The artist, from Bologna, was inspired to re-create Gromit as a stylish carousel horse, inspired by classic fairgrounds from around the world.

Lot 18. The Secret Garden Sarah-Jane Grace

Being Bristol born and bred, the artist has incorporated Bristol expressions and phrases such as ‘Ark at eee’ and ‘Yer tiz’ in the form of striking red and white illustrative patterns adorning the sculpture.

Philip Treacy’s iconic Butterfly print adorns Gromit in an array of bold colours. Treacy is a British milliner and de-signer, creating hats for Princess Beatrice, Victoria Beckham, Lady Gaga and many more.

The Secret Garden sculpture has been designed to represent a topiary bush canine, peeping out of a great hiding place. Within the leaves it is possible to see all sorts of creatures such as ladybirds, butterflies, dragonflies, berries and flowers.

Filthy Luker is a Bristol-based international artist, specialising in humorous and striking inflatable sculptures in unexpected places, including giant octopuses, plants and banana skins.

aMazing Gromit is inspired by the landscapes of Bristol’s Leigh Woods. The tree motif drawn solely by hand that covers him is also a maze navigating from his right ear through the forest to the cottage on his tail.

Covered in a mosaic design using steel nuts, Natalie’s sculpture is based on Wallace’s love of madcap inventions and inspired by Brunel’s Clifton Suspension Bridge and Bristol’s industrial history.

Jools was inspired by Gromit’s ‘inner boogie-ist’ to create a musical Gromit by creating his interpretation of Flight Of The Bumblebee, the Bumble Boogie! Sarah-Jane has complimented the score beautifully with a jazz inspired array of colours, musical notes and instruments.

This lot comes complete with a musical plinth.

Lodekka, with its nostalgic green and cream colours, is inspired by its 1940s namesake, the Lodekka Bus, one of the most recognisable buses of the Bristol Omnibus Company.

The artist’s blueprint design reflects the history of engineering in Bristol, and Wallace & Gromit’s renowned love of mechanical contraptions as well as providing a comic suggestion of the inner workings of Gromit.

Astro’s glow in the dark design reflects the world’s fascination with space travel and Wallace & Gromit’s World of Invention, in which Wallace and Gromit create a cheese so smelly it has a neon green glow!

Richard Williams is a Canadian-British animator best known as Animation Director and the creative mind behind the ani-mated film Who Framed Roger Rabbit?. His bold andcolourful rainbow design features Williams’ hand drawn image of Roger Rabbit.

Simon Tofield is the creator of the animated cartoon series ‘Simon’s Cat’, a cute and mischievous character who appears in hundreds of amusing situations covering this sculpture from head to toe in stunning hand-drawn detail.

David Inshaw is a British artist, particularly noted for his painting ‘The Badminton Game’ exhibited at the ICA and the Tate Gallery. His sculpture is inspired by a classic topiary bush, painted in hues of rich greens.

Creature Comforts is inspired by the wonderful green spaces of Bristol, and the abundance of wildlife that can be found there, imagining Gromit exploring these woodlands with his inquisitive nose, discovering animals, birds, insects, plants and flowers of all kinds.

Malago celebrates the region’s rivers in hues of ‘Bristol blue’, with its flowing illustrative style graphically representing the movement and energy of the river Malago which runs through Bedminster from the Avon.

A member of the Royal British Society of Sculptors, Marlow has re-imagined Gromit as an honourable and brave medieval knight, complete with a stunning stainless steel suit of armour.

Sarah’s detailed design featuring Bristol’s architecture and landscapes represents the artist’s love of Bristol, and depicts some of the iconic and unique areas of the city.

In Simon’s fun design, Gromit has been recreated as a bright and colourful strawberry in delicious shades of red, complete with a mini strawberry collar!

Viva Las Vegas! Elvis has left the building but for now Gromit rocks around the clock, re-imagined in one of Elvis Presley’s favourite 1970s stage jumpsuits.

Cloaked in the bold red, white and blue Union Jack flag, the artist was inspired by Wallace and Gromit as cultural icons of all things British.

Zayn Malik is a member of international pop group One Direction and his design is inspired by comic book heroes. In his spare time, Zayn is a keen artist and created his sculpture whilst embarking on a UK tour.

