The City Council meets the first and third Tuesday of each month beginning at 7:00 p.m. Meetings are held in City Hall at 321 Walnut Street and audio recordings of the meetings are posted in the City's website at www.greencovesprings.com.

The City may take action on any matter during this meeting, including items that are not set forth within this agenda.

In accordance with Section 286.26, Florida Statutes, persons with disabilities needing special accommodations to participate in this meeting should contact the City Clerk's office no later than 5:00 p.m. on the day prior to the meeting.

Public Participation: Pursuant to Section 286.0114, Florida Statutes, effective October 1, 2013, the public is invited to speak on any "proposition" before a board, commission, council, or appointed committee takes official action regardless of whether the issue 'is on the Agenda. Certain exemptions for emergencies, ministerial acts, etc. apply. This public participation does not affect the right of a person to be heard as otherwise provided by law.

Exparte Communications: Oral or written exchanges (sometimes referred to as lobbying or information gathering) between a Council Member and others, including staff, where there is a substantive discussion regarding a quasi-judicial decision by the City Council. The exchanges must be disclosed by the City Council so the public may respond to such comments before a vote is taken.

Minutes of the City Council meetings can be obtained from the City Clerk's office. The Minutes are recorded, but are not transcribed verbatim. Persons requiring a verbatim transcript may make arrangements with the City Clerk to duplicate the recordings, or arrange to have a court reporter present at the meeting. The cost of duplication and/or court reporter will be at the expense of the requesting party.

Persons who wish to appeal any decision made by the City Council with respect to any matter considered at this meeting will need a record of the proceedings, and for such purpose may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based.

WHEREAS, the library card is the most important school supply of all; and

WHEREAS, libraries play an important role in the education and development of children; and

WHEREAS, libraries bridge the learning gap by offering a wide range of digital and print resources; and

WHEREAS, libraries offer free access to technology and innovative educational programming; and

WHEREAS, libraries continue to transform and expend their services in ways that meet the needs of the communities they se1-ve; and

WHEREAS, a free library card is the coolest card you can own; and

WHEREAS, the Green Cove Springs Library, with the support of the Friends of the Green Cove Springs Library, will support the National Library Card Sign-Up Initiative through a photographic display featuring community leaders holding their library cards; and

WHEREAS, the Green Cove Springs Library, a cornerstone of our community, celebrated 45 years of excellent service to our fair city on September 11, 2015.

NOW, THEREFORE, BE IT PROCLAIMED BY THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS, FLORIDA, AS FOLLOWS:

The City Council hereby proclaims the month of September 2015 as "Library Card Sign-Up Month" in Green Cove Springs and urges all residents to sign-up for the "smartest card" at their Green Cove Springs Library.

The City Council desires to commend the Staff members of the Green Cove Springs Library, both past and present, for their longstanding service to our City as well as the Friends of the Green Cove Springs Library for their efforts to preserve and promote the presence of the Green Cove Springs Library in the community.

A true copy of this Proclamation shall be spread upon the Official Minutes of the City Council of the City of Green Cove Springs.

BACKGROUND: Mr. Art Yeaman with Heritage Guides has requested to make a presentation to the City Council regarding "TAPS", the Clay County Fallen Warriors Monument Project. As part of his presentation, he will be recognizing POW-MIA Day.

• It's a rather forgotten, low profile display, at the base of two flag poles near the Jail/Courthouse (US 17 -Orange Ave).

• During 2007 BCC the were in agreement to relocate; however, they were not able to agree on a new location.

• Commissioner Harold Rutledge said

"A place of honor ... is long overdue, :=-==lll•••~= it would be appropriate to list the names. Regardless of where, I think we need it. "

• The names of our Clay County Fallen Warriors (in theater casualties), listed by each war period inscribed on the sides of the base.

• Yes, we are allowing space for future casualties.

• The three rifles sit on a triangular piece of marble, symbolizing a folded flag (as presented to the family of a Fallen Warrior).

• In the center of the marble is a bugle which reflects the Civil War era.

• The barrels of each rifle face down, representing those who have fallen in battle.

The Vietnam Veterans of America, Clay County Chapter # 1059, in

partnership with Heritage Guides and other private sector organizations/volunteers are raising

funds to build a permanent Clay County Fallen Warriors Monument to honor all past, current,

and future - in theater - casualties of military war.

This permanent memorial will replace current monument at the Clay

County Historical Triangle, aka Veterans Triangle, at 915 Walnut St. Green Cove Springs, FL.

32043 (SR 16 West at the Railroad tracks).

Please join our efforts to create a NEW Monument. TAPS (named for Civil War era musical that is

sounded at dusk and funerals) will be placed on top of a 5'x5' marble monument that will have the names of all of our

Clay County Fallen Warriors inscribed. TAPS will be surrounded by a brick area of 500 square feet.

Whereas, in 1979, Congress passed a Resolution authorizing "National Prisoner of War (POW)/Missing in Action (MIA) Recognition Day" to be observed throughout the United States; and

Whereas, since 1986, the third Friday of September has been the national observance day; and

Whereas, in 1990, the 101st Congress recognized the National League of POW/MIA Families' Flag and designated it "as a symbol of our Nation's concern and commitment to resolving as fully as possible the fates of Americans still prisoner, missing and unaccounted for in Southeast Asia, thus ending the uncertainty for their families and the Nation"; and

Whereas, the records of the Defense POW /Missing Personnel Office shows there are 73,515 Americans still unaccounted for from World War II, 7,841 from the Korean War, 1,627 from the Vietnam War, 126 from the Cold War, and at present, 6 from Iraq and recent conflicts; and

Whereas, their families, friends, and countless other Americans still deal with uncertainty regarding their fates; and

Whereas, on this day, the National League of Families' POW/MIA flag is flown across the country as a symbol of bravery and sacrifice of those who answered the call to serve in our Armed Forces; and

Whereas, on this day, we pay tribute to our Nation's Prisoners of War and those who are Missing in Action, and we stand behind our government's steadfast commitment to account for them; and

Whereas, we remember the sacrifice the Prisoners of War and those Missing in Action to fight for our freedoms and uphold peace and security around the world.

NOW, THEREFORE, BE IT PROCLAIMED BY THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS, FLORIDA, AS FOLLOWS:

CITY OF GREEN COVE SPRINGS, FLORIDA STAFF REPORT FOR MEETING OF

SEPTEMBER 15, 2015

SUBJECT: Second Reading of Ordinance No. 0-12-2015, an Ordinance establishing an additional Homestead Exemption in an amount up to fifty thousand dollars for certain qualifying low-income senior citizens pursuant to section 196.075, Florida Statutes, to be applied to Ad Valorem Taxes levied by the City of Green Cove Springs.

BACKGROUND: As part of the budget hearing process for FY 2016, the Administration presented information during the special session on August 18, 2015 from the Clay County Property Appraiser's Office regarding additional Homestead Exemptions for persons 65 and older, copy attached. Article VII of the Florida Constitution and Florida Statutes. 196.075 authorizes counties and municipalities the option to grant by local ordinance two separate additional homestead property exemptions for qualified persons who are 65 years of age and older, and who meet certain requirements. A copy of the ordinance must be delivered to the property appraiser no later than December 1 of the year prior to the year the exemption will take effect. The Council advised staff to proceed with preparing the ordinances for the two separate additional homestead property exemptions to be delivered to the property appraiser no later than December 1, 2015.

Ordinance No. 0-12-2015 addresses Exemption #1 which is an additional homestead exemption up to $50,000 for persons 65 and older who have legal or equitable title to real estate and maintains thereon the permanent residence of the owner, and who have a . limited income as prescribed by Florida law.

FISCAL IMP ACT I FUNDING SOURCE: According to the Clay County Property Appraiser's Office, there are seventy-three (73) parcels located within the city limits of Green Cove Springs that have an estimated city taxable value of $3,112,013 and corresponding ad valorem taxes of $11,203.25. If the city elects to adopt Exemption #1 (at the $50,000 maximum), the taxable value would be reduced to $886,382, with corresponding ad valorem taxes of$3,190.98 (using the 2014 millage rate of 3.6000). This would result in an ad valorem tax reduction of $8,012.27.

