Toinforrn the Minister of the certification of the agreement between the parties in.the above land claim by the Regional Land Claims Commissioner for theLimpopo: Mashile Mokono in terms of Section 14(3) of the Restitution of LandRight Act 22 of 1994, as amended.., ..' '. "

1.3 To request the Minister to approve the Settlement Agreement reached by theparties in terms of Section 420 of the Restitution of Land Rights Act 22 of 1994as amended. :/.

1.4 To request the Minister to approve a total amount of R3,084,OOO.OO for purchaseof land as per the Settlement Agreement proposed herein.

1.5 To request the Minister to authorise the Regional Land Claims Commissioner forLimpopo, Mashile Mokono or his nominee to sign the Settlement Agreement,Sale Agreements as well as the necessary property transfer and registrationdocuments on behalf of the State. . .

2.2.1 The Claimed land is composed ofthe farms: Doornlaagte 787 LS, Eeerste Geluki790 LS, Vrede 789 LS, Klein Begin 833 LS, Mooiplaats 815 LS, Weeskind 7861.LS, Kleinfontein 834 LS (now known' as the farm Bloemspruit 871 LS),iBlinkwater 784 LS, Uitval 817 LS, Droogegrond 814 LS (Portion 2 is now part ofthe farm Zet Zoet 878 LS), Zandbult 813 LS (now part of the farm Aalwyn 880LS), Magataspruit 816 LS, Rietgat 836 LS, .Smitskraal 788 LsiWilgeboschfontein 818 LS, Bloemtuin 828 LS, Waterval 785 LS and Geluk 783LS in the Capricorn District of Limpopo.

2.2.2 The MakgatoTribe initially lodged a claim on 44 farms (Annexure "C1 "). Durin~

. the research interactions with the Regional Land Claims Commission: Limpopo,it was found that the Tribe ~ad been dispossessed of some.of the farms priort~1913. The Makgato Tribe then reduced the number of Claimed farms to nineteen(19) as evidenced byAnnexure "C2". . .' .,.. ....' _._.

The most common feature through which the claitnants describe their ancestralland is a hill on the farm Magataspruit 816 LSon which five of their earlier Chiefshave been bU~Ied. Chief Makgato's headkraal or mosate used to be on the saidhill. i i

2.2.10 Note should be taken of the fact that there are still disputes regarding thevalidity. of the claim between the RLCC and landowners on some of theproperties mentioned in 2.7 above. Such properties have been referred to theLand Claims Court for adjudication of the said dispute.

2.2.11 The' Regional Land' Claims Commission: Limpop~ is of the opinion thatfinalisation of the Makgato Tribe land claim on properties belonging to willingsellers should not be held to ransom by the unwilling sellers. The research that has been conducted by the Regional Land ClaimsCommission: Limpopo indicates that the Makgato Tribe lost land rights on itsland gradually. According to deeds records, the farms claimed by the MakgatbTribe were first surveyed in the 19th Century and since then have changed·

Inessence, the Makgato Tribe was dispossessedofits rights in land because itwas viewed asa "blackspot" in a white area. Soon after the meeting with theNative Affairs Commissioner: Soekmekaar, Chief Makgato and his followerswere loaded onto trucks and dumped on the farm Klipplaatdrift 508 LS next tothe Machaka Tribe at Matoks. The removal of the Chief was the final blow to theMakgato Tribe in terms of the erosion of its land rights on the land it hadoccupied for more than a century. As a result of the aforementioned position of thegovernment at the time, some members of the Makgato Tribe were evicted fromthe farm Smitskraal 788 LS in 1925 by the then government. Other members of

tenure conditions. Some of the members who remained on the land were later tobe evicted from the farms in different years.

The ·Makgato Tribe had beneficial occupation and use rights on the land since it·occupied the land for more than a century prior to its removal. The Tribe alsohad grazing, hunting, cropping, fishing and burial rights. The Makgato Tribe leftmany graves on the farms including those of its earlier Chiefs.

The total extent of the land claimed by the Makgato Tribe is approximately23230.9189 hectares. So far, 5759.9769 hectares have been restored to the

3.1 The claim substantially complies with the requirements contained in Section 2 ofthe Restitution of Land Rights Act 22 of1994, as amended.

3.2 The Regional Land Claims Commissioner: Limpopo is of the view that theMakgato .. Tribe. was dispossess~d of its land· rights. through raciallydiscriminatory laws and practices and did not receive just and equitablecompensation because the farm Klipplaatdrift 508 LS which was offered asalternative land is rocky and characterised by poor soils. Furthermore, nosooner had the Tribe settled down on the farm Klipplaatdrift 508 LS than theywere removed again in 1979 and settled on the farm Kromhoek 438 MS, whichis more than 150 kilometres away from where the claimants originally lived.

As alluded to in 2.2.10 supra, some of the private landowners are challengingthe validity of the land c1aimand thus their properties have been referred to theLand Claims Court for adjudication of the dispute. So far, valuations have nowbeen finalised on properties belonging to two (2) willing sellers whose propertieswere still at valuation stage when the first Memorandum (Annexure "e5") wassubmitted for approval. The RLCC is of the view that the claim should befinalised on the willing sellers' properties that have already been valued so thatthe claimants can find some relief while the dispute on other properties is beingresolved.

5. POST SETTLEMENT SUPPORT-AND IMPLEMENTATION ISSUES .
