    Action Items1. Consider Approval of Minutes from the Committee Meeting of March 31, 2014

    On a motion by Brower and second of Burnett, the minutes were approved with a request thatpublic comment be listed prior to committee action. The motion was adopted unanimously ona vote of 2 0 by Brower and Burnett. Potter was absent. No public comment was directedto the committee on this item.

    2. Review and Approve for Distribution the Draft Request for Proposals (RFP) for a Contract toConduct Value Engineering Analysis of CDM Desalination Project DesignsJim Cullum, Executive Director for the MPRWA gave a presentation. His comments arecontained the staff report presented for this agenda item.

    Public Comment: (1) Jeanne Byrne reviewed comments on the RFP from the WaterManagement District. (a) The life of source water wells is 20 to 30 years. When replacement isnecessary, will approval be needed to re-drill the wells? How will that affect project cost? (b)The RFP mentions compliance with the silver award for sustainable infrastructure and the LEEDsilver award requirements. She had understood that the project will meet the LEEDrequirements without certification. The process to apply for those awards is expensive and willdelay completion of the project Any expense to go after those awards should not be charged

    3. Receive Report from Cal-Am on Contingency Source Water Intake Locations and DevelopRecommendation on Future Action regarding Source Water IntakesIan Crooks, Engineering Manager for California American Waters Coastal Division, presented areport. A summary is available for review on the Governance Committee website.

    Public Comment: (1) Michael Warburton , representing the Public Trust Alliance, stated thatthe scope of the contingencies is a problem, as they are very expensive. There are 169,000acre-feet of water that belong to the public that Monterey County has a right to. The publicmight want to use it as source water for a Peninsula water supply. The scope of thecontingency is so narrow that it can only be seen as a phenomenal waste of public resources.We should be thinking about adjusting this project responsibly. (2) David Stoldt , MontereyPeninsula Water Management District, asked two questions. (a) Is there space at the CEMEXsite to drill replacement wells over a 100 year period? (b) Is there any risk for transmissivity or

    hydrologic features at the CEMEX site that might result in the need for additional water? If so,would you drill to the 180 foot aquifer or develop the Potrero Rd. site as a back-up? TheDistrict generally supports the concept of a contingency site. Response : Cal-Am must operatetest wells at the CEMEX site to determine the potential for production. Cal-Am believes theywill obtain enough land at the CEMEX site for replacement wells. Engineers are saying there is

    No comments were directed to the committee during the public comment period on this item.

    Della Sala offered a motion to adopt the recommendation of the ad-hoc selection committeeand contract with Value Management Strategies, Inc. (VMS) for preparation of a valueengineering study for a not-to-exceed cost of $124.000. Jim Cullum shall be authorized tonegotiate with VMS to reduce the cost from $129,997.22 to $124,000. The motion wasseconded by Brower and approved unanimously on a vote of 2-0 by Della Sala and Brower.MacLean expressed agreement with the committee action.

    Discussion Items

    2. Update from California American Water on Source Water Intake Location InvestigationsIan Crooks, Engineering Manager for Cal-Ams Coastal Division reported that the publiccomment period on the City of Marinas consideration of the application for construction of atest well at the CEMEX site closes on June 17, 2014. The goal is to obtain approval fromMarina by August. The permitting process for the Potrero contingency test well site shouldbe submitted to the California Department of Parks and Recreation by mid-June.

    Public Comment: (1) David Stoldt , Monterey Peninsula Water Management District, askedwhen the CEMEX test well is to be considered by the California Coastal Commission (CCC). ( 2)George Riley asked if applications are being submitted for both the CEMEX and Potrerolocations.

    Crooks responded that an application for the CEMEX site has been filed with the CCC If the

    There was a request that Cal-Am provide to the committee a detailed critical path method forcompletion of the desalination project.

    Public Comment: (1) George Riley requested that the committee provide an update on thethree desalination project alternatives. He explained that Cal-Ams desalination proposal isbehind schedule and the other two alternatives will be entering the EIR process soon. Theother two alternatives would be less costly than Cal-Ams proposal, so it would beadvantageous to review the project schedules again. (2) Michael Warburton , representing thePublic Trust Alliance, expressed agreement with the request to develop a comparison of thethree desalination project alternatives, and stated that the Governance Committee would be

    the appropriate entity to conduct the study.

    Brower stated that the Water Management Districts Water Supply Planning committee wouldconsider the request to conduct a comparison of desalination alternatives. MacLean statedthat a comparison study should not be conducted by the Governance Committee, but could beconsidered by the JPA.

    Public Comments: (1) Tom Rowley thanked David Potter for attending the Water Authoritymeeting and urged him to attend regularly to represent the California

    American Water Company (Cal-Am) rate payers in the unincorporated areas ofMonterey County. (2) Nelson Vega thanked Mr. Potter for attending themeeting. He also described Mr. Della Salas term as president of the WaterAuthority as exemplary and commendable.

    Action Items1. Receive Report from Value Management Strategies, Inc. Discuss and Provide Direction on the

    Draft Preliminary Value Engineering Study of CDMs 30% Design of the California AmericanWater Company Desalination ProjectMark Watson of Value Management Strategies gave a presentation that summarized thepreliminary results of the Value Engineering (VE) Study. He noted that comments received atthe meeting would be incorporated into the final report that should be provided within 30days. The final step in the process will be to decide which alternatives presented in the reportshould be incorporated into final design. Watson stated that the purpose of the study was toidentify a series of value enhancing options to the current design of the project through anobjective, not an independent review. He reiterated that VE is not a cost reducing exercise butan intersection of performance, cost, risk and time, all appropriately weighted that couldi h l f h j If h 15 id ifi d i i i i l d h ld

    Public Comment: (1) Nelson Vega questioned the potential impacts to the cost per acre-footof the project and supported the larger facility size. ( 2) Rick Riedl requested renegotiation

    with CDM to recoup some of the cost savings and questioned if there was an incentive toreduce costs within the contract. (3) Dale Hekhuis requested clarification of the definitions ofvalue comparison. (4) George Riley asked if the quality or components of the source waterwould change, were the VE study suggestions to be implemented. (5) David Lifland questioned the RO schematic expressing concern that the building was not large enough andquestioned if the public would be able to comment on the final process. (6) MichaelWarburton questioned how drought regulations would be enforced and spoke to pendinglegislation as it relates to this project.