RECOMMENDATION: Adopt Ordinance No. 0-12-2015 on Second and Final Reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS, FLORIDA, CREATING CITY CODE SECTION 66-126 ENTITLED "ADDITIONAL HOMESTEAD EXEMPTIONS FOR LOW­INCOME RESIDENTS 65 AND OLDER", IN CHAPTER 66 ENTITLED "TAXATION", ESTABLISHING AN ADDITIONAL HOMESTEAD EXEMPTION IN AN AMOUNT UP TO FIFTY THOUSAND DOLLARS ($50,000.00) FOR CERTAIN QUALIFYING LOW-INCOME SENIOR CITIZENS PURSUANT TO SECTION 196.075, FLORIDA STATUTES, TO BE APPLIED TO AD VALOREM TAXES LEVIED BY THE CITY OF GREEN COVE SPRINGS; PROVIDING FOR THE ANNUAL SUBMISSION OF A SWORN STATEMENT OF HOUSEHOLD INCOME AND SUPPORTING DOCUMENTATION TO THE COUNTY PROPERTY APPRAISER; PROVIDING APPLICABILITY FOR TITLE HELD JOINTLY WITH A RIGHT OF SURVIVORSHIP; PROVIDING FOR AVAILABILITY OR WAIVER OF THE EXEMPTION; PROVIDING FOR TRANSMITTAL OF THE ORDINANCE TO THE PROPERTY APPRAISER; AND PROVIDING FOR REPEALER, SEVERABILITY AND SETTING AN EFFECTIVE DATE.

WHEREAS, Section 196.075, Florida Statutes, authorizes municipalities to provide qualified low income seniors with an additional annual homestead exemption in an amount up to $50,000.00; and '

WHEREAS, the City of Green Cove Springs City Council has determined that the adoption of an Ordinance creating such an additional homestead exemption for qualified low income seniors is in the best interest of the City and provides such seniors with much needed tax relief.

NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS, FLORIDA AS FOLLOWS:

Section 1. PURPOSE AND INTENT. In accordance with Section 196.075, Florida Statutes, any person sixty-five (65) years of age or older who has the legal or equitable title to real estate located within the City of Green Cove Springs and thereon maintains their permanent residence, and whose household income does not exceed Twenty Thousand Dollars ($20,000.00) as annually adjusted pursuant to Section 196.075, Florida Statutes, shall be entitled to make application for an additional homestead exemption of up to Fifty Thousand Dollars ($50,000.00). This additional homestead exemption, if granted, shall be in addition to and shall not replace any other lawfully approved additional homestead exemption for low income seniors authorized under Section 196.075, Florida Statutes, and shall be applied to all ad valorem taxes levied by the City of Green Cove Springs.

Section 2. ANNUAL APPLICATION REQUIREMENT. Every person claiming the additional homestead exemption pursuant to this Ordinance must file a sworn written statement of household income with the Clay County Property Appraiser no later than March 1st

of each year for which such exemption is claimed. Such sworn statement and supporting documentation as required by the Florida Department of Revenue shall be filed on a form prescribed by the Department.

Section 3. RIGHT OF SURVIVORSHIP. If title is held jointly with right of surv:ivorship, the person residing on the property and otherwise qualifying may receive the entire amount of this additional homestead exemption.

Section 4. AVAILABILITY OF EXEMPTION. Section 196.075, Florida Statutes, requires that once approved, this Ordinance be delivered to the Clay County Property Appraiser no later than December 1, 2015, for it to be effective for the 2016 tax year. This additional exemption shall be available commencing with the year 2016 tax roll, and the Clay County Property Appraiser may begin accepting sworn statements of household income and supporting documentation for the year 2016 tax roll as soon as the appropriate forms are available from the Florida Department of Revenue.

Section 5. FAILURE TO FILE APPLICATION. Failure to file the sworn statement of household income and supporting documentation by March 1st of any given year shall constitute a waiver of the exemption privilege for that year.

Section 6. TRANSMITTAL TO THE PROPERTY APPRAISER. Upon adoption by the City Council, the City Clerk sha~l deliver a certified copy of this Ordinance to the Clay County Property Appraiser to be applicable for the tax year 2016.

Section 7. CODIFICATION. This Ordinance shall constitute and be codified as new City Code Section 66-126.

Section 8. REPEALER. Any Ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed to the. extent of such conflict.

Section 9. SEVERABILITY. The various parts, · sections, and clauses of this Ordinance are hereby declared severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the Ordinance shall not be affected thereby.

Section 10. EFFECTIVE DATE. This Ordinance shall become effective upon passage.

On July 27th, you made a request for the Clay County Property Appraiser's Office to provide you with an estimate of the potential ad valorem tax iinpact should the city adopt an ordinance whereby allowing for the implementation of the Additional Homestead Exemptions for Persons 65 and Older. Additionally, you asked "how far in advance" the city would need to enact the ordinance.

Article VIl of the Florida Constitution and Florida Statute s. 196.075 authorizes counties and municipalities the option to granfby local ordinance two separate additional homestead property exemptions for qualified persons who are 65 years of age and older, and who meet certain requirements. A copy of the ordinance must be delivered· to the property appraiser no later than December 1 of the year prior to the year the exemption will .take effect.

The two exemptions are as follows:

Exemption #1: Additional homestead exemption up to $50,000 for persons 65 and older who have legal or equitable title to real estate and maintains thereon the pe1manent residence of the owner, and who have a limited income as prescribed by Florida law.

Exemption #2: Additional homestead exemption for persons 65 and older with limited income and at least 25 years of consistent and pennanent residency. The property must have a just value less than $250,000 (as determined by the property appraiser). The exemption is equal to the assessed value of the property.

Note: Applicants must satisfy the requirements of the first exemption to be eligible for the second exemption. Additionally, the exemptions apply only to the tax levies (millage rates) of the county or municipality granting the exemptions.

As you are aware, the Board of County Commissioners adopted Exemption #1 in 2000. According to our records, there are seventy-three (73) parcels located within the city limits of Green Cove Springs that received the BCC's exemption for the 2015 assessment roll (see enclosed spreadsheet). Those parcels have an estimated city taxable value of $3,112,013 and corresponding ad valorem taxes of $11,203.25. If the city elects to adopt Exemption #1 (at the $50,000 maximum), the taxable value would be reduced to $886,382, with corresponding ad valorem taxes of $3,190.98 (using the 2014 millage rate of 3.6000). This would result in an ad valorem tax reduction of $8,012.27.

Of the seventy-three (73) parcels that may be eligible for Exemption #1, twenty-three (23) may also be eligible for Exemption #2. If the city elects to adopt Exemptions #1 and #2, the taxable value would be further reduced to $837,386, with corresponding ad valorem taxes of $3,014.59. This would result in a combined ad valorem tax reduction of $8,188.66.

196.075 Additionru home§tead exemption for persons (15 and older. -

(1) As used in this section, the term:

(a) "Household" means a person or group of persons living together in a room or group of rooms as a housing

unit, but the term does not include persons boarding in or renting a portion of the dwelling.

(b) "Household income" means the adjusted gross income, as defined in s. 62 of the United States Internal

Revenue Code, of all members of a household.

(2) In accordance with s. 6( d), Art. VIl of the State Constitution, the board of county commissioners of any county

or the governing authority of any municipality may adopt an ordinance to allow either or both of the following

additional homestead exemptions:

(a) Up to $50,000 for any person who has the legal or equitable title to real estate and maintains thereon the

permanent residence of the owner, who has attained age 65, and whose household income does not exceed $20,000; or

(b) The amount of the assessed value of the property for any person who has the legal or equitable title to real

estate with a just value less than $250,000 and has maintained thereon the permanent residence of the owner for at

least 25 years, who has attained age 65, and whose household income does not exceed the income lirnitatiOn

prescribed in paragraph (a), as calculated in subsection (3).

(3) Beginning January 1, 2001, the $20,000 income limitation shall be adjusted annually, on January 1, by the

percentage change in the average cost-of-living index in the period January 1 through December 31 of the immediate

prior year compared with the same period for the year prior to that. The index is the average of the monthly

consumer-price-index figures for the stated 12-month period, relative to the United States as a whole, issued by the

United States Department of Labor.

(4) An ordinance granting an additional homestead exemption as aut.1torized by this section must meet the

following requirements:

(a) It must be adopted under the procedures for adoption of a nonemergency ordinance specified in chapter 125

by a board of county commissioners or chapter 166 by a municipal governing authority, except that the exemption

authorized by paragraph (2)(b) must be authorized by a super majority (a majority plus one) vote of the members of

the governing body of the county or municipality granting such exemption.

(b) It must specify that the exemption applies only to taxes levied by the urut of government granting the

exemption. Unless otherwise specified by the county or municipality, this exemption will apply to all tax levies of the

county or municipality granting the exemption, including dependent special districts and municipal service taxing

units.

( c) It must specify the amount of the exemption, which may not exceed the applicable amount specified in

subsection (2). If the county or municipality specifies a different exemption amount for dependent special districts or

municipal service taxing units, the exemption amount must be uniform in all dependent special districts or municipal

service taxing units within the county or municipality.

( d) It must require that a taxpayer claiming the exemption annually submit to the property appraiser, not later

than March 1, a sworn statement of household income on a form prescribed by the Department of Revenue.

