WELTKUNST is the most traditional art magazine in Germany, founded in 1930 in Berlin. It is the most important magazine for the art market. Weltkunst is read by collectors, artists, dealers, curators – by the decision-makers of the art world.

Since Spring 2012 WELTKUNST has appeared in a new design that was developed by the highly distinguished art director, Mirko Borsche. Editor-in-chief is Lisa Zeitz, formerly the art market author of the “Frankfurter Allgemeinen Zeitung” for many years. Christoph Amend, editor-in-chief of the ZEITmagazin, is the publisher.

WELTKUNST shows the most attractive sides of all art eras, from the old masters to contem-porary artists. The magazine has a distinct structure. As an introduction to each issue there are entertaining and competent columns and headings such as the “Marktfrau” (Market Woman) by Susanne Schreiber from the “Handelsblatt” or the series of interviews “Was haben Sie gese-hen?” (What have you seen?) with the world’s most influential curator, Hans-Ulrich Obrist.

This is followed by the opulent middle section with great portraits, reportages, photo gallery – including a design and interior series.

The magazine closes with the “Agenda” that provides a concise overview of all the important events and news of the month.

Besides art, the WELTKUNST readers are also interested in other items of beauty such as fashion, watches, jewellery and design. For them Tillmann Prüfer, the style director of the ZEITmagazin writes every month in his column “Die Hand des Meisters” (The Hand of the Master) about special craftsmanship. In each magazine under the heading “Was passt zu….?” (What goes with ….?) the editors present products from the worlds of fashion, design, beauty, watches and jewellery that go with the style of an artist who is currently topical.

Figuratively speaking: WELTKUNST is like a beautiful old villa where an old master can hang wonderfully next to a book shelf by the designer Dieter Rams.

TECHNICAL SPECIFICATIONS: Stapled inserts must be delivered folded and untrimmed. All bound inserts must have a 3 mm grind-off margin at the spine. Stapled inserts that, due to their design, are not recognisable as advertising must be labelled "Advertisement" for legal reasons.

DELIVERY OF LOOSE INSERTS/TIP-ONS/STAPLED INSERTS

Loose inserts/tip-ons/stapled inserts have to be packed properly, hold unidirectional, separated by boards of 2mms and have to be sent 14 days prior to publication date and free of charge to our printers packed on euro-pallets.

The delivery note must include the following information: • Sender and recipient• Magazine, issue number• Name of special insertion• Quantity of copies on euro-pallet• Type of ad special (Loose insert/tip-on/bound insert)• Quantity of euro-pallets

1. ScopeThe following General Terms and Conditions (GTC) shall apply to any and all contracts on publishing one or more advertisements and other inserts (“Order” in the following) in the publisher’s publications.

2. Order and Contract2.1 For purposes of these GTC, the term “Order” shall mean a contract on publishing one or more advertisements or inserts of an advertiser or other entity wishing to advertise for distribution in a print medium.2.2 Orders for advertisements can be made in person, in writing, by e-mail or fax. In case of Orders or changes to Orders made by phone the publisher shall not be liable for any transmission errors.2.3 For purposes of these GTC, the term “Contract” shall mean a contract between the publisher and the customer on publishing several advertisements considering any discounts to be granted to the advertiser according to the price list, in which case the respective publication of such advertisements shall be effected only after the customer’s request.

3. PlacementExcept as otherwise specified, advertisements are to be placed within one year of Contract execution. If the Contract contemplates the right to place a series of individual ads, the Order is to be completed within one year of the first ad’s appearance, provided the first ad is placed and published within the timeframe established in Sentence 1. When a Contract has been executed, the customer is also entitled to place more advertisements or inserts than the number set forth in the Order, provided the customer does so within the agreed-upon timeframe or that timeframe established in Section 1.

4. Reimbursement of DiscountsIf one or several Orders are not filled because of circumstances for which the publisher is not responsible, the customer shall, without preju-dice to any further legal obligations, reimburse the publisher for the difference between the discount granted and the discount correspon-ding to the amount of ad placements accepted.

5. Delivery to PublisherOrders for ads and inserts with requests for exclusive publication in certain issues or editions or at particular locations within the print me-dium must be received by the publisher in sufficient time to allow the publisher to notify the customer before the advertising deadline if the Order cannot be filled in the desired manner.

6. Full-position Ads and Advertorials6.1 Full-position ads are advertisements that are surrounded on at least three sides by text and that are not adjacent to other advertise-ments. Advertisements that are not identifiable as advertisements due to their editorial design shall be clearly marked by the publisher with the word “advertisement”.6.2 Advertorials are articles produced by third parties, which differ significantly in design and structure from the editorial parts of the prin-ted medium (typography, graphics, color, columns). The publisher shall be entitled to mark an advertorial with the word “Advertisement” without consulting the customer. The publisher must receive an advertorial at least five work days prior to the copy deadline for examination and approval.

7. Rejection of PlacementThe publisher reserves the right to reject Orders for ads and inserts — including requests to place individual ads or inserts in connection with a Contract — in accordance with its uniform, objectively justified principles because of the ad’s or insert’s content, origin or technical form, if the content is in violation of the law or official regulations or if the ad’s or insert’s publication would be unreasonable for the publisher. Orders for inserts are not binding on the publisher until a sample of the insert has been submitted and approved. The customer shall be notified promptly in the event an Order is rejected.

