TRATON HEADLINE: Georgia Legal Disputes

Over Property

The Atlanta Journal Constitution, in its article Tyler Perry property

dispute creates drama worthy of Madea, reported a bitter battle

between Tyler Perry, writer-producer-entertainer, and Morton

Rolleston, attorney. The article discusses a protracted legal battle that

has gone through at least three courts, and is causing a headache for

Tyler Perry. Rolleston, being an attorney, appears to have no worries

about attorneys' fees, insofar as he represents himself. As such, it

appears that the only person that has to expend significant costs in

fighting this legal battle is Tyler Perry.

Since the subject-matter of the lawsuits relate to one's home, it is

understandable how emotions can run high.

Not

surprisingly, a

quick review of

Georgia cases

shows other

bitter battles

over

homeowners'

rights. One

example is a

lawsuitbetween a

homeowner

and Traton

Corp. The legal

papers in that

lawsuit show

that the Traton

Corp.

repeatedly

damaged the

right-of-way that forms a portion of the homeowner's yard. A

When requested by the homeowner to fix the damage, rather than

repairing the damage, Traton cited the homeowner for being in

violation of the covenants, thereby forcing the homeowner to file a

lawsuit against Traton.

The homeowner's emotions, understandably, led him to pursue this

matter through the trial courts and all the way to appeal. As of the

writing of this article, the case was pending in the Supreme Court of

Georgia.

Surprisingly, the Court of Appeals, despite seeing the picture of the

damaged yard, held that the homeowner had no right to prevent others

from damaging that portion of the yard, since the damaged portion

was part of the county right-of-way. In holding so, the Court of

Appeals indicated that the homeowner had no obligation to maintain

county property, insofar as that responsibility must be shouldered by

the county. When asked, Ms. Kate Berry, attorney for Cobb County,

refused to comment.

Given the abuses of the legal system by Mr. Rolleston, and the counter-

intuitive Court of Appeals decision that curtails homeowners' rights,

one can only wonder whether the Georgia legal system is irreparably

damaged by entities such as Traton and Rolleston.

things that I've heard about. No rights or obligations in one's

own yard. You've GOT to be joking!