Inspired by the Bristol Aeroplane Company’s aptly named ‘Bristol Bulldog’, Dan’s design inspired by the Bulldog ‘defends the skies’, bringing two of Bristol’s greats together in a fantastic collaboration.

Inspired by nature, surface pattern and the artist’s own imagination, Lisa’s sculpture is a playful arrangement of abstract forms and organic shapes, its contrasting colour palette capturing a sense of fun.

Vivi has re-imagined Gromit as a colourful mandrill, as they somewhat surprisingly share a lot in common. Both are remarkable and comical creatures with animated facial expressions, long muzzles and expressive eyes.

The proceeds from this sculpture at auction will be donated to Bristol Zoo Gardens (charity registration no. 1104986).

Working as a designer at Aardman, Gav has used his typographic design as a unique way to share some facts, figures, and secrets of Aardman Animations with lots of interesting information for fans to pore over. There are even some hidden facts to find if you look closely!

A renowned graffiti artist, Cheba’s stellar Gromit design was inspired by NASA photos from space and the birth of stars.

Tom is a UK graffiti artist, and his bright and bold design was inspired by all superheroes, because Gromit always saves the day – watch out world!

Inspired by Vincent van Gough, the swirling Bristol scenes in Laura’s rich distinct style are her interpretation of “how he might have painted Bristol, if he had painted our beautiful city.” Filled with detail, the artist has portrayed Vincent Van Gromit as an inspiration to adults and children alike to look at the world through Van Gogh’s eyes.

Rich in detail and vibrant in colour, as a fashion student Nia’s design has been inspired by her love for surface textiles and print.

The inspiration for Marie’s design was observing British birds in her garden. Her sweet and delicate illustrations all have their own characters – Mr and Mrs Blackbird are very much in love, while Robin is a noisy little chap!

Gerald Scarfe, CBE, is an English cartoonist, designer and animator. Scarfe was inspired to create a ‘cartoon’ situation in the form of an unfortunate paint bespattered Gromit!

Cath Kidston is an English fashion designer renowned for her distinctive floral prints. Bouquets of pink blooms adorn this beautiful sculpture, with Cath Kidston’s signature Antique Rose and Spot Red prints.

The artist has imagined Gromit as a Bristolian at heart who enjoys a good tea party and is adorned with colourful Bristol communities and landscapes, with plenty of bunting to go round.

Inspired by the decoratively painted horses of Merry-Go-Rounds and the cowboy style of 1950s Westerns, Carys’ sculpture is a stylised take on the fictional masked characters renowned for fighting injustice in the American Old West. Ride ‘em cowboy lad!

Steam Dog pays homage to the ‘steam punk’ technology used in the Wallace & Gromit animations, and is also influenced by a Victorian style, adorned with quirky details, levers and buttons.

Diarmuid Gavin is an award winning garden designer, author and presenter, with a flair for gardens that are exuberant and quirky, and at other times tranquil and gentle. Oops a Daisy! is a fun take on Diarmuid’s style, with Gromit covered in artificial turf and bright daisies.

Lot 54. Golden Gromit Julie Vernon

The Wild West illustrates Bristol as a city of nature, with its bold squirrels of Brandon Hill Park, basking cormorants of the river, urban foxes and impressive fallow and red deer herds of Ashton Court, the wildlife of the South West through the changing seasons are the inspiration for The Wild West.

Nick Park is the multiple Oscar winning Director of Aardman Animations, the creator of Wallace & Gromit, a Patron and Trustee of The Grand Appeal, and the creative mind behind Gromit Unleashed. Nick’s design is the only sculpture to feature Wallace as well as Gromit, and a trusty paint can that doubles as a seat!

Julie’s mosaic design is a glittering, shimmering golden homage to Gromit, with over 10,000 gold tiles, which truly show him off in all his splendour. Inspired by golden Buddhas in Thailand, where sculptures are objects of vibrancy and glory, the design also plays on Bristol’s connection with pirates and the idea of gold treasure.

In his design, Joseph pays homage to pre-Colombian art and imagines the discovery of a mysterious ancient site which held all kinds of incredible treasures, the most surprising of which was this sculpture! Covered in Aztec-like symbols and designs, Nezahualcoyotl has more than an uncanny resemblance to Gromit!