(5) TI1e department must require by rule that the filing of the statement be supported by copies of any federal

income tax returns for the prior year, any wage and earnings statements (W"-2 forms), any :request for an extension of

time to file returns, and any other documents it finds necessary, for each member of the household, to be submitted fo1

inspection by the property appraiser. The taxpayer's sworn statement shall attest to the accuracy of the documents

and grant permission to allow review of the documents if requested by the property appraiser. Submission of

supporting documentation is not required for the renewal of an exemption under this section unless the property

appraiser request:S such documentation. Once the documents have been inspected by the property appraiser, they

shall be returned to the taxpayer or otherwise destroyed. The property appraiser is authorized to generate random

audits of the taxpayers' sworn statements to ensure the accuracy of the household income reported. If so selected for

audit, a taxpayer shall execute Internal Revenue Service Form 8821or4506, which authorizes the Internal Revenue

Service to release tax information to the property appraiser's office. All reviews conducted in accordance with this

section shall be completed on or before June 1. The property appraiser may not grant or renew the exemption if the

required documentation requested is not provided.

(6) fThe board of county commissioners or municipal governing authority must deliver a copy of any ordinance

~µopl~~ under th~s sec~ion to the property appraiser no later than December 1 of the year prior to the year the

~xemption will take effect. If the ordinance is repealed, the board of county commissioners or municipal governing

authority shall notify the property appraiser no later than December 1 of the year prior to the year the exemption

expires.

(7) Those persons entitled to the homestead exemption ins. 196.031 may apply for and receive an additional

homestead exemption as provided in this section. Receipt of the additional homestead exemption provided for in this

section shall be subject to the provisions of ss. 196.131and196.161, if applicable.

(8) If title is held jointly with right of survivorship, the person residing on the property and otherwise qualifying

may receive the entire amount of the additional homestead exemption.

(9) If the property appraiser determines that for any year within the immediately previous 10 years a person who

was not entitled to the additional homestead exemption under this section was granted such an exemption, the

property appraiser shall serve upon the owner a notice of intent to record in the public records of the county a notice

of tax lien against any property owned by that person in the county, and that property must be identified in the notice

of tax lien. Any property that is owned by the taxpayer and is situated ill this state is subject to the taxes exempted by

the improper homestead exemption, plus a penalty of 50 percent of the unpaid taxes for each year and :interest at a

rate of 15 percent per annum. However, if such an exemption is improperly granted as a result of a clerical mistake or

omission by the property appraiser, the person who improperly received the exemption may not be assessed a penalty

and interest. Before any such lien may be filed, the owner must be given 30 days within which to pay the truces,

penalties, and interest. Such a lien is subject to the procedures and provisions set forth ins. 196.161(3).

HOMESTEAD EXEMPTION IN AN AMOUNT UP TO FIFTY THOUSAND DOLLARS FOR CERTAIN QUALIFYING LOW-INCOME SENIOR CITIZENS PURSUANT TO SECTION 196.075, FLORIDA STATUTES, TO BE APPLIED TO AD VALOREM TAXES LEVIED BY THE TOWN OF ORANGE PARK; PROVIDING FOR THE ANNUAL SUBMISSION OF A SWORN STATEMENT OF HOUSEHOLD INCOME AND SUPPORTING DOCUMENTATION TO THE COUNTY PROPERTY APPRAISER; PROVIDING APPLICABILITY FOR TITLE HELD JOINTLY WITH A RIGHT OF SURVIVOR~HIP; PROVIDING FOR AVAILABILITY OR WAIVER OF THE EXEMPTION; PROVIDING FOR TE.ANSMITTAL OF THE ORDINANCE TO THE PROPERTY APPRAISER; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN IMMEDIATE EFFECTIVE DATE

WHEREAS, Section 196. 075, Florida Statutes authorizes

municipalities to provide qualified low income seniors with

an additional annual homestead exemption in an amount up to

$50,000.00, and

WHEREAS, the Orange Park Town Council has determined

that the adoption of an ordinance :. creating such an

additional homestead exemption for qualified low income

seniors is in the best interest of the Town and provides

such seniors with much needed tax relief; now therefore,

BE IT' ORDAINED by the Town Council of Orange Park:

Section 1. Purpose and Intent. In accordance with

Section 196.075, Florida Statutes, any person sixty-five

(65) years of age or older who has the lega~ or equitable

title to real estate located within the Town of Orange Park

and thereon maintains their permanent residence, and whose

household income does not exceed Twenty Thousand Dollars ·

($20,000.00) as annually adjusted pursuant to Section

196.075, Florida Statutes, shall be entitled to make

application for an additional homestead exemption of up to

Fifty Thousand Dollars ($50 I 000. 00) . This additional

homestead exemption, if granted, shall be in addition to

and shall not replace any .other lawfully approved

additional homestead exemption for low income seniors

authorized under Section 196.075, Florida Statutes, and

shall be applied to all ad valorem taxes levied by the Town

of Orange Park.

Section 2. Annual Application Requirement. Every

person claiming the additional homestead exemption pursuant

to this Ordinance must file a sworn written statement of

household income with the Clay County Property Appraiser no

later than March 1st of each year for which such exemption

· Section 3. Right of Survivorship. If title is held

jointly with right of survivorship, the person residing on

the property and otherwise qualifying may receive the

entire amount of this additional homestead exemption.

Section 4. Availability of Exemption. Section

196.075, . Florida Statutes requires that once approved, this

Ordinance be delivered to the Clay County Property

Appraiser no later than December 1, 2014, for it to be

effective for the 2015 tax year. This additional exemption

shall be available commencing with the year 2015 tax roll,

and the Clay County Property Appraiser may begin accepting

sworn statements of · household income and supporting

documentation for the year 2 015 tax roll as soon as the

appropriate forms are available from the Florida Department

of Revenue.

Section 5. Failure to File Application. Failure to

file the sworn statement of household income and supporting

documentation by March l 8 t of any given year shall

constitute a waiver of the exemption privilege for that

year.

Section 6. Transmittal to the Property Appraiser.

Upon adoption by the Town Council / the Town Clerk shall

deliver a certified copy of this Ordinance to the Clay

County Property A~praiser to be applicable for the tax year

2015.

Section 7. Conflicts. In the event that the

provisions of this Ordinance are in conflict with any other

ordinance 1 then the provisions of this Ordinance shall

prevail.

Section 8. Severability. If any section 1 sentence /

clause or phrase of this Ordinance is held to be invalid or

unconstitutional by any court of competent jurisdiction 1

then said holding shall in no way affect the validity of

the remaining portions of this Ordinance.

Section 9. Effective Date. That this Ordinance shall

become effective immediately upon its adoption.

Section 6. Transmittal to the Property Appraiser.

Upon adoption by a super majority of the Town Council, the

Town Clerk shall deliver a certified copy of this Ordinance

provisions of this Ordinance are in conflict with any other

ordinance, then the provisions of this Ordinance shall

prevail.

Section 8. Severability. If any section, sentence,

clause or phrase of this Ordinance is held to be invalid or

unconstitutional by any court of competent jurisdiction,

then said holding shall in no way affect the validity of

the remaining portions of this Ordinance.

SEPTEMBER 15, 2015

SUBJECT: Second Reading of Ordinance No. 0-13-2015, an Ordinance establishing an additional Homestead Exemption in the amount of the assessed value of the property for certain qualifying, long-term resident, low-income seniors who are maintaining their permanent residence thereon, hav~ng a just value less than two hundred and fifty thousand dollars, pursuant to section 196.075, Florida Statutes, to be applied to Ad Valorem Taxes levied by the City of Green Cove Springs.

BACKGROUND: As part of the budget hearing process for FY 2016, the Administration presented information during the special session on August 18, 2015 from the Clay County Property Appraiser's Office regarding additional Homestead Exemptions for persons 65 and older, copy attached. Article VII of the Florida Constitution and Florida Statute s. 196.075 authorizes counties and municipalities the option to grant by local ordinance two separate additional homestead property exemptions for qualified persons who are 65 years of age and older,. and who meet certain requirements. A copy of the ordinance must be delivered to the property appraiser no later than December 1 of the year prior to the year the exemption will take effect. The Council advised staff to proceed with preparing the ordinances for the two separate additional homestead property exemptions to be delivered to the property appraiser no later than December 1, 2015.

Ordinance No. 0-13-2015 addresses Exemption #2 which is an additional homestead exemption for persons 65 and older with limited income and at least 25 years of consistent and permanent residency. The property must have a just value less than $250,000 (as determined by the property appraiser). The exemption is equal to the assessed value of the property. Note: Applicants must satisfy the requirements of the first exemption (Additional homestead exemption up to $50,000 for persons 65 and older who have legal or equitable title to real estate and maintains thereon the permanent residence of the owner, and who have a limited income as prescribed by Florida law.) to be eligible for the second exemption. Additionally, the exemptions apply only to the tax levies (millage rates) of the county or municipality granting the exemptions.