    Watson made the following statements in response to questions from the assembled Boardsand members of the public. (1) The highest risk identified in the VE study is the raw waterdata. The report will indicate that there is a lack of data on the water and assumptions weremade according to different speculated results. Source water is a key aspect to overall cost ofthe project. (2) The VE recommendations propose to increase the RO water recovery ratefrom 45% to 50% on the first pass, and 90% on the second pass, for a total 45% recovery. VMSbelieves that there is a possibility for a higher recovery rate which would impact the RO

    membranes positively. (3) The project proposes 33 energy saving devices. Energy recovery ispart of the project design. One of the risks and uncertainties is use of methane gas. Thecurrent plan is to utilize dual sources from methane and PG&E; however, the ultimate powersource for the project has not been determined. (4) The VE study did not calculate the cost ofa 9.6 mgd plant vs a 6.5 mgd plant. The study did evaluate if any of the alternatives would

    2. Approve Response to California American Water re Request for Proposal for Test Slant WellConstructionPublic Comment: (1) Tom Rowley , representing Monterey Peninsula Taxpayers Association,asked if the proposed monitoring wells could be converted to water supply wells. (2) MichaelWarburton opined that the Governance Committees proposed response to California-American Water (Cal-Am) is inadequate and does not protect the public interest. The projectproponents have moved ahead based on presumptions, and the Governance Committee

    should examine those presumptions. He expressed hope that the Governance Committeewould seek to protect the public interest and not focus entirely on protection of businessinterests.

    Ian Crooks, Engineering Manager for Cal-Ams Coastal Division, responded to questions fromthe committee. He noted that bids will be due on September 5, 2014. The notice to proceedshould be issued by September 19, 2014. He stated that monitoring wells are a valuable toolfor groundwater monitoring programs, but would not be used for water supply as they are too

    small for that purpose.

    On a motion by Burnett and second of Brower, the committee authorized submission of theresponse letter to California-American Water as presented. The motion was approved on avote of 2 0 by Burnett and Brower

    TP-7 Committee clarified that if this change were implemented, a one-month delay inproject completion would result. However, due to the time extension recently

    granted by the California Public Utilities Commission (CPUC), this delay would notinhibit timely completion of the project.

    TP-9 Cal-Am representatives stated that the review of alternatives will be completedprior to the September 17, 2014 meeting of the Governance Committee.

    TP-10 Committee agreed that an expenditure of $225,000 to evaluate the mean size ofsand granules so that pump screens can be designed properly, would be a wiseexpenditure.

    TP-11 Cal-Am representatives say they will review this, but have concerns thatimplementation would result in increased iron and manganese to the outfall.

    RS-2 The committee requested that this be carefully analyzed, so that the information isavailable before State Water Resources Control Board hearings on this issue. Thereshould be a plan to accelerate construction so that operation could begin as soon aspossible, especially in the event that drought continues. (Cal-Ams current plan is

    that partial operation of the plant could begin after the first six months ofconstruction.) There are permitting and environmental considerations to plan for, ifconstruction were to be accomplished in shifts at night. A final decision on whetherto implement shifts could be made after 60% design work is complete. Cal-Am willinvestigate this, and also ask the test well drillers to provide a quote for operation

    Crooks reviewed the Monterey Peninsula Water Supply Project Anticipate Schedule, updatedon August 25, 2014. He reported that final publication of the project EIR is set for July 2015.

    California Coastal Commission (CCC) approval is expected to occur in February or March 2016.He noted that if the Public Utilities Commission and the CCC could process the applications inparallel, the CCC could approve the slant well portion of the project first. Under that scenario,slant well construction would not be delayed by the Snowy Plover nesting season. Crooks

    agreed to develop information on the implications of parallel process of the permits, and makehis analysis available to Burnett for future discussions with John Laird at the California NaturalResources Agency.

    Public Comment: (1) Michael Warburton expressed support for meetings with John Lairdregarding the project timeline, as he believes it is not clear that constitutionally delegatedofficers that protect the public trust understand their duties. However, Warburton opined thatthe desalination project has been driven by presumption, ambition and knee-jerk protection ofproperty which people might not own. He expressed support for broadening public discussionand understanding of what is at stake, but also noted his concern that accelerating theconstruction schedule could have a deleterious impact on that aspect of the project. ( 2) Tom

    Rowley stated that several years ago the Monterey City Council decided to not pursue PuebloWater Rights due to the high cost and potential years-long legal battle associated with thateffort. Rowley stated that at this time, the community cannot avoid the deadline it is under todevelop a water solution. Possibly at some future date the community can take the timenecessary to divide up water from the Salinas Basin.

    Summary: A representative from California American Water (Cal-Am) will present a

    review of bids received and advise the committee of the companysrecommendation for preferred contractors (see Exhibit 2-A ).

    Action: The committee will review information provided by Cal-Am, take publiccomment and make a recommendation to Cal-Am regarding thepreferred contractors.