The artist has been influenced by his love of pattern, geometrical shapes, bright colours, natural forms and ornithology to create this striking tessalating bird design. The artwork utilises a colour palette based on the vibrant, celebratory hues of our spring and summer.

Aardman’s classic Gromit, this sculpture is painted in his original form, and has become the icon for the Gromit Un-leashed trail.

One Red Shoe have used their distinct, delicate style to adorn Gromit with an antique globe highlighting Bristol’s rich port. The cartographic elements such as sea monsters, giant fish and ships are all painted in a dip pen and sepia ink style.

Martin Handford is an English author and illustrator of the internationally loved Where’s Wally? Books. His design has re-imagined Gromit as Wally, with his trademark glasses, hat and stripes. With a wonderful attention to detail, the back pockets feature mini illustrations where Gromit is hidden!

The artwork has a futuristic, mechanical and geometric style, combining a sense of order with chaos, with this design fea-turing a highly detailed and densely packed cityscape rich in narrative and vibrant in colour. Gromit now is not just a dog but an idea and a vision which encompasses the whole city. The design reworks the film Being John Malkovich for Gromit Unleashed.

Groscar was inspired by Aardman’s pioneering style of stop motion animation, and the success that has followed, including a number of Oscars to their name. Groscar is a sharp suited golden vision, complete with a polka dot bow tie!

Artist Tim has created an illustrative homage to Isambard Kingdom Brunel in the form of a newer Bristol icon – Gromit, as Isambark, complete with stovepipe hat.

Pixar Animation Studios is a world renowned Academy Award®-winning film studio and creator of some of the most successful and beloved animated films of all time, includ-ing Toy Story, Monsters Inc, Cars, The Incredibles and Up. Gromit Lightyear re-imagines Gromit as Buzz Lightyear, complete with space helmet. The sculpture was shipped to LA and created at Pixar Studios. As a homage to Toy Story, Gromit Lightyear has ‘Andy’ written underneath his foot.

Axel Scheffler is a renowned illustrator, best known for The Gruffalo which he has illustrated with author Julia Donaldson, which is loved in over 50 countries throughout the world. Axel’s beautiful sculpture features all the characters from The Gruffalo in solid bright colours.

In Carys’ bright and stylized sculpture, Gromit takes on a Mexican wrestler and superhero persona as the loveable character unleashes his inner tiger…Grrrrr!

Lindsay’s Gromit design captures the vibrant ‘buzzing’ Bristol City life as well as the communities, architecture and iconic Bristol hot air balloons.

The Royal Mint is one of the world’s oldest and esteemed organisations, with an unbroken history of minting British coinage dating back over 1,000 years. With each coin being its own miniature work of art, this design forms a natu-ral connection between coins and the national icons that are Wallace and Gromit, using an incredible mosaic effect using nearly ten thousand one pence pieces! Nick Park designed the one-off Gromit medallion which has pride of place on Gromit’s haunch.

Lot 70. Eldoradog Seb Burnett

Peter Brookes is an English cartoonist who has produced work for numerous publications, most notably The Times, for which he is the leader-page cartoonist. His famous satirical illustrations depicting politicians Ed Milliband as Wallace and Ed Balls as Gromit feature on this dalmation inspired sculpture.

Taking inspiration from Wallace’s holiday essentials, this sculpture has been created to look like a vintage leather suitcase, complete with stickers and postcards from Wallace & Gromit’s travels. This sculpture was created in partnership with Visit England, the English tourist board, to encourage holidaymakers to holiday at home.

The artist’s colourful Gromit depicts famous Victorian explorer Bertram Fiddle and his manservant on their fabled mission to find the lost city of Eldoradog. Making their way through dense, exotic jungle, their quest is watched by peculiar flora and fauna.

Design duo Monster Riot have used their love of all things colourful and characterful to create a design inspired by a sleepy village complete with hot air balloons adorning the skies and a giant friendly monster releasing the balloons into the atmosphere.

Lot 74. Gnashional Gromit The Beano

Joanna Lumley is an actress, model, author and charity cam-paigner, most famously known for her role as Patsy Stone in Absolutely Fabulous. Joanna was inspired to create her Gromit through her love of poetry, painting her sculpture with bright colours and adorning him with fragments of poems which she has loved since childhood.