FISCAL IMP ACT I FUNDING SOURCE: According to the Clay County Property Appraiser's Office, of the seventy-three (73) parcels located within the city limits of Green Cove Springs that may be ·eligible for Exemption #1, twenty-three (23) may be eligible for Exemption #2. If the city elects to adopt Exemptions # 1 and #2, the taxable value would be further reduced to $837,386, with corresponding ad valorem taxes of

WHEREAS, Section 196.075, Florida Statutes, authorizes municipalities to provide qualified low income seniors who have maintained their home as their permanent residence for at least twenty-five (25) years and whose home has a just value of less than Two Hundred and Fifty Thousand Dollars ($250,000.00) with an additional annual homestead exemption in the amount of the assessed value of the property; and

WHEREAS, the City of Green Cove Springs City Council has determined that the . adoption of an Ordinance creating such an additional homestead exemption for qualified, low income seniors who are long-term City residents, is in the best interest of the City and provides such seniors with much needed tax relief.

NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS, FLORIDA AS FOLLOWS:

Section 1. PURPOSE AND INTENT. In accordance with Section 196.075, Florida Statutes, any person sixty-five ( 65) years of age or older who has the legal or equitable title to real estate located within the City of Green Cove Springs having a just value less than Two Hundred and Fifty Thousand Dollars ($250,000.00) and which has been maintained as their permanent residence for at least twenty-five (25) years, and whose household income does not exceed Twenty Thousand Dollars ($20,000.00) as annually adjusted pursuant to Section 196.075,

Florida Statutes, shall be entitled to make application for an additional homestead exemption in the amount of th~ assessed value of the property. This additional homestead exemption, if granted, shall be in addition to and shall not replace any other lawfully approved additional homestead exemption for low income seniors authorized under Section 196.075, Florida Statutes, and shall be applied to all ad valorem taxes levied by the City of Green Cove Springs.

Section 2. ANNUAL APPLICATION REQUIREMENT. Every person claiming the additional homestead exemption pursuant to this Ordinance must file a sworn written statement Of household income with the Clay .County Property Appraiser no later than March 1st of each year for which such exemption is claimed. Such sworn statement and supporting documentation as required by the Florida Department of Revenue shall be filed on a form prescribed by the Department.

Section 3. RIGHT OF SURVIVORSHIP. If title is held jointly with right of survivorship, the person residing on the property and otherwise qualifying may receive the entire amount of this additional homestead exemption.

Section 4. AVAILABILITY OF EXEMPTION. Section 196.075, Florida Statutes, requires that once approved by a super majority (a majority plus one) of the members of the City Council, this Ordinance be delivered to the Clay County Property Appraiser no later than December 1, 2015, for it to be effective for the 2016 tax year. This additional exemption shall be available commencing with the year 2016 tax roll, and the Clay County Property Appraiser may begin accepting sworn statements of household income and supporting documentation for the year 2016 tax roll as soon as the appropriate forms are available from the Florida Department of Revenue.

Section 5. FAILURE TO FILE APPLICATION. Failure to file the sworn statement of household income and supporting documentation by March 1st of any given year shall constitute a waiver of the exemption privilege for that year.

Section 6. TRANSMITTAL TO THE PROPERTY APPRAISER. Upon adoption by a super majority of the City Council, the City Clerk shall deliver a certified copy of this Ordinance to the Clay County Property Appraiser to be applicable for the tax year 2016.

Section 7. CODIFICATION. This Ordinance shall constitute and be codified as new City Code Section 66-126.

Section 8. REPEALER. Any Ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

Section 9. SEVERABILITY. The various parts, sections, and clauses of this Ordinance are hereby declared severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid by a court of compete.nt jurisdiction, the remainder of the Ordinance shall not be affected thereby.

Exemption #2: Additional homestead exemption for persons 65 and older with limited income and at least 25 years of consistent and permanent residency. The property must have a just value less than $250~000 (as determined by the property appraiser). The exemption is equal to the assessed value of the property.

As you are aware, the Board of County Commissioners adopted Exemption #1 in 2000. According to our records, there are seventy-three (73) parcels located within the city limits of Green Cove Springs that received the BCC's exemption for the 2015 assessment roll (see enclosed spreadsheet). Those parcels have an estimated city taxable value of $3,112,013 and corresponding ad valorem taxes of $11,203.25. If the city elects to adopt Exemption #1 (at the $50,000 maximum), the taxable value would be reduced to $886,382, with corresponding ad valorem taxes of $3,190.98 (using the 2014 millage rate of 3.6000). This would result in an ad valorem tax reduction of $8,012.27.

Of the seventy-three (73) parcels that may be eligible for Exemption #1, twenty-three (23) may also be eligible for Exemption #2. If the city elects to adopt Exemptions #1 and #2, the taxable value would be further re~uced to $837,386, with corresponding ad valorem taxes of $3,014.59. This would result in a combined ad valorem tax reduction of $8, 188.66.

(1) As used :in this section, the term:

(a) "Household" means a person or group of persons living together :in a room or group of rooms as a housing

unit, but the term does not include persons boarding in or renting a portion of the dwelling.

(b) "Household income" means the adjusted gross income, as defined in s. 62 of the United States Internal

Revenue Code, of all members of a household.

(2) In accordance with s. 6( d), Art. VIl of the State Constitution, the board of county commissioners of any county

or the governing authority of any municipality may adopt an orillnance to allow either or both of the following

additional homestead exemptions:

(a) Up to $50,000 for any person who has the legal or equitable title to real estate and maintains thereon the

permanent residence of the owner, who has attained age 65, and whose household income does not exceed $20,000; or

(b) The amount of the assessed value of the property for any person who has the legal or equitable title to real

estate with a just value less than $250,000 and has maintained thereon the permanent residence of the owner for at

least 25 years, who has attained age 65, and whose household income does not exceed the income limitation

prescribed in paragraph (a), as calculated in subsection (3).

(3) Beginning January 1, 2001, the $20,000 income limitation shall be adjusted annually, on January 1, by the

percentage change in the average cost-of-living index in the period January 1 through December 31 of the immediate

prior year compared with the same period for the year prior to that. The :index is the average of the monthly

consumer-price-index figures for the stated 12-month period, relative to the United States as a whole, issued by the

United States Department of Labor.

(4) An ordinance granting an additional homestead exemption as auL1lorized by this section must meet the

following requirements:

(a) It must be adopted under the procedures for adoption of a nonemergency ordinance specified in chapter 125

by a board of county commissioners or chapter 166 by a municipal governing authority, except that the exemption

authorized by paragraph (2)(b) must be authorized by a super majority (a majority plus one) vote of the members of

the governing body of the county or municipality granting such exemption.

(b) It must specify that the exemption applies only to taxes levied by the unit of government granting the

exemption. Unless otherwise specified by the county or municipality, this exemption will apply to all tax levies of the

county or municipality granting the exemption, including dependent special districts and municipal service taxing

units.

(c) It must specify the amount of the exemption, which may not exceed the applicable amount specified in

subsection (2). If the county or municipality spec~fies a different exemption amount for dependent special districts or

municipal service taxing units, the exemption amount must be uniform in all dependent special districts or municipal

service taxing units within the county or municipality.

( d) It must require that a taxpayer claiming the exemption annually submit to the property appraiser, not later

than March 1, a sworn statement of household income on a form prescribed by the Department of Revenue.

(5) The department must require by rule that the filing of the statement be supported by copies of amy federal

income tax returns for the prior year, any wage and earnings statements (VV-2 forms), any :request for an extension of

time to file returns, and any other documents it finds necessary, for each member of the household, to be submitted fo1

inspection by the property appraiser. The taxpayer's sworn statement shall attest to the accuracy of the documents

and grant permission to allow review of the documents 1£ requested by the property appraiser. Submission of

supporting documentation is not required for the renewal of an exemption under this section unless the property

appraiser requests such documentation. Once the documents have been inspected by the property appraiser, they

shall be returned to the taxpayer or other.wise destroyed. The property appraiser is authorized to generate random

audits of the taxpayers' sworn statements to ensure the accuracy of the household income reported. If so selected for

audit, a taxpayer shall execute Internal Revenue Service Form 8821 or 4506, which authorizes the Internal Revenue

Service to release tax information to the property appraiser's office. All reviews conducted in accordance with this

section shall be completed on or before June 1. The property appraiser may not grant or renew the exemption if the

required documentation requested is not provided.

(6) l:'fhe board of county commissioners or municipal governing authority must deliver a copy of any ordinance

~q~pted . under this se~tion to the property appraiser no later than December 1 of the year prior to the year the

~xe:mption willtake effect. If the ordinance is repealed, the board of county commissioners or municipal governing

authority shall notify the property appraiser no later than December 1 of the year prior to the year the exemption

expires.

(7) Those persons entitled to the homestead exemption ins. 196.031 may apply for and receive an additional

homestead exemption as provided in this section. Receipt of the additional homestead exemption provided for in this

section shall be subject to the provisions of ss. 196.131and196.161, if applicable.