8. Joint AdvertisingAdvertisements containing advertising by third parties or for third parties (joint advertising) require a prior written declaration of accep-tance from the publisher in each case. This entitles the publisher to charge the joint-advertising surcharge.

9. Copy and Proofs9.1 The customer is solely responsible for the timely delivery of the inserts or of the advertising text and correct copy. They must conform to the format or technical specifications of the publisher. The publisher guarantees the standard print quality for the publication in which space has been reserved within the limits established by the copy provided. In case of hidden defects in the inserts or advertising texts, which can-not be identified immediately on delivery, the customer shall not be entitled to any claims arising from a deficient publication.9.2 Proofs are provided only on express request. Proofs are not provided for classified ads. The customer is responsible for the correctness of proofs that it sends back to the publisher. The publisher shall correct all errors of which it is notified by copy deadline or by the deadline established when the proof is sent.9.3 The customer shall pay the costs incurred by the publisher for artwork created at the request of the customer, or for modifications to the artwork delivered, which are desired or made necessary by the customer.9.4 Copy shall be returned to the customer only on the customer’s specific request. The duty to retain copy shall expire six weeks after publication of the advertisement.

10. Location of AdvertisementsAdvertisements shall be published in specific issues or editions or at specific locations within the print medium, if such was agreed upon in writing or by fax or e-mail on conclusion of the Contract. If no clear specifications as to the location of the advertisements were agreed upon, the publisher shall be free to determine the location at his discretion.

11. Rights Arising from Defects11.1 In the event the advertisement is wholly or partially illegible or is printed incorrectly or incompletely, the customer shall be entitled to a reduction in price or to a correct reprinting of the advertisement, but only to the extent the advertisement failed of its essential purpose. If the publisher fails to reprint the advertisement within the timeframe established, which timeframe must be reasonable, or if the reprint also contains errors, the customer shall be entitled to receive a reduction in price or to cancel the Order.11.2 Claims for damages arising from positive violation of contractual duty, culpa in contrahendo and tort are excluded — with equal effect on Orders given by phone; claims for damages arising from impossibility of performance and delay are limited to the foreseeable damages and to the fee owed for the advertisement or insert concerned. The foregoing shall not apply in the event of the intentional misconduct or gross negligence of the publisher or its employees/agents and legal representatives, nor shall it affect the publisher’s liability for damages caused by the absence of warranted quality.11.3 When dealing with merchants, the publisher shall not be liable for the gross negligence of its employees/agents; in cases where the publisher is liable to merchants for gross negligence, its liability shall be limited to the foreseeable damages in an amount not to exceed the fee for the advertisement concerned. Except in cases of defects that are not apparent, refund claims must be asserted within four weeks of receiving the invoice and any verification copy of the advertisement.

12. Force MajeureIn the event of a break in production or of a force majeure event, labor dispute, seizure, traffic disruption, general shortage of raw materials or energy, etc. — whether at the publisher’s facilities or those of its suppliers — the publisher is entitled to full payment of the advertisements published if the publisher delivered a sum of copies of the publication that equals or exceeds 80% of the average number of copies sold in the past year. If fewer copies are delivered, the amount owed shall be reduced in direct proportion to the difference between the number of copies actually delivered and the number of copies guaranteed to be sold.

13. Prices and Payment Conditions13.1 Prices, surcharges, and reductions or discounts arise for all customers on a uniform basis from the publisher’s price list in effect at the time of the Order, or the request to publish the advertisement, respectively. 13.2 Except where other payment terms or prepayment has been arranged, payment is due within the period established in the price list, which period commences upon invoice receipt.13.3 In the event the customer defaults on payment or is given extra time in which to pay, interest and collection fees shall be charged. If the customer is in default, the publisher may suspend filling the present Order until such time as payment is effected and may demand payment in advance for the remaining advertisements.

14. Copy of AdvertisementOn written and express request by the customer the publisher shall provide a copy of the advertisement with the invoice. Depending on the type and scope of the Order, this copy shall be in the form of the individual advertisement, a full page or an entire issue. If a copy can no longer be furnished, the publisher shall provide instead a legally binding certification attesting to the publication and distribution of the advertisement.

15. Advertising Agencies and BrokersAdvertising agencies and brokers agree to conform to the publisher’s price list when making offers to, executing agreements with and sett-ling the accounts of their clients. The commission given by the publisher cannot be passed on to these clients, either in whole or in part. The commission given by the publisher is calculated on the basis of the net charge to the customer, i.e. after subtraction of discount, bonuses and discounts due to defects.

16. Place of Performance and Venue16.1 Place of performance and venue is Hamburg as the publisher’s domicile.16.2 In the event of business relations with merchants, legal entities under public law or public-law special funds, the publisher’s domicile shall be agreed as exclusive place of jurisdiction. To the extent that the publisher’s rights cannot be asserted by means of summary procee-dings, venue shall be determined in the case of non-merchant customers on the basis of the customer’s domicile. If the domicile or habitual abode of the customer is unknown at the time the suit is filed or has moved outside of the purview of the law, venue shall be Hamburg.