Dale’s inspiration for her design came from the Egyptian col-lections at Bristol Museum. Her distinctive, striking sculpture was created by the concept that if Gromit lived in Egypt 3,000 years ago, he would have been a god. He might even have ended up in Bristol Museum alongside the catmummies!

The Beano is an iconic children’s comic dearly loved by generations of British children from 1938 to present day. Editor Mike Sterling, iconic Beano artist Dave Sutherland and the Beano team worked together to create this Gromit featuring iconic characters Dennis and Gnasher.

Harry Hill is an award-winning English comedian, author and television presenter. He is most famously known for his highly successful television series ‘TV Burp’ and as a sell out stand up comedian. Harry has emerged as an eager artist over the last few years, including an exhibition of his art at Edinburgh Art Festival, and has now created his own unique Gromit design inspired by baldness!

Lot 78. Gizmo Sir Quentin Blake

Trevor Baylis is an English inventor, best known for inventing the wind-up radio. Gromit is sporting an inventor’s overcoat that Wallace would very much approve of, adorned with badges inspired by Trevor’s inventions and fascinating life.

Richard Starzak is the award-winning director of ‘Shaun the Sheep’, ‘Robbie the Reindeer’, ‘Rex the Runt’, and ‘Creature Comforts’ and works as Creative Director of the Broadcast Development department at Aardman. Richard’s design was inspired by Shaun the Sheep controlling a ‘Troy’ style Gromit.

Sir Quentin Blake is a world renowned artist and illustrator, and has drawn ever since he can remember. He is known for his collaborations with many writers, most famously, Roald Dahl. He was inspired to give the illustrations of children featured in his design ‘wings’ and his inimitable style is put to striking effect on this sculpture.

Artist Andy took inspiration from the beautiful design of the spaceship in A Grand Day Out. The artist has created a fun and vibrant sculpture in the form of a Gromit-shaped space-ship much like one that Wallace & Gromit might actually build.

Beto Cuevas is a Chilean artist, actor and lead singer for the band La Ley, and a judge on ‘The Voice’, Mexico. His Gromit is influenced by his trademark graphic style in red, black and white.

Franz is inspired by the study of phrenology, and is the creation of David Sproxton, Co-Founder of Aardman Animations.

Julian Opie was born in 1958 in London and graduated in 1983 from Goldsmith’s School of Art, where he was taught by Michael Craig-Martin. He lives and works in London.

Opie has exhibited widely in the UK and internationally, with major museum exhibitions including shows at Kunst-verein in Cologne, Hayward Gallery and ICA in London, Lehnbachhaus in Munich, K21 in Dusseldorf, MAK in Vienna, CAC in Malaga and IVAM in Valencia, as well as the Dehli Triennial, Venice Biennial and Documenta.

He is represented by 13 galleries worldwide, including Lisson and Alan Cristea in London, Barbara Krakow in Boston, Bob van Orsouw in Zurich, Gerhardsen Gerner in Oslo, Krobath in Vienna, Kukje in Seoul, Mario Sequeira in Portugal, Patrick De Brock in Brussels, Sakshi in Mumbai and SCAI Bathhouse in Tokyo.

Opie has presented many public projects in cities around the world, notably in the Dentsu Building in Tokyo 2002, City Hall Park in New York 2004, Mori Building, Omotesan-do Hill in Japan 2006, River Vltava in Prague 2007, Pheo-nix Art Museum USA 2007, Dublin City Gallery in Ireland 2008, Seoul Square in South Korea 2009, Regent’s Place in London 2011, and more recently permanent installations in Calgary, Canada and The Lindo Wing, St Mary’sHospital, London.

He is represented in many public art collections, includ-ing Tate, British Museum, Victoria & Albert, Arts Council, British Council and National Portrait Gallery in London, The Museum of Modern Art in New York, ICA in Boston USA, Essl Collection in Vienna, IVAM in Spain, The Israel Museum in Jerusalem and Takamatsu City Museum of Art in Japan.

Luke Jerram’s multidisciplinary practice involves the creation of sculptures, installations, live arts projects and gifts. Living in the UK but working internationally since his career began in 1997, Jerram has created a number of extraordinary art projects which have excited and inspired people around the globe. He is currently Visiting Senior Research Fellow at CFPR, University of West of England.