(8) If title is held jointly with right of survivorship, the person residing on the property and otherwise qualifying

may receive the entire amount of the additional homestead exemption.

(9) If the property appraiser determines that for any year within the immediately previous 10 years a person who

was not entitled to the additional homestead exemption under this section was granted such an exemption, the

property appraiser shall serve upon the owner a notice of intent to record in the public records of the county a notice

of tax lien against any property owned by that person in the county, and that property must be identified in the notice

of tax lien. Any property that is owned by the taxpayer and is situated in this state is subject to the taxes exempted by

the improper homestead exemption, plus a penalty of 50 percent of the unpaid taxes for each year and interest at a

rate of 15 percent per annum. However, if such an exemption is improperly granted as a result of a clerical mistake or

omission by the property appraiser, the person who improperly received the exemption may not be assessed a penalty

and interest. Before any such lien may be filed, the owner must be given 30 days within which to pay the truces,

penalties, and interest. Such a lien is subject to the procedures and provisions set forth ins. 196.161(3).

such seniors with much needed tax relief; now therefore,

BE IT. ORDAINED by the Town Council of Orange Park:

Section 1. Purpose and Intent. In accordance with

Section 196. 075, Florida Statutes, any person · sixty-five

(65) years of age or older who has the lega~ or equitable

title to real estate located within the Town of Orange Park

and thereon maintains their permanent residence, and whose

household income does not exceed Twenty Thousand Dollars

($20,000.00) as annually adjusted pursuant to Section

196.075, Florida Statutes, shall be entitled to make

application for an additional homestead exemption of up to

Fifty Thousand Dollars ($50,000.00). This additional

homestead exemption, if granted, shall be in addition to

and shall not replace any .other lawfully approved

additional homestead exemption for low income seniors

authorized under Section 196.075, Florida Statutes, and

shall be applied to all ad valorem taxes levied by the Town

of Orange Park.

Section 2. Annual Application Requirement. Every

person claiming the additional homestead exemption pursuant

to this Ordinance must file a sworn written statement of

household income with the Clay County Property Appraiser no .

later than March 1st of each year for which such exemption

Section 3. Right of Survivorship. If title is held

jointly with right of survivorship, the person residing on

the property and otherwise qualifying may receive the

entire amount of this additional homestead exemption.

Section 4. Availability of Exemption. Section

196.075, Florida Statutes requires that once approved, this

Ordinance be delivered to the Clay County Property

Appraiser no later than December 1, 2014, for it to be

effective for the 2015 tax jear. This additional exemption

shall be available commencing with the year 2015 tax roll,

and the Clay County Property Appraiser may begin accepting

sworn statements of · household income and supporting

documentation for the year 2015 tax roll as soon as the

appropriate forms are available from the Florida Department

of Revenue.

Section 5. Failure to File Application. Failure to

file the sworn statement of household income and supporting

documentation by March 1st of any given year shall

constitute a waiver of the exemption privilege for that

year.

Section 7. Conflicts. In the event that the

provisions of this Ordinance are in conflict with any other

ordinance, then the provisions of this Ordinance shall

prevail.

Section 8 . Severability. If any section, sentence,

clause or phrase of this Ordinance is held to be invalid or

unconstitutional by any court of competent jurisdiction,

then said holding shall in no way affect the validity of

the remaining portions of this Ordinance.

Section 9. Effective Date . That this Ordinance shall

become effective immediately upon its adoption .

CITY OF GREEN COVE SPRINGS, FLORIDA STAFF REPORT FOR MEETING OF

SEPTEMBER 15, 2015

SUBJECT: Second Reading of Ordinance No. 0-14-2015 amending City Code Section 78-83 (6) b., entitled Bulk Power Cost Adjustment.

BACKGROUND: The City adopted Ordinance No. 0-05-2013 on April 9, 2013 which amended the method for computing the monthly Bulk Power Cost Adjustment (BPCA) for electric power costs calculations. The Ordinance states that "In no case, however, will cumulative under or over collections be allowed to exceed six percent of the fiscal year's annual adopted bulk power supply budget without appropriate adjustments to the BPCA. All over recovered funds remaining at the end of a fiscal year would be carried over to the subsequent fiscal year to be applied to the BPCA calculation for future months." Staff recommends increasing the six percent to eight percent of the fiscal year's annual adopted bulk power supply budget without appropriate adjustments to the BPCA. The additional two percent increase would provide funds to offset sudden and/or temporary changes in the cost of power. The additional increase would also allow the City to recover:

1. Cost of power purchased from any bulk power supplier for use in the City's electric system.

2. The cost of transmission services to deliver bulk power to the City's substations.

3. The cost of any equipment owned or leased by the City to generate power. 4. The cost' of operation including fuel and maintenance of City-owned or

operated power generating equipment. 5. Other costs directly related to securing bulk power supply for the City, such as

professional services to issue, evaluate, and negotiate bulk power supply contracts, and regulatory fees associated with bulk power supply.

FISCAL IMP ACT I FUNDING SOURCE: Based on the current FY 2015 budget figures for cost of power, the 6% limitation on under/over collections could not exceed $572K. The 8% limitation on under/over collections would be $763K which would generate an additional $191 K in over recovered funds that can be used for the cost of bulk power supply and related expenses actually incurred ,by the City to provide electric service to its customers as explained above.

RECOMMENDATION: Adopt Ordinance No. 0-14-2015 on Second and Final Reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS; FLORIDA, AMENDING CITY CODE SECTION 78-83 (6) b., ENTITLED "BULK POWER COST ADJUSTMENT"; PROVIDING FOR REPEALER, SEVERABILITY, AND SETTING AN EFFECTIVE DATE.

WHEREAS, fuel costs and purchased power costs fluctuate from month to month and it is necessary to monitor and make adjustments to retail rates in response to these changing costs in a timely manner; and

WHEREAS, a Bulk Power Cost Adjustment (BPCA) policy based on actual bulk power costs allows the City to recover the costs of bulk power supply and related expenses as well as stabilize fluctuations in the BPCA; and

WHEREAS, the cumulative under or over collections in no case, however, will be allowed to exceed eight percent (8%) of the fiscal year's annual adopted bulk power supply budget without appropriate adjustments to the BPCA; and

WHEREAS, in order to change the percentage, the City Council has proposed an Ordinance.

NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF GREEN COVE SPRINGS, FLORIDA, AS FOLLOWS:

Section 1. City Code Section 78-83 (6) b., set forth in Section 78-83 of the City Code entitled "Bulk Power Cost Adjustment", is hereby amended to read as follows:

Sec. 78-83. Rate Schedule for electricity furnished.

b. Bulk power cost adjustment. The bulk power cost adjustment (BPCA) will be determined each month by the City. This factor is designed to recover the cost of bulk power supply and related expenses actually incmTed by the City to provide electric service to its customers. Bulk power supply costs shall include the following:

1. Cost of power purchased from any bulk power supplier for use in the City's electric system.

2. The cost of transmission services to deliver bulk power to the City's substations. 3. The cost of any equipment owned or leased by the City to generate power.

4. The cost of operation including fuel and maintenance of City-owned or operated power generating equipment.

5. Other costs directly related to securing bulk power supply for the City, such as professional services to issue, evaluate, and negotiate bulk power supply contracts, and regulatory fees associated with bulk power supply.

If the BPCA under recovers the actual costs of bulk power supply and related expenses, the City will increase the BPCA to collect the under recovery. If the BPCA over collects actual costs of bulk power supply and related expenses, the City will decrease the fuel adjustment to credit back to customers the over recovery. In order to stabilize fluctuations in the BPCA, the City Manager may determine to phase in such increases or decreases over time. In no case, however, will cumulative under or over collections be allowed to exceed six percent eight percent (8%) of the fiscal year's annual adopted bulk power supply budget without appropriate adjustments to the BPCA. All over recovered funds remaining at the end of a fiscal year would be carried over to the subsequent fiscal year to be applied to the BPCA calculation for future months.

Definitions.

Bulk power cost (BPC) means all electric energy costs during the calculation period related to the purchase of wholesale power and the capacity costs associated with the Joint Action Agency ownership of generation.

Bulk power cost adjustment (BPCA) means the difference between the adjusted bulk power unit cost and the power cost base, stated in cost per kilowatt-hour, as determined by the calculation. This is also referred to as the purchased power/fuel adjustment factor.

Bulk power cost true-up (BPCT) means the difference between the bulk power cost actually incurred and the bulk power cost recovered through the power cost base and the bulk power cost adjustment that may be deposited in or removed from a true-up account, as applicable. The BPCT is that p011ion of the true-up account to be recovered from or returned to customers through the calculated BPCA.

Power cost base (PCB) means the bulk power-related cost that is embedded within the base retail rate, stated in cost per kilowatt-hour. The energy charge includes a power cost base of $0.060150 per kWh in the base rate.

