1 In accepting an advertisement (includinga notice) for publication, and in publishing itwe are doing so in consideration of andrelying on the advertiser’s express warran-ty, the truth of which is essential:a. That the advertisement does not containanythingthat is misleading or deceptive or likely tomislead or deceive or which otherwisebreaches the Fair Trading Act 1986.that is defamatory or indecent or which oth-erwise offends against generally acceptedcommunity standards.that infringes a copyright or trademark orotherwise infringes any intellectual orindustrial property rights.that breaches any provision of any statute,regulation, by-law or other rule or law, and b.That the advertisement complies in everyway with the Advertising Codes of Practiceissued by the Advertising StandardsAuthority Inc. (”ASA”) and with every othercode or industry standard relating to adver-tising in New Zealand, andc.Publication of the advertisement will notgive rise to any liability on our part or in aclaim being made against us.2 The advertiser agrees to indemnify usagainst all losses or costs arising directly orindirectly from any breach of those warran-ties by the advertiser and from any costsincurred in our making corrections oramendments in accordance with the termsthat follow.3 By supplying or placing an advertisementfor publication the advertiser grants us aperpetual, royalty free license to reproducethe advertisement in any print or electronicadvertising media we offer advertisers nowor in the future. 4 Where the advertiser utilises any aspectof our creative services in the design orproduction of an advertisement (includingphotographic or design work) the advertiseracknowledges that we own the copyright insuch work and that such work is not workfor which a commissioning payment hasbeen made or agreed. 5 We may refuse to publish, or withdraw anadvertisement from publication without hav-ing to give a reason. 6 We may publish the advertisement on thenext available day if there is an error ordelay in publication of the advertising asbooked.7 We may correct or amend advertising toconform to style or for other genuine rea-son as long as we do so using reasonablecare.8 We may take orders for advertising inspecific spaces (space orders). The spacemay be used only by the advertiser foradvertising of the advertiser’s usual busi-ness and may not be transferred by theadvertiser to another person. 9 The guarantees contained in The Con-sumer Guarantees Act 1993 are excludedwhere the advertiser acquires, or holdshimself out as acquiring, goods or servicesfrom us for the purpose of a business.10 The advertiser must tell us as soon aspossible if there is an error or omission inany advertisement the advertiser hasplaced. We will not be liable for any indi-rect or consequential loss (which includesloss of revenue or profit) from an error oromission or failure to publish and if we arefound to have any direct liability for anycircumstance that liability is limited to thecost of the space of the advertisement.11 To cancel an advertisement a cancella-tion number must be obtained from us.12 The charge for an advertisement will bein accordance with the published rate cardapplying at the time for the publication,unless we agree otherwise in writing. Ratecard adjustments will apply to space orderswith effect from advertising appearing 28days after the rate adjustment is publishedon our rate card. Rates for space ordersapply for the whole space and are notreduced if the whole space is not used.13 Advertising placed by advertisers whoare not New Zealand residents will be zero-rated for GST purposes.