Jerram’s Glass Microbiology artworks are in museum collections around the world including The Metropolitan Museum of Art (NYC), Shanghai Museum of Glass, Wellcome Collection (London), the Corning Museum (USA). The work has recently been shown in Glasstress at the Venice Biennale and Museum of Art and Design in NYC.

Conditions of BusinessThe nature of the relationship between the Charity, as seller and a Bidder and the terms on which the auction is held are set out below.The purpose of the auction is for the Charity to raise funds for its charitable purposes. Bidders’ attention is specifically drawn to Conditions 3/4 and 12/13, which require a Bidder to investigate lots prior to bidding, contain specific limitations and exclusions of the legal liability of the Charity, and detail the specific restrictions on the use of the sculpture.Bidders, as prospective purchasers, should pay particular attention to these Conditions.

1. Introduction(a) A sale contract is made directly between the Charity and the Buyer.

2. Common TermsIn these Conditions of Business: “Gromit Unleashed” is the event that is owned and managed by the Charity.“Auctioneer” is the individual(s) conducting the auction; “Bidder” is any person considering, making or attempting to make a bid, by whatever means, and includes Buyers;“Buyer” is the person that makes the highest bid or the winning bid accepted by the Auctioneer. The Buyer can bid in person or instruct an agent to do so on their behalf.“Buyer’s Expenses” are any costs or expenses due from the Buyer.“Charity” - Royal Hospital for Children Bristol Appeal limited, Registered Charity Number 1043603 Registered address – 24 Upper Maudlin Street, Bristol BS2 8DJ, who are offering a lot for sale. “Hammer Price” is the highest bid accepted by the Auctioneer by the fall of the hammer, or in the case of a post-auction sale, the agreed sale price;“Intellectual Property Rights” are any patents, rights to inventions, copyright and neighbouring and related rights, moral rights, trade marks and service marks, business names and domain names, rights in get-up, goodwill and the right to sue for passing off, rights in designs, rights to use, and protect the confidentiality of, confidential information (including know-how) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world“New Party” any party to which the Buyer may pass the title of a lot “Purchase Price” is the Hammer Price.“Reserve” is the (confidential) minimum Hammer Price at which the Charity has agreed to sell a lot;

3. Duties of Bidders and the Charity in respect of items for sale(a) Each lot offered for sale may or may not be available for inspection by Bidders prior to the sale. It is the responsibility of the Bidder to satisfy themselves as to both the condition of the lot and the accuracy of its description.(b) All lots are offered for sale in the condition they are in at the time of the auction on 3rd October 2013. It is the Bidder’s responsibility to inspect lots prior to purchase. This term applies whether or not Bidders are in attendance at the auction. Illustrations included in printed material and on the internet are for identification purposes only and will not convey full information as to the actual condition of lots.(c) Information provided to Bidders in respect of any lot by the Charity, including any estimate, whether written or oral and including information in any catalogue, condition or other report, commentary or valuation, is not a representation of fact but rather is a statement of opinion genuinely held by the Charity. Any estimate may not be relied on as a prediction of the selling price or value of the lot and may be revised from time to time.(d) No representations or warranties are made by the Charity whether any lot is subject to copyright or whether the Buyer acquires copyright in any lot.

4. Exclusions and limitations of liability to Buyers(a) In the light of the matters in Condition 3 above and subject to Condition 4(c), the Charity:(I) is not liable for any errors or omissions in the information provided to the Bidder, whether orally or in writing, whether negli¬gent or otherwise;(II) does not give any guarantee or warranty to Bidders and any implied warranties and conditions are excluded (save in so far as such obligations cannot be excluded by law) other than the express warranties given by the Charity to the Buyer in Condition 3 of these Conditions of Business;(III) does not accept any responsibility to any Bidders in respect of acts or omissions (whether negligent or otherwise) by the Charity in connection with the conduct of auctions or for any matter relating to the sale of any lot.(b) Without prejudice to Condition 4(c), any claim against the Charity by a Bidder is limited to the Purchase Price with regard to that lot. The Charity shall not under any circumstances be liable for any conse¬quential losses.(c) None of this Condition 4 shall exclude or limit the Charity’s liability in respect of any fraudulent misrepresentation

made by the Charity, or in respect of death or personal injury caused by the negligent acts or omissions of the Charity.