Rate stabilization fund adjustment (RSFA) means funds to offset sudden and/or temporary changes in the cost of power may be deposited in or removed from a rate stabilization fund, as applicable. The RSF A is that portion of the rate stabilization fund to be recovered from or returned to customers through the calculated BPCA.

System loss factor means the factor applied to adjust the bulk power unit cost from a basis of cost per kilowatt-hour of purchases to a basis of cost per kilowatt­hour of sales.

Section 2. REPEALER. Any Ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

Section 3. SEVERABILITY. The various parts, sections, and clauses of this Ordinance are hereby declared severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the Ordinance shall not be affected thereby.

SEPTEMBER 15, 2015

SUBJECT: Public Hearing- Resolution R-25-2015, a Resolution amending the operating budgets for Fiscal Year 2015 per Exhibit "A".

BACKGROUND: Exhibit "A" is attached listing the budget adjustment #6 for fiscal year ending September 30, 2015. This adjustment is needed to record the debt forgiveness of interfund balances between the Electric, Water, Wastewater, Solid Waste and Customer Service Funds. The Council approved the debt forgiveness of interfund balances qetween the Electric, Water, Wastewater, Solid Waste and Customer Service Funds in the amount of $213,067 during the June 2, 2015 Council Meeting.

On May 6, 2014 the Council was presented the Audited Financial Statements for FY 2013 ending September 30, 2013 by Mr. Ron Whitesides with Purvis Gray and Company. Mr. Whitesides reviewed the changes made during FY 2013 including the moving of cost allocations for and to the actual Utility Fund departments. The Audited Financial Statements showed the Business-type Internal Service Fund owing the Electric Fund $213,067 at September 30, 2013. The interfund balance between the Electric Fund and Business-type Internal Service Fund arose as a result of the separation of the utility funds and is not expected to be repaid within one year. During the Budget Policy Decision Meeting on May 5, 2015, the Council was asked to make a policy decision regarding the interfund balance between the Electric Fund and the Business-type Internal Service Fund that occurred by segregating the equity in the various Utility Funds. The Internal Service Fund receives all of its revenues from Interfund Transfers from the various utilities. Since the Internal Service Fund is funded by all 4 Utility Funds (Electric, Water, Wastewater and Solid Waste) through customer service allocations, it would appear the $213,067 should be split equitably between all 4 Utility Funds (Electric, Water, Wastewater and Solid Waste). A motion was approved during the Budget Policy Decision Meeting on May 5, 2015 to forgive the cumulative previous year's debt between the Business-Type Internal Service Fund and the 4 Utility Funds (Electric, Water, Wastewater and Solid Waste) in the amount of $213,067 and to schedule a budget hearing which would occur during the final quarter of FY 2015.

FISCAL IMPACT I FUNDING SOURCE: Transfer $97,524 from Retained Earnings within the Electric Fund to Customer Service Fund Interfund loan repayment. Transfer $55,246 from Retained Earnings within the Water Fund to Customer Service Fund Interfund loan repayment. Transfer $53,677 from Retained Earnings within the Wastewater Fund to Customer Service Fund Interfund loan repayment. Transfer $6,620

from Retained Earnings within the Solid Waste Fund to Customer Service Interfund loan repayment. The equitable split between the Electric Fund ( 46% ), Water Fund (26% ), Wastewater Fund (25%) and Solid Waste Fund (3%) is based on FY 2015's Budget Split for Customer Service Allocations to the Customer Service Fund. This will not impact any cash balances.

RECOMMENDATION: Staff recommends approval of Resolution R-25-2015 amending the 2015 Operating Budgets for the Electric, Water, Wastewater, Solid Waste and Customer Service Funds per Exhibit "A".

WHEREAS, it is necessary to increase the Fiscal Year 2014-2015 Special Revenue Building Department Fund budget to reflect revenues and expenses associated with unanticipated revenues . from residential building permit fees, residential plan review fees, contractor license fees and school impact fees and to fund unanticipated expenditures; and

WHEREAS, it is necessary to hold a public hearing to approve the amendment to the Special Revenue Building Department Fund to recognize unanticipated revenues and unanticipated expenditures for the fiscal year ending September 30, 2015; and

WHEREAS, interim budget adjustments are necessary for changes in expenditures and revenues during the period.

NOW, THEREFORE, BE IT RESOLVED BY THE CI1Y COUNCIL OF THE CI1Y OF GREEN COVE SPRINGS AS FOLLOWS:

Call to Order

A duly called Special Session of the Green Cove Springs City Council was called to order Tuesday, August 4, 2015, at 9:00 a.m. in the City Council Chambers, 321 Walnut Street, Green Cove Springs, Florida.

Invocation and Pledge of Allegiance to the Flag

The invocation was given by Mayor Royal followed by the Pledge of Allegiance to the Flag of the United States of America.

COUNCIL BUSINESS

1. Overview of General Fund.

Mayor Royal recognized Ms. Judd who reviewed the proposed budget for the General Fund via a PowerPoint Presentation (see attachment marked Exhibit "A"). She also advised that the proposed. budget did not include any merit raises or Cost of Living Adjustments (COLA), but did include the Wage Study.

2. Taxable Values - 2015

Ms. Fleet presented the 2015 Book of Taxable Values for properties in the City limits.

3. Presentation by the Haught Group - Health Insurance Overview.

Mayor Hampshire recognized Phil Haught, The Haught Group, 125 Clearlake Drive, Ponte Vedra Beach, who reviewed the proposed changes for the Health Insurance coverage plans for FY 2015/2016. Mr. Haught advised that the proposed increase had started at 32%. He believed the reason behind the increase was due to the following issues:

• 13 large claims of which 4 were over $100,000; • the average age of the workforce was 47 which translated into higher RX charges; and • the City, with 50-100 employees, fell into the small group category.

He also advised that rates would increase significantly again next year due to the Affordable Healthcare Act. Council Member Timberlake offered a suggestion that the City look into collaborating with other local government agencies for next year.

After comparing plans from AvMed, Aetna, UnitedHealthcare, and Blue Cross and Blue Shield (BCBS), he had been able to negotiate it down to 20% through BCBS. Although the rate increases were somewhat less with the other carriers, he believed that the plan coverages were better through BCBS.

Further discussion ensued regarding the percentage splits of premium payments (cost sharing) between the City and the employees and various other options of offering health insurance to the employees. It was noted that the City would pick up 75% of the cost increase. There would be a slight increase in the employee cost sharing and another decrease in the insurance subsidy payments from $3,291 to $1,600 for the 16 employees who waived their coverage with the City. In addition, Mr. Haught suggested offering the employees the option of a Health Spending Account (HSA) and/or Flexible Spending Account (FSA) . This would allow employees more control over how their health insurance funds were spent.

Mayor Royal supported the recommendation but would like to see Staff look at plan options next year.

A MOTION WAS MADE BY COUNCIL MEMBER TIMBERLAKE TO ACCEPT THE RECOMMENDATION TO GO FORWARD AS RECOMMENDED FOR THIS YEAR, AND BEYOND THAT, HE WOULD LIKE TO HAVE MORE EARLY WORK DONE ON ALTERNATIVES NEXT YEAR ON HOW WE CAN SHIFT THE FOCUS AWAY FROM THE CONTINUED INCREASES SEEN BY SMALL GROUPS; THAT MAY BE GOING WITH THE COUNTY, THE STATE, THE CITIES, OR WHATEVER POOL GROUP THE CITY COULD GET HOOKED UP WITH AND TO LOOK AT ALTERNATIVES AND WAYS TO MAKE SURE THE EMPLOYEES RECOGNIZE THE AMOUNT OF MONEY THE CITY PAYS ON THEIR BEHALF. THE MOTION WAS SECONDED BY VICE MAYOR ·BRALY. THERE BEING NO FURTHER DISCUSSION, THE MOTION WAS PASSED BY THE FOLLOWING ROLL CALL VOTE: AYES - COUNCIL MEMBERS PAMELA J. LEWIS, ROY M. A workshop for employees was suggested by Council Member Lewis. Ms. Judd noted that the insurance open enrollment meetings were scheduled and she would put together a memo for employees that would make it clear how the Council has directed the City Manager to proceed. Mr. Haught also noted that the option of offering Flexible Medical and Dependent Care Spending Accounts to the employees; a minimum of 1 O employees was required.