5. Bidding at Auction(a) The Charity have absolute discretion to refuse admission to the auction. Bidders act as principal unless they have the Charity’s prior written consent to bid as agent for another party. Bidders are personally liable for their bid and are jointly and severally liable with their principal if bidding as agent.(b) The Charity advises Bidders to attend the auction if possible but will seek to carry out proxy and telephone bids that are in pound sterling and that in the Charity‘s opinion, are clear and received sufficiently in advance of the sale of the lot, endeavouring to ensure that the first received of identical written bids has priority.

6. Conduct of the Auction(a) Unless otherwise specified, all lots are offered subject to a Reserve, which shall be no higher than the low presale estimate at the time of the auction.(b) The Auctioneer has discretion at any time to refuse any bid, withdraw any lot, re-offer a lot for sale (including after the fall of the hammer) if he believes there may be error or dispute, and take such other action as he reasonably thinks fit.(c) The Auctioneer will commence and advance the bidding at levels and in increments he considers appropriate and is entitled to place a bid or series of bids on behalf of the Charity up to the Reserve on the lot, without indicating he is doing so and whether or not other bids are placed.(d) Subject to Condition 6(b), the contract between the Buyer and the Charity is concluded on the striking of the Auction-eer’s hammer, whereupon the Buyer becomes liable to pay the Purchase Price.(e) Any post-auction sale of lots offered at auction shall incorporate these Conditions of Business as if sold in the auc-tion room.

7. Payment and Collection(a) Your obligation to pay the Purchase Price arises when the lot is knocked down to you on the fall of the Auctioneer’s hammer in respect of the lot.(b) Unless agreed in writing with you by the Charity, you must pay all sums to the Charity in the currency in which the sale was conducted immediately upon winning the lot and you must ensure that the funds are cleared by the 5th working day after the sale. Payment must be made to the Charity by cheque, bankers draft, cash, credit card or debit card unless otherwise agreed with you in writing by the Charity. There will be a 3% charge for payment by credit or debit card. If you do not pay any sums due in accordance with this clause, the Charity will have the rights to withhold the lot.(c) Title in a purchased lot will not pass until the Charity has received the Purchase Price for that lot in cleared funds. The Charity are not obliged to release a lot to the Buyer until the title of the lot has passed. Any earlier release does not affect the passing of title or the Buyer’s unconditional obligation to pay the Purchase Price.(d) The Buyer is responsible for organising delivery of their purchase and lots must be collected within 5 days of the funds for the full Purchase Price clearing unless otherwise agreed in writing with the Charity. The Buyer will be respon-sible for paying the daily storage cost of £50 per day from the 5th day after the Charity has received the full Purchase Price in cleared funds. Failure to collect a lot within 5 days of the full Purchase Price in cleared funds being received by the Charity, unless a written agreement has been made with the Charity prior to this date, could result in the Charity retaining the title of the lot and the decision regarding this will be at the Charity’s discretion. Purchased lots are at the Buyer’s risk (and therefore their sole responsibility for insurance) from collection or after 5 days of the Purchase Price being received by the Charity in cleared funds.

8. Failure to pay for the lot(a) If the Purchase Price for a lot is not paid to the Charity in full in accordance with the contract, the Charity will be en¬titled, without further notice to you, to exercise one or more of the following rights:(1) To terminate immediately the contract for sale of the lot for your breach ofcontract(2) To re-sell the lot by auction, private treaty or any other means on giving seven days written notice to you of the inten¬tion to resell(3) To retain possession of the lot(4) To remove and store the lot at your expense(5) To take legal proceedings against you for any sum due to the contract for sale and/or damages for the breach of contract(6) To be paid interest on any monies due (after as well as before judgement or order) at the annual rate of 5% per an¬num above the base rate of Lloyds Bank from time to time to be calculated on a daily basis from the date upon which said monies become payable until the date of the actual payment(7) To repossess the lot (or any part thereof) which has not become your property, and for this purpose (unless the buyer buys the lot as a consumer from the Charity selling in the course of a business) you hereby grant an irrevocable licence to the Charity by yourself and your servants or agents to enter upon all or any of your premises (with or without vehicles) during normal business hours to take possession of the lot or part thereof (8) To retain possession of any other property sold to you by the Charity at the sale or any other auction or by private treaty until all sums due under the contract of sale shall have been paid in full in cleared funds(9) To retain possession of, and on three months written notice to sell, without reserve, any of your other property in the possession of the