4. Presentation by Outside Agency Funding Requests

b. Council on Aging of Clay County

Andrew DeCandis, Executive Director, Council on Aging of Clay County, 600 Walnut Street, Green Cove Springs, reviewed the benefits of the funding request of $35,000 or assistance with their utility bills. Mayor Royal reminded Mr. DeCandis and the City Council that he considered this request as "double dipping." The citizens of the City already contributed through their taxes and the City did not receive any taxes and revenues from the County. In addition, the City contributed through its support of their special events, i.e. road closures and police security details. Ms. Judd reminded the Mayor that the proposed budget did not include this funding request.

a. Episcopal Children's Services

Teresa Matheny, Vice President of Family and Provider Services, Episcopal Children's Services (ECS), 8443 Baymeadows Road, Jacksonville, reviewed the benefits of the funding request of $1,000. She explained that the state matches these funds with $16 for every $1 the City contributes; therefore, the City's $1,000 grant would bring in a little over $16,000 to be spent for childcare in the community. In response to Mayor Royal's inquiry, Ms. Judd advised that the renovation project of the facilities leased by ECS at the Augusta Savage Arts & Community Center was a year behind schedule but was finally getting to the construction phase. This was due, in part, because the contactor had left. The plan now called for the project to be completed before the beginning of the school year.

5. Wage and Fringe Benefits.

Mayor Royal recognized Ms. Judd who reviewed the following:

• Should look at benefits package outside of health insurance benefits; • Fund were included for the Wage Study; • She considered the plans to be very rich but felt the City should look at benefits for new

hires; • FRS - numbers should be run and reviewed; • She did not support any increase in benefits for the Police Pension Plan; • She had a positive meeting with Luke Byrne, Chairman of the Police Pension Board, and

suggested the City Council hold a joint special session with the Police Pension Board; • The State's base multiplier was at 2. 75 and the City was set at 3; and • It was a policy decision to be made by the City Council and should be set by Resolution; • Nationwide - employees do not contribute anything but the City contributes 10%; and • Two (2) employees are in ICMA where the City contributes 15%.

Council Member Timberlake requested that all employees be provided with a document that will explain the totality of their compensation package.

Mayor Royal stated he would like to come back to this item after review of the others. Ms. Judd distributed a spreadsheet documenting the percent of increase for each employee as requested and referenced her Staff Report of June 2nd regarding the mid-year revised salary ranges for the Line Crew Personnel in the Water, Sewer and Electric Funds.

6. City Council review of the General Fund Revenues.

Mayor Royal recognized Ms. Guthrie who reviewed the General Fund Revenues via MSExcel spreadsheets (see attachment marked Exhibit "B"). She explained that the numbers were based on state estimates and noted that property values had increased.

Council Member Hampshire entered the meeting at 11 :44 a.m.

Ms. Guthrie also reviewed the amount of the transfer from the Electric Utility Fund of $900,000 and $264,370 from the Cost Allocation Study.

Council Member Timberlake felt the City needed to do a better job at educating and communicating with the citizens about what it costs to run a city.

A break for lunch was taken from 11 :55 a.m. and reconvened at 12:26 p.m. with all Council Members and City Staff present.

7. City Council review of the General Fund Operating Expenditures for:

Ms. Judd advised the City Council that the City Clerk had left the meeting to prepare a Supplemental Agenda for this evening 's regular session and would return shortly. She and the Department Heads reviewed the General Fund Operating Expenditures for the following Departments:

a. City Council - Ms. Judd noted that funds had been added back into the budget for the Annual Florida League of Cities Conference. No changes were made.

c. City Manager - No changes were made.

e. Personnel - No changes were made.

f. Augusta Savage Arts & Community Center - No changes were made.

Ms. Judd recommended the City Council review the CIP as they progressed through the budget for each Department. Mayor Royal advised he would rather review the CIP as a separate item. Further discussion included the CIP requests for a playground, library, and new Gym floor.

b. City Clerk - The City Council discussed the proposed funding of $20,000 for the complete Recodification of the City Code project. It was last done in 2001 and Section 2.17 of the City Charter required that it be completed at least every 1 O years. This project would encompass a 10-15 month span.

Ms. Judd advised there were Ordinances that were currently against State Statute and non-compliant. She recalled when she had worked on the recodification for the City of Alachua and it had required an intensive amount of work on the part of the City Clerk and City Attorney. Mr. Arnold believed the City was at a low risk of any legal action and as a City would never be in total compliance. Vice Mayor Braly suggested postponing this project for a year since Ms. Clevinger was taking college courses and FACC courses. Council Member Hampshire agreed suggesting this project be postponed until she finished her courses. Council Member Timberlake suggested delaying the project until the City

Clerk had more time to work on it. Ms. Clevinger was requested to further research this with MuniCode and bring it back to the City Council.

The funding request for approximately $4,300 for the scanning of historical documents was also discussed.· Ms. Clevinger advised she had just received the proposal late in the day before. She had found out that MuniCode had scanned the Minutes from 1891 to 1989 using Laserfiche and would like to research this project further with MuniCode. No other changes were made.

g. Finance - No changes were made.

h. Information Technology - The City Council discussed outsourcing vs. current employee costs. The City Manager was having the costs reviewed by an outside party. No changes were made.

i. General Services (includes Special Events) - Mayor Royal requested and Ms. Hunter advised she would provide him with the quarterly report of claims paid, the number and amount of liability claims filed, and how an increase of the deductible would affect the premiums. No changes were made.

d. City Attorney - No changes were made.

j. Development Services - No changes were made.

k. Code Enforcement - No changes were made.

I. Police - Mayor Royal requested a list of personnel prior to the August 18th meeting. Ms. · Hunter was to check with the Florida League of Cities regarding any possible liability premium discounts for departmental training. Mayor Royal expressed his disagreement to the increases in the budget versus the other departments. Chief Musco countered by recalling how previous City Councils had charged him with cleaning up the City and reviewing the strides his department and Police Officers had made in the community since he became Chief in 2006. Crime rates were down, drug crime rates were down, and the volunteer rates in the community from the Police Officers was up; but he believed the City was at the "tipping point" due to other crimes now being committed in other areas of the City. Ms. Judd disagreed with some of the comments made and explained how she believed other departments had been lacking in funding due to the amounts budgeted (35%) for the Police Department. She believed it was a good mix now but felt more funds should be directed to the Parks and Recreation so that attention was given to kids on the front side versus the back side. Council Member Timberlake compared the cost of maintaining versus investing in the City. He believed it was the City's responsibility to educate the community on the costs needed to run a City based on the level of services the citizens wanted . No changes were made.

A break was taken from 4:51 p.m. and reconvened at 5:00 p.m. with all Council Members and City Staff present.

Ms. Judd advised the City Council that a Supplemental Agenda had been prepared for the Regular Meeting at 7:00 p.m.

Ms. Judd requested an emergency motion to allow her to move to the next qualified firm for negotiations on the Spring Park project should the negotiations with the top ranked firm not be successful.

Ms. Judd noted that the line items in the Parks & Recreation budget for Salaries - Parttime Pool ( 1312) and Workers Comp - Pool (2412) were overstated by a total of $26, 500. No changes were made to these budgets.

8. Special Revenue Funds:

Mayor Royal recognized Ms. Judd who reviewed the Special Fund Revenues via MSExcel spreadsheets (see attachment marked Exhibit "C").

a. Building - Ms. Fleet requested an additional $12,000 for the scanning of building plans. Ms. Judd suggested taking the funds from the line item for the Contract Building Inspector (3100).

b. Special Law Enforcement Trust - Per State Statute, this account required City Council approval prior to expending any funds. No changes were made.

Call to Order

The regular session of the Green Cove Springs City Council was called to order Tuesday, August 4, 2015, at 7:00 p.m. in the City Council Chambers, 321 Walnut Street, Green Cove Springs, Florida.

Invocation and Pledge of Allegiance to the Flag

The invocation was given by Bob Page followed by the Pledge of Allegiance to the Flag of the United States of America.

Mayor Royal recognized Chad Patrick, CEO of Orange Park Medical Center, who presented a donation of physical fitness equipment to the Green Cove Springs Police Department's Fitness Room.

Mayor Royal recognized Brian Baker and Tom Beck, Verizon Wireless, who advised the City Council that they would be sponsoring the construction of dugouts at the Augusta Savage Arts and Community Center and Vera Francis Hall Park softball fields.

Mayor Royal recognized Mike Kelter, 630 Myrtle Avenue, Green Cove Springs, who expressed his concerns regarding security and code enforcement issues in his neighborhood. Ms. Judd gave a brief update on Mr. Kelter's concerns.

New Officer Swearing-In Ceremony - Brett Morando and Michael Patrick

Mayor Royal led the swearing-in ceremony of Officers Brett Morando and Michael Patrick with Officer Morando's wife and Office Patrick's brother pinning the GCS Police Badges on their uniforms. Chief Musco asked them to recite the Police Officer's Code of Ethics.

Mr. Arnold read the title of Ordinance No. 0-10-2015 (see attachment marked Exhibit "A") into the record as follows:

Mayor Royal opened the Public Hearing and recognized the following for comments:

• Calvin Wilcox, 700 Walnut Street, Green Cove Springs, who expressed his opposition to the rate increases. Mr. Wilcox cautioned the City Council to be very certain that this was the only option available.

• Carolyn Harrell, 1514 Julia Street, Green Cove Springs, who expressed her opposition to the rate increases. Ms. Harrell complained that "they" (FMPA) were spending money frivolously and it was not fair to put this on the backs of the citizens. She accused the City Council of not having to pay the increases. She referred to Council Member Timberlake, Vice Mayor Braly, and Mayor Royal because they lived in Magnolia Point and did not live in the City limits. She believed the City had "double" billed her on her utility bill. Mayor Royal corrected this misinformation stating the City Charter required all City Council Members to live within the City limits and that Magnolia Point was located within the City limits. Ms. Judd requested Ms. Guthrie meet with Ms. Harrell to go over her utility bill issues.

• Mike Kelter, 630 Myrtle Avenue, Green Cove Springs, who clarified for the audience, that he was okay with the increase of the base rate charges as long as they would stay in the City and be used only for improvements of the infrastructure. Mr. Kelter also noted that sales of electricity were down due to the conservation efforts of the residents.

There being no further comments, the Public Hearing was closed.

City Manager Judd acknowledged she also lived in the City and paid the same rates. She reviewed the issues with FMPA and what the City had done to try to exit from the contract. In addition, she reviewed the mail-out that documented the rate increases.

Mayor Royal recognized Calvin Wilcox and reviewed what the City had accomplished over the years to maintain and upgrade the electrical system. Vice Mayor Braly reviewed the history with the hedging by FMPA, Contract Rate of Delivery (CROD), and other issues with FMPA.

Allowing the Public Hearing to continue, Mayor Royal recognized Joe Sobotta, 212 North Street, Green Cove Springs, who believed the City was charged more for power because less was being used. He also acknowledged the need for the rate increases but also noted the lack of upgrades and insulation to the aging structures/homes in the City.

Mayor Royal recognized Mike Kelter who confirmed via the City Manager that the rate increases would net approximately $300,000 per year for infrastructure. He also noted that power sales were down over the past four (4) years.

There being no further comments, Mayor Royal closed the Public Hearing.

Council Member Timberlake noted the City acted as the CEO of the electric system and it was their responsibility to look at what it costs to run the electric system and to establish rates that allow us to reinvest in the electric system. He reminded the City Council that the Electric system infrastructure had been run in a "break/fix mode" over many years and the City needed to invest in the system now and for the future. In addition, he praised the media for publishing the fact that the base rate would double but also admonished them for not publishing the fact that the break for residential usage would go from 500 to 1,000 kilowatt hours before an increase in bills would be seen. He encouraged the media to publish both sides of the story.

Discussion ensued with the City Council regarding the monthly FMPA Report for May 2015 as presented by Mr. Page. Ms. Judd distributed to the City Council evaluation forms for Nick Guarriello, CEO, and Fred Bryant, General Counsel, of FMPA, requesting that any comments be submitted to her before the phone conference on Thursday. Mr. Page also advised that comments could be directly e-mailed to FMPA.

A MOTION WAS MADE BY COUNCIL MEMBER HAMPSHIRE TO ACCEPT THE REPORT AS PRESENTED. THE MOTION WAS SECONDED BY COUNCIL MEMBER TIMBERLAKE. Ms. Judd advised that she had placed additional information on the upcoming 2016 APPA Conference in Orlando.

2. North Florida Regional Council (NFRC) 2016 Legislative Priorities for Northeast Florida. Clevinger

Discussion ensued with the City Council regarding the Council's 2016 Legislative Priorities for Northeast Florida. The City Council ranked their Legislative Priorities in the following order:

1 . Outer Beltway; 2. Mooring Fields; and 3. Spring Park Funding for Protection of the Springs.

Council Member Lewis also suggested including language regarding economic development to the Spring Park funding item.

After further discussion, the City Council requested Ms. Clevinger to formalize these three (3) items and bring this item back on the next Agenda for further discussion.

SUBJECT: REVIEW AND APPROVAL OF REVISED GUIDELINES AND APPLICATION FOR THE GATEWAY CORRIDOR/CENTRAL BUSINESS DISTRICT MATCHING GRANT PROGRAM

BACKGROUND: At the Visioning Session on April 21 5\ one of the major needs for the

City was improving the curb appeal, the redevelopment of US 17 and the downtown district. The need for redevelopment of US 17 was a component of the Tomorrow's Vision Plan. The Gateway Corridor zoning district was established in 2007 to promote the redevelopment of US 17. In addition, the Central Business District (CBD) was established in 1996 to promote redevelopment of the Walnut Street area. The boundaries of the CBD include an area on US 17.

To promote improvements to existin_g properties, the matching grant program was developed. Funds can be used for landscaping improvements, streetscape, streets and sidewalks, lighting, facade improvements, and conversion of pole signs to monument signs for properties in the Gateway Corridor and Central Business District. The City Council budgeted $35,000 in FY 2013 and FY 2014, $20,000 in FY 2015, and is proposing $20,000 in FY 2016 for the program.

The following are the parameters for the matching grant program:

• Maximum matching grant is shown below for improvements in these categories o Landscaping- $2,500 o .Sidewalks, Streetscape - $2,500 o Lighting - $2,500 o Signs - $5,000 o Facades /Building Improvements- $5,000 o Dumpster relocation and enclosure - $500

• Site Development Plan application and Building Permit Fees paid by an applicant will be counted towards the cash match.

• All applications will be reviewed by staff and approved by City Council. • Applications may be submitted throughout the fiscal year and will be approved

until all funds have been spent. • Grant funds would be reimbursed upon completion of the awarded project.

The initial program guidelines required ap~licant to complete the project within 90 days. Extensions were given to September 30t , in order to complete the project within the fiscal year the project was approved.

In fiscal year 2014-2015, the Council approved $18,000 for improvements the Rivers property located at 401 Ferris Street. As of August 2015, the project has not begun and it seemed very unlikely that the project would be completed by the end of the fiscal year, September 30th. In July and August, the City received grant requests that would have exceeded the budgeted funds for FY 2014-2015. The Council approved these requests. At the Council budget hearings, it was suggested that the program application guidelines be revised to require a project be completed within 90 days. This would alleviate the situation that occurred in FY 2014 - 2015. The attached program guidelines and application reflects this change.

FISCAL IMPACT/FUNDING SOURCE: Funds for the program are included in the Proposed FY 2015-2016 budget in the amount of $30,000.

RECOMMENDATION: Staff recommends approval of the revised guidelines and application for the Gateway Corridor and Central Business District Matching Grant Program.

GATEWAY CORRIDOR AND CENTRAL BUSINESS DISTRICT

MATCHING GRANT PROGRAM GUIDELINES

The City of Green Cove Springs has created a Gateway Corridor/Central Business District Matching Grant Program to assist owners of properties within the Gateway Corridor and the Central Business District in upgrading their properties to bring them into compliance with current codes. Eligible projects in the boundaries of the Gateway Corridor or the Central Business District may receive grant awards up to 50% of the total project cost as a reimbursement for expenditures. The maximum grant allowed is based on the project type. The following are the maximum grant amounts per project type:

• Landscaping - $ 2,500 • Sidewalks, Streetscape - $ 2,500 • Lighting - $2,500 • Ground Signs - $5,000 • Facades /Building Improvements/Building Sign- $5,000 • Dumpster relocatiqn and enclosure - $500

Only one project type per parcel, as defined by the Clay County Property Appraiser's Records, may be submitted. The City of Green Cove Springs Development Services Department shall manage the grant with oversight and final approval by the Green Cove Springs City Council. All completed applications shall be forwarded to the Site Development Review Team (SORT) for review and recommendations. The SORT will assign points to each project based on established program priorities set by the City Council. SDRT's recommendations will be forwarded to the City Council for final approval.

The City Council has budgeted $20,000 for the 2015 - 2016 fiscal year, which begins October 1, 2015, to the Gateway Corridor/Central Business District Matching Grant Program. Applications may be submitted throughout the year and will be approved based on availability of funds. Once funds have been approved by the City Council, the applicant shall have 90 days to complete the project and request reimbursement. Grant funds would be reimbursed upon completion of the awarded project. If the project is not completed in 90 day, it is subject to loss of the funding . Request for extensions may be requested and are subject to City Council approvaL All projects must be completed funds expended by the end of the fiscal year, September 30, 2016. Any expenditure made after September 30, 2016,· will not be reimbursed.

TYPES OF ELIGIBLE PROJECTS • Exterior building renovation which improves the appearance of the facility • Pressure washing and/or repainting of the exterior of buildings • Installation of landscape buffers where none exist • Installation of tree island or landscape islands in older non-conforming parking

lots • Replacement of non-conforming signs with monument signs • Installation or rehabilitation of doors or windows

Site Development Plan application and Building Permit fees shall count towards project match . Landscaping and irrigation projects are eligible for funding by the grant program. Once a project is funded, it is the responsibility of the property owner to maintain the improvements.

General building or facility maintenance is not eligible for funding under the pilot program .

Properties that have Code Enforcement violations are not eligible for funding .