Charity (including, without limitation, other goods sold to you) and to apply any monies due to you as a result of such sale in satisfaction or part satisfaction of any amounts owed to the Charity;(10) So long as such goods remain in the possession of the Charity, to rescind the contract for the sale of any other goods sold to you by the Charity at the sale or at any other auction or by private treaty and apply any monies received from you in respect of such goods in part or full satisfaction of any amounts owed to the Charity by you.(b) You agree to indemnify the Charity against all legal and other costs of enforcement, all losses and other expenses and costs (including any monies payable to the Charity in order to obtain the release of the lot) incurred by the Charity (whether or not court proceedings will have to be issued) as a result of the Charity taking steps under this clause 8 on a full indemnity basis together with interest thereon (after as well as before judgement or order) at the rate specified in clause 8.a.6 from the date upon which the Charity becomes liable to pay the same until payment by you.(c) On any re-sale of the lot under clause 8.a.2, the Charity will account to you in respect of any balance remaining from any monies received by him or on his behalf in respect of the lot, after the payment of all sums due within 28 days of receipt of such monies by him or on his behalf.

9. The Charity’s liability(a) The Charity will not be liable for any injury, loss or damage caused by the lot after the fall of the Auctioneer’s hammer in respect of the lot.(b) The Charity will not be liable (whether in negligence, other tort, breach of contract or statutory duty or in restitution or under the Misrepresentation Act 1967, or in any other way) for any lack of conformity with, or inaccuracy of the lot or any entry or estimate in relation to the lot.

10. General(a) All images and other materials produced for the auction are the copyright of the Charity, for use at the discretion of the Charity.(b) Should any provision of these Conditions of Business be held unenforceable for any reason, the remaining provi¬sions shall remain in full force and effect.(c) These Conditions of Business are not assignable by any Buyer without the Charity’s prior written consent, but are binding on Buyers’ successors, assigns and representatives. No act, omission or delay by the Charity shall be deemeda waiver or release of any of its rights.

11. Law and Jurisdiction(a) Governing LawThese Conditions of Business and all aspects of all matters, transactions or disputes to which they relate or apply shall be governed by and interpreted in accordance with English law.(b) JurisdictionFor the benefit of the Charity, all Bidders agree that the Courts of England are to have exclusive jurisdiction to settle all disputes arising in connection with all aspects of all matters or transactions to which these Conditions of Business relate or apply.(c) Service of ProcessAll Bidders irrevocably consent to service of process or any other documents in connection with proceedings in any court by facsimile transmission, personal service, delivery by mail or in any other manner permitted by English law, the law of the place of service or the law of the jurisdiction where proceedings are instituted, at the last address of the Buyer known to the Charity or any other usual address.

12. Restrictions on the use of purchased lots(a) The Buyer shall not, and shall procure that any New Party shall not, do, or omit to do, or permit to be done at any time any act:(i) that uses the lot to further any political, quasi-political or charitable objectives;(ii) that associates the lot with any political, quasi-political or charitable campaign or objectives; or(iii) (in connection with the lot) that negatively impacts on the reputation of the charity or which damages the reputation or goodwill associated with the lot or the charity.(b) The Buyer shall indemnify the charity against all liabilities, costs, expenses, damages and losses (including any direct losses, indirect losses, consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by the charity arising out of or in connection with the use of the lot by the Buyer, a New Party or any third party or any breach by the Buyer of this clause 12.13. Intellectual Property Rights(a) The Buyer acknowledges and agrees that no intellectual property rights in the lot will pass to the Buyer as a result of the Buyer’s purchase of the lot. All intellectual property rights in the lot will remain with the charity or the charity’s licensors.(b) The Buyer acknowledges and agrees that no licences in respect of any intellectual property rights will be granted to the Buyer as a result of the Buyer’s purchase of the lot.(c) All goodwill associated with the lot (both at the time of the auction and afterwards) shall belong to the charity. The charity may at any time call on the Buyer to execute a confirmatory assignment of any goodwill associated with the lot and the Buyer shall execute it forthwith.
